look at the golden gate bridge. how you feeling on this friday morning? should be feeling good. it's friday, august 17th, this is "today in the bay." >> good morning. it is 5:00. i'm marla tellez in for laura garcia-cannon. >> i'm jon kelley. good morning everybody. we're learning more about that breaking news we've been following out of san francisco. a deadly early morning house fire in the city excelsior district. christie smith just arrived on scene with something that firefighters found inside that home that made this fire so tough to put out. what's happening? >> reporter: good morning to you, jon. we have a real tragedy here in vienna street. two people dead in a home, firefighters have the street blocked off this morning. what they tell us, neighbors, that they believe two elderly people live inside the home, when they came out neighbors say it was already burning. this is the excelsior district

and firefighters say when they arrived there was heavy smoke and flames coming out of the front of the building. there is a huge window in front. they say that when they got there they ran into a big problem. i think that's what you were talking about, there was piles of debris all over the home. they say in some cases it was six feet high and that actually delayed firefighters from getting to at least one of the victims inside. both of them were found on the second floor. again, one victim still inside, the other taken out. they also say there was another problem and that is the building to the left that there was a hot power line down that had melted in front of the building, so firefighters had real tough challenges trying to rescue folks. i asked what that debris was, was it household items, look like someone was moving. they say it's dark inside. they are having a tough time seeing but calling it debris, firefighters telling us that they are going to be out here for several more hours

investigating as again, still they need to get that second victim from outside of the home so we'll stay on it for you and give you the latest as soon as we get that. but that is what we have so far. reporting live in san francisco, i'm christie smith, "today in the bay." >> search crews in yosemite will resume efforts to find a 6-year-old boy swept away in the merced river. the boy and his 10-year-old brother were hiking the popular trail with their family from southern california when they stopped to cool off in the merced river. the swift current carried them away. the body of the 10-year-old was found about 150 yards downstream. the 6-year-old has yet to be found. also in yosemite two hikers contracted the rare hantavirus at the curry village. one has died. a 37-year-old man died and a woman is seriously ill. both stayed in tent cabins in mid june. the virus is spread by rodents.

they are stepping up efforts and disinfecting cabins. since the virus was identified in 1993 there have been 60 cases in california. >> a long time teacher has been fired from a private high school in the north bay over allegations of inappropriate relationships with three students 30 years ago. the san rafael police department says it is investigating the claims but so far the teacher has not been arrested. the marin academy in san rafael has not released the teacher's name but the teacher work there had 35 years. the school says it's asked the teacher to cut off all contact with students and faculty. >> the fate of san francisco's embattled sheriff ross mirkarimi is in the hands of the board of supervisors. after 11 hours the city's ethics commission voted 4-1 to uphold one charge of official misconduct.

related to a new year's eve fight in which mirkarimi bruised his wife's arm. the commission determined that domestic violence conviction makes the suspended sheriff unfit for office and will now forward its recommendation to the board of supervisors. but mirkarimi's legal team says it is a flawed decision. >> they didn't meet their burden. under the city charter then since they didn't make their burden they can't remove him from office so that's the legal version of he just got screwed. >> mayor ed lee issued a statement thanking the ethics commission for carefully weighing the evidence. he is urging the board to do the same. the board is expected to make its decision in september. >> turns out california bike riders won't be banned from riding and using cell phones after all. the cell phone ban on bikers was tucked into a bill to increase fines for drivers caught texting or holding cell phones up to their ear. the bike ban was removed but the

fine hike has been approved by a assembly committee. if it's signed into law next week tickets would increase by $10 each. and when you factor in all of the fines and fees, first time offenders can expect to pay about $200 in fees and fines, up $40. if you are caught again expect to pay about $370 total. that's up $90. >> keeping with the bike theme making the city of sunnyvale more bicycle friendly, the goal of an anti-harassment law for cyclists. it gives extra legal protection for riders. bob joins us live from sunnyvale with the latest on this new law. good morning. >> reporter: good morning to you. it's already illegal in a criminal sense to harass a bicyclist if you are a driver, this new anti-harassment ordinance in sunnyvale makes it a civil offense as well. whether that harassment and assault, a threat, an attempt to distract the cyclist to cause them harm or run them off the road, like i said that's already

illegal in the criminal sense. but sometimes those crimes are hard to prove because the burden of proof is higher 18 criminal court. it's easier in a civil court. that's why this ordinance is significant in why the city put it in place. it gives the cyclist more power in civil court if they sue the driver and gives the court the authority to triple the amount of damage the bicyclist should win. this is part of their commitment to making the city more bike friendly. they expanded the biking network by more than 70 miles, added more safe routes for students trying to ride to school and added bridges so bicyclists can get over the freeway. this as far as we know is the second city, sunnyvale, the second city in the bay area to have a bicyclist anti-harassment ordinance, it was berkeley that issued a similar ordinance in february and prior to them los angeles. reporting live in sunnyvale, bob redell, "today in the bay." >> good news on the horizon.

