what caused this leak in the first place. residents, they still have aa lot of questions, particularly those affected by this huge cloud of black smoke that filled the neighborhood on monday. they showed up last night for a town hall meeting and frankly they didn't like what they heard at all. a large angry and vocal crowd packed into a town hall meeting last night as chevron apologized and tried to explain at least what they knew so far. they had the air quality district there and county health officials. emotions ran high especially from those forced to shelt ner place with one man saying how long can i hold my breath as the crowd cheered him on for saying that? monday a fire sent a huge cloud of black smoke into the sky for hours. hundreds of people showed up at hospitals complaining of eye irritations, headaches and breathing problems. the bay area air quality management district said so far it has collected six samples.

>> any chemical component that we think is going to pose a serious health concern. we're always concerned about the smoke, and we had a big plume of smoke. so it's probable that people were impacted by that smoke. >> reporter: now, some protestors came out worried about the potential effects to their vegetable gardens saying that basically they were useless and they had to throw them away now. chevron aannounced a claims program to try and help pay for anyone affected by this with their health expenses and any damage from the smoke and fire. a number of other people also came out, and they were complaining p about the early warning system saying they didn't get enough notification or any notification at all. reporting live in richmond, christie smith, today in the bay. the time is 5:03 right now. this morning the o.c. bracing for aftershocks after a late night jolt. a 4 t.4 struck last night in

northern orange county. we have a look at the seismograph when the quake first hit. later a aftershock hit that area. so far, no word of any damage or injuries. an investigation is under way this morning into a jet sea crack that kimmed a teen vacations in honolulu. the medical examiner's office says the 16-year-old died monday after her jetski was rear-ended by another rider. the second rider, a man in his 20s, is in serious condition. both riders were on an aloha jetski tour where that crash happened. san francisco's controversial cell phone safety law is right now heading for a courtroom showdown. if you recall, san francisco became the first city in the entire nation to require retailers to post radiation warnings about cell phones. that happened about two years ago. as a result the international wireless industry sued the city in federal court.

the city attorney's office will defend the law before the ninth circuit court of appeals foam. new this morning, the newest casino officially opens its doors. >> it starts dealing the cards after a five-year legal delay. this new location has created hundreds of jobs, and that they are still hiring and for a city casino matrix will contradict roughly $10 million annually in gaming revenue. >> as a taxpayer along with our competitor, we bring more revenue than anybody else. we bring high-paying jobs to people who he want don't have to have a degree to get to the jobs. we bring a lot of positive economic stimulus to the local economy for sure. >> reporter: anyone who has driven by 880 has seen this eight-story structure just sitting there. it was supposed to open in april, but they needed permission from the police. they delayed over concerns about monitoring and surveillance. they wanted to do so better paperwork on background checks. the owner sued and failed. finally about a week ago chief chris moore gave conditional aapproval for the gaming on the bottom floor. still waiting for permission to open up gaming on the top floor.

in afghanistan nato confirms a deadly attack on the troops. we're following the latest headlines from overseas and here at home. marla. >> we begin in afghanistan where nato is confirming a suicide attack killed three coalition troops, and the taliban is claiming responsibility. officials say this happened in the province of kunar to the far east. nato says the blast sparked by two suicide bombers on foot also killed at least one afghan civilian. now to syria where forces continue to pound rebels from the air. this is amateur video right here from a town in southwest syria right near the border of lebanon. president al assad military is using jets and helicopter gunships to strike against the rebels. nbc news cannot verify the video

authenticity because of restriction on the media. to the latest in wisconsin where alleged shooter wade michael page shot and killed six members of a sikh temple over the weekend. we just learned page's ex-girlfriend has been arrested on a weapons charge. officials say there's no immediate indication, though, the 31-year-old nursing student was linked to sunday's shooting in oak creek. in the meantime, hundreds gathered there last night for a candlelight vigil to remember the six victims. here in the bay area similar vigils are planned for to her. they're set to neat in san jose, fremont and hayward. >> thank you very much. we get the first stirrings a potential scandal in the silicon valley this morning. were bloggers paid to say nice things about two tech giants? scott mcgrew is here and has been watching this one very carefully. >> you recall oracle and google have been fighting it out in court. oracle said google used computer xoed it shouldn't have. the judge in that case issued an

