local time. we'll continue to monitor this story for you. we thank you so much for joining us. we'll have a local update in a half hour. this is an nbc news special report. and good morning, everyone, i'm matt lauer alongside savannah guthrie. we are following breaking news right here in new york city. a deadly shooting outside of the empire state building. >> it happened just in the last hour or so at the intersection of 34th street and 5th avenue. if you know new york city, you know this is a very popular spot for tourists. >> and a very busy spot at this time of the day. nbc's jeff rossen has made his way to the scene. he joins us now by phone. jeff, what can you tell us? >> reporter: hi, matt, let me set the scene. i'm at the corner of 34th and 5th avenue right in the heart of midtown manhattan right outside the empire state building where of course it was busy when this shooting happened a short time

ago. the latest information we have from the nypd is that four people have been shot, and at least one is dead, and that person who is dead, we're told, is the suspect. the gunman here. other details are still coming in, but just to set the scene, the nypd has now shut down the very busy 5th avenue, if you've ever been to new york city, you know how devastating that is for the city. from 42nd all the way down into the 30s. so we're talking about a mile stretch or a half-mile stretch of 5th avenue. police are investigating the scene. there are witnesses who have been pushed back. and witnesses are reporting that the shooting happened basically out of nowhere. police are still trying to figure out what this person's motive was. but once again, to repeat, four people shot according to the nypd. at least one of them dead. and again, that number could rise. depending on the conditions. and that person who was killed is the gunman, we're told. >> and jeff, let me add a little bit because according to

jonathan dienst who is a reporter for wnbc and who does work for us here at the "today" show and nbc news, we're hearing that the shooter was, in fact, an employee of the empire state building or at the empire state building. he's being described as a disgruntled employee, and yes, we are hearing that, in fact, he is now dead. i understand there are two, jeff, separate scenes there. is one where the victims of this shooting were hit, and is the other where the gunman was apparently apprehended and then later shot? >> reporter: i actually see clusters of police officers in several different locations, at least two of them, matt, and that would make sense. oftentimes in these situations bullets fly, especially when they are flying through streets in different locations. so what officers and investigators are going to try to do now is try to immediately find those bullet casings to figure out how many shots were fired, where people were hit. so it would not surprise me. and especially from what you're reporting and from what i am seeing, that there are multiple scenes here.

but yes, there are clusters of officers in several locations up and down fifth avenue. >> and we don't know whether the shooter in this situation walked out onto the street and targeted individuals for a reason or just began shooting indiscriminately. but he could not have picked a busier place at this time of the morning in new york city. any busier than the area around 34th street and 5th avenue, the empire state building. jeff, i know you'll stay on the scene and learn as much as you can. thanks very much. >> reporter: thanks, matt. >> we want to talk to james boulden now. he was walking in the area when the shooting began. he's on the phone with us. mr. boulden, thank you for being with us. >> thank you. >> tell us what you saw this morning. >> well, i was walking, like, i got off the train on 33rd street, 2 train, and i was walking on 33rd. by the empire state building. i got by the loading dock. i actually work in the building. and i heard three or four shots and just a whole bunch of people running towards me. so i'm on the phone with my

wife. and i'm telling her, i don't know what's going on. a whole bunch of people running towards me. and i just happened to run across the street. and i see somebody laid down dead on the floor. >> the person that you saw, and this may be a hard question to answer, do you believe that was the suspect, or do you think it was somebody who was shot by the suspect? >> actually, it's being said that that's the person that was shot by the suspect. and i took, like, a couple of pictures of it. >> where exactly did it happen? we're trying to get a sense of where the shooting actually took place. do you think you know? >> it took place on 33rd street between 5th and 6th avenue. >> you said you saw a lot of people running away from the scene. i take it it was very, very crowded at that hour. >> yeah, very crowded. everybody was basically going to work. at this time of the hour, it's always, like, heavy, heavy traffic on the sidewalks. >> did you see anyone wounded? >> yes. it was the guy that was on the floor. he was bleeding, like, from his

neck area. >> and any other victims that you saw? >> one more guy was dead on 5th avenue between 33rd and 34th. >> how quickly did police arrive? i imagine you stayed for a little bit? >> well, i'm still here. because i work in the building. the police came fairly quick. they actually were on the scene fairly fast. >> have you talked to anybody that you work with? we have a report from our local reporter, jonathan dienst, that this may have been a disgruntled employee at the building. have you heard anything like that? >> i haven't heard anything like that. i haven't -- like everybody's just in shock. >> have you been talking to anybody else on the street there with you, people who watched this and saw this? have they described what they saw? >> just a few people. like, it was like a few. it was like a little group of people that was actually on scene. and everybody was just taking pictures and filming, like, the

