games. and along with it all of the smiles, tears and sometimes even the scandal that comes with it. raj mathai, our international man on the move joins us live with a suspicion now being starting to happen at a young chinese swimmer's success. what's happening with this, my man? >> reporter: hello from london. now when we talk about the olympics you have to talk about doping allegations, you have to talk about drug use and that's what happened this morning, we woke up to screaming headlines in the local papers here, we'll bring up the times of london. right there, front and center is the chinese swim star and says i'm clean. what's happening is some of the american swim officials are pointing the finger at the chinese for some doping allegations. we're talking about a fantastic swimmer, she was in the 400 meter medley. she shattered the world record and won the gold.

her final 50 meters she swam faster, ryan lochte, but also faster than michael phelps but she denies the allegations. here is the critical comments. the head of the american swimming coaches association says her performance was unbelievable, disturbing and does not add up so. this will be a talking point and story in the days to come. unfortunately, though, we have to cover these issues here at the olympics. from that kind of news to some really good news. we're talking about judo. judo is not really in the headlines. it's usually swimming or gymnastics or beach volleyball. how about this, for only the second time in american history, a female has won an olympic medal in judo. where is she from? would you believe san jose. yes. congratulations to marti malloy t 26-year-old judoca wins the bronze medal, only the second time in american history a woman wins a medal in judo. we caught up with her a while

ago. >> feels a little surreal for me. i surprised myself in the final when i won, so it's still a mix of happiness and unbelievableness. but it feels really good. >> reporter: excellent. she is excited and part of that big time program at san jose state. a lot of people in the south bay excited what's happening in london with marti malloy. in terms of what's coming up today, it's a big day. some people say it's the best day of competition in all of the olympics, the women's gymnastics, team final. that means all of those young ladies that we saw in san jose last month qualifying for the team are now in the spotlight as the gold medal is on the line. so, the athletes are a bit nervous and how about the moms and dads. we caught up with jordyn wieber's mom. here's what she does before a big meet. >> i have to find a church, whatever town we're in for a meet like almost the first day and i go there every day and you

describing the horrific scene after two women fall from a party bus onto busy highway 17. christie smith is live in san mateo where bay area lawmaker trying to toughen regulations for the buses. >> reporter: good morning. details of this horrible party bus incident are being sorted out by the california highway patrol. assemblyman jerry hill here is talking about his bill that he thinks would bring much more accountability to this party bus industry. the woman killed, she fell out of a bus after a dispute with a 20-year-old. how the door flew open is still unclear. we have video of the type of buses that were involved. the chp says that some passengers actually fled and many who remained were completely intoxicated. the bill could change a number of things. if minors are on board there

would have to be a chaperone. fines coulding up to $2,000 for drivers who don't cooperate. he thinks it could help. >> what's disturbing is had this bill been in place it would have required the bus operator, the driver of the bus, to take responsibility as to what was occurring behind him. >> reporter: the chp says in this incident the person driving the bus has been cooperating with them. right now the bill is in the senate. if approved it could go into effect january 1, 2013. reporting live in san mateo. christie smith, "today in the bay." >> a bay area family demanding justice after a police shooting killed their teenage son. family for 18-year-old allen blueford will who would rally in oakland tonight demanding release of the police report. blueford was shot and killed

after allegedly pointing a weapon at officers trying to arrest him. >> the suspect charged with the disappearance of sierra lamar will be in court this morning. bob joins us with an update whether he will enter a plea. good morning. >> reporter: good morning to you. antolin garcia torres is expected in court this morning at the hall of justice where he could enter a plea to the charges of kidnapping and murdering 15-year-old sierra lamar. i say could because according to our legal analyst he may ask for another delay. he did this in his first court appearance in may, he might do the same today in order to get more time to prepare his defense. he does face serious challenges in proving he was not involved in sierra lamar's disappearance. investigators say his dna was found ond her clothes and her dna in his car. our legal analyst points out

this isn't an open and shut case. >> one, there is no body. number two, we don't know much about any crime scene or evidence of trauma and we have no murder weapon. >> reporter: sierra lamar's parents will not be at the hall of justice because they don't want to hear the suspect in their daughter's disappearance say the words "not guilty" when asked how he pleads. this is according to marc klaas coordinating searches, the klaas kids foundation is conducting volunteer searches every wednesday and saturday in morgan hill. reporting live, bob redell, "today in the bay." >> another bay area fire district fighting to save its stations. the contra costa county fire district will propose asking voters to pass a $75 a year parcel tax to try to prevent the closure of up to ten stations.

