monday, august 20th, this is "today in the bay." >> 6:00 on the nose. good monday morning everybody. always happy to have you along for the ride. i'm jon kelley. >> i'm marla tellez in for laura garcia-cannon. we begin with breaking news in saratoga. a water main break has partly collapsed a stretch of road, dispatchers telling us a sinkhole tore through pierce road close to pike road. that's about a mile north of the mountain winery if you're familiar with that. so far no word on injuries or damage to cars. we do have a crew on the way and will bring you updates as soon as we get them. >> we're following a developing story in the south bay, san jose dealing with a spike in violent crime including four killings in six days. bob joins us live with more on

what's being done to try and stop the violence. good morning. >> reporter: good morning. yes, four homicides with over the -- within the past week or so, and police right now, they don't see this being an upward trend. they are, rather, characterizing it as an anomaly, a bad coincidence if you will. this shows the location of where those people were murdered. most happening this past monday. two men were shot in separate instances then, and a woman in a third instance stabbed by a sword. a vigil planned for her tonight. another man was shot near south winchester. no arrests yet. police are investigating whether some of these are gang related. mayor chuck reed says this violence shows that the city need more officers on the streets, how to pay for that, though, is a point of

contention. the mayor argued pension reform would help. it's not exactly popular with the police rank and file. reporting live, bob redell, "today in the bay." >> new this morning the man in the east bay now dead after being hit by an ambulance at 65 miles an hour. the man stopped his car on the shoulder of highway 4 east of eighth street in antioch about 11:30 last night. he left the car running and then walked out into traffic where he was hit by an ambulance. officers shut down the left lane during the investigation. the chp says it's not sure why the man wondered onto the road. >> an 81-year-old man facing charges for road rage. police say 81-year-old harry e. smith of oakmont chased down a cyclist on the golf course before hitting him with his car. smith was driving with a license suspended because of previous

road rage that happened on 101. the cyclist's wrist was broken. smith was arrested over the weekend. >> a bizarre twist in the scandal involving melky cabrera. we're learning he may have tried to fool major league baseball with a creative cover-up that backfired. christie smith is in san francisco with details of this alleged scheme. good morning. >> reporter: good morning to you. another strange turn and it is not looking good for the milk man. according to a new report an associate of melky cabrera's bought a website in an attempt create a defense against alleged steroid use. the associate bought the website to try to fool major league baseball to show that cabrera ordered supplements that were spiked with testosterone.

the report suggests that it all backfired as investigators looked into the positive test. comcast insider says that cabrera's days with the giants are over. >> obviously he didn't tell me the truth a few weeks ago when i asked him. he didn't tell -- it underscores why you'll probably never see melky in a giants uniform again. >> reporter: giants management has not commented on this report but has sparked a federal investigation. cabrera's agents say they had no knowledge or dealings with any one associated with this website. christie smith, "today in the bay." >> bay area firefighters loading up and heading out to the front line of two massive fires up north. calling this the ponderosa fire, threatening more than 3500 homes

and forcing thousands to evacuate. about 1,000 firefighters including crews from san jose, san francisco and san mateo county, are battling this fire which destroyed more than 12,000 acres. mandatory evacuation orders as firefighters battle a wild fire that burned nearly 45,000 acres since july 29. firefighters are working on burnout operations. >> let's see what forecast they are up against with meteorologist christina loren. >> different from what we expect here in the bay area. they are going to get a little delta breeze, however, they are not going to get as much marine influence that they need to get a handle on the fire. for us in the bay area, woo we're getting the moist air. this is a beautiful sun vise this morning coming in from san rafael. let's show you the difference,

pension and retiree program. leaders will not make any concessions. >> hey, before you pack up those bunches you want to check out the romaine lettuce. a recall warning. the supplier is voluntarily recalling romaine labeled field fresh single head romaine. there have been no reports of illnesses but the supplier is concerned that lettuce could be contaminat contaminated. including pennsylvania, puerto rico and canada. >> soaring temperatures are prompting state lawmakers to consider new laws to protect farm workers from the heat. a bill would require water to be available at all times within 10 feet of all employees, also shade within 200 feet. the bill would let people sue if

they break the rules. another would make at crime if employers don't provide adequate shade. two death this is summer are being investigated. >> governor brown is calling a special legislative session to get ready for the national health care overhaul. it comes as state lawmakers wait for guidelines from the federal government as california prepares to implement the land fork act by 2014. the act recalls for expansion of the medical program, the state is also working to set up a public health insurance exchange. >> coming up, paying more for shorter tripes. why an airline is hiking fares. >> campaign controversy. a swing state in jeopardy for the g.o.p. after a candidate