unusual order. he wants to know if google or oracle have been paying bloggers to write nice things about them during that trial, and he wants names by next friday. oracle has already voluntarily said it's paying one blogger. it should go without saying journalists should not be taking money from the up company or people they are covering, but some bloggers and analysts do. in fact, there are whole businesses built around that. in principle you should know you know that up-front. take a look at this. this is a screen of the iphone. one is the iphone and the sorry the samsung. one of the charts the jurors in the pattern case under way in san jose federal court were shown. that's the iphone on the left, by the way, if you're playing at home. apple has been showing jurors these internal samsung documents. they line up cool things about iphone on one side and the things that lack about samsung about the other.

good for 18-year-old aly raisman coming back to the united states with a few medals in her hand. not so good for her teammate the flying squirrel, gabby douglas. it didn't quite happen. a rare occurrence the on the balance beam. she fell, and she was okay. she finished 7th. nonetheless inning to going to wane her spirit. >> i definitely didn't want to end this way, but you know what? if it wasn't my time to shine, it wasn't my time to shane. i'm so happy for aly up on the podium and she deserves this. it's my first olympics and i'm glad to go home with two olympic gold medals. >> reporter: absolutely. to gracious not only in victory but in defeat as well. if you crunch the numbers here, historically speaking if you win one or two gold medals and you're a usa gymnasts, its worth in terms of endorsements about $1 million to $2 million per year in endorsements.

we start out with uniform numbers. 50s about everywhere except in the north bay. it's nice and crisp up there. things change, hot conditions in wine country today. we'll see a 60-degree jump in your temperature between where they are now and where they are headed in some cases. it is going to be a really, really hot day today. this is the hottest region. hot and hazy by tomorrow. i would not be surprised. i will forecast we'll be snaring the air for foam and friday as well. when you have high pressure moving in, you get that sneaky air, that compression. that layer of haze sits right over your valleys. now, breezy conditions today help to mix up the atmosphere and keep that haze from settling in today. we lose that wind tomorrow. 89 degrees in san jose today, 90 in los gatos. i want to keep this map up for a moment and be prepared for the heat of the day. 98 degrees at 4:00 p.m. in concord, 99 in livermore and the

big winner in the south bay, gilroy at 100 degrees. we heat you up even more so all the way through friday. looks like saturday we get cooler conditions at the beach. sunday, monday, tuesday want 90s continue staying very, very hot. when does the heat end? unfortunately it doesn't look like until the end of next week until we finally significantly cool down to get the onshore flow. economic the fluids in your car. do you have any other hot weather driving advice? >> check the fluids in the car definitely, and make sure you have plenty of gas because sometimes when we get in traffic jams, folks run their air conditioner and idle there and there's problems with stalls and overheating as well. full tank of gas is advisable as well. we look at south bay. a smooth drive right now. no need to stall or idle. we have a nye flnice flow of traffic here.

welcome back. a live look from new york city this morning where there's reports of a fire on the 88th floor of 1 world trade center. it is under construction there this morning. the smoke was reported about 4:45 our time. we look at the live pictures. you can see so many fire personnel live on the scene there. we're told that there's no one inside the building, so that is good news. we don't know the cause just yet. 5:27, still ahead call this one a card room shuffle as the south bay takes on a gamble at a new casino. the smoke has cleared, but is the air really safe to breathe? the latest on the fallout from the fire in richmond.

