team usa water polo advances to the gold medal match against spain on thursday. when you think b.a.r.t.about th olympians, it's world class but not everything goes according to plan. this is the german weightlifting champion and this is difficult to watch. 432-pound barbell comes crashing down on his neck. he was okay. the medical staff did rush to his aid and got him on his feet and he went to the hospital to make sure everything was fine. he's okay. you see the fine line here, the difference between succeeding and not succeeding. he'll be marching with the germans for the closing ceremony and enjoying the olympic experience. that's the latest from london. see you this morning. >> it makes my neck sorry to see that. >> kerri walsh going for the

gold tonight at 8:00 on nbc bay area. also tonight the track and field gold medal finals and the qualifying rounds of the women's platform diving. stay with nbc bay area both on air and online with all the action from the 2012 games. our man on the move will be back in a few minutes with another liver update from london. you can follow him on twitter. continuing coverage of the refinery fire in richmond this morning where it is already driving prices at the pump a few cents higher. these are live pictures from a 87 gas station on north first street in san jose. aaa predicts gas prices across the bay area will climb to $4.50 a gallon by labor day because of that fire. this morning residents near the refinery are outraged about everything from the fire itself to the way chevron handled it. christie smith is live in richmond with the details.

good morning. >> reporter: good morning. we're in the middle of a shift change so employees show up at the refinery this morning. we expect investigators to be back here, state, local and federal. stilt don't know what caused this it leak in the first place, but the apology that chevron offered to people nearby who live around here, that was met with boos last night at a town hall meeting. the crowd was angry demanding that chevron do more to protect its neighbors. the leak at the refinery on monday sent a huge plume of thick, black smoke into the sky. it could be seen for miles. for thousands of people with shelter in place, hundreds showed up in hospital complaining of eye and throat irritation and breathing problems. they wanted to know what turned up in early air testing, and the discussion that followed didn't calm people down. >> this is like a bomb being dropped on under the circumstances for the fourth time. >> how in the world can -- how long can i hold my breath?

>> reporter: now, some protestors u-urban farmers, showed up and said they had to throw out their vegetables because of safety concerns. the air quality management district says the toxins ethanol, freon and benzene were found but they believe they were below harmful levels. others in the crowd were upset over the community alert system about this saying the notifications were spotty. others said they were upset that the incident -- they were on chevron's side actually saying that if vef ron went aaway, they would lose jobs or money, so they didn't like what happened. they also wanted to hear the company out. chevron for its part is saying it's going to compensate people who incurred medical bills or any sort of property damage. reporting live in richmond, christie smith, "today in the bay." new this morning after years of battling in the courts, the south bay's newest card room is finally open for business. bob riddell is live at san jose's casino matrix where the

dealing has only just begun. bob, good morning. >> yeah. i had a schedule. good morning, john. if you haven't been to a card room before, this doesn't look like your typical card room in the bay area. casino matrix has a glitzy feel to it. it wasn't supposed to open untille this morning at 8:00, but the customers have beaten the casino to the punch. word got out about a private opening for families and friends taking place yesterday. customers started to pour in. the owners are like, they're here. let they stay. they have 49 tables and 15 card games. this replaces the old garden city casino owned by the same people. that's shut down. casino matrix has added a few hundred jobs on top of those from garden city, and it's estimatesed this new location will contribute roughly $10 million annually in gaming revenue for the city, which is

about 2 to 3 million more than the old location. >> the taxpayer along with our xet to her, we bring more revenue than anybody else. we bring high-paying jobs to people who don't necessarily have to have a degree to get those jobs. so we bring a lot of positive economic stimulus to the local economy for sure. >> reporter: anyone who has driven by 880 has seen this eight-story structure just sitting there for several mohs. it was supposed to open in april, but police delayed this opening. they had to give their permission first. they had concerns about monitoring and surveillance and wanted to see better paperwork on background checks. the owners of the casino did sue and that failed. finally in the last several days the police chief gave his approval for gaming on the bottom floor. they're waiting for permission to open up gaming on the fop floor. nare only allowed two card rooms

