where it's now 2:00 in the afternoon and people are still talking about a female chinese swimmer who swam faster than even ryan lochte. let's go to raj mathai. this is turning into now a swimming scandal. and suspicions about how she did it. good morning. >> reporter: it's at the early stages now. that's exactly what's happening. here's the deal. some top level swim officials for the united states are criticizing and pointing the finger at this chinese swimmer. we woke up this morning to the front page of the times of london, you see it there, i'm clean vows china's swim star. she's talking about these allegations. the head of the american swimming coaches association says it's unbelievable, disturbing and does not add up what this young lady did. we'll tell you what she did. 16-year-old chinese swimmer not only does she win the gold medal in the 400 meter relay but shattered the record. her final 50 meters, this is

catching attention, she swam faster than ryan lochte and michael phelps in their medley. but we should be clear she denies all allegations. from that story to a more heartwarming local story, when we talk about the olympics, you talk swimming, gymnastics, beach volleyball, one of the sports that dent get a lot of attention is judo but we have one of the best judokas in the world. during her competition her friends in the south bay got together to cheer. >> it's amazing. words can't describe the feelings that go into this and i mean, how much work and time and preparation. >> reporter: a lot of work, time and preparation for marti malloy, part of that very world famous san jose state judo program and here in london she

wins a bronze medal. this is significant, winning a medal is great but becomes only the second american female in the history of the olympics to win a medal in judo. >> a little surreal for me. i surprised myself in the final when i won, so it's still a mix of happiness and unbelievableness. feels really good. >> reporter: congratulations to marti malloy, the judoka. from san jose state. congratulations. coming up later michael phelps in the pool looking for his 19th career olympic medal which would be a record. i don't know where he puts all of those back at home. >> but he'll keep on winning them. thank you very much. right now we're going to put up the results of the competition from some of our bay area yo

this party bus he started thinking about this lajlation and it kuld do a number of things starting with holding party bus drivers and tightening the loophole in place for limos but not the buses. a 25-year-old santa cruz woman was killed after she and a 20-year-old woman somehow fell out of a moving party bus. it's believed that they were fighting and the floor flew open. that's under investigation. the 20-year-old did tell investigators she had been drinking on the bus. there are often sound systems and dance floors. the bill is that if minors are drinking on one of these the trip is over. the driver could face stiff penalties for not enforcing the rules and in some cases sapper reasons would be required.

appearing arguments in federal court, this after yesterday's jury selection. among the jurors a google engineer and early people who own their own patents. the judge in the case started the proceedings off by asking each juror if they had an iphone or samsung phone or something else. you would think everyone has an iphone. of the first 30 people impaneled yus ten had apple igons. one guy had a phone made by cas casio. one did it for the junior, he did have a samsung microwave. he wasn't sure if that would affect the trial at all. >> honesty. >> 2$2.5 billion at stake. first day of the opening arguments this morning.

>> good morning everybody. thanks for joining us. i'm jon kelley. >> i'm laura garcia-cannon. 4 1/2 months after she disappeared the man accused of killing sierra lamar could enter a plea. bob is live in san jose with how sierra's parents are dealing with this day. good morning. >> reporter: good morning to you. it's our understanding they don't want to be in court at the hall of justice when the suspect in their daughter's disappearance appears because they don't want to hear him enter the words not guilty if he enters a plea according to marc klaas. an too little garcia torres did not enter a plea in may and it's possible he might not again during his appearance scheduled for a couple of hours from now. our legal analyst says his attorney might ask for another delay to give more time to prepare a defense. garcia torres has been charged

with the abduction and murder of the 15-year-old girl who disappeared in march. the challenge for the prosecution according to our analyst is proving this case without a body and as far as we know without a weapon and crime scene. the challenge for the defense, explaining how her dna ended up in his car and his dna on her clothes. >> is there an innocent explanation for why garcia torres's dna may be on his possession and how much dna and how could it have been transf transferred in a way that doesn't equal murder. >> reporter: the search for sierra does continue in morgan hill. the klaas foundation is still coordinating searches every wednesday and saturday. reporting live outside the hall of justice, bob redell. >> this was a freak accident with a fatal outcome.

chp investigators trying to figure out how two women fell out of a party bus on highway 17 and leaving one of those women dead. christie smith is live with efforts to tough at any regulations on popular rides. good morning. >> reporter: good morning. details of this horrible party bus incident are still being sorted out but assembly man jerry ll we were at his offices, he is talking about his legislation and what he thinks it could do like bringing more accountability to this party bus industry and more in line with what happens. 25-year-old natasha was identified as the woman killed when she fell out of a bus this weekend in a dispute with a 20-year-old woman. how the door flew open is unkeer. the 20-year-old said she was drinking on the bus. we have video of the type of buses.

the company of stealing its popular ipad and iphone designs. samsung counters saying apple is the one ripping off designs since it didn't jump into the mobile phone business since 2007 year after the first cell phone. apple is demanding $2.5 billion in damages and injunction barring samsung from selling its phone and tablet. >> apple scheduled an event to unveil a, quote, major product. analysts speculate this is probably the iphone 5. reports say apple may show off that new mini ipad with a 7-inch screen. apple keeping with tradition not saying anything publicly. >> we're talking about the forecast, want to check in with christina loren. >> very publicly. this is a live look at london and you can see everyone has their umbrellas out.

are on board a chaperone too, if minors are caught drinking the troyp is over. if approved this could be in effect january 1, 2013. reporting live in san mateo, christie smith, "today in the bay." >> we can tell you a bay area fire district is right now fighting to try to save its stations. the fire district will propose asking voters to pass a $75 a year parcel tax in november ta try to prevent the closure up to 10 stations. this tax would generate an estimated $16.8 million each year, that would be over seven years. if approved the tax would take effect starting july of 2013. >> the cocoa county fire district covers more than 300 square miles, hoping to avoid the same fate as its neighboring east fire district. it had to close half its stations earlier this month

after a parcel tax there failed. >> this is interesting. a german company's bid for peet's coffee may not be enough. >> there is talk that starbucks could come in. >> maybe so. let's look at the evidence. we have no hard facts. consider this. a share trading above what is the company is offering to pay so that makes no sense. why would you buy shares in something that pay less when the sale goes through. unless you think some other company is going to swoop in and pay even more. that company, if it exists, would logically be starbucks. we'll continue to watch. the worst is really over in the housing crisis. for a couple years you heard experts say we were recovering and i've been less optimistic because i was looking at the data. for several weeks now we've seen more and more actual factual data that prices are moving up across the board including san francisco prices were starting
