it's not over here. there are many questions this morning about exactly what happened. yesterday around 6:15, that fire broke out, sending belching black smoke five or six miles away into the sky and surrounding neighborhoods. richmond, north richmond, san pab pablo, even north oakland impacted as the sirens blaired. chevron said they were investigating a leak in their number 4 crude unit which processes diesel. they were looking into just before the fire. residents reported smelling burning plastic and irritation. >> definitely concerned. you don't know what's being -- what the toxics are until they you notice, tell you what it is. >> reporter: a chevron spokesperson says that diesel was leaking above its auto ignition temperature which basically means that it can ignite without even a spark. they put nitrogen on the unit to

stop the spread of the fire. one operator at the scene had minor injuries. we're told people have many, many questions so in response a community fire -- community forum is being held at the richmond auditorium. christie smith, "today in the bay." >> the big concern this morning is as you may have guessed, air quality and how it's affecting residents. dozens of people ending up in emergency rooms with symptoms, ranging from light headedness to shortness of breath. even children were wearing surgical masks to protect their lungs. most people didn't know about the smoke coming from the refinery. contra costa county had a shelter in place order to approximately 8,000 residents in richmond, north richmond and san pablo. >> there's about 40, maybe 50 people in there now waiting to be seen. they are handing out slips for emergency purposes.

>> all smoke can be toxic. it's very black so a lot of particulates, incomplete combustion from the fire. >> the bay area air quality district set up air monering stations. it will have results out in a couple days. >> this isn't the first time a fire erupted at the refinery. some previous fires led to fines and citations. a fire back in january 2007 burned for more than ten hours. it was a fire also at the number 4 crude unit, the site of last night's fire. the cause of that fire was a corroded pipe. another fire was back in march 1999, that blaze sent hundreds to the hospital with breathing and eye problems. osha fined chevron and state safety officials cited them for failing to properly inspect a valve. osha said chevron should have known there was a substantial safety hazard.

we'll bring you the latest throughout the morning. the shelter in place order has been lifted. air quality officials are still working to determine what if any health hazards remain in the area surrounding the refinery. at this point investigators say the fire may have been caused by a leak in a super heated diesel tank but it's not clear how the leak started. we'll have much more on our website. check out nbcbayarea.com, key word refinery. >> a baby girl believed to have been kidnapped by her father is safe this morning but her father is still on the run. investigators say 30-year-old jonathan martinez kidnapped his 1-year-old near tracy last night and threatened to harm the girl and himself. the abduction triggered an amber alert. police found martinez' car in a parking lot near the stone ridge mall. turned out martinez had dropped the baby off at a relative's house. several family members came out to pleasanton to try to help

investigators with the search. >> san jose's police chief could lose the support of his officers as they consider a vote of no confidence. police chief chris moore said he has no intention of resigning. some san jose police officers say they are frustrated with the way the chief is running the department. the police officers association board is expected to decide this morning whether to hold a vote of no confidence or to simply let the matter drop. other officers tell us that it's only a small fraction of officers who actually want moore out. >> on to the 2012 london olympic games. another big day ahead for south bay olympian kerri walsh. >> another bay area athlete has sports fans buzzing, the u.s. women's soccer team and alex morgan. raj mathai has a look at the play that saved team usa. >> reporter: hello from london. a huge day, the semifinals of beach volleyball. that means kerri walsh and misty

may-treanor, the semifinals against the chinese team if they advance, they go on to the gold medal match where they won back to back golds. last night the star for team usa. >> here comes the drop. it's in! alex morgan has done it. >> reporter: alex morgan, unbelievable. the cal alum near the end of the second overtime with the dramatic goal. team usa eliminates canada 4-3 and now the big showdown. team usa advances to the gold medal match against japan. last year, japan beat the americans in the world cup final, now maybe redemption as team usa gets a change for revenge. that gold medal match is on thursday. how about this. it's okay to have a little fun in london. you finish, you won your medals.

jose, 59 concord, at 50 degrees in santa rosa and novato to start temperatures are going to be on the mild side for the first part of the day, turning hot by about noon inland. talking about hot conditions, temperatures are going to be in the low 90s. tomorrow the upper 90s. hot for tuesday, then it soars as we head through thursday, friday, saturday, some of the hottest days we've had. we're talking about potential for records, so what happen when's we see this, we lose our better air quality that we've been dealing with with onshore flow. we also lose unfortunately some of the great pacific air conditioning. so you might have to turn on your ac. 69 degrees, 82 in redwood city. the forecast is coming up. stay tuned, it's going to be a hot one. first, check your drive. here's mike. >> first look at the freeways throughout the south bay. overall things are moving nicely. a couple of construction spots. we'll talk about those in upcoming reports. i want to focus on an incident

here, this is off of highway 9 near 35. heather heights at the top of the map, this is outside of saratoga in the hills, reports of a deadly accident. a car went down the hill and about 150 feet off the road. emergency crews on scene still there. we're trying to get details. looks like chp is not the one in charge. that's why i'm not getting the reports. we're tracking it. it does not affect your main commute. all freeways sound like they are uninterrupted by this accident. we'll follow the human factor as well. we'll look at 880, oakland, travel past the coliseum. light volume north through the construction zone. we'll look over north at -- sorry, further west, san mateo bridge where you're going west with the taillights. no problem after all of that. the the problem, me talking. back to you. >> not at all. don't get lost. we need you around. 4:40.