welcome back. time for a quick economic. authorities say a fire in the new world trade center tower is likely a false alarm. emergency vehicles filled the street this is morning after reports of a fire on the 88th floor of the skyscraper still under construction. the emergency call may have been related to welding. several hundred people packed the richmond auditorium last night to blast chevron officials about the refinery fire. chevron held the meeting to inform and to apologize to the public about that fire, which caused a huge plume of black smoke to cover most of the city. chevron has set up a claims process through crawford and company to pay for medical or property expenses that residents may have incurred. san jose's new casino is open for business. casino mate trix had a soft opeg

yesterday. a ribbon-cutting snoceremony wi be held this morning. to the lats he is in wisconsin where six members of a sikh temple were shot and killed. police have made another arrest. marla is following the latest held lines in our newsroom with the latest. >> authorities have arrested the ex-girlfriend theaged shooter. they say she was taken into custody on a weapons charge. officials say, though, there is no immediate indication that the woman is linked to sunday's shooting in oak creek. in the meantime, hundreds gathered there last night for a candlelight vigil to remember the six victims. a controversial execution is making headlines this morning. marvin wilson of texas was put to death in huntsville, texas by lethal injection tuesday night just hours after the supreme

court rejected arguments he was too mentally impaired to qualify for the death penalty. he was convicted of killing a 21-year-old police informant two decades ago. overnight hurricane ernesto making landfall over the yucatan peninsula with sustained winds of 85 miles per hour. you can see the palm trees there struggling to stand still. ernesto has been downgraded to a tropical storm, and it is expected to weaken even more as it moves west. now, although there are no early reports of damage, officials say more than 1300 tourists stayinged on the peninsula were forced from their resort just as a precaution. thank you very much. 6:16. now back to the london 2012 olympic games where american gymnasts aly raisman finally got her golden moment. a last look at the olympic caldron burning brightly there. >> let's go back live to london.

thank you very much. a scandal in silicon valley in morning. were bloggers paid to say nice things? scott mcgrew has more. >> you remember oracle and google are fighting it out in court about the android operating system. the judge in that case has issued an unusual order. he wants to know if google or oracle have been paying bloggers to write nice things about them during that trial, and he wants names by next friday. oracle has already voluntarily said it's paying one blogger. it should go without saying that journalists shouldn't take money from people they cover. some bloggers and analysts do, and there's a whole business built around that. in principle those bloggers and analysts should make sure you know about that up-front. starbucks have invested in san francisco's square.

$25 million, a really small amount of money, but howard schultz the head of starbucks sits on square's board. this is huge for square, because starbucks obviously one of the biggest retailers in the world. quite the endorsement. square's technology will let you walk into a starbucks, your first name and picture will show up on the cashier's cash register, and they'll know you are. they ring you up without anybody hanging over a money or credit card all done through the phone, through the square app. you don't have to take your phone out. once people get a taste of this, obviously, laura and jon, they come to expect it other places. so this starbucks part of it is a huge part of it. >> interesting. thank you. >> like norm at cheers. everybody knows your name. they hit their bull's eye on their bottom. zooishgs

moments. san mateo bridge from the peninsula side, things are picking up. those slowdowns are coming up. >> it's about 6:31. good morning. i'm jon kelley. >> and i'm laura garcia-cannon. a well-loved gymnastics coach who died enjoying the great outdoors will be remembered today. >> friends and family say 57-year-old russell wright was a pillar of his community on the peninsula. wright was swimming in yosemite's merced river last week when he drowned after getting trapped in the water. the gymnastics coach lived in san mateo and taught children of all ages in palo alto. we spoke to one of his colleagues to reflect on how much he meant to everyone around him. >> he just did a wonderful job with the young kids. he had such a gentle and calming approach, and the kids and parents just loved him. so he's going to be missed. >> today a memorial service will be held for wright the at that

lucy stern community school at palo alto on middlefield road. he's survived by a sister and two daughters. his family says beyond his career as a gymnastics coach he was also a musician and environmentalist. john. >> thank you very much. jaycee dugard is back in the news this morning. her attorney now accusing federal attorneys of witness tampering. they filed papers claiming department of justice lawyers tipped kept the former chair of the parole commission from being a witness. she sued the federal government. the suit claims they share blame for the kidnapping and 18 years of captivity fwil lip garrido. he was out on parole. dugard's suit alleges parole officers should have revoked his parole prior to that kidnapping. a hearing is scheduled for september.