it's very late in the week, that means it's friday, something to celebrate and the weather sounds like it's going to agree with us. >> when we're sleeping in tomorrow it's really going to agree with us. comfortable conditions similar to where we start out this morning in the mid-50s. 56 degrees in napa. 60 here in san jose. and about 56 in san francisco. a mix of sun and clouds. low clouds will likely burn off before we hit mid morning. so what's interesting is we have area of low pressure on the way. that's working against an area of low pressure. could bring in showers to the bay area as of this evening over the local mountains we get into the forecast coming up. what you need to be aware of is you've been too hot. we have a mild pattern and that's going to continue into next week. today, temperatures work like this. 77 degrees at noon inland, 72 bayside and a warm day for the second half of the day inland. we're not talking about the triple digits any longer. 67 degrees at the coast today. about 65 in san francisco so

grab that jacket. 5:07, first i want to check your drive. it's friday, any problems? >> not yet. the city, a couple of things, so far into san francisco a smooth drive but we want -- civic center there is phish concert so a lot of people hanging out to watch that pedestrian traffic as you head out or through the city for dinner perhaps. i want to show you this, a look at this orange blob, that's what christina was showing you. it affects highway 1, not affecting 101 but that may be an issue coming through santa rosa the next half hour to hour. we'll see if this changes. we'll get a live look, san rafael shows a clear view. no problems across the richmond/san rafael bridge to the east bay. an east bay shot for fremont, a smooth drive. these headlights are traveling south past the mall and pacific

commons. the flow is smooth. the wi-fi signal not so much. >> 5:09. new concerns about radioactive contamination on treasure island. an investigation published in the "san francisco chronicle" reveals the navy made several mistakes in its radiation cleanup on the former naval base. it was used as a repair yard for ships that may have been exposed to nuclear testing. studies reveal higher than acceptable levels of radiation on the island and areas previously thought to be clean. the island has been undergoing radiation cleanup for years ahead of plans to build a high rise community there. >> the time 5:09. it's been joked about, discontinued by some but never fear, the mini van bringing sexy back. just making a comeback. we'll let you know what drivers are doing to up the sales.

>> this is san rafael, traffic moving along highway 101 north and southbound fine so far. we'll get a look at the roads with mike in a moment. 5:12. >> big is back. growing number of new minivans hitting the streets. the sales of what some called the mom mobile jumped 17% in july and minivans offer better

fuel efficiency and lower sticker price than suvs. some owners say the minivan is more practical for larger families. >> technology now with the doors that open on the sides automatically, great for carpools, great for bags full of groceries, that kind of thing. you can put everybody in and they don't have to touch each other. >> why would they want to do that. despite the resurgence, chrysler, toyota, nissan and honda produce minivans. >> state leaders hoping to generate revenue by selling a blast from the past. to sell replica license plates, the measure would produce vintage looking plates from the 1950s through the 1980's. sacramento hope this is will entice motorists to buy plates to match their cars. $50 for each plate. >> shares in facebook have never seen such a low. they will start trading today at

less than half of the value they hit during may's big ipo. scott mcgrew all a result of that lockup thursday. >> the pressure doesn't go away. in fact, it gets worse. facebook shares fell to $19.87 as investors had their first opportunity to sell stock. there are four more dates on the calendar where this is going to happen again. the biggest in november when facebook employees finally get the freedom to exit if they so choose. disappointment over facebook really one black eye on the stock market. bill gross called it a ponzi scheme. we're going to hash out wall street's trust issues this sunday on press here after meet the press on nbc bay area. we should see the last testimony today in the apple/samsung patent fight. again the judge in the case urged the two sides to settle, warning neither may be happy with a jury decision. closing arguments are next week.

