husband, and by the way, her husband, andy grant, a former stanford swimmer who grew up in livermore. it's not an easy road. it rarely is. the injuries, she had diet issues but here she is now as she wakes up a gold medalist for the former cal star. >> i'm still shaking all over. seeing my family, i haven't got tune see them yet and that really made it set in. >> reporter: it really is a nice scene to see the vollmer family celebrating. so much fun. what a great scene. also if you've been watching over the weekend, the olympic, you might have noticed what's up with the seats? a lot of empty seats. maybe not the basketball games but most of the venues you see empty seats. people are ticked off in london. really it's been an embarrassing story for the london officials. why the empty seats? usually they are corporate seats. most are going unused.

we've been to several olympics before and usually this is how it works. in athens this happened. the first weekend, the opening weekend, you have a lot of empties, then the corporate guys and women come in and they fill it. so that's what's happening with the seats. then here's a story, talking about the, well, remember the wedding crashers, how about the opening ceremony crasher. who is this lady in the red? this woman walked into the opening ceremony with the indian olympic team, slight problem, though. she's not on the indian olympic team, not even an olympian. she apparently is a grad student from india studying in london. they did find, track down her parents in india and they apologized on her behalf. she kind of walked in, she got through security and walked with the indian olympic team. i'm indian, i didn't even get to walk with the indian olympic team. >> you missed your chance. >> looks like you could have had you tried. >> she just you know, she was

>> happening now, an amber alert in effect for a missing teenage girl from monterey county. eunice serrato is from san ardo. she lives in the same house where two men in their 20s were found dead on saturday night. investigators say it is possible serrato's boyfriend and his father kidnapped the girl, the plan to take her with them to mexico. the boy's father wan manuel salazar turned himself in. the boyfriend juan manuel salazar jr. >> james holmes will hear a formal reading of the charges. holmes is accused of killing 12, wounding 58 during a midnight screening of the new batman film. the 24-year-old appeared dazed

and confused in a last appearance last week. the district attorney says she wants to talk with victims' families before making a decision whether to seek the death penalty. >> if the death penalty is sought that's a very long process. that impacts their lives. for years. and so they will want to have and we'll want to get their input before we make any kind of a decision on that. >> holmes could face more than 100 charges including 12 counts of first-degree murder. >> to a developing story. a brand new ride at six flags vallejo is off limits. this just opened up recently. a dozen were stranded on the superman ultimate flight 150 feet up in the air. they were there for nearly two hours on sunday. christie smith is live in vallejo. good morning. >> reporter: good morning. what a day for people who wanted to come out to six flags and catch a ride on the newest roller coaster. the highest part, it's hard to see because they turned the

lights off the ride. but the highest part is 150 feet in the air which is taller than all of the trees out front. the park opened at 10:30 this morning but exactly when superman ultimate flight will reopen is unclear according to a six flags spokesperson. it won't happen until an inspection is complete. it was around 2:30 in the afternoon when it stopped at the crest of the ride a. dozen riders sat for nearly two hours as firefighters were called in. a large crane was lifted up with a mechanic and firefighters, they delivered water and sun screen to the riders. fortunately, they were prepared for something like this. >> oshaa wanted a system in place in an event like this occurred. and they actually required it and we went ahead and complied and did training. >> reporter: that crane basically just sits here all the time. apparently some riders tried to

shake the ride to get it loose and going. that didn't work as mechanic got it going and they rolled back to the ground to safety and no one was hurt. why it stalled they don't know. a spokesperson said if the ride stops it usually detects something and stops for safety reasons. reporting live, christie smith, "today in the bay." >> 5:09. two tech titans due to square off. the case could have a big impact on the iphone and tablet markets. apple is suing samsung saying that they are knock-offs. the company demanding $2.5 billion in damages. that number is the biggest of any patent-related case by far. in about 10 minutes scott mcgrew will have more on the lawsuit including a look at samsung's defense. >> a major milestone in the construction of the san francisco 49ers new stadium in the south bay.

