plane tickets, hotels, gifts. the specific spending records, no state agency has asked to review. >> the goal of dra is to provide the commission with recommendations that ensure safe and reliable utility service at the lowest possible rate. >> reporter: he is a project manager for the state's division of rate payer advocates. it protects consumers by reviewing costs for california's investor own water companies like san jose water. the d.r.a. has inspected thousands of financial records for san jose water but admits, it has not reviewed or asked to see detailed records like the ones requested by nbc bay area. they are records that remain off the radar and san jose water clearly wants to keep it that way. san jose water deny nbc bay area's records request, saying, quote, we are not obligated to provide the requested information and will not be doing so. >> don't the rate payers have a

right to know how they're spending their money? >> i think they do. >> reporter: but roger addictioninson knows under current state law, san jose water does not have to share the reports with rate payers. currently the water provider is allowed to keep all the specific records and all that detailed spending secret. >> they operate in an environment where they have no competition. and they are charging the public, the taxpayers, the rate payers, to cover the cost, they ought to yank those available. >> reporter: he has proposed a new law requiring public transparency, more public accountability for all public utilities. >> if they want that rate increase, they need to be prepare to justify it. they have to make records available that would help that judgment. >> reporter: rate payers have the right to know how you're spending the money. which brings us back to that critical question and the answers from the highest paid executive. >> why is it a secret? >> it is not a secret.

>> reporter: then you're not providing it. we've asked for the records. if there is nothing to hide, why not give them to us? >> because we don't have to. it is our legal right. >> reporter: so ultimately the ceo of san jose water wants his rate payers to accept a 44% increase over the next three years while keeping all specific travel, entertainment and bonus expenses a secret. >> you're getting into a $70,000 audi. that rate payer is paid for. shouldn't they get to find out what else they're buying? so provide us the records we've asked for. let us come to san jose water and get your expense reports. >> not going to happen. >> reporter: why not? >> because it's not relevant to the rate increase. we're a private company. we to. it is the law and you want to advocate the law. you want special privileges. >> reporter: you're a private company but a public utility, sir. here's more perspective for you. in the records it did review the state's rate payer watch dog

cheryl has that part of the story. >> reporter: the officials held a briefing today with the officials. they say cal osha is still on the scene them say that leaks are being kept to a minimum and they still don't know what caused the fire. because of what that on monday, some believe that chevron should go. others feel strongly that it should stay. >> when you're a business like they are, you can't win for losing. >> reporter: on monday many considered chevron's refinery the bad guy after a huge fire broke out and a black cloud covered most of the city. according to community activists and lifelong richmond resident, chevron is considered the good guy when it pours mound into the community. >> we have them giving money to the colleges. >> reporter: chevron is the largest employer and largest taxpayer in richmond. it provides job for 2700 people and 850 contract workers.

>> reporter: now chevron has set up a compensation hotline. that number is 1-866-260-7881. if you would like to see that number again, go to our website at nbcbayarea.com. reporting live, nbc bay area news. a false alarm at the shell refinery in martinez this morning at 7:00 a.m. contra costa county sent out a warning. a spokesperson said workers performed a low risk procedure at the refinery. there was a miscommunication with the county and somehow the alert was issued. a frightening armed robbery in sunnyvale followed by a diversion. tonight the police have called off the search for thieves with two getaway cars. police responded to men in ski masks and found a man bound and gagged inside. the robbers had smashed display cases and ransacked the goods. they darted for the parking

garage and created diversions. they lit a white four door nissan on fire before the thieves ran off in another niss. the founder announced she will be leaving her post as ceo. many have called for her resignation since jab when the komen foundation announced would it elittle night financing for breast cancer screenings at planned parenthood clinics. it spread wide back lash forcing komen to reverse its decision. komen said it is playinging the change to refocus on phrasing, strategy and growth. let's turn things over to jeff ranieri. he is focused on those 100s. >> we have a few of those in the seven-day forecast. like a laser beam. currently we have temperatures in the upper 60s and the low 70s. a mild night for a lot of you. that will give you a quick jump