apple stock hitting an almost new high, for a broader look at the markets let's turn to hampton pierson in washington. good morning. >> hey, scott. we're looking for futures that are a little flat after a nice rally on thursday. markets were boosted by comments from the german chancellor who says germany will do what it takes to protect the euro currency supporting the head of the central bank a few weeks ago. european markets are a touch higher. data later on consumer sentiment t dow rising 85 points to close at 13,250, the dow is just 29 points shy of a 4 1/2 year high. the nasdaq closing up 31, to 2062. check your wand at the door. ebay is banning sales of magic related goods and services. you will no longer be able to

you should have seen him pulling out his wand during that break. temperatures are looking pretty good. 5:17 now. it's crisp out there, it's friday. i thank you for waking up with us each morning getting your day started with a live look at the low clouds over san jose this morning. let's get right to it. as you can see, visibility is dropping off. we have a mile in santa rosa, 10 miles about everywhere else. what's happening is our atmosphere is getting a little bit of a mix up as we head throughout the next couple days. we're going to see breezy conditions, the winds pick up. that keeps the fog from settling right to the surface. in addition to that it keeps that pollutant out of the area so it mixes up the atmosphere and keeps the pollutant from settling to the surface. we're in the good range all across the bay area. we'll hold onto that all weekend long. this is why we're excited in the weather department. we're following this thunderstorm forecast just about all week, and this is the general consensus.

late today we expect isolated showers over the western facing slopes, surrounding the south bay. i think we'll see coastal activity as well. so isolated thunderstorms are in the forecast for today. which makes it a little interesting for us. we're also expecting showers and drizzle each morning throughout the weekend with this strong onshore flow. so, things have changed from where we started out the week. 89 degrees in livermore. we hold on to the 80s all throughout the weekend. let's check your drive. >> it is 5:18. so we have the early signs of slowing. this is westbound. easier drive, speeds starting to eek down. notproblem here toward the castro valley "y." close to the speed limit. approaching 880 and along 880. we'll get awe look south of here on the maps, northbound 101 with an easy drive throughout, into san jose, no major problems. i want to call out this.

construction has a closure for northbound 101 onto northbound 880. but your alternate, pass that and take brokaw, over to 880, you should be fine, light traffic right now. drop by and see us. looking here along the peninsula, 101 past the shopping center at university, continued at the limit all the way through the city and across from the east bay, we're looking at the san mateo bridge. look at that westbound with the headlights off of the high rise, on the downward slope that's what you have on friday, coming into the weekend with a smooth drive. back to you. >> i love that shot of the san mateo bridge. thanks. the movie whitney houston was working on before she died is opening in theaters across the country today. >> you can have it. it's how you use it. >> what did you say? >> sparkle was the first acting role for houston in more than 15 years. it would be her last. in the movie houston plays a mother coming to terms with her own bad choices while encouraging her daughters'

you're on a film set. that controlled explosion shook brooklyn last night, part of a staged stunt for the tv series "boardwalk empire." the blast was music to the ears of city leaders, the mayor's office, the media and entertainment says the tv and film industry brought in more than $7 billion to the city's economy last year. and yes, that's billion with a "b." >> have you seen boardwalk empire? >> never. >> brilliant. highly recommend it. 5:23. let's see if the weather is something we want to be recommending and enjoying this weekend. >> it's going to be nice to walk the santa cruz boardwalk for example. temperatures are going to be just about perfect, just about everywhere even with the micro climates we're falling back in the 80s inland. today is going to be on the warm side but you'll see more cloud cover, more mid and high level clouds. maybe some showers. we'll talk about where you might

need your umbrella and we expect a little thunder. that's coming up. first, your drive. here's mike. >> we'll look over to the east bay and the maze as you see moving smoothly in your commute direction toward the bay bridge. your typical overnight construction, 880 coming up north of 23rd. and highway 24 behind the placard we have construction at fish ranch toward the caldecott. no problems for the tunnel. this does not affect 880 but getting out of the port of oakland, the seventh street on ramp is blocked. there is that deadly accident that happened overnight. again, that involves chp. suffice to say your morning commute will not be affected unless you go through the port of oakland. at the bay bridge, it's still smooth. you can see the east shore freeway in the middle of the screen but the low clouds are hovering and fog is an issue in parts of the north bay. we'll track it. back to you. >> thanks, mike. >> 5:24. yesterday we told you about a

bird that went on the run, felt guilty maybe and ended up turning itself in. >> he may have started a trend. police in upstate new york say a cockatiel surrendered to one of their officers. this bird landed on the brim of an officer's cap during firearms training at the police academy. police took the bird into custody. it is being held for safekeeping until the owner claims it. officers say they have received 25 calls from people claiming to be the bird's owner. he's a famous cockatiel. >> if i'm the cops i don't want the bird on my hat too long. >> better there than flying by. >> i guess so. still to come on "today in the bay," 5:25, we're following the development in a deadly house fire in san francisco. two people have been killed and the home gutted. we're there live with the latest. >> also we're learning more about the man accused of stabbing a woman to death with a samurai sword. why those who know him say it's

