in a rut and popular bad maintained roadway heed to the death of a bay area man? that's what his family believes. his death may not be an isolated tragedy. the lack of road maintenance can cause accidents, even deadly ones. nbc bay area's been looking into it and joins now to see how they could prove deadly, as well, at least. >> every day, we drive on some of the poorest roads in the country here in the bay area. there is growing concern that if roadways to continue to be elected, your chances of being in a car crash will only increase. >> no one expected it to happen. >> it's hard to tell your kids that their father died. >> gone and 53 years old.

al lee slammed his back bike into a pothole. his wife nancy says a car then hit him head on. >> probably needed to be paved. that's why we have infrastructure. that's why we pay our taxes. >> harry creeper says he is seeing more and more accidents. during the last four decades, he served as an expert witness in a growing number of lawsuits against public agencies due to poor road conditions. >> the accidents that result are serious accidents, not just small and trivial incidence. >> david wraglen says as pavement ages, it becomes more of a hazard. >> there will be more crashes, more off-the-road-crashes.

>> crunching the numbers from the national highway traffic administration from 2001 to 2010, we found nearly 70 people were killed in car crashes in the bay area. a all were caused by reoad conditions. fatality rates could spike if roads are not fixed. >> we are only 40 pnt of the funds that are needed for us to maintain and rehabilitate our roadways. >> cal-trans admits it's had difficulty keeping up with repairs due to lack of funding. but says that has not impakted safety. crews go out on a daily basis and repair what they can repair daily. >> they should warn that the pat holes exist. >> but creeper argued the state

and then i kind of double checked and low and behold, there was a one next to my name. >> nathan, you really won. congratulations. the last american men, the last american male to win a gold in the 100 free back in 1988. so another gold for cal. that's where he grew up and now nathan adrian in some rare company. team usa gymnastics. it's amazing. they win the gold, they chat with president obama. and then soccer city of london, like rock stars. what's next for them? well, things are going to change, but their first stop when they return to the united states is in san jose, once again, take a look. >> lights, camera, action. >> pretty crazy right now. from here on out, their lives will change forever. >> i saw this medal and i was looking at it and i just can't believe it's around our neck right now. i love how it's purple and it's

a couple more weeks in london and then back home. and then september 8th, they're doing a tour which starts right back where it started in san jose at the hp pavilion. guys, i think it's going to be very loud, once again, for these young ladies. >> full circle for sure. that's going to be extraordinary. rveg . . moving onto news, several o initials report three passenger jets came within seconds of a mid-air collision. it happened near reagan international airport when confused air traffic controllers launched two out bound flights just as another plane was coming in for a landing. the three planes all operated by u.s. airways. the problem? appeared to be miscommunication. the faa is investigating. witness learning tonight that president obama gave the cia an order to help bring down the syrian president.

nbc news is affirming the president approved an order earlier this year. the white house says it is not giving the rebel's weapons. the state dpt has confirmed it has put aside $25 million for what it calls nonlethal assistance to rebels. the new report says six weeks before the massacre, the therapist was so alarmed, she notified the campus threat assessment team but no action was taken. he's accused of killing 12 people and injuring 58 others. the yuchuniversity is not commenting. >> ask and you shall receive, unless you're asking for stun guns.

tonight, a fourth san francisco police chief is, again, asking the permission to give city officers a less lethal option. live at city hall with some politics at play and there's some discussion on whether they really are nonlethal. >> the police chief believed a stun gun would have prevented an officer. but police commissioners and the victim's family, are not supportive of the idea. >> i remember that day, july 18. i dropped him off. he looked at me. he hugged me. and he told me he loved me. >> her brother was shot and killed by san francisco police july 18th. police say he attacked a coworker with box kutsers. police chief greg surge with officer crisis intervention training to try to diffuse the

situation. >> he turned on her and she had no choice. maybe if she had a tazer, we're finding out why he was the way he was. >> he is the fourth san francisco police chief to ask the police commission for the tool. >> the difference is i'm not asking for the entire police dp. i'm asking it for trained officers. there are 74 of them right now. >> opponents lined up at wednesday night's meeting, starting with commissioners. >> i've been extremely stressed out and upset that this is happening so quickly. >> and to express my deep disappointment to try to get tazers. stun guns are too expensive and a liability. members of the public expressed out rage.

and they are thrilled. but let's put pizza on hold for just a minute. they're thrilled about that bronze medal that their son has just earned here in london. synchronized diving, i'm new to this. it's so cool to watch. i'm sure a lot of people agree with me. they win the gold, chris along with his diving partner, synchronized diving. he grew up in the east bay, yes, a stanford alum and a medallist here in london. back to the family business, perhaps they name a pizza after him back home. >> do you think this will be a special pizza dead sined to celebrate this medal? >> that's a good question. i need to talk to my dad, he is back there, you can is him maybe, yeah. that would be amazing if there was an olympic sort of pizza. that would be awesome to bring in new customers. >> they will, in fact, they've said the lines have been ringing off the hook for the east bay.
