saturday with planstake her with them to mexico. the boyfriend's father turned himself in last night after investigators found the suspect's wife. the boyfriend wan manuel. >> the man accused in the nation's largest mass shooting expected back in court. james holmes facing formal charges today. he is suspected of opening fire in a theater during the midnight showing of the new batman movie. a total of 12 people were killed, 58 others injured. holmes could be facing more than 100 charges including 12 counts of first-degree murder. >> it is 4:35. a kent state student will be in court after sending a tweet saying he planned to shoot up the school. 19-year-old william was arrested at his parents home following the message sent on twitter. the sophomore will be arained on

a variety of charges. >> right now it is 4:35. stuck 150 feet up in the air for nearly two hours, the frightening ordeal for a dozen people, the new superman ride in vallejo. christie smith is live there with what's next for the newest attraction at the popular park. tell us what's the latest? >> reporter: good morning. the park opens at 10:30 this morning. i checked their website. there is no mention of what happened over the weekend, but the superman ride is one of the first you see when you turn into the park and at this point it's not even clear exactly when this ride will reopen. a spokesperson for six flags discovery kingdom said it wouldn't happen until after a thorough inspection is done, after the newest park roller coaster stalled. superman ultimate leaving about a dozen riders stuck 150 feet in

the air for almost two hours in the afternoon. the firefighters were dispatched to the scene and a park crane and personnel bucket had to deliver water and sun screen. eventually a mechanic got it moving. >> we were able to fortunately go ahead and release the train after inspection taking a look at it. we released the train, got down safely. no injuries. >> the riders, get this, had to roll backwards to get down to the ground. no one was hurt but one other park visitor said that she thought that the ride which just opened about a month ago stalled briefly two weeks ago but a park spokesperson said that she was unaware of it or what compensation might be offered to those stranded riders. reporting live, christie smith, "today in the bay." >> a bay area lawmaker's fight

to restrict party buses has new ammunition a. 25-year-old woman was killed saturday when she and a second woman fell from one of the buses along highway 17 in los gatos. the 20-year-old woman who tumbled out survived with minor injuries. the chp says everyone on board was intoxicated. assembly man jerry hill wants to tighten regulations on the buses. >> this legislation will hold the driver, the bus company and a mature 25-year-old or greater or older individual responsible in the future. that's what we're hoping will stop this from occurring. >> the chp is still looking for some of the people who were on the bus. investigators say some of the riders fled the scene when that accident happened. >> changing gears now, you might be able to help an abandoned puppy who had a rough start. his name larry. the little guy is looking for a home. animal rescue says he was found

in a ditch in tracy last month, injured, possibly hit by a car. and had also been abused. he's now recovering and will soon be up for adoption. if you like the looks of this little guy, give him a home, call noah's ark foundation in tracy. 925-461-4347. >> bullet train to party train, california's high speed rail could whisk you from the bay area to sin city. private developers are gambling on a plan to build a second train that would lead to las vegas. they hope that the obama administration provides a record loan to kick start construction of the train line that could some day connect california's high speed rail near los angeles. the trip san francisco to vegas would take about four hours traveling two lines. >> stretch out the muscles, get ready. >> it is 4:39.

we check in with meteorologist christina loren to find out what's happening on this beautiful monday and the week ahead. >> good morning you two. we have a really good looking start to the day. it's going to be a little on the hot side inland later on. your extreme east bay cities getting close to the triple digits. a live look. downtown san jose this morning, we don't have much of a marine layer in the inland valleys. we have a little formation at the coast and over the bay. as we head throughout the morning that will become more visible. 61 to start out in sunnyvale. livermore, 56 degrees. 57 in san jose. futurecast tells the story. at 8:00, you can see at that point really hardly any cloud cover from san jose all the way through the silicon valley, dealing with a little bit of low clouds from san francisco down to san mateo. but as we head throughout 10:00, the whole thing pushes back out to sea. talking about abundant sunshine and a hot day in the inland cities. 95 in concord, 95 in livermore, but look at san francisco, 71

bridge before the sun comes up. traffic going very nicely early in the morning. mike inouye will fill you in. christina loren says it's going to be the warmest day of the week. 4:44. >> india, massive grid failure left 350 million in the dark, it's the worst to hit the country in more than a decade. the total of seven northern states were without power more than eight hours. hundreds of trains completely shut down, hospitals had to shift to generator power. the power was restored and most people by late this morning. the rest should be back to normal later today. >> in southern india dozens are dead after a fire swept through a passenger train. at least 47 people were killed, dozens injured when the flames broke out while passengers were sleeping. officials fear the death toll will rise as they continue to search for victims. a railway station employee noticed the fire, allowing some