6:32. new this morning. service cuts come to amtrak's popular capital corridor line. next monday 30 trains run instead of the usual 32 on weekdays. operators say it will save a million dollars a year. it will affect the first day of the day out of the square. the bus service will be available. one late night train leaving sacramento was also eliminated. it's being merged with another train and weekend service won't be affected. >> your water bills get bigger if a big bay area utility gets its way. san jose water doesn't want to show how the top executives are spending your money. the chief investigator has to see the traveling and entertainment expenses of the utili utility, and he was denied. >> san jose water wants rate pay erdz to reach into pockets. but whether it comes to spending money you're investigation

discovered it's aa public utility wants to keep some spending private and currently it's not against the law. we asked for the records. if there's nothing to hide, why not give them to us? >> because we don't have to. >> reporter: richard roth is the ceo of san jose water. the utility asking for a 44% increase in water rates over the next three years including a 21% increase next year. nbc bay area sent this request for records to san jose water. we asked the utility for all travel, entertainment and expense reports. detailed spending records no state haeg has asked to review. our records request was denied, and the ceo didn't want to explain why until we met him in downtown san jose. why is it a secret, mr. ross? >> it's not a secret. >> you're not providing it. we asked for the records. if there's nothing to hide, why not give them to us? >> because we don't have to, tony. it's our legal right. >> dp they want that rate

a north bay mother giving birth in her car on a busy street gets much needed help from firefighters. eight members came to her rescue on sir francis drake boulevard on monday. when they arrived mom was in the back seat and the baby's head was already showing. the captain said they arrived just in time.

>> 6 feet of sunshine is what they call her. what's she doing this afternoon before her big match? she's tweeting. a short while ago we captured in it from her twitter account. two of my three favorite men in the world, and that's her husband and one of her two sons. they will all be watching mom on the beechl volleyball court tonight against the other american duo. what happened last night, it was close. kerri walsh jennings and misty may-treanor against the chinese team, and they were trailing for much of the match but came back to win in their third consecutive gold medal match and it will happen at 9:00 p.m. london time tonight. not just one bay area star like kerri walsh, also maggie and jessica steffens, the steffens sisters from danville in water polo. team usa in the sem finifinals against australia. the most dramatic event came in extra time as the americans advance to the gold medal.

we actually have a very, very different scenario than we've seen so far this summer. we had a couple days of triple-digit heat. we're talking about six to ten days of near triple-digits inland. it's going to be hot, and this is the reason why. you can see right through the very thin marine layer this morning. it doesn't keep you cool in the heat of the day today in san francisco climbing to about 75 degrees. at 6:49, this is san jose. that sun is baking at 6:49, and temperatures have jumped up into the 60s now in some cities. 57 degrees to start out in san jose. we'll quickly transition to the 80s by about noon and round it out close to 90 degrees. warm conditions as high pressure amplifies and moving in. for us that means a hotter day today. we see the air quality suffer. we see kind of a hot breeze out of the north. elevated fire danger as we head throu throughout the next few days. take it easy if you camp in particular, do not leave that

campfire until it's completely out. tomorrow more triple-digits on the map. 99 in livermore and 100 driveways in gilroy. it's hotter and hotter friday into saturday. we talk about 101 degrees in livermore. that translates to 110 in places like fresno. even though it's hot, we could be in fresno, mike. over to you. >> cross it off my to do list this weekend and stay out of fresno. the peninsula where this got out of the roadway. the pt cruiser and embarcadero from the northbound side and the backup kicked in because of the traffic hitting the roads, that ripple effect and it lasts much of the morning through mountain view into palo alto. slow from capital expressway up to the airport where it merges with 101. by the cameras north of 680. we look at the camera and see how it sorts out. a quick end look at the bay bridge toll plaza and backup

near the bay. san jose's newest card room gambling can bring the feel of las vegas into the south bay. we're live at casino matrix where dealers are busy in the pits. good morning. >> there weren't supposed to be. the soft opening wasn't supposed to be until 8:00 this morning with ribbon cutting, but word got out yesterday tlchs a private gathering for families and friends. a lot of regular customers from garden city casino came over here. here you have it at the early hour. some people are already playing cards here. it was supposed to be open quite a few months ago in april, but they needed permission from the san jose police first. they delayed the permitting over concerns of monitoring and surveillance. they need better paperwork on background checks. the owner stewed and failed. police chief chris moore gave conditionalal proouchl for the gaming on the bottom floor and they open gaming on the top floor.

