it's wednesday, july 25, 2012. this is "today in the bay." good morning, everybody, it's just about 4:31. >> thanks so much for joining us. let's check that forecast with meteorologist christina loren. good morning. >> good morning to you. you made it to wednesday. want to help you get over that hump. the good news is if it's too hot in the inland we'll cool down this afternoon. starting out this afternoon in the upper 50s, 60 degrees in san francisco. i'll take you to that full forecast because after we cool down we jump right back up as we head into the weekend. lots to talk about at 4:21. here's your drive. >> accident in the final clearing stages of san francisco. northbound highway 101, macarthur tunnel, reports of an accidents now getting cleared. near the construction zone as well. highway 1, 19th avenue there.

no reports of any injuries and also this does not involve any construction vehicles or the zone itself. that's good news as we travel through that area and to the golden gate bay. live look at the bay bridge, traffic very light. crystal clear view of the span and oakland side no problems for the east bay but other slowing coming up. we begin with developing news in the south bay where it appears it was a self-inflicted gunshot wound. santa cruz from the santa fe police track down a suspect wanted on a weapons violation. not clear exactly what happened but we're told somehow a probation officer's gun accidentally went off hitting him in the upper leg. that probation officer was airlifted to a local hospital to be treated for nonlife threatening injuries. the suspect officers were

pursuing was arrested without incident. >> police on the hunt for a gunman after a shooting on a busy east bay freeway. we have more on what happened. >> reporter: good morning. we're hearing from someone who works at this gas station. it's on i-80 east. we're told by the attendant someone went into the store late last night and said please call 911, somebody has been shot a car pulled into one of the handicap spots here with two hem, a man, a male driver and his female passenger who had been shot and according to the attendant there was another adult and three young kids in the back seat. apparently they were driving on 80 east and that's when someone shot at this car. the attendant counted six bullet holes on the driver's side, rear door. she saw a man with bleeding

hands. he's been shot once in the hand and the female passenger shot in her leg and left stomach area. the young kids in the back seat were unharmed. we spoke with police this morning. it was a bizarre string of event. they got a 911 call after 10:30 last night. someone report ad man walking on 80 east causing traffic to swerve to avoid hitting him, not sure who that was and how that was related. it is confirmed related to this shooting. now they closed a stretch of 80 east near willow avenue for 20 minutes as they looked for evidence and then re-opened the lanes to traffic before midnight. it happened pretty quickly. no requested on the condition of the man and the woman. hercules police have taken over this investigation, trying to determine if this was a random or targeted shooting. >> breaking news. there's some rattled nerves in southern california after an early morning earthquake. the magnitude 3.7 quake struck

two miles from marina delray. while it rattled nerves no reports of injuries. many people originally thought the quake was actually stronger because of its shallow epicenter. >> a psychiatrist accused of molesting boys during exams could be released from a state hospital today. hours from now -- we have the wrong photo up here, a judge will decide if the 79-year-old can be released from the hospital. an attorney for ayres said the former psychiatrist is too sick mentally and physically to remain hospitalized. he could be sent to an unlocked senior facility or let out for outpatient treatment. ayres is accused of molesting nine boys between 1991 and 1996 at a san mateo office. the trial against ayres ended in

a hung jury. a serial killer is questioning dna evidence that allegedly links him to a murder victim. the 78-year-old joseph naso want as forensic expert for defense to examine dna evidence. he's accused of killing four northern california women in the 1970s and 1990s. he's now acting as his own attorney in this case. funeral and memorial services are being planned around the country for the 1 people killed in the aurora theater massacre. the suspect james holmes remains in solitary confinement this morning. police are analyzing evidence found in his apartment. the suspect james holmes remains as i said in confinement. we're having problems. investigators in the mean time the star there you see the star of the batman movie made a surprise visit to the hospital.

he went to the memorial site near the theater leaving flowers and standing in silence. >> everyone is impressed with his sincerity. so he was sincere of why he was here. >> there are stories of hope. caleb was injured while protecting his pregnant wife from the gunman and on tuesday she gave birth to a healthy baby boy. >> a bit of sunshine in a tough story. >> some officials are joining that fight over the state's water supply. governor brown wants to install two huge pipes beneath the bay delta. it supplies water to millions of people from the bay area down to southern california but compton pumping has damaged the eco system and threatened fish species. another concern is the fragile levees surrounding the delta. some are more than 100 years old

and could fail in an earthquake. >> if the levees do fail we can have an outage of six months to a couple of years which would require us to have extreme conservation measures and have a significant economic impact. >> some supporters say the proposed pipes would be more reliable in an earthquake and pull water from the delta with less harm to the environment. opponents they worry pipes will only increase the strain allowing more water to be diverted away from the delta. governor brown and opponents will be holding dual press conference in sacramento and arguing their points. >> the san francisco district attorney say they have no plans to open a perjury investigation against the mayor. the district attorney said there was no basis to start a criminal investigation. lawyers for suspended mayor called for that investigation. the issue centers around accusations that mayor had tried