to evacuate. >> new zealand has a new look after an earthquake reduced it to rubble. 185 people were killed, more than 1,000 buildings destroyed in last year's quake. >> time to give you the business and a check on wall street and nu news before the bell. we turn it over to our man hampton pierson. good morning. >> hey, jon. futures are lower as the markets come off a rally last week. the dow jumping more than 350 points wednesday through friday, the biggest gains of the year, as investors anticipate the fed and european central bank will launch or signal new economic stimulus measures. the ecb meets on thursday, asian and european markets are higher. we get data this week on

spending, home price, all topped off by the july jobs report on friday. the dow rising 187 points on friday to close at 13,075, the nasdaq up 64, 2958 was the close there. meanwhile, gas prices on the rise. the latest survey finds the national average for regular unleaded rose 10 cents in the past two weeks to $3.51 a gallon, the first increase in 14 weeks as wholesalers pass on the cost of higher crude prices to consumers. in san francisco, gas is averaging about $3.85, across the bay in oakland at $3.78 and in san jose in your back yard, jon, a penny higher at $3.79 a gallon. back to you guys. >> all right, hampton. thank you. we'll check in with you later on. >> they are billed as nutritious snacks. the fda has 2,000 complaints from pet owners claiming that certain types of chicken jerky treats have sickened their

beloved pets. now only nbc bay area has results of a new test conducted on a local dog that died within 48 hours of eating two treats. vicki joins us with more on what scientists found. >> jack's my guy. >> rachel's four dogs are family. she says three of them became sick after eating milo's kitchen jerky treats made by del monte. >> he was very, very sick. sick for just a couple days with diarrhea. >> but it was the shepherd mix cali who couldn't be saved. >> it was violent and she did not deserve the way that she died. >> her veterinarian said he's seen more owners bringing in sick dogs after feeding them chicken jerky treats. >> you think these are dangerous? >> they are.

they are causing vomiting and diarrhea, discomfort. >> the fda issued three warnings since 2007 saying chicken jerky treats may be associated with illness in dogs. more than 1800 complaints have been sent to the fda about the treats. the agency posted a fraction of those records. we found the brands with the most complaints were wagon train and kingdom pets. despite the warnings, the treats are still on shelves at target, walmart, costco, petco and petsmart. spokespeople say no recalls have been issued by the makers or the fda so they have no plans to pull the product. the other stores had no comment. pet owners have turned to the internet to stop sales of these. a pet now has more than 66,000 signatures. bay area chain pet food express doesn't sell any of the treats on the list but has posted the

warning. >> we know our customers are going to have questions about chicken treats so we want to give them as much information as possible. >> the chain tracks customer complaints and has not recorded a difference between chicken treats from china and those from the u.s. >> we wouldn't carry anything we wouldn't feed. >> the fda says it's tested in nearly 300 treats, sent in by consumers but nothing surfaced to prompt a recall. anguished pet owners are pursuing suits. one attorney is suing del monte. >> the fda has gone down to china and inspected the facilities but we can't get the results of that. >> del monte and nestle's say they test for safety. >> when the product is ready to use. >> they posted this video to show pet owners how the wagon train treats a made. kingdom pets posts data sand atheir treats come from the same

suppliers for kfc china and mcdonald's china and never tested positive for known contaminants. treat makers repeat the products are safe if fed as directed. the maximum recommended portion is between 4 and 5 pieces. cali ate two. >> we did not give the entire bag. even if i gave them a whole bag and if you ate a box of ding dongs you're not going to die. >> her stomach twisted and ruptured. it's undetermined what caused that. the report does not show a clear link between the treats and her death. she wants retailers to post the warning. >> by not giving these a simple advisory saying this could cause illness or death, i would not have purchased that and my dog would still be here. >> the fda is testing samples

best of the best with. our overnight lows have pen on track with seasonal averages. 61 degrees, 55 to start out in san francisco, 46 in novato and 61 degrees in sunnyvale where we're in the upper 50s here in san jose. so as we head throughout the day, temperatures on the mild side for first part of the day by noon getting hot possibly too hot for outdoor activities if you want to go for a job better in the early hours. mostly cloudy conditions by 11 a.m. that means great beach weather 74 degrees in santa cruz today. 84 in los gatos, 83 in oakland. we're talking about the 90s, 95 degrees in livermore today. so it remains warm throughout the week but look at what happens. we swing you back down to the upper 80s tomorrow, to the 90s wednesday, thursday, leveling off for friday into the weekend but over all like i said hotter than it was last week. >> missed all of you guys.