>> breaking news out of san francisco. two people have died in an overnight house fire. i spoke with firefighters and they say they had a real tough time even getting in. i'll explain why coming up in a live report. >> reporter: more protection for bicyclists against drivers in the south bay. i'll tell you about a new ordinance going into effect today in sunnyvale. >> and a couple more weekends before the kids head back to school. this weekend looks good. 80s inland, 70s bay side, 60s at the coast, thunder and rain on the way. we'll tell you where coming up.

>> a few of those kids in san jose saying we started. a start to this friday commute. i'll show you where the brakes are kicking in coming up. >> and a live look outside, that is downtown san jose, the lights sparkling on this early friday morning. august 17th, this is "today in the bay." >> almost 5:30. good morning. thanks for joining us. i'm jon kelley. >> i'm marla tellez in for laura garcia-cannon. we continue to follow breaking news out of san francisco, two people are dead after an early morning house fire in the city's excelsior district. christie smith is live with what else we have just learned. good morning. >> reporter: good morning. a real tragedy this morning, two people have died in a house fire, firefighters telling us that one of the victims is still inside right now. the real challenge for firefighters, though, the house

was absolutely packed, so full they say, they had a hard time getting to one of the victims inside on the second floor. neighbors tell us that two elderly men live in the home. here's what we know. firefighters got the alarm overnight and they found smoke and flames pouring from a second story front window. they also, though, had another challenge. they say that a live wire from the house next door was down making it difficult for them to approach the front door here on vienna street. they were able to get to one victim but firefighters say the garage and the interior of the home was full. >> there is debris, some areas, many areas of the building over six feet tall blocking means of ingress and egress. there was a delay in both getting to one of these victims and obviously it hinders the firefighters as well. >> reporter: they tell me they still don't know what even started this fire but it will take a long time to go through the home and overhaul it because

there is so much inside. back live, what i wanted to show you is what the garage looks like. i asked the firefighters what's in here, is it furniture, is it boxes, what is it? and the firefighters said it's debris, it's everything. he said it's hard to characterize because there is just so much inside. so again, they tell us that they will be here for several more hours investigating. reporting live in san francisco, christie smith, "today in the bay." >> 5:31. a memorial continues to grow on a sidewalk in front of a san jose walgreen's this morning. dozens of people left flowers, notes and stuffed animals for a homeless woman stabbed to death there monday night. police say 31-year-old marcus reynolds used a samurai sword to kill her. the president of the naacp jeff moore says he knows reynolds well and says he is a religious man and a role model for kids. that's why he's shocked reynolds is a suspect in this case. >> what drives a man to do anything like this, one never

knows what's inside their head but we have to understand there is -- we need places where they can reach out and feel safe and secure. >> monday night at 7:30 the community will hold a candlelight vigil for the homeless woman at the site. >> oakland police offering a $10,000 reward for information that leads to arrest in a deadly shooting that happened in the drive-through lane after kfc restaurant that happened last night on international boulevard and 73rd avenue. after being shot numerous times the victim was able to drive out of the drive-through and across a busy international boulevard before hitting a building there. that victim died at the scene. a female passenger was also shot. fortunately, she is expected to survive. san jose police at this hour looking for a gunman who opened fire on a teen boy. officers were called to the scene. investigators say the teen was shot once and say his injuries

are life threatening. the suspect took off before police arrived. so far the police have not found a motive. >> a bay area man wanted for a string of armed robberies on the peninsula is behind bars. miguel was wanted for several holdups in and around redwood city. tips from family members and this surveillance video captured during a robbery helped lead police to his home yesterday. but he refused to come out. it took a few hours but a negotiator finally convinced him to give up. the business owner who he robbed said he is glad his video helped police es make the arrest. >> they don't realize they are helping business people like my parents and others that have been robbed before, frightened and we don't say anything, just keep quiet, nothing's going to happen. they'll keep coming back. they do what they do elsewhere or get a real job. >> before s.w.a.t. teams handcuffed him a robot searched