a proposal to raise the minimum wage in san jose takes a step forward. the council agreed to put it on the ballot. it will ask voters to decide if the minimum wage should be increased to10 an hour. tonight the council will vote on the exact wording of that measure on the sample ballot sent to voters including the rebuttal argument. the push to raise the minimum wage started as a sociology project at san jose state. the students joined to gather the 36,000 signatures to get that proposal on the ballot. >> all right. it's 4:41. up next, they could have been saved. a new report reveals costing the state for the yacht crash that killed sailors. >> watching youtube on your phone could soon get more complicated. the latest in the rivalry coming up. >> and it's the side of london olympic organizers do not want you to see.

nearly four months after five sailors were killed during a yacht race we now know what caused the deadly accident. the boat called low speed chase capsized during a race. seven of the eight on board were thrown into the water past the southeast fair lawn islands. only two survived and one person who managed to stay with the boat. a panel hired by u.s. sailing to investigate the crash has released findings. part of the record reads the primary cause of the cap size was due to the course sailed by the low speed chase. the panel also found there were additional safety issues that came to light during the investigation. improved personal safety gear including life jackets and harnesses may have increased the sailors' chances of survival. the report also noted that at least ten other crews saw or heard the low speed chase had capsized but none stopped to help them. >> silicon valley rivalry taking a twist that could affect the

apps on your smart phone. live at cnbc, we have more on apple's decision to cut its youtube iphone app. good morning. >> good morning. that's right. amle stepping up its rivalry with google. the company won't include a prepackaged youtube app in the new vegs of its software for the iphone and ipad that is out later this year. apple says you'll be able to access youtube through its safari web browser and google is writing a youtube app for sale in the itunes app store. a look at the market, futures are higher, closing a fresh three-month highs, a strong start to the week. good corporate earnings and less concern about europe's debt crisis helped boost investor sentiments. asian and european markets are higher today. this morning we get data out on consumer credit and disney reporting earnings after the closing bell. in terms of how the markets closed yesterday the dow rose 21

points to close at 13,117, and the nasdaq up 22 to 2989. the street is hoping for another rally on wall street. >> thank you very much. >> time to check the forecast. meteorologist christina loren, i know a little warmer already this morning. >> wait till tomorrow. yes. it's going to be hot. break out the tommy bahama gear, everything that you think of when it comes to a hot summer in the bay area. you'll need it not just for one or two days, we're talking maybe five to six days of temperatures near that century mark inland. we're talking about triple-digit heat on the way. a long stretch of hot weather. likely requiring you to turn the ac on and keep it on for at least three days. 59 in concord. depends on your threshold for the heat. wait till i show you the seven-day forecast. as we head throughout the day temperatures are going to be comfortable the first part of the day, but this is the coolest

day of the next seven. we're talking about low 90s even today. what's happening you normally associate showers and thunderstorms with areas of low pressure. not the case when it comes to this four corners ridge. you get this subtropical moisture pumped up from off the coast of baja, high pressure sucks it up, wraps around the ridge. you can see that clockwise rotation. for us we're going to see this ridge amplifying so much that we get some of those muggy conditions, that humidity possibly an isolated thunderstorm or two right here in the bay area. so for the next couple days, things are going to get interesting around here. definitely getting hot. especially by wednesday, thursday we'll peak at 100 in livermore. so today one of the cooler days. 91 in livermore today, 77 along the shore, 69 in san francisco and here in san jose we're going to get treated today with the low 80s. come wednesday, the 90s return even here in san jose. thursday, that heat is really on.

>> welcome back everyone. a live look at london this morning. this is inside the coliseum where they have the olympic caldron burning brightly. we'll have more live from london. it's 4:54. >> walgreens now facing new accusations of illegally dumping hazardous waste. alameda county joining a lawsuit claiming more than 600 stores sent hazardous material to landfills over a 6 1/2 year period. those include bleach, paint and other toxins, according to the suit walgreens did take shortcuts in order to cut costs.

richmond refinery waiting to hear from a spokesperson. they are walking up and expected to get started any minute. what i can tell you is that i spoke with richmond fire this morning. as far as they know the fire is out. i can show you what the scene looks like this morning. employees still coming and going as normal. i drove by the refinery this morning. we didn't see that huge plume of smoke or flames that blackened the skies into last night as emergency sirens blaired in the neighborhood. when this fire started at the refinery it was around 6:15 last night and we all know it sent huge plumes of black smoke about five to six miles in the sky prompting a shelter in place, warnings for neighboring communities. sm chevron reported everyone was accounted for. this began in something called their crude unit number four with a leak saying it was about the aut
