morning and they are well read and they have strong opinions. they are a's fans as well and disappointed now that their starting pitcher is out. but also they are saying they are not totally surprised even with all of the drug testing they say there are still those athletes who want to have any advantage regardless of the risks. that said, we also asked them if the 50-game suspensionç for bartolo colon wos too much and they said no. the suspension comes one week after giants outfielder melky cabrera had the same positive test. 39-year-old became a contender in the american league west, fans say the tougher drug testing is certainly having an impact. >> we're still going through the whole steroid thing, and hopefully we'll make it through it. they said they are going to have better testing so i think this is kind of the beginning of many

could be in trouble for writing a book about the top secret mission. the book "no easy day" set for release on september 11th. there are legal and intelligence concerns. special ops forces like navy seals often sign nondisclosure agreements and barred from releasing classified information. the publisher says the work was vetted by an attorney with military experience. however, two years ago the pentagon paid thousands of dollars to destroy copies of a book by a former army intelligence officer claiming it exposed military secrets. >> first lady michelle obama is on her way to milwaukee to visit members of victims in that sikh temple shoot iing. a total of six people were killed. four were hurt. investigators say the shooter who had ties to hate groups later took his own life. >> texas is stepping up its

assault on mosquitoes infected with west nile virus. planes will blanket houston in the hopes of killing the mosquitoes. the plan is to spray for five hours and treat more than 60,000 acres. animal control confirms that west nile virus in more than 300 mosquito sampled and in nearly 100 dead birds. 13 human cases have been reported in houston, three of them deadly. >> bay area vector control is taking action as well today, spraying gets under way in the peninsula in a few hours from now. marla tellez is live at palo alto, she has all of the latest details. good morning. >> reporter: jon, good morning. that battle against the growing mosquito population happens here at the bay lands in a couple of hours the helicopter according to the santa clara vector control district, choppers will take to the skies above the bay lands to spray up to 400 acres, targeting the summer salt marsh

mosquito. experts say this mosquito is not known to carry the west nile virus but they do have a brutal bite and have become a problem for the area. it's similar in contra costa couldn't. an outbreak of west nile is prompting officials there. it will treat the area that's bordered on the north by willkins way. the east by sellers avenue, the south by armstrong road, and the west by walnut boulevard. this treatment in brentwood gets under way at 7:00 tonight. here some latest news for the centers for disease control t number of cases of west nile virus reported this year is the highest on record since west nile was first edetectived in the u.s. in 1999. as of this week almost 40 states have reported human infections. california recorded its first death of west nile on august 3.

hour away from opening, chick-fil-a's first san jose location attracting a crowd. bob redell is live to explain why some not just showing up for the food. good morning. >> reporter: good morning to you, laura. more than a crowd. it's a camp if you will that's set up for the past day. i don't want to speak too loud. there is a 3-year-old boy sleeping inside. his mom, good morning. you can see the restaurant is going to be opening in an hour. you can see that because you see people are starting to pack up waiting to get in line. now, this is a restaurant chain from the east coast. used to be in the bay area a while ago, it's back, this new location in san jose and as they do with grand openings the first 100 in line receive what the chain promotes as free chick-fil-a for a year. it's 52 coupons for a year. there are people who showed up, the restaurant held a raffle and here you have them. what's so special about this

opening here and the 100 people are going to be whetting their appetite. something they have been waiting to do for the past 24 hours. bob redell, "today in the bay." >> thank you. very kind of bob to keep it down so the 3-year-old could sleep. push back this morning over a proposed law in san jose that would raise the minimum wage city wide. scott mcgrew has been covering this from the very start. scott, business owners are worried bigger salaries cost them. >> sure. that makes sense, right. you pay people more, your costs go up. san jose students first came up with this idea putting the proposed $10 an hour minimum wage on the november ballot. the san jose chamber of commerce telling the "wall street journal" business owners are fighting this proposed raise but, and we talked about it before, this has been done in other cities. this economist here studying it in berkeley and san francisco, studies show those wages don't cost businesses extra in the

>> 5:30 on the nose. good morning. thanks for joining us. i'm jon kelley. >> i'm laura garcia-cannon. happening now, the signs are in place and the planes are ready as santa clara county launches an assault on a ballooning mosquito population. marla tellez is live in palo alto with the details. good morning. >> reporter: laura, good morning. we're here at the palo alto bay lands which lines highway 101 just to the east, this is where the aerial assault against the mosquitos is going to be happening in less than two hours. it's going to be hard to miss because as we're talking about it's going to be done via helicopter. officials with the vector control district say helicopters will drop spray to reach as many as 400 acres. take my word for it, there are plenty of mosquitoes out here this morning. one happened to land on my script before one of my live

reports last hour. officials say this is the summer salt marsh mosquito. and while it's not known to carry west nile it has a vicious bite and has become problematic enough to do today's spray. for the folks in brentwood help is on the way there. the contra costa district says it's treating the area bordered by wilkins way, sellers avenue, the south by armstrong road, and the west by walnut boulevard. ultimately officials are reacting to a rise in west nile virus cases, california just reported its first death almost three weeks ago back on august 3. that was in kern count near bakersfield. the time to be most aware is dawn and dusk, so if you're out in the early morning as we are this morning, or at dusk, it's important that you throw on long sleeves, long pants, also some