bob redell is live with a look at all of that heavy lifting out there planned for this morning. bob, i imagine you'll just be watching, not doing the lifting. >> reporter: i don't think they want me behind any crane. good morning to you. in the months since the groundbreaking, the stadium news focused on laying the foundation, leveling the dirt. but today people in santa clara will get to see the stadium itself start to take place, you can see behind me they have four cranes set up. at 6:30 the mayor and the 49ers will oversee a ceremonial raising of the first beams. they will lift into place the steel structure. the end goal is to look something like this. the animation shows what the $1.1 billion stadium will look like. they say in time for the 2014 season. the new digs will seat 68,500 fans, about 1500 less than kand

cell phones and apple is america's most valuable company. apple accuses samsung of copying many of the features found in iphones, like rubber banding where you can flick the screen to scroll. apple wants $2.5 billion in damages. samsung says even if they did get idea from apple, apple got it from sony. jury selection begins today, testimony as soon as tomorrow. court records show everything is a fight even which company gets to sit at which table. we'll also be watching facebook stock. facebook founder has in the last few days lost a billion dollars a day on paper as that stock sank to new lows. you remember hours before facebook's ipo general motors said it would no longer advertise on facebook. the guy who dropped that bombshell at gm has been dropped

at gm. that and more. good morning. >> general motors has in fact ousted its global marketing chief two years after he joined the company. he was responsible for pulling gm's ads from facebook earlier this year. he made the decision not to advertise in next year's super bowl, moves seen as controversial within gm. reports say he didn't properly report the details of chevy's recent five-year sponsorship deal with manchester united, the soccer team. apple and twitter in talks, one time about a possible tie-up. reports say discussions involve apple making a bigger investment in the micro blogging service but the talks which were held more than a year ago didn't result in a deal and they aren't currently active. apple is still a big partner for twitter as it continues to mesh its message service. >> hampton pierson live in

morning, hosting a variety of events including beach volleyball, judo and table tennis. swimming of course is under way. >> absolutely it is. in the bay area natalie coughlin making headlines not for her performance but a decision made on the sideline. >> raj mathai joins us live in london. you spoke to natalie. is she keeping her spirits up? >> reporter: my gosh, she has such a good positive attitude. i know deep down this is confusing to her and a bit hurtful. a lot going on. just in case you missed it essentially natalie coughlin was benched by her own team. she wasn't allowed to swim in the finals. in the finals they did win a bronze medal so natalie does win a bronze. however, she didn't really take part in the finals. she took part in the preliminaries. the next question is what happens now. we've been around the world with her. she won 12 medals, a record for an american female athlete.

she could retire. seems that team usa is nudging her out of the picture by taking her off the team there for the final race. the question is why would they do that? especially since her coach for team usa is also her personal coach in berkeley. >> there are a lot of factors that go into it. i think we were swimming pretty evenly, if you factor in our relay take-offs and everything. our times are pretty even. i think part of it is having the head coach be your personal coach. you don't want to cause a controversy and don't want any one to think she's giving me special favors so i think we' we'rerring on the other side. you have to stick with the decision and be supportive. >> been very up front and honest with us your career. disappointed how it went down? >> i'm -- it's hard to say. i'm just kind of disappointed how this year has been.

morning, my friend. how could you not. >> me too. >> i'm energized. i'm eating my wheaties. i'm having gatorade with all of the athletes. we'll check back later on. >> a developing story, 15 stories high and stranded for hours. sounds scary. the brand new superman roller coaster ride in vallejo coming to a halt on sunday afternoon. that's where christie smith is live with a dramatic response from the rescuers there. good morning. >> reporter: good morning. what a day for people who just wanted to come out to six flags and enjoy this coaster. it can go about 62 miles an hour, and the coaster stopped near the very top. it's one of the first things you see when you pull into six flags. they turned the lights off this morning. i checked the website. the park opens at 10:30 this morning. when this will reopen is unclear. a spokesperson says that it