tech. business and tech reporter scott mcgrew joins us. >> you have to do something to make it more exciting than does this phone from samsung look like this phone from apple? opening arguments will begin today in a san jose federal court after yesterday's jury selection, among the jurors a google engineer and several people who own patents themselves. a judge in the case started the proceedings off by asking everyone to turn off their cell phones. and then asking each juror if they had an iphone, samsung phone or something else. of the first 30 people impaneled just ten had apple iphones. 18 had others. lots of lg's. one had a phone by casio, two people didn't own cell phones at all and one candidate for the jury explained he did have a samsung microwave in his

kitchen. all of this comes as apple apparently will announce the apple iphone 5 according to one of those blogs that specializes in apple rumor. sales growth in the last quarter has fallen for apple as people wait for this iphone 5. and this coming quarter should be slow, too, because september 12th is just at the tail end of the third quarter with still no new iphone. let's check the markets before the bell. hampton pierson is live in washington. good morning. >> scott, we've got futures higher after a lackluster session monday. the dow extending its losing streak monday to nine weeks, the fires time in 39 years. investors are being cautious and with the fed meeting that begins today and friday's jobs report. now, the fed is widely expected to hold off on launching big new stimulus program until september. it may extend its pledge to keep

them spoiler alerts. >> 5:32. new details in other news, a witness accounts the chaotic scene after two women tumble from a party bus while it's moving. one of those women was killed. christie smith is live in san mateo where a bay area lawmaker says the tragedy could have been avoided. good morning. >> reporter: good morning to you. assemblyman jerry hill says as soon as he heard there was a minor on board he started thinking about his own legislation and the difference that it could have possibly made. over the weekend as you said two women tumbled out of a moving party bus returning from a concert. investigator believe that the two women may have been fighting and somehow the door flew open. a 25-year-old santa cruz woman was kill and 20-year-old woman injured. that 20-year-old said she had been drinking.

we have video of similar party buses and hill and the assemblyman says that ab-45 would mean if a minor is on board the bus company would require the person making the reservation to have an adult chaperone. if minors are drinking the trip is over. the driver could face penalties like a $2,000 fine. >> certainly don't expect him to take his eyes off the road or not be responsible in his driving, but it would have required him to at least pay attention, to know if there are minors on board, one, and two, if they were drinking. >> reporter: the chp says the driver involved in this weekend incident is cooperating with them. some in the party bus industry feel that all of these rules could distract the driver and be a burden. right now the bill is in the state senate. if if approved, though, it would go into effect january 1st, 2013. reporting live in san mateo, christie smith, "today in the bay." >> 5:34.

the man charged with kidnapping and killing sierra lamar returns to court. antolin garcia torres could enter a plea. bob is live with why sierra's family doesn't want to be there. >> reporter: good morning. sierra's parents don't want to be at the hall of justice because they do not want to hear the suspect in their daughter's disappearance utter the words not guilty if and when he pleads, this according to marc klaas who has been helping coordinate the search for sierra lamar. antolin garcia torres did not enter a plea shortly after his arrest and is possible he might not this morning. our legal analyst says his attorney might ask for another delay to give them more time to prepare a defense. garcia torres has been charged with the abduction and murder of the 15-year-old girl who disappeared in march. the challenge for the

first the gaffe in london questioning whether the city was ready for the olympics. now israel was the next stop. he left people there palestinians very, very upset. romney was trying to make a point that the israeli economy is doing well and he said that's a result of the culture. well, in doing so he slighted the palestinian culture, palestinians saying sure, the israelis are doing fine, they have restrictions on our economy, that's what's holding us back and called romney a racist for his remarks, they are upset that he declared jerusalem the tour capital of israel. today romney is in po hand trying to keep the gaffe meter down. one of his campaign spokespeople say it has been a good trip generally speaking but they note that romney tends to speak his mind and say what he believes, not working so well in this case. >> exactly. it's an interesting foreign tour so far.

every stop along the way. thank you. >> interesting. good way to put it. back to the london olympics and this morning, team usa has a brand new golden girl, 17-year-old missy franklin of colorado. she finished first in last night's 100 meter backstroke. that achievement marking franklin's first gold medal. she is only 17. the teenager says she could barely contain her excitement at the podium. >> i was like crying at same time, then i forgot the words, i didn't know what i was doing. i was a huge mess. seeing that flag being raised was so unbelievable. i could have never dreamed it would feel like that. >> that it is a beautiful thing. franklin made up for the performance by ryan rockty who finished fourth in last night's 200 meter freestyle final. >> we're still a fan, though. the american women's gymnastics team hoped to tumble to a team