repellent. it's not going to hurt. the spraying from above gets under way at the bay lands at 7:00 this morning. marla tellez, "today in the bay." >> fallout from the chevron fire, doctors say it's still operating in disaster mode. the e.r. is crowded with patients seeking treatment for symptoms they say are related to the august 6 refinery fire. the medical center called in extra staff to try to handle the more than 4,000 patients that have come through the door. >> you can see that they were in a bit of distress. >> chevron says it's going to cover the costs of medical bills but the deed line for care was yesterday. there is no deadline for filing a claim. >> a 22-year-old cal student is

under acrest for crashing his car into the putnam hall dorm. it's a story we brought you yesterday on "today in the bay." 22-year-old douglas perez was taken into custody on suspicion of dui. hundreds of students were evacuated from the dorm after the crash severed a gas line. pg&e capped the leak but students in the hall are still without hot water. the fall semester starts today. >> governor brown declaring a state of emergency in northern california where the ponderosa fire threatens at least 200 homes. lightning started this fire which has destroyed 50 buildings and scorched 38 square miles. crews are making some progress but flare-ups and steep terrain and the temperatures make it extremely difficult to fight. this one is about 50% contained. >> those lightning strikes can

be tough. let's check in with meteorologist christina loren. she's got a look at our temperatures. >> good morning. a live look over san jose, it's comfortable but what you can't see is we have a full deck of clouds and that is also the case in the extreme east bay through gilroy. so it's a foggy start. that will mean a comfortable afternoon. we're at 57 in san francisco. your hour by hour forecast works like this. fog and clouds right at 8:00 and you can see at that point we'll still have a fair amount of cloud cover in the north bay, oakland, san francisco down to san mateo. but palo alto will be clear. as of 8:00 a.m. then we're going to continue to clear you out especially in san francisco between 11:00 and 12:00. the fog will roll back in at about 5:00 tonight. limited sunshine in the city. you'll get better beach days. 78 degrees at noon. comfortable until about noon.

a possible hurricane threat there. that hurricane -- tropical storm isaac brewing in the caribbean, the worry is it's going to turn into a hurricane and could possibly hit florida, at the same time 50,000 people are descending on tampa for the republican national convention on monday. now, the party organizers of the convention say contingency plans are in place should a worse case scenario happen but they are moving forward and expect to hold the convention at the tampa bay times forum next monday. forecasters do say that there is still a threat from that tropical storm. we're live in washington. jon, back to you. >> thank you very much. >> a ceremony will be held in the nation's capital this morning commemorating one year since a large earthquake rattled the east coast. the 5.8 quake damaged famous land marks like the national

cathedral and the washington monument. the quake was felt along the eastern seaboard and as far west as chicago. no one died and damage was limited to d.c. and the suburbs of maryland and virginia. >> a man is in police custody this morning after storming a jetway at baton rouge airport and locking himself in the cockpit of an american eagle jet. 37-year-old andrew had a ticket to the flight to dallas/ft. worth but before boarding began he pushed past a gate agent, ran down the jetway and locked himself in the cockpit. he surrendered after oxygen and power were cut off to the plane. he will likely face state, local and possibly federal charges. >> we check in a little bit of baseball, that pennants race starting to heat up. there is a new scandal involving a player from the oakland a's. >> bartolo colon was suspended 50 games. the team will have to move on

you're waking up with us. i'd say in the inner bay region, even in san jose, i got away without the ac. 55 degrees here to start. 57 in livermore and 55 in fairfield. uniform temperatures at this point. that's courtesy of mostly cloudy conditions. the the marine layer pushed inland. it's not going to last as long as winds will pick up and stir up our atmosphere keeping the dense fog from settling at the surface. so area of low pressure came through overnight. a cold front on the way competing with an area of high pressure so the two work against each other. we have what we call a tight pressure gradient. the winds pick up. they will be at their strongest just in time for that big race. the america's cup, let's get to your forecast. today you can watch the live racing on our sister station. comcast sports bay area starting at 2:00, it's going to be active. more wind out there and you want the wind. that's what makes it more exciting.

there is some slowing here on northbound 101. starting to bog down. 15 to 20 minutes earlier than we expect. as well as chick-fil-a. that's where bob redell is. and all of those folks camping out for chicken sandwiches. >> not an easy drive, happening in scottsdale, arizona, crews are actually trying to rescue a driver that is stranded in that white van that you see to the upper top right of the screen. it is trapped in the swift moving water. it's used to transport handicapped. the driver drove around the barricade and became stranded. remarkable how youç drive -- b you know t flooding can happen so quickly in arizona. but we'll continue to monitor this situation for you as the rescuers are standing aside now. but no doubt they have to go in. right now the threat isn't too large but the water can pick up quickly. if there is a person inside they need that team in place.

deficits. they were supposed to be the fiscal cliff like sort after stick in the carrot and stick system. nobody expected the commission to fail so nobody thought the punishment was that big of a deal. officials at hewlett-packard got on the phone after the company reported its financials. hp is about one third of the way through its massive layoffs. 11,000 workers set to lose their jobs as part of that previously announced reduction in staff. another blog has published details about the iphone 5. it says the new iphone will have a bigger screen, though not as big as the samsung galaxy. for all of the excitement about apple announcements we tend to know a lot about it ahead of time. not once but twice apple employees lost iphones in bars. that has not happened with the iphone 5 yet.
