people were actually hit by gunfire. >> reporter: that's right, jon. a 24-year-old man and a 24-year-old woman. they stopped at this gas station for help. hercules police in the last half hour came back and went to talk to the own about surveillance footage, you have a clear shot of the highway because the gunman is still on the loose. the victims parked their car here where the handicap spot is. we under there were three young kids in the back seat. thankfully they were not hurt. now the gas station attendant who was here said she counted six bullet holes in the white upon tiing a, the windows completely shattered on the left side. a man of hit in his hand and woman hit in her left stomach area and leg. the victims were driving past pinole valley road when fired several shots at the car.

we're told officers from the chp said police and santa clara sheriff's department were tracking a suspect wanted for a weapons violation. at some point after they stopped him a probation officer on the scene accidentally shot himself in the leg. this morning the officer is being treated for nonlife threatening injuries. the suspect was arrested without incident. this morning anxiety appears to be the word of the day as investors brace for what could be a fourth straight day of losses on wall street. this morning new numbers out of great britain shows that country is well into a recession with third straight quarter of negative growth. here at home bad news from several hi-tech giants sent stocks tumbling. scott mcgrew has been pouring over apple's numbers. a rare miss. >> reporter: apple missed street estimates for the second time since 2013, estimates th-- sinc.

apple said they sold fewer iphones. they say people were waiting for the next apple iphone before buying a new phone. apple has never confirmed there will be an iphone 5, you know how they are. we expect one. here's your after hours number. apple shares fell well under $600 a share. down a whopping $28. now apple is the most important stock on the nasdaq. nasdaq is weighted apple is the heaviest. folks let's look ahead on this on this apple crisis. this crisis such that it is could actually get worse because apple's disappointing numbers cover -- i got by desk calendar, april, may and june but the new iphone won't be out until october. meaning there are three more months of full financial quarter, july, august, september where fewer people will be buying apple iphones because

they want that new iphone 5. as far as iphone sales it will get worse before it gets better. this morning the san francisco sheriff's department is facing a brand new controversy. lieutena lieutenant being arrested on domestic assault. this arrest coming as ross mirkarimi is fighting removal for his own domestic incident with his wife on new year's eve. a commission has to decide whether or not ross mirkarimi should actually keep his job. here's something you don't hear every day on a college campus, watch out for mountain lions. one of the big cats have been spotted recently off the uc berkeley campus. >> i saw a mother there, two cubs, and then right up this walkway i saw a large male.

back to you. california is calling at it massive rodent infestation and now officials are calling on an east bay food distributor to launch a nationwide recall. >> this is all because of a story nbc investigative unit uncovered. we have the details on the state's aggressive move. >> reporter: good morning. the fda and the state of california temporarily shut down san francisco herb and natural food company in fremont. up until two weeks ago the company sold herb, teas, spices and natural foods to customers around the world. it accurate to call this outrageous? >> this is a fairly significant finding. we don't typically find warehouses in this condition. >> reporter: he's talking about what state inspectors discovered inside this east bay facility. >> we found massive rodent infestation throughout the facility including direct product contamination, evidence of both dead bodies, dead rodent

bodies, fecal and rodent urine contamination on products. >> reporter: the state health department posted this notice an embargo that shut down all sales and distribution of products at san francisco herb and natural food located north of the solyndra plant on highway 880 in fremont. the state health department discovered the violations shortly after learning details of our ongoing investigation. you shut down the facility. why >> because of the massive rodent infestation, the evidence that product at the facility had become adulterated by filth that we had seen rodents getting into products. >> reporter: the state's embargo prevented the company from moving product. the company's website distributed products to customers all over the world. but the site now tells customers we're temporarily not accepting

we were talking about this very idea this time exactly yesterday. apple said it sold far fewer iphone 4ss than vaflts had hoped. that's because people are waiting to buy the iphone 5. apple never confirmed the existence of the iphone 5 but we know it's coming. shares fell 5% right after the news. apple missed estimates for only the second time and that's serious business. now there are two kinds of estimates. what analysts are paid to predict what we call the street estimate that's what apple missed and what the company estimated. apple was right on. nobody believes apple's estimates because the company is incredibly conservative. in a last minute thing here, lost in this apple panic the company sold a record number of ipads, 17 million of them. 84% sales increase. this is the company everybody is tearing their hair out, 84% sales increase in ipad.

