hazardous. more test results are due back today. there was smoke and many people sensed that in their noses and lungs. around 200 people showed up at doctors hospital, some wearing masks. several more visited the e.r. at kaiser in richmond. the complaints range from an overall sick feeling to trouble breathing and other respiratory problems. >> i have light-headedness. >> wearing the mask, having a hard time breathing. >> headaches and migraines and people's eyes are watering. >> reporter: there had been a shelter in place during the fire for san pablo, richmond and north richmond, basically asking people to seal themselves in their homes. but that was lifted around 11:30. reporting live, bob redell, "today in the bay." >> christie smith is also covering this.

this was a press conference. we're told that christie smith has new information. what can you tell us? >> reporter: good morning to you. we have new information for you. we heard from a chevron spokesperson of course what you want to know if you live around here the main fire, the one causing all of the issues yesterday, that is out. they tell us that this started in a processor called the crude unit number 4 and while chevron doesn't know what started this mess in the first place, i can tell you that chevron has their own investigators out on scene right now, but also cal osha is here and investigators from contra costa county after a long night for thousands of east bay residents ordered to shelter in place after fires broke out at the refinalry here. it blackened the sky for hours. the shelter in place i think as bob said lifted p 11:30. health officials the main concern the fumes. some residents complained of throat irritation. a spokesperson told us what

happened they were investigating a leak in the unit 4 and then the fire broke out right after. right now they say, though, there is a small controlled burn going on so no more hydrocarbons are released. at the height of this 80 firefighters were here. a spokesperson explained the challenges. >> all of these crews worked together, they worked the plan, they used the best available technology and did an excellent job in making sure that this incident didn't become anything worse than it was. >> reporter: earlier we were told that it was one worker who suffered a minor injury. we're told that three workers here at chevron suffered minor injuries. everyone is coming back to work this morning, unit 4 is still down this morning but i'm told that the other units are functioning here. of course, many questions, concerned residents have today. so what's happening is chevron is holding a community forum that's held at the richmond memorial auditorium at 6:00 this

evening. reporting live, christie smith, "today in the bay." >> thank you very much. east bay drivers who thought they were getting a free pass through tolls because of that fire, turns out that message was just too good to be true. last night cash lanes were closed because toll workers were ordered to shelter in place. signs on the toll booth said do not stop, toll free. this morning caltrans changed things up. in fact, the tolls were not free and drivers will be sent a bill in the mail. drivers will not be fined extra for not stopping. this morning b.a.r.t. is running normal hi and the three b.a.r.t. stations that were shut down last night have now been reopened. that includes the richmond station. >> moments after the fire erupted viewers captured amazing images of the flames and billowing smoke. you can go to see them on our home page at nbcbayarea.com. while there sign up for breaking news e-mail alerts and if you

less than 90 minutes. the issue is spear headed by officer howard johnson, he and several others tell nbc bay area there's mounting frustration with how the department is run so they want chief moore out. our colleague damian trujillo got an exclusive interview with the chief who says he gets it but he is committed to san jose. >> i'm not going anywhere. >> how do you fix this? >> it depends. we'll see what happens on tuesday. >> reporter: it's very important to note that chief moore has the backing of the city manager who incidentally is the only one who can actually fire him. she says she's not doing it. >> chief moore, i'm sorry that he is confronting this, i am disappointed but i have the utmost confidence that he is a professional and will continue to work with all of the stake holders even though they might be turning their backs on him

during this difficult time. >> reporter: to be absolutely clear, the union today is simply deciding whether to bring this issue of vote of no confidence to the entire force f. they decide against this, and chief moore is off the hook. marla tellez, "today in the bay." >> budget cuts now taking a serious toll on safety in the bay area communities. average response times for firefighters have increased by more than a half minute after last month's fire station closures in east contra costa county. according to the chief in some cases the delay has been up to five minutes. both dangerous and potentially deadly. stations were closed july 1. in june the average response time was 6 minutes 34 seconds. in july it increased to 7 minutes 10 seconds. >> 6:10.

>> welcome back everyone. 6:13. time for a quick check on the top stories. a three-alarm fire at the refinery in richmond is out but plant workers letting a small fire burn to bend the pressure. chevron says the air is now in fact safe and a shelter in place order has been lifted. >> the san jose police officers

association meets in about an hour to decide whether to take a vote of no confidence against police chief chris moore. some officers complained moore's leadership, about it, but the chief says he has no plans to resign. >> a newborn baby is safe after a woman tried to steal her from a hospital in southern california. police say the woman waited until the mother was in the bathroom, then put the baby girl in a bag and tried to carry her out. a sensor attached to the baby set off an alarm and officials were able to catch ramirez and return that baby safely to her mother. >> it is 6:14. investigators know the cause of a crash that killed five sailors. you may recall the boat capsized in mid april during a yacht race. seven of the eight people on board were thrown into the water. an independent panel released

findings. its report blamed the cap sizing on the course sailed. it says improved safety gear might have increased the sailors' chances of survival. >> the number of bay area cities have i banned plastic bags could increase. cooper teen backers hope the ban will reduce litter. the issue will be discussed during a city council meeting later on this afternoon. >> yes, it's day 11 of competition at the london olympic games. and the competition right now already under way. >> it's a big day in fact for kerri walsh and her partner misty may-treanor. they compete later today in the beach volleyball semifinals. let's go to raj mathai live in london with the duo hoping for

amazon says try to keep that to a minimum. then you send it back. it's a challenge for chegg doing the same thing for years. apple says phones and iphones and ipads will use the popular youtube app. it's not clear who pulled out of the deal first, only that the argument between youtube has expired. when iphone was first introduced there weren't that many things you could do with it. there wasn't an app store. didn't play flash videos but had a youtube app from the git-go. that app was critical to the early days of iphone. of course you'll still be able to watch charlie bite his brother's finger. in some ways this is good news for google because it means they can get advertising involved and