in those circumstances should be legal. >> it seems to be first of all from what i understand from doctors that's really rare. if it's a legitimate rape, the female body has ways to try to shut that whole thing down. >> according to a 1996 study in the journal they found that among adult women an estimated 32,000 pregnancies result from rape each year. akin later said he misspoke in a statement saying the remarks did not reflect his empathy for the thousands of women raped and abused. the romney ryan campaign response was quick to distance itself from akin. quote, governor romney and congressman ryan disagree with mr. akin's statement and a romney-ryan administration would not oppose abortion in instances of rape. akin a tea party candidate won his primary two weeks ago and many considered him a favorite to unseat democratic senator

claire mccaskill. it would be a win for republicans who are trying to take control of the senate. the race now in question more than ever. >> thanks so much. new this morning political scandal out of china. the country's highest profile murder trial in years ended today. the wife of a chinese politician was given a suspended death sentence after confessing to killing a british businessman. she says she got him drunk and then poisoned him. media reports say they had a dispute over money and the man allegedly threatened her son. a suspended sentence is usually commuted to life in prison after two years. >> also new this morning the country of myanmar says it's doing away with its harsh censorship of media. journalists will no long ver to submit their work to state sensors before publication. reporters in the asian nation have long been considered the most restrictive in the world. >> in scotland prince phillip

left the hospital after successful treatment of a bladder infection. the husband of queen elizabeth ii was hospitalized. he is on his way to where the royal family is on vacation. >> if you are just waking up we're happy to have you. good morning. here is a check on the top local stories. san jose leaders say they are troubled by a wave of crime in the south bay. in six days four people killed and a number of others injured. >> a man in the east bay dead after being hit by an ambulance at 65 miles an hour. the chp says the man was hit on highway 4 east of eighth street in antioch at about 11:30 last night. the chp says it's not sure why the man wandered out on the road. >> the new york daily news reporting that a friend of melky cabrera tried to create a fake website to cover up his alleged steroid use.

it was trying to trick into believing that he had a test spiked with tess as the ter reason. the agent said he had no knowledge or dealing with the web zblixt stories we're following, an airline loved for low fares is about to ding travelers. southwest airlines is raising fares on flights less than 500 miles by $10 per round trip. that is about one third of their routes. united and delta matched their hikes. flight attendants at american airline approved an offer. the majority of flight attendants have now voted to accept the contract. by voting for the proposal, flight attendants avoid deeper cuts in bankruptcy court. the court needs to sign off on the new contract. the pilots union is still in dispute with that airline. >> a step closer to becoming a low income housing complex.

marin county officials deciding 240 affordable housing units could be built at grady ranch. the tract is owned by george lucas and in april lucas pulled the plug on a proposed compound over complaints by neighbors about the environmental impact. >> the jury in the apple/samsung case could reach a verdict this week. >> they will have plenty to play with. >> right. good morning. lawyers say they will provide jurors with dozens of cell phones to play with and examine as they come up with a decision, did samsung copy apple's iphone and ipad? final arguments should come tuesday in san jose. the jury should get the case by wednesday. apple wants $2.5 billion in damages. the judge in the case has hinted apple will not get it. >> also this week we'll see inside the financial world of

long suffering hewlett-packard on wednesday, other companies have reported slower pc sales. in fact, sad to say the most interesting thing out of hewlett-packard, explaining how layoffs are going. hp is cutting 8% of its work force. and video from stanford, engineers unleashing the latest robotic car. over the weekend students took measurements from real race car drivers in cars so they could get a better idea where they are. the robot audi can hit the track at 120 miles per hour. amazing. >> i need a robot. >> i would love to go 120 miles an hour. >> 6:18. if you're a college student cramming a new study might make you say why bother.