5:30 right now. very happy you can join us. i'm jon kelley. >> i'm laura garcia-cannon. new details this morning. first tempers flaring at the latest incident at chevron's richmond refinery. christie smith on the anger that confronted the company at a town hall meeting. >> reporter: good morning. the cleanup continues today. the investigation with state and local and federal investigators expected out here again later today. chevron, they held a town hall meeting trying to address neighbors at least with what they know so far. those neighbors are the same one who watched a black cloud move over their homes on monday. they made it clear they were upset and they want the company to do much more to protect people who live closeby. the refinery manager was booed as he tried to apologize for the fire and the smoke that billowed from the refinery on monday after a crude oil processing unit leaked and then ignited. thousands of residents were forced to shelter in place.

hundreds showed up at hospitals complaining of things like eye irritation and breathing problems. >> are you serious? if they were serious they'd had somebody here who has the authority to say they're going to do it. >> it's like a bomb being dropped on us. this is not the first time. this is the fourth time. >> reporter: some protested outside of that meeting saying that their homegrown vegetables have to be tossed out due to safety concerns, and another issue is what was in that smoke that billowed overhead? we're told that it was 23 compounds. that's according to the pay area air quality management district. they also say it was toxins that includedest naul, freon and benzene. he they say it was below harmful levels. a number of people were upset because they were referred to the website for details. neighbors upset with the alert system saying it was spotty or

late or didn't happen at all. reporting life from richmond. this morning, friends, family and concerned volunteered continue the search for young sierra lamar. this manslaughter is accused of kidnapping and murdering the morgan hill teenager. she disappeared on her way to school back in march. police believe she was murdered, but so far her body has not been found. volunteers will be out searching for more clues starting at 8:00 this morning at burnett elementary school in morgan hill. 5:33. a woman kidnapped and held captive in the east bay for 18 years is now accusing federal attorneys of underhanded tactics in court. attorneys for jaycee dugard claim lawyers at the department of justice kept the former chair of the u.s. parole commission from appearing in court as dugard's expert witness. dugard is suing the federal government and claims the parole commission shares the blame for her kidnapping by philip ga rfi

rideau. he was out on parole when he kidnapped her. he was released early from prison after serving 11 years of a 50-year rain sentence. cal trans could be in the hot steet in sacramento. state leaders raising questions over reports of falsified safety tests on several spans. the sacramento bee is reports cal trans intentionally modified test data on the new span. caltran is blasting that article and says the bay bridge is safe. the hearing is held next week. san jose's newest card room hope it has the winning hand. bob riddell is live at this morning's official opening of the casino matrix. good morning, bob. >> reporter: good morning, laura. they feel that way considering they have customers already in here, and they haven't had their soft opening yet. yesterday they had a private gathering for family and friends here. the word got out, so people

started to show up. they said they had probably in the order of 1,000 people here. here you are wednesday morning. they still have people inside the soft opening at 8:00 this morc morning when they have a ribbon cutting. this new casino is adding hundreds of jobs to the area and planning on hiring more people. in terms of gaming revenue it will add around $10 million annually to the city of san jose economy. this was supposed to open sometime in april, but there was delay san jose police had concern over monitoring and surveillance. the owner sued and it didn't work out. they finally got permission from chris moore, the police chief, within the past week to open. good morning. i'm curious after these months of delays, obviously you wanted to be open in april. how is the relationship with the city? >> the relationship is really good. it's like a marriage. it's an ongoing relationship. there are great days and not so great days, but it all works

out. we rely on the police department. one of the best police forces in the nation. they help us as a business. we rely on them. it's a mutual coexistence. >> this has more of a vegas feel, you put a lot of money into it. $50 million. you see this eight-story tall structure. what vibe are you trying to produce? >> if you come down here, it's just a great, electric las vegas style vibe. it if you didn't drive up and just kind of drops were in the middle of the casino, you would think you're in las vegas. it's aamazing. the sports bar is fantastic. two 120-inch tvs and tons of tvs all over the place. great food and bars. it's just electric and get her quickly. we had 1,000 people yesterday, facebook, twitter, everyone was getting the word out. >> briefly garden city casino. you owned that casino, and there's only two cards in san