start on tomorrow's forecast. let's take you to that coastline. san francisco, and you will see where falls creek, the city lights shining bright. the fact that golden gate bridge lights are vibl from this view a few miles back. there are still days left of the london games. we had the incredible performance by misty may-treanor and kerri walsh. there on the cusp, one of my followers calls it a heat wave but it will be some of the hottest weather they've had in the games coming up. we'll have that forecast. meanwhile at home in the four corners, it is all about the monsoonal moisture. this area of high, high pressure. if this was to sit on top of california, we would be talking about 110 to 115. thankfully that won't happen but it will nudge close enough that we do think as we head throughout thursday, friday and saturday, we will have the

hottest stretch of wave so far this summer. it won't be hot for everyone. we'll keep that fog. it won't be too widespread but maybe a little cloud cover. then 90s to 100s. i think by friday, that's when many of you will be dealing with the hottest weather in the forecast. we'll start with the warmer weather. 60 in concord, 60 in livermore. definitely some awesome relief. we'll top out thursday with the hottest temperature in morgan hill with 98. 100 in gilroy. 92 in sunnyvale. back for the east bay. 100 in livermore. get the water, get spf. it will be a scorcher. great for the kids if they're trying to squeeze out some of that summer vacation. 89 in san rafael and 97 in santa rosa. still plenty of events happening. dressage will be winding down with some awesome weather.

our olympic coverage begins now with the queens of the beach. now beach volleyball royalty after pulling off a gold medal three peat. >> they trounced their american competitors in the stand. raj mathai joins us from london. another great night for the golden girls. i loved that shuffling she did. >> reporter: it was nice, wasn't it? a good thursday morning to you from london. we're coming to you this morning from the tower of london. another iconic piece of history here in this fabulous olympic city. and yes, we have two amazing stories that really are emblematic of the olympic spirit. we'll start with the golden girls on the beach. we're about kerri balance should and misty may-treanor. it was like a who's who. russell brand and even joe montana from san francisco. really, it was the regular fans, the normal fans that provided the electricity. >> usa! usa! >> reporter: the all american

finalists. we heard a lot of this. beach volleyball. it is like going to a nightclub with sand. we'll say it, it wasn't even close. kerri walsh jennings and misty may-treanor beat their american counterparts from southern california in straight sets. perhaps the most touching scene was after the match. walsh holding her two young sons. a mother who has made such an impact on the bay area and now wins gold in london. >> balancing motherhood and this crazy career of yours. how did it feel holding your boys in your arms? >> that's what life is all about. family. and i just feel so blessed. i have the support system of my husband. he sacrificed my boys. sacrificed so much to accomplish this dream together and it was a family journey. my boys have allowed me to find my true self and the world is such a better place now.

it is up to me to make my world how i wantd want it. >> we've seen you grow up here from san jose to stanford. how much does it mean to you? >> i am so proud of my roots. my dream is to move back with my family. everyone at home, if you rooted for us, i know you did, i can't tell you how much it fortifies me and it gives me strength and courage. if i ever doubted, i would look at the tweets. i get the tweets from home. we got so much love and that helps you. i don't even have the words to thank everyone at home. >> we have followed her around the world and once again, a gold medal for the former, this marks the end of a great relationship. misty may-treanor is retiring. this was her final match. as for kerri walsh, she says no way. i am not retiring. she wants to be in rio for the next olympics in 2016. we mentioned two great stories. the other story is not about

winning any type of medal. instead it is about perseverance. a lot of people were in tears for this event. the 800 meter race in track and field. sarah attar, she finished dead last in her qualifying heat. dead last. and more than a half minute slower than the rest of the field. but it didn't matter shelf got a standing ovation from more than 80,000 fans. she was born in escondido in san diego. but is representing saudi arabia. she is the first ever female olympian in saudi history. her body covered, as you can see, she did not qualify but really is the symbol of the olympic spirit. >> such an honor to be here and an incredible experience running in this kind of environment. to have so many people supporting me is such a huge honor. i can't believe i'm here really. >> a standing ovation from that crowd. her father was born in saudi arabia.