we'll check ahead throughout the morning and bring you updates but no surprise. returning to the coast we can count on the flight delays. we'll see mostly cloudy conditions in san jose. you can see not as thick, not as low to the surface, so this morning you're going to get clearing in the east bay areas as well as your san jose valley area, the whole silicon valley i should say. 58 in sunnyvale, 53 in san francisco and 57 degrees in san jose. it works like this. high pressure is still in control for the most part. we're going to see this area of low pressure sit and spin, ushering in a strong on shore flow throughout each day this week. starting tomorrow and hence our temperatures will be cooler and cooler. 3 to 5 degrees cooler by tuesday. santa cruz is the place to be if you're looking for the sun. 2:00, 70 degrees. saw ears perk up in the studio

one lane of pierce road is closed. we have a crew on the scene. we'll bring you updates as soon as we get them. >> we're following a developing story in the south bay as it's often ranked one of the safest big cities but san jose is dealing with a spike in violent crime. bob redell joins us with the latest. good morning. >> reporter: good morning to you. in the past several hours another man was shot here in san jose, officers found him with at least one gunshot wound around 9:00 last night. the last report from police his injuries are possibly life threatening. if you look at what's happened since monday, there has been a lot of violence. this map shows the locations of where four people were murdered over the past week. a man was shot in his car. later that day a man killed a woman using a samurai sword.

a vigil planned for her tonight. a 21-year-old man was shot that day, he ended up dying on wednesday. then yesterday morning when another man was shot and killed, that taking place near south winchester. that is four homicides, does not include other crimes in which people were seriously hurt. >> the gangs are getting ridiculous. >> i don't want to be walking the wrong colors so i threw away my blue and red colors. i don't want to take no risk. >> reporter: police are looking into whether some of those are gang related. they do not see this recent violence as part of a broader or upward trend. mayor chuck reed says and the chief would agree that the city needs more officers on the street the mayor argued that pension reform would help pay for that, not being very popular with a lot of police

department's rank and file. >> 6:33 now. a preliminary hearing being held in the case of a san francisco man accused of impersonating a plastic surgeon. carlos guzman operated a dermatology clinic without a medical license. he was arrested after a woman accused him of smoking a cigar and making her hold her own i.v. bag during a liposuction procedure. since then eight others, patients, have come forward including two women claiming they were assaulted. if committed he faces more than 30 years behind gars. >> new details are unfolding in the steroid scandal around melky cabrera. christie smith is believe the unusual steps he is accused of taking to cover up his alleged drug use. good morning.

>> reporter: good morning. this drug test story gets more and more strange. now comes a new report that an negotiate of cabrera's bought a fake website as part of a scheme to cool major league baseball. and explain steroid abuse. the plan to get him out of his suspension from the giants, that according to the new york daily news, which suggests the trick was to try and suggest that cabrera ordered a supplement from the website that was inadvertently spiked with te testostero testosterone. but that blew up in the investigation. comcast forts said cabrera and the giants are done. >> it shows the develop of deception that melky cabrera has gotten into. >> reporter: the daily news

>> bad news out of hollywood. a famous direct ser dead after jumping from an l.a. county bridge. 68-year-old tony scott directed several block busters. investigators say he jumped from a bridge at the port of los angeles. a dive team there pulled his body from the water several hours later. a suicide note was found in his office. no word what was written in that note. scott believed to leave a wife and twin sons. >> a man convicted of killing john lennon is up for parole. the new york department of corrections says mark day individual chatman could have a parole hearing tomorrow. the board could make a decision thursday or friday. he shot lenon in december 1980

together. the dynamic duo out in new hampshire. >> president obama returning to a doubleheader, in ohio before heading to nevada on wednesday. >> the white house is hosting an unusual state dinner of sorts this afternoon. first lady michelle obama has invited 54 children for the first ever kids dinner. they were selected after entering a contest for creating healthy lunches as part of the first lady's let's move campaign. they will have a tour of the white house kitchen gardens. >> mrs. obama did so many things for that campaign. cool for a kid to be out on the white house lawn eating, lunching with the first lady. >> kids eat free there. i love kids eat free rules. temperatures are good enough to get the kids out for the first part of the day if they are still home with you for summer it's going to be a little too hot later on.

police do not see this being representative of an overall trend in violence, rather, anomaly according to chief moore. this shows the locations of where the people were murdered. last monday a week ago two men were shot in separate crimes. in a third a woman was stabbed to death outside a walgreen's. a vigil is planned for her tonight. yesterday morning this was sunday morning, another man was shot to deathç near south winchester. no arrests in that case. police are investigating whether some of these murders are gang related. mayor chuck reed says the violence shows the city needs more officers on the street. how to pay for that is a point of contention. pension reform would help. pension reform is not exactly popular with all of the police rank and file. reporting live, bob redell, "today in the bay." >> thank you. update to breaking news also in the south bay.
