let's check that forecast with christina loren. we can't hear you, christina. there we go. check a mic as we look at the temperatures appearing on the map. cool start for our day. we'll check with her coming up. there we go. >> 54 degrees in oakland. 59 in concord. 59 in san jose. >> you know what? i have to show you the maps for san jose where we actually had a couple of accidents that just in the last 30 seconds cleared from this report. so let me tell you what may still be going on. we have southbound 280, earlier accident, route 4 hit the center divide, spun around, blocked the left lane for about an hour but that's coeur d'alene as well as northbound 880. that transition, a fender bender there as well but things have cleared. we'll look at a live shot outside and see how things are shaping up for the peninsula. 101 northbound with the headlines come you through palo

alto. no delays between south bay and the bridge. >> women's gymnastics walking away with the top prize. >> this is something that's not been done since back in 1996. it was jordyn wieber overcoming that disappointment for not qualifying with that all around finals. she and her teammates outscoring the gymnast from russia who struggled with slips and their falls. now after winning that gold wieber talks about her feelings going into those finals. >> i knew that i really had to mentally turn it around and pull it together for the team and just keep the momentum going into this competition. >> next up for the gymnasts, the women's all around finals goes off on thursday. >> it was a huge night in the swimming pool as well. michael phelps won two medals to become the most decorated

olympian in history. phelps bringing in the u.s. home with a huge lead, beating second place france by three seconds. gold medal is phelps 19th olympic medal, breaking the record of 18 held for 48 years by soviet gymnast laresa latia. he won a silver medal in the 200 meter butterfly. team usa added two its medal count yesterday. team usa now has 23 medals overall. nine of them gold. china also has 23 medals overall but has four more golds than the u.s. japan is in third with 13 medals overall. host country united kingdom is still looking for its first gold. >> here's a look at some events going off today.

latest. good morning. >> reporter: good morning. more criticism coming down on the oakland police department at this time that even with the severe budget problem the department went on ahead and bought equipment that it didn't use or that was underused. that according to a new report that was just released by the city auditors office, including the shot spotter gunshot detection system, a series of microphones around the city that can pick up sound and determine where it's coming from. in that case the lack of use was because of staffing shortages and also apparently officers received some really inconsistent alerts about what was going on. the report covers a period from 2006 to 2011 and indicated that 1.87 million was spent on things that were not used enough. another system the cameras used in oakland police cruisers didn't work as initially planned. the cameras among other things were brought to bring oakland in

line with a federal judge's order stemming from a civil rights lawsuit from human rights abuses. another system used to help identify at risk behavior wasn't used because that vendor went out of business. the auditor made 22 recommendations for improvement including a long term purchasing plan. reporting live in oakland, christie smith, "today in the bay." >> oakland mayor says she will fight the finding of the new report that cast the police department in a bad light. >> like many other thing in my short life as a mayor, i feel i'm sort of the pinch hitter at the bottom of the ninth. some of the things in the report are pretty old and that's one of the problems i found as being mayor for 18 months. i get reports that are six months old on things that happened six months ago. in this city that's a lifetime. >> she says most of the reports complaints have been solved. one of the most trouble findings

was racially tinged photos of the mayor and a judge on a bulletin board inside police headquarters. henderson could decide whether to place the department under federal control. new details in a deadly san francisco shooting. one person is dead, another right now fighting for life this morning. both were shot last night near the intersection of san bruno drive west of highway 101. the suspects are two young men in the 20s. they shot the victims in front of a house and then drove off in a white four door car. police at this point asking anybody with any kind of information about the shooting to give them a call. a memorial service being held this morning for the san jose couple killed right in front of their three children. pedro and mary belle were shot to death in their home early monday morning last week. the suspect, 31-year-old pedro

medina may have acted out of jealousy. >> a serial car thief's career may be over. they say gomez shattered car windows and grabbed purses, wallets and small electronics. he's suspected of victimizing members of the palo alto family ymca. the palo alto y just upgraded its security cameras which were helpful in tracking gomez down. >> just made an upgrade about a month ago, and we have a number of cameras that are really good resolution and they are in color and hd, and shows some good footage. >> gomez was caught trying to

use a stolen credit card from a palo alto victim. after searching his home they found a cache of stolen items. >> 4:38. let's check back in with christina loren, a crispy start today. but it's going to get warmer? >> it's going to be toasty out there. good morning. temperatures are really comfortable right now. we're in the upper 50s. just about every where. the exception to that rule is novato at 48 degrees. this afternoon temperatures will climb into the 70s as of noon so make sure you're dressing for two parts of the day especially up in novato, a hot area getting close to 90 degrees later. we start that future cast clock at 9:00 and what you can see is still mostly cloudy conditions from oakland. the bay area will be nice and clear by 9:00 a.m. today. what that means is a very, very warm afternoon. we haven't had a lot of temperatures in the 90s. even mid-90s this summer so far.

