court. we'll be all over this and bring you updates as soon as we can. >> the operators of a california charity for veterans are facing a lawsuit. the state is suing claiming millions of dollars were diverted to pay for excessive salaries, a condo, golf memberships. good morning, marla. >> the group is help hospitalized veterans based in southern california specifically in riverside county. according to its website its primary mission is to provide hospitalized and homebound veterans with therapeutic arts and crafts activities. according to the california attorney general's office the group is also helping its president and its board by squandering millions so the ag office is suing. they reported more than $400 million in revenue since 2001 but a watchdog group says only 35% of the group's fund goes to

programs to help veterans. the industry standard is 65%. the complaint says the president likele lynch overpays himself spending thousands on perks, including $80,000 in golf membership. the former president robert chapin is also named for his inflated salary and retiring with a nearly $2 million pension plan. the state is calling for the current leadership to be ousted, it wants at least $4 million returned to the charity. >> thank you very much. it's 5:05. a teenage mom has been shot and killed on the streets of oakland. now that search is under way to try and find the person who pulled that trigger. 16-year-old tatiana turner was shot and killed wednesday night near talbot avenue and foothill boulevard. her family says she was out with friends when somebody started shooting at their group. turner leaves behind a

9-month-old daughter. >> a legal tug of war over millions meant for the new 49er stadium is settled this morning. the team and santa clara county agreed to share millions of dollars in redevelopment funds. the 49ers you may recall sued back in june after the county announced it would take the stadium money and use to the replenish battered school budgets. now santa clara will get a duty help balance its budget and the rest will go to the big new stadium. the 49ers kick off their preseason tonight, can you believe it? jon's excited. it's against the vikings. >> along with football it's a big weekend for music. nearly 200,000 people will flood golden gate park for outside lands. christie smith is live with a look at why not everybody's a fan of this event. good morning. >> reporter: good morning. we're a couple of hours from the start of outside lands, tens of thousands of music fans crowding

into golden gate park. in fact, there is so much fencing it was hard for tuesday get to this location. estimates are about 75% of the people who come are from outside of san francisco. while it's an absolute blast for the people who come here to attend, it's some of the neighbors are less than thrilled. i read one on line complaint from a man overrun by partiers and traffic. one man said that getting home in the city took him 2 1/2 hours the last time he attended. the trains and buses were absolutely packed. that said, the concert itself, well, there are going to be plenty of fans, over 100 artists, major headliners, food, wine, beer f. you are lucky enough to have scored a ticket because it's sold out, you can see stevie wonder and norah jones and today we read a couple of the names. fitz and the tantrums, beck, foo

palm springs, 115 to 120 degrees. so here in the bay area, as we all know, we get some of the best weather across the state. today it will be hot. especially in the extreme east bay with little formation of that marine layer. this is san jose. we'll get the hazy sunshine again as we head to the afternoon hours. we're at 66 degrees right now. this is the coolest point of the day. 64 in concord and 64 in livermore. by about 8:00, 9:00 this morning we'll see the 70-degree readings. it's going to be a very hot day. what i can tell you is it's a spare the air day. we have the worst air quality in the east bay and the south bay and that air quality will see the highest pollution level as more cars hit the highway, you get the compressional heating so that's what you want to keep in mind. right now best air quality tloud the day. that sizzle stays all weekend long. great beach weather though. take a look at your hour by hour

its new store at the mession inn san francisco. the company is hosting that job fair at the metreon city view room, 11:00 to 7:00 and 9 to 5 tomorrow. this is the great part. officials say they will interview and hire the candidates on the spot. it's expected to open in october. >> the u.s. justice department says it will not prosecute goldman sachs for tricks it tried on some of its own customers. scott, another example of a company avoiding serious charges. >> for all of what happened during the credit crisis there have been few prosecutions. the case at goldman sachs is startling. back in the bad old days of 2008, goldman sachs is accused of creating one of the worst mortgage-backed securities, a real dog with the intention of helping one of its biggest

clients bet against so it when the mortgages weren't paid their big client would get very rich. the problem of course is you need someone to take the bet on the other side, actually invest and goldman sachs was accused of convincing more of its clients t not so rich ones, to take the other side of that bet. a little like giving a race horse sleeping pills and getting against him at the track. you have to have suckers bet on the horse to win if you are going to make money. prosecuting goldman sachs was, quote, not viable. a separate senate investigation ended with senators concluding much the opposite. the hot start-up pinterist signed. south bay in the midst of an apartment building boom. bob redell live in san jose where the race is on to house

all of the new hires in silicon valley. good morning. >> reporter: good morning. look around and you'll see projects like this going up. when the epic apartment complex in north san jose is complete it will add close to 800 units to the area's supply of housing. according to analysis by the "mercury news" developers in the south bay are building new apartments at a record pace. in san jose, 7,000 new units are on the way, 4,000 of which will be completed by this year. that's a 20% increase in the supply of luxury amounts, more than 2,000 headed to milpitas, 1700 in mountain view which represents a 30% increase. there is a lot of demand for new units. one, more people are renting because of tighter lending standards that made it more difficult to buy a home. and two, the hiring. silicon valley hired 30,000