to work out a deal to get him another job if he stepped down. mayor lee has denied those allegations. this morning the san francisco sheriff's department is facing a new controversy. lieutenant vince calvary will be arraigned thursday on assault charges. they arrested him on july 19th on charges of domestic assault. the arrest comes as he was suspended. he's fighting his removal from office following his own domestic incident with his wife on new year's eve. a commission has yet to decide whether or not he should keep his job. he has been put on administrative duty while dealing with his own legal issues. thieves are creating a big stink at the garlic festival. organizers for this weekend's event said someone stole $12,000 worth of tickets. several locked cases were broken into the festival's main office. those tickets were then spotted

for sale on craigslist. the money raised at the garlic festival helps out local nonprofits and charities. >> they are taking money directly from local charitable organizations and that's really the shame of all this. >> gilroy police said the stolen tickets will not be honored at the festival. they say ticket takers at the entrance gates will be checking serial numbers. if you bought a ticket on craigslist or facebook, check your serial numbers because it could be one of the stolen ones. if it has serial numbers between 0505001 to 050500 your ticket is among that will not be honored. so check them. >> is absolutely. 4:40. check in with our meteorologist christina loren. >> good morning. begot a good looking forecast. so far a mild summer.

couple of hot days earlier in the week. the cooling trend kicks in. we got a great day shaping up for your inland cities happened on the hot side. today i'm forecasting low 80s, upper 70s right here in san jose. 59 in oakland. 59 in sunnyvalsunnyvale. as we head through the next couple of hours onshore flow is in place so that means lots of fog through your inland valleys for the first part of the day but brilliant sunshine comes out for the second half. 79 degrees in san jose. 84 today. that's in livermore. temperatures are cool at the coast not too shabby don't have to bring that jacket. 66 degrees later today in san francisco. a hot, hot weekend ahead. i'll take you through that forecast and what's happening around the bay area this week. here's mike with your drive. >> we have a pleasant but also

watch out zone for the oakland area. we're looking at 880 north. 23rd avenue on-ramp is closed. crews also in place northbound side from fruitville past that closure and up towards 7. two lanes closed at a time so slow a tad bit ep as you pass those zones. no major issues. we reported about the shooting which ended in hercules. that did effect interstate 80 for a couple of minutes. so highway 4 and interstate 80 moving smoothly. we'll get you a look outside and see how things are shaping up. we'll end with this shot of the south bay. still ahead as they say let the games begin. as you may know the olympic opening ceremony not until friday. guess what? the competition starts today

>> the team took beijing by storm you may recall in 2008 beating brazil in overtime 1-0. pretty spectacular. that gold medal was the third for the united states in women's soccer following gold medal performances at the 2004 athens olympics and the 1996 atlanta games. we can tell you that bay are a athletes are a big part of the usa london games including three former stanford players. they will all play for the u.s. soccer team today. buehler is one of the team captains. no other college has as many players. and reilly will play for her home country of new zealand. east bay represented very well by cal star alex morgan. she sent out this tweet yesterday saying quote, just finished our pre-game practice, all the sweat, booed and these shed on the field is for this

expected. ceo tim cook says that may be due to rumors and speculation as consumers hold out for that iphone 5 which is expected in october. futures are lower this morning after the dow posted its third straight triple-digit decline, first time that's happened since last september. europe playing a big role in that on fears that greece may still be unable to pay its bills. investors are focusing on the earnings from u.p.s. which were disappointing as the package delivery giant usually seen as a bellwether for the overall economy. posted losses yesterday on a "wall street journal" that the fed may be moving closer to taking new action to try to spur the economy. today we get data on new home sales and earnings from falling caterpillar, ford and pepsico which came out this morning. the dow dropping 104 points and the nasdaq losing 27. toyota may be poised to take back its crown as the world's

rescue crews had their work cut out for them. trying to get the big man, 2,000 pounds of animal stuck in there. not easy to get him out. they were able to do it. still not sure how the big fellow got in there. how long he was stuck there. but the good news is the bull is free today and feeling like a new cow with horns. >> he's more than a cow. >> absolutely. >> funny twist on it. he must have tripped. >> let's check the morning commute right now. >> free from fulsom. sounds like a johnny cash song. >> no bull. >> looking at the south bay, just some construction. i show you the light volume of traffic. southbound 85 you'll slow a bit as you travel between 237 and steven's creek because of construction zones taking you down a couple of lanes.