the home for booby traps. >> president obama's open campaign office was occupied by more than staffers, this is video from a live stream posted by protesters, kind of dark, but if you look closely you'll notice some of the occupiers took over. they started that sit-in about 5:30 yesterday afternoon. eventually six people were arrested. protesters were there demanding justice for bradley manning, the army private accused of leaking thousands of documents to wikileaks. >> the rules of the road are changing in one city. cyclists in sunnyvale now have recourse against aggressive driver who is try to run them off the road. bob redell is live in sunnyvale with this story. bob, good morning. >> reporter: good morning to you, marla. yes, berkeley already enacted this bicyclist anti-harassment ordinance, that was in february. sunnyvale's enacting it today, making sunnyvale the second bay area city to do this. this ordinance gives protection

for bicyclists against menacing drivers making it a civil offense in addition to it already being a criminal offense. that harassment, whether it's an assault, a threat, an attempt to distract the cyclist to cause them harm, to run them off the road, that as i said is already illegal in the criminal sense. if you're 18 criminal court it's a burden of proof that's higher, higher to prove those crimes, that's why they enacted this, because it gives lesser burden of proof in a civil court. the ordinance gives cyclists more power in court if they decide to sue the driver and gives the judge the authority to triple the amount of damages awarded if the bicyclist should win. sunnyvale likes to point out this is part of making the city more bike friendly. the city expanded its network by more than 70 miles, added safe routes for students riding to school and added bridges so bicyclists can get over the freeway.

friday morning a. clear start. we'll look at the forecast with christina in a moment. it's 5:41. >> new this morning, nato says a new police recruit in afghanistan opened fire on his american allies today just minutes after they gave him a new weapon as a present. two u.s. troops were killed. there have been a string of recent attacks by afghan security forces on the international troops training them. >> more international news, a stand-off in london continues at the ecuadorian embassy where julian assange is holed up. ecuador granted his request for asylum. british officials will not allow him to leave the uk. assange is trying to avoid extradition to sweden to face charges for sex crimes. the international police agency issued a statement saying assange is still on the most wanted list regardless of ecuador's decision. >> the battle over medicare continues on the campaign trail with teams obama and romney trying to convince voters young

build up over our local mountains. and you'll likely notice increase in humidity as well. we've got an area of low pressure from the north that's working an area of high pressure that's going to bring in the monsoonal moisture. for us today temperatures are going to feel warmer than the true temperature with that added humidity. 89 in livermore, 81 degrees in almaden valley a. good day for the hike out in almaden. 87 by sunday. then we're going to heat up on monday, a little hot inland, down to the upper 80s on tuesday, then the low 80s for wednesday. 5:46. that drive is getting busy as promised. >> as promised or threatened i guess. we're looking at 580 off of the 205 merge. altamont pass in the area starting to show the gentle build. a little slower, later for the build but it forms for 580 through livermore. speeds are okay through most of the area.

but at the dublin interchange i saw a lot of slowing at hawthorne. moving in the 40s instead of the 20s. no accidents reported but i'll track that. 680 moves through sunol and 880 into the south bay. i want to point out 101 north to 880, the connector is closed. surface street traffic is okay. going to get busy. there is a 2:00 music fest at shoreline. starting about noon between rensdorf and 85 you'll get congestion around that shoreline off ramp. if you go to or from google or the vicinity that will be an issue for traffic as well. we'll move up to the north bay where christina was talking about the fog. i can see that as well but same reading she has. half moon bay down the coast. 101 moving smoothly at the limit. a live look at the bay bridge toll plaza. no major problems.

olympic gold medalist and water polo sensation maggie stef fins is back. she will show off her gold medal today. she helped lead team usa to their first olympic gold medal. she scored five goals in the gold medal match against spain and led all water polo players with 21 goals in london. she even tied the world record for most goals in a match. the 19-year-old will attend stanford in the fall. >> another local olympian just back from london made it into our studios. >> we were happy to have her. judo bronze medalist marti malloy telling us her achievement is starting to sink in. that medal nearly didn't happen. she had to compete just an hour after losing the gold medal round. those emotions were raging. >> i was fuming. i wanted to throw my water bottle and take my shoes off and