wouldn't happen until a thorough inspection is done after the newest roller coaster stalled, leaving about a dozen riders stuck 150 feet in the air for almost two hours in the afternoon. vallejo firefighters were dispatched to the scene almost immediately. a big park crane and personnel bucket that stands by was used to deliver water and sun screen and eventually a mechanic got it moving again. >> we were able to fortunately go ahead and release the train after inspection, take a good look at it deeming it was safe. we got down safely. 12 individuals, no injuries. >> reporter: the riders had to roll backwards to get down to the ground. he mentioned no one was hurt. one other park visitor said that the ride which just open add month ago stalled briefly two weeked ago. a park spokesperson said she was unaware of that or what

compensation the stranded riders might be offered because of this. christie smith, "today in the bay." >> 5:34. a bay area lawmaker's fight to restrict party buses has new ammunition a. 25-year-old santa cruz woman was killed saturday when she and a second woman fell from one of the buses along highway 17 in los gatos. the 20-year-old woman who tumbled out actually survived. she had minor injuries. the chp says everyone on board was intoxicated. they are looking for some of the people on the bus. investigators say some of the riders fled that scene when the accident happened. >> california's high speed rail could one day whisk you from the bay area to las vegas. private developers are gambling on a plan to build a second bullet train that would end in vegas. they hope the obama administration provides a record loan to kick start construction of the line that could some day

connect high speed rail near los angeles. the trip from san francisco to las vegas would take about four hours traveling two lines. >> new this morning, very heavy lifting planned at the site of a new 49ers stadium. bob redell is live in santa clara where the first steel beams will be put in place. good morning. >> reporter: good morning, jon. the first indication, the first visual will show people the stadium is starting to take shape. in just under an hour the mayor of santa clara and the 49ers will oversee a ceremonial raising of the first beams, four large cranes will lift those steel structures, some 90 feet tall. the end goal is for it all to look like this. this shows their $1.1 billion stadium, what it will look like when they say it will be

hospitals had to shift to generator power. power was eventually restored by this morning. the rest could be back to normal later today. >> in southern india dozens are dead after a fire swept through a passenger train. at least 47 people were killed. dozens injured when flames broke out while passengers were sleeping. officials say they fear the death toll will rise as they continue searching for victims. a rail station employee noticed the fire, raising the alarm allowing some to evacuate. >> new zealand plans a new look for christ church after an earthquake reduced it to rubble. today officials unveiled blueprints for a convention center and performing arts complex. 185 people were killed, more than 1,000 buildings destroyed in last year's 6.1 quake. >> turning to politics, this morning mitt romney making his final stop on his trip abroad. today, poland.

in israel he had tough words for iran and its nuclear program. brian mooar is live on capitol hill. it's your world, take it away, my man. >> jon, this is about mitt romney looking presidential. he's hoping that poland goes off less like london where he had the gold medal gaffe. more like israel where he stood a hard line against iran. he didn't have to criticize president obama or the u.s. government policy, he stood along side people who did it for him. romney rubbing elbows with his friend of decades, the prime minister benjamin netanyahu who has a notoriously icy relationship with president obama. he's going to do more of the same in poland. today is going to be meeting with the former president lech walesa who has snubbed or i should say exchanged snubs with president obama. each refusing to see the other. this is a chance for mitt romney to stand on that world stage, to fill in his foreign policy resume a little bit.

in fact, i think before we even hit 9:00 a.m. but we're starting out with a beautiful, beautiful temperature in san jose, 58 degrees, crisp, great for a morning jog. here is san francisco. you can see the embarcadero here, we're not expecting flight delays. what's happening is we have a marine layer. about 1200 feet. high pressure is compressing that, forcing it to the surface. so, we do have reduced visibility for the time being. but it won't last long. 58 to start out in oakland. 58 degrees this morning in san jose. high pressure is in control. that's going to bring monsoonal moisture into southern california for us it's really going to warm us up, high pressure will be stronger than it was yesterday. 3 to 5 degrees warmer than where we ended up on sunday. as we head through tomorrow we're going to cool you off a touch with a deeper marine layer. to the beach, that's the place to be today. you've got kids home with you for summer take them to pacifica with 72 degrees, comfortable conditions. wind at about 10 to 15 miles per