>> 6:25. students get in trouble for drugs and violence at school, the district is supposed to document and turn it over to the state. >> it's how california keeps tabs on dangerous schools. but no one is checking if that data is accurate.

>> the website seem likes a great resource to compare schools. but what if we told you some districts are giving wrong information. and no one knew about it until we investigated. >> this data is flawed. some of it is inaccurate. >> for some districts it may be. for many that report accurately it's very useful. >> useful and used frequently. the data can be seen in studies, on safety websites, cited by the media and lawmakers. information we found to be inaccurate. incomplete, and sometimes downright absurd. >> there is no way to get around the fact that we reported some numbers that were truly absurd. >> schools are required to report suspensions and expulsions along with all firearm-related incidents. the superintendent of the san lorenzo school district says he had no idea the data his district submitted was wrong. until we told him. >> did you review the records

before they were submitted to the state? >> no. we review the financial portion. >> do you think you should have looked at this? >> no. i don't think i have time to go through every 300-page document. >> the state uses the data to identify persistently dangerous schools. a requirement under the no child left behind act. in california, pds is based only on the number of expulsions for specific violent offenses. if a school expels a high enough number three years in a row, they are designated as persistently dangerous. >> the districts think nobody is going to review the data, then they take it upon themselves to have des kregs how to report crimes. >> after the olympics we'll show you major orting errors by bay area school districts and why an assembly member is pushing for better record keeping. >> 6:27. we're learning more about the leak that sparked a massive fire at the chevron refinery.

the chevron fire may have long lasting effects. bay area commuters could feel the impact of higher gas prices. bob redell is live in san pablo with how it will be felt at the pump. >> reporter: yes, the amount you spend to fill up a tank in your car could increase as a result of last night's fire by how much, though, will all depend on how long it takes for chevron to get its richmond refinery back up and running. remember, that fire burned for several hours yesterday. not clear what kind of damage it caused. what happens there, though, can have a tremendous impact on gas prices because it does provide so much fuel for the state. producing more than 240,000 barrels of crude a day. making it the biggest refinery in the bay area, third largest in the state of california. you cut out the supply, prices go up. another reasons prices could go up, there are strict rules that

require a particular blend ha is more environmentally friendly and because this blend is so specialized, there's not an abundant supply. any disruption can affect the price. bob redell, "today in the bay." >> we have new information about the refinery fire in richmond. a chevron spokeswoman held a news conference a short time ago. she started with apologizing to the community for the shelter in place and the entire incident. the main fire is out, it started as a processor -- actually in a processor called the crude unit number 4. chevron still doesn't know what started the fire in the first place but it does have its own investigators on scene to check it out. cal osha is there as well as investigators from contra costa county. >> safety officials are allowing a small controlled burn as a safety measure to help reduce pressure. this is helping to ensure that

family of marvin hamler saying the composer died at the age of 68. he wrote for the ground breaking broadway musical "the chorus line." no word on the cause of his death. police are searching for a father suspected of kidnapping his daughter e. they say he abducted the 1-year-old sunday  night. the 30-year-old had threatened to harm the girl and himself but she is safe. right now in her family's hands after police say martinez dropped her off at a relative's home in san lorenzo. the man's abandoned suv was later found near stoneridge mall. >> southern california lawmaker pushing for a national lgbt bill of rights. the assembly resolution 43 asking president obama and congress to include sexual orientation and gender identity in federal anti-discrimination

time. ocean avenue is blocked to traffic this morning, and the muni k line is affected. a crew on the way. we'll bring you the latest as soon as we can. >> also this morning a wisconsin police officer right now clinging to life after being shot nine times during a deadly attack at a sikh temple in milwaukee. lieutenant brian murphy, a 21 year veteran, he is expected to survive. officers say murphy was shot by this man, wade michael page, a 40-year-old army veteran who unloaded handgun at that sikh temple sunday, killing six and injuring three. page as killed a short time later in a shoot-out with police. investigators say page was a former leader of a white supremestist heavy metal band. they believe he acted alone in the shooting. >> a plea deal is in the works for an arizona man.

>> reporter: good morning. we heard from a chevron spokesperson this morning and what you need to know is the main fire is out. the huge plume of black smoke we don't see that this morning. they tell us this started in a processor called crude unit 4. they still don't know exactly how it started but they have investigators here from chevron, cal osha and contra costa county after a very long night for thousands who were ordered to shelter in place after the fires broke out. earlier a spokesperson for 7 ron said they were investigating a leak and the fire broke out after. if you drive by there is a small controlled burn going on. that is to ease pressure at the height of this. 80 firefighters were here. >> work together, they worked the plan, they used the best available technology and did an excellent job making sure this