thousands of ripped off gilroy garlic festival tickets being sold online. represented red has the details on this theft and the problems it can create for unsuspecting attendees. good morning. >> reporter: at first organizers of the gilroy garlic fest thought tickets had been misplaced but once they turned up on craigslist and facebook they realized they had been stolen. 1,000 tickets worth $12,500. the festival wants to get the word out and warn people if you bought any of those tickets online they will not be honored at the gate. ticket takers will check the serial numbers. they are numbered 050001-050500. children's tickets are running

highest peaks in sierra nevada. the 31-year-old san rafael man disappeared sunday after climbing to the summit of mount langley. tom hang was hiking with two friends but ended up getting separated. one said he spotted hang as he was climbing down from the summit but has not seen him sense. >> back here in the bay area protecting both presidential candidates at the same time may have caused more headaches than expected for local law enforcement. this morning the chronicle reports san francisco police had to pull officer that were assigned to republican candidate mitt romney in order to help cover president obama's much larger motorcade. in oakland the city brought in 75 county sheriff deputies at a cost of $75,000 to help deal with the president's event. earlier this week marked the first time both candidates were in the bay area at the same time. the giants are once again going to bat for injured fan brian stow. at last night's game they

if you're like most of us, you've had one of those nights that you would like to forget. that's exactly the deal for are a northern california bull. there's a happy ending here. this bull got stuck in about seven feet of water in an irrigation well in fulsom. rescue crews had to step up and work overtime to free the big fellow. took them four house to get him out. checked the scales at 2,000 pounds. until not sure exactly how the big guy got in there or how long he was stuck before somebody finally saw him. he's now the brunt of all jokes of all bulls every where. >> put him in a trailer somewhere. >> take at that look that. this morning we're getting a new

look at the first moment a whale turns on his trainer at seaworld in san diego. pretty amazing video. 6,000 pound whale thrashing the trainer around in the water. can you make it out? amazing thing about it is the trainer did survive. this is the attack that happened back in 2006 but the video was just released after being locked up during litigation. seaworld is currently being investigated for endangering its trainers nationwide. you may recall four years after this attack an orca killed a seaworld trainer in orlando. fun to watch during those shows but they are still wild animals and they have instincts that take over. 6:44. we'll go live back to london to check in with rajmathias and looking good. >> we'll take you life to the east bay for the hundred on a gunman who opened fire on a car

4s slumped as people wait forward the new iphone 5. apple is not admitting there's an iphone 5. we expect one in october. the company says only 26 million iphones in the past three months were sold and the company made just 35 billion in sales. putting that into perspective, what apple made in sales not positively but mentally would buy them two yahoo!s or seven aircraft careers or the l.a. dodgers seven times over. this problem is going get worse because apple's disappointing quarter was april, may and june, right? but the new iphone probably won't be out until october meaning there are three more months of full financial quarter again, july, august, september where even fewer people are going to be buying iphones because they want that new iphone 5. that's why you're seeing apple down $23 a share this morning. >> thank you very much.

6:48. police right now searching for a gunman who shot two people along a busy east bay freeway overnight. it happened on highway 80 near hercules and police say it could have been worse. stephanie chuang live in hercules has the very latest. >> reporter: hercules police just threat gas station here at 76 to get surveillance footage because this gas station is where the two victims both 24 years old were shot on 80 east in hercules last night at around 10:45. someone would works at the gas station who was here said the victims parked their car in the handicap spot. in the back seat another man even three young kids were not hurt. the gas station attendant says a man and woman sitting in the passenger seat had been shot. the attendant counted six bullet holes in the white upon take. hercules police say the victims had gotten on to 80 east from pinole valley road when someone

lane so folks will take about a week to adjust. should be better, southern 101. >> this morning thieves have created a big time stink for the upcoming gilroy garlic festival. bob redell has an update on the thousands of dollars of tickets that have been ripped off and what it means for unsuspecting attendees. >> reporter: good morning to you, jon. that's why the festival is getting the word out to let people know somebody stole tickets worth about $12,500. if you bought any of these tickets they will not be honored. the ticket takers will check the serial numbers. if you bought tickets online make sure you don't have any of these numbers. the stolen adult tickets are numbered 050001-050500. children tickets are 100001.