you'll turn on that air conditioner even in san jose by 3:00, warmest time of the day is 4:00 p.m. and then that sun sets just after 8:15. so 84 degrees in san jose today, 86 in los gatos and best temperatures will be found around the water. great conditions there. take a 20-minute drive to get 15 degrees cooler. as we head to this afternoon, winds will pick up. we'll talk about that and the changes on the way, seven day outlook. first here's mike with your drive. >> we'll take you back to the south bay. i want to point out we're looking at sunniville, cupertino. 85 both directions have construction take you can at times down to one lane. we don't have any slowing at least not on our sensors. 50s and 60s at times as bright lights do have an issue through the early morning hours. over here to southbound to 101

in mountain view, past san antonio road stalled vehicle out blocking your left lane. use caution as you pass the san antonio off-ramp. further up the peninsula live look outside shows folks coming off the san mateo bridge with those headlines, smooth drive to and from events over 92. on the east bay, headlights towards down. a campus police officer involved in a now infamous pepper spraying incident at usc davis. lieutenant john pike left the department yesterday and this is of course video of pike and other campus police officers dousing occupy protesters with that spray. this was last fall. uc davis would not confirm whether he quit or let go. but pike and another wasser were placed on administrative leave. fwative report released in april called the use of pepper spray

hi, again, everybody. welcome back on a wednesday morning. give you a nice live look early over san jose, the south bay. christina loren says cool start, another smoker out there, it will be hot. 4:45. >> several parts of president obama's health care reform law take effect today including a controversial rule that requires employers to provide free birth control coverage for female employees. the rule has touched off a national outcry among religious and conservative groups who claim the government is violating employer's rights. >> it forces an impossible choice on them. either they got to violate their conscience or faced with extraordinary fines. >> several other rulings also kick in today. health plans must now provide free preventative care and

screenings everything from stds to diabetes to domestic violence. republicans are still trying to repeal the health care reform law. >> some good news for a lot of people. try over a half billion. the lights back on in india this morning. power was restored yesterday to more than 600 million people after the electrical grid collapsed for a second time over two face. this blackout brought 500 trains to a halt, trapping thousands of riders inside. traffic lights stopped working as did bank atms. the outages raising questions about the country's long term economic prospects. >> time for a check of the markets. for that and the rest of our news, we go to cnbc world headquarters. good morning, jackie. >> reporter: good morning, lawyera. the futures are higher on wall street as investors await the fed decision this afternoon. now the central bank is widely expected to signal it's ready to take action to boost the economy but probably not just yet.

the fed may extend its pledge to keep interest rates low until well in 2015. asian markets were mixed overnight, european markets higher. we'll get data on private-sector jobs, manufacturing and construction spending. wall street closed out july in the red but still posted gains for the month. the dow falling 64 points on tuesday to 13,008. nasdaq down six to 2939. and house and senate leaders have agreed on a deal to fund the federal government for the first six months of the new fiscal year starting on october 1st. the move helps avoid a budget battle before the presidential election. back over to you. thank you so much, jackie. >> time for another check on our weather and that brings in lower. what's happening. >> it's nice out there now. another hot day shaping inland with temperatures close to that century mark in many east bay cities.

i'm talking about the extreme east bay. san francisco, live picture of the golden gate bridge. not a lot of fog. what that's indicative is of moisture out there. we'll see coastal cloud cover. not a lot. 54 degrees and cooler start with mostly clear conditions in san francisco this morning. we're at 56 in sunnyvale. future cast clock for you at 9:00. mostly clear conditions. heading throughout the day high pressure really moves in, so for us this is our warm up. high pressure moving in for today and tomorrow so tomorrow we're actually going to peak but today running three to five degrees warmer than yesterday. a warm one especially in the east bay. make sure you grab that water bottle out the front door. 80 in los gatos. great beach water. we'll talk about the best beaches across the bay area.

you're losing a couple of lanes northbound. this is your traditional overnight construction where it's yellow right here speeds getting down to 50, 55 at the worst. you're losing two lanes with light volume of traffic. keeps you moving smoothly in both directions through oakland and further north eastbound 80, away from the bridge berkeley to richmond. more construction blocking a lane here past the merge and split off of the freeway and over towards the bridge taking to you the north bay. the headlines southbound coming out of novato no delays and after a week of adjustment that hov lane looks like it's operating just fine up there off of highway 37 and 101. good flow of traffic. no problems down to the golden gate bridge. back to you. remember when puff taed wda went to p. diddy.