>> no hard feeling? >> no. once you come in here, you start to enjoy the vibe and see all the people having a good time out here. you tend to forget the past. >> now, the people who are running casino matrix did run garden city casino. you can only have two card rooms in the city. bay 101 is here and garden city is shut down. in its place in this $50 million eight-story complex. the casino tell us that this location adds a few hundred jobs more than the old location. in terms of revenue it will bring in about $10 million a year for the city. that's an estimated 2 to 3 million more for garden city. that ribbon cutting is an hour from now. this is the soft opening. they expect mayor xhuk reed to be here to help officiate. reporting life until san jose, bob riddell, today in the bay. a long of anger p boiling over after that fire and a chemical release at a richmond

refinery. facing its neighbors and getting an earful the aa town hall meeting last night. today in the bay's christie smith is live at the refinery with what chevron is trying to offer to appease the public. good morning. >> reporter: good morning. investigators are expected back out here later this morning trying to figure out what caused this leak and fire. chevron's refinery manager offered an apology, but that was met with loud boos from neighbors at a packed town hall meeting at richmond last night. managers tried to explain what they learned last month when a leak ignited sending a huge plume of black smoke in richmond and beyond. hundreds of them turning up at hospitaling complaining of breathing problems. now people demand to know what was in the air. they heard toxins including ethanol, freon and benzene but blow harmful levels. still the crowd very upset. >> if they were serious, they'd have somebody here that has got

the authority to say they're going to do it. >> we think it's a bomb being dropped on us. this is not the first time. this is the fourth time. >> reporter: chevron has set up a claims program saying they'll pay for my medical or property damage related to the fire and smoke. you can find that on their website. reporting live in richmond, christie smith, "today in the bay." new this morning, orange county bracing for some aftershocks following that earthquake that happened late last night. a magnitude 4.4 quake striking just after 11:20 last night centered two miles east offer belinda in northern orange county. an aftershock then hit the area. no word of damages or injuries. a teenager have been killed and a 20-year-old man seriously injured in a jetski crash in honolulu. she died monday after her jetski was rear-ended by a second

rider. both riders were on the aloha jetski tour when it happened. the controversial cell phone safety law is headed for a courtroom somehow joan. san francisco was the first city in the entire nation to require retailers to post radiation warnings about those cell phones. as a result, the international wireless industry is now suing the city in federal court. the city attorney's office will defend that law before the ninth circuit court of appeals tomorrow. the head of california's fish and game commission could be voted out of office six months after he shot and killed a cougar legally in idaho. a picture of dan richards with the big cat drew outrage and demands he be fired. mountain lions are protected in california but not in idaho. board members are expected to vote today to replace richards as president. if they remove him, he'll still remain a member of the commission. richards says he did nothing wrong, and he will not resign. happening right now,

firefighters have contained a very small fire at 1 world trade center in manhattan. that blaze was sparked by a welder's torch up on the 88th floor of the skyscraper being built on the site of the twin towers. there were earlier reports that this was a false alarm. now the fire department has clarified this saying it was, quote, equipment burning and not the building. >> 6:56. more signs the economy is recovering this morning. >> that's right. scott mcgrew. more pple are paying their mortgage on time. >> that's right, good news. the most is about three years. about 5.5% of americans are still 60s da 0 days or more beh payments but the number is on the way down partly because the economy is getting better in most cities and people found their mortgages more afford aven able. a record number of people refinanced because of lower rates, and the payments are easier to make. you're looking at this.

we have moderate air quality in the east and south bay. tomorrow i'm forecasting a faspe the air day. high pressure is compressing all that particulate matter. keep that in mind. we'll have your seven-day forecast every 15 minutes through the "today" show. a normal pattern as far as the backups go. you see the orange, and it goes into the 30s and 40s north of 101 up towards the san jose airport. 280 and 87 shoiing that bump of traffic flow as well. speeds coming down into the 50s. the big issue is northbound 101. it cleared out lanes, but that caused backup and mountainview is paying the price sbl and sunniville comes off 85 at the merge. that's where we see the unusual slowing. we look over to the peninsula along the kooes as well. half moon bay without much of a