new this morning, an active scene in new york city right now. this is the construction site at 1 world trade center. marla has the story right now. good morning. >> good morning. authorities report a fire on the 88th floor of the new world trade center tower. now, this is at the site of the skyscraper skruktsed on the site of the twin towers that were destroyed in the september 11th attac attacks. you can see plenty of emergency crews on the scene this morning. now, the fire department says the fire was reported shortly before 5:00 a.m. local time. this is at 1 world trade right in the center of manhattan. authorities say there's no reports of injuries, but traffic in that area is certainly aeffectsed on wednesday mortgage in new york city. to ohio. the husband accused of shooting his sick wife in the intensive care unit is set to be aarraigned in court on an attempted murder charge this mortgage. it happened at a hospital in akron, ohio over the weekend. police say the 66-year-old man

stood by his wife's bed in the icu and fired one shot. the 65-year-old woman is now in critical condition, and authorities are investigating whether the shooting was an attempt at a mercy killing. the brother of an olympic medal winner could be heading back to prison if he has it his way. mark kerrigan, the brother of figure skater nancy kerrigan will ask the judge if he can finish serving his sentence behind bars after being released earlier this month. he was convicted in 2011 on assault and battery charges in the death of their father. authorities say he wants to finish out his sentence behind bars to avoid alcohol and mental health counseling. laura. >> thank you very much, marla. 5:43. now to the london 2012 olympics where bay area athletes showing really amazing skill in the water and on the beach. you're looking live at london where it's about 1:45 in the afternoon. >> a smorgasbord of sports, and

it's a big day for south bay native kerri walsh. she's going for her third gold medal at the olympics. let's go to raj mathai in london with a preview of the beach volleyball match-up and a look at the phenomenal win for the u.s. women's water polo team. it was ladies night, raj. >> reporter: it sure was. we're in london, but there's so much bay area flavor here. we're talking the east bay from danville, the steffen family is here in london with us. we chatted with the parents. they're so excited and a little nervous but rightfully so. two of their daughters are on team usa, and both of their daughters are the stars of team usa. we saw it last night in the water. we talk about maggie and jessica step fens. maggie scored four goals including the game winner in overtime against australia. jessica did just fine. she scored one goem. between the steffens sister they had five goals and rance to the gold medal match against spain.

it works out like this today. 80s and 90s and hot and hazy. hotter for tomorrow. triple-digit on the map. yesterday we hit the low 90s. in san jose we hit 79 degrees yesterday. livermore yesterday h89 degrees and farrellfield at 91. you consider the fact we jump by 5 to 10 degrees. we'll hold onto hot weather all weekend long. look at all those triple-digits sunday, monday, tuesday, temperatures creep down a touch. i have to tell you, if this ridge does not weaken, we can be in the mid to upper 90s all next week swg, likely sparing the air tomorrow. today moderate air quality or good air quality across the bay area. we take a better look at that coming up. >> join any. there we go. 101 to northbound getting slower and more congestion. the meters lights are on. show you how it plays out. the slowing shows up northbound just north of 680 where we have the camera sxhoes the slower

conservative news outlets like the "wall street journal" and fox news take issue with. the ad which is a collection of text and sound bites from politicians, taking the obama administration to task for changing the rules for the welfare program temporary assistance for needy families. a narrator says president obama plans to, quote, gut welfare reform by dropping work requirements. the program the ad is talking about sending federal money to states and states give that money to needy families. under the rules, under the welfare reform program, the states need to make sure half the welfare recipients are in a work program in order for the states to get the money. over the past ten years, though, several states have asked for little wiggle room on the rules so they could develop better work programs and still get that money. last july the obama administration said, fine, and allowed those waivers. one of the governors who supported that waiver who wanted