people. the east bay is expected to add more than 1,000 units over the next couple of years, not as robust as the south bay but that region hasn't seen as much job growth. >> thank you. 5:17. shares in yahoo! fell hard after the ceo there said the company may not give its shareholders the billions of dollars made when it sells its assets in china. this leads to wonder what the ceo might do with the money instead. perhaps buying a big company instead. it's going to be in a huge amount of money that's not going back to shareholders. >> interesting. thank you. >> it's 5:17. meteorologist christina loren joins us again. a lot to think about this weekend with the heat rolling in. >> right. keep on eye on your body heat if you work outdoors in the heat of the day. good morning. take you out starting with this live look over the bay bridge. yes, phenomenal conditions

continue in the city by the bay. it's actually going to get hot downtown with all of the pavement radiating the heat back out into the atmosphere so keep that in mind. a suit to work negotiation with the coolest suit you have. jon kelley has his on. starting with a live look in san jose, we have a few high thin clouds out there. getting a stronger on shore flow. with all of the micro climates it's going to cool the coast down. just as hot in the east bay with a warmer start yesterday. we had the low 60s, we have 66 right now in fairfield. 64 in concord. 64 in livermore. throughout the day today, i want to point out how impressive this ridge of high pressure is, controlling the weather pattern for the entire western half of the united states. if you're headed into los angeles it is going to be a scorcher in southern california. you want to keep that in mind especially traveling to the central valley along i-5, very,

very hot conditionses. make sure you have coolers in your vehicle and yeah, that ac is running. hotter conditions inland, tomorrow we're going to cool you off so just a touch. it comes to beach weather we're cooling you down. fantastic conditions. half moon bay about 72 degrees, right at room temperature. the warmest will be santa cruz with 83 degrees today. a little cooler tomorrow but you can imagine, lots of traffic over highway 17 with mike in a moment. 103 in livermore today, 104 in fairfield, a comfortable 86 degrees today in los gatos. you'll get marine influence. in san jose, 90 for us and 93 degrees in almaden valley. it's a spare the air day.

unhealthy air in the south and the east. better for the second half of the weekend as temperatures start to drop off and you get more fog, that tends to purify our air. 5:20. you got to get out the front door. >> sorry to say we're not helping the spare the air day. a lot of cars on the road. we're looking at 580 westbound out of the altamont pass. we have a nice flow. the yellow, speeds coming down to 60, 55 maybe at the worst patch. the flow is all right as far as the speeds. any incidents none for this portion of the try valley. here through oakland, 880 in both directions, the interchange there we're seeing more slowing. still lose a couple of lanes. over the next half hour the crews will start moving. we're going to look at the approach to the bay bridge and a smooth drive down the freeway. the construction behind the 580

complicated case. she wants the current leadership ousted. >> understandable. thank you. we'll keep our eyes on that. they investigated the bp oil spill in the gulf of mexico. now the same team is in richmond trying to get to the bottom of the chevron refinery fire. the chemical safety board will inspect the unit. they are working along side state and chevron inspectors to try to figure out if it's even safe to enter and when production can resume. because of the fire gas prices could climb well over $4 a gallon. chevron is opening up a help center trying to help out people who want to file claims. it opens at 9:00 this morning at the nevin community center. >> a police station a scene of a deadly shooting. an officer is on leave after killing a man outside the vacaville police department. investigators say the man pulled a knife on the officer in the

police department parking lot yesterday, and allegedly started making threats. the man refused to drop his weapon. a 20-year-old veteran of the force shot the man twice in the chest. police have not released the man's name. the police officer was not injured. >> happy to report a teen mom and her baby are waking up safe after a scary 24 hours. but the man accused of kidnapping hem is still out on the run. 19-year-old marcus hernandez attacked his girlfriend and then force heard and their 2-month-old baby into his car. the mother of the car, they were found safe at an oakland home but hernandez is still on the loose. officers describe hernandez as armed, dangerous and potentially unstable. if you see him call police and stay away. >> 5:33. dozens of riders from colleges are taking off on bikes to raise money for undocumented students.

they are trying to support the california dream act which could allow undocumented students to receive financial aid to attend public colleges. the 10-day, 540-mile ride stretches from uc-berkeley to ucla. a live look, the first leg of the ride leaves that campus, heads to san jose. >> whout question one of the hottest tickets in town this weekend, outside lands kicking off. already all three days are all sold out. christie smith is live at golden gate park with a look at what's shaping up t be a phenomenal lineup. >> reporter: good morning. they expect at least 65,000 people a day to come. about 75% of those coming from outside of san francisco, as you said an amazing lineup. but some of the people who live nearby they are not always feeling the joy of it. we have video of the setup from

last year. reading some of the complaints. buses blow past people. one man said it took him 2 1/2 hours to get home and he lives in san francisco. i checked the outside lands website. they have tips for neighbors. they have a complaint hot line and suggestions for getting around and say they have got two dedicated tow trucks for those blocking a driveway. they are serious about this. if you're lucky enough, one who did score a ticket, more than 100 artists, food and drink, big names. i was reading an insider's guide suggesting that biking is a good way to get here. for today's lineup they have foo fighters, neil young and crazy horse. if you need to file a complaint