situation. >> mr. boulden, thank you very much. we'll ask you to stand by. if you're just joining us, this is a special report because there's been a shooting this morning outside the empire state building or near the empire state building in the heart of new york city. it's the area of about 5th avenue and 34th or 33rd street. there are varying reports as to the number of people who have been wounded in this shooting. anywhere from two, we've heard as many as eight or ten. however, one thing that seems to be confirmed at this point is that the person who did the shooting was, in fact, shot and killed. so at the moment, we can confirm, according to the fire department of new york, that one person is dead. we do not have any numbers beyond that. you can see that the police have closed down the area on 5th avenue and 33rd and 34th street. obviously, trying to piece this together. we've heard reports that there are personal belongings in the street in several different

locations. and that's pretty much what we have at this point. we've been told that the shooter may have been a disgruntled employee of or at the empire state building. >> as we mentioned, this is a developing story. we have widely varying numbers. but the latest we have from the fire department of new york was that eight people were being evaluated. that's their term. the new york police department confirmed for us that indeed the suspect is dead. but that four people have been shot. so obviously, we continue to watch this unfold. >> and you can imagine the chaos that this must have created at just after 9:00 local time in new york. not only were the streets immediately closed down by the responding police, but we work just about ten blocks or so, 15 blocks from that area. i could hear helicopters here hovering around the area, circling. obviously, they were trying to make sure that no one else was fleeing from that area. but at the moment, it appears that they do have the person responsible for this, and he has been killed. again, no word on the condition of any other victims. but we're going to be trying to find out more about that. >> all right.

we want to get back to jeff rossen who's actually at that scene. jeff, do you have any more information for us? >> reporter: yeah. police are still obviously fanned out and more are showing up by the carload. you can imagine, and matt just alluded to this, what this is doing to new york city traffic. i mean, this has brought the city to a standstill here in midtown. even just to get here, the street is closed at least seven blocks in both directions. we couldn't get down. we had to run down the street. there are literally hundreds of people standing behind police barricades just trying to get a look and, you know, crosstown traffic is an absolute mess at this point. and there's no traffic heading southbound on fifth avenue which, as you mentioned, is an incredibly important thoroughfare in the city at this time of day when this shooting happened. there are detectives showing up who i've worked with in the past who still don't know anything. there's a bit of chaos at the scene, controlled chaos, just trying to figure out what the

motive could have been, exactly where everything happened. that's why we mentioned there are clusters of officers at different locations trying to figure out okay, where did the bullets land? where were people hit? trying to put this together. and that also helps them treat the victims as well. >> jeff, we had mr. boulden on talking to us by phone just a couple of minutes ago. he was an eyewitness to this. and one of the things he said caught my attention. he said he walked around a corner and saw someone lying on the floor bleeding from the neck area. i notice he didn't say on the street. do you know if the shooting began inside the building and then worked its way out to the street? can you tell me anything about that? >> reporter: yeah, we don't know that yet, frankly. and i would hate to speculate. i am trying to find out more information as detectives sort of roam around the scene here, getting as close as i can. i'm about a block away from the empire state building as i talk to you now. inside the barricade line but still a bit away from where they're investigating. i'm trying to talk to detectives and give you more information as i get it here. >> jeff rossen down on the scene

with information for us. again, we're going to have much more information as it becomes available. but just to recap, a shooting in midtown manhattan just after 9:30 local time. we have confirmed that one person is dead. up to four people have been shot. the person who's dead, we believe, is the shooter in this case. and we're going to have more on this story throughout the morning on msnbc and tonight on "nightly news." some of you will return to your regularly scheduled programming. the rest of you on the west coast will on more of "today." i'm matt lauer along with savannah good morning again. it's 7:10 pacific time. we are following another big story in addition to that breaking news out of new york city. lance armstrong set to be stripped of his record seven tour de france titles after he decided to give up his fight

against the u.s. anti-doping agency. armstrong is saying he will no longer take part in the process that he called one-sided and unfair. let's get to anne thompson who's got the details. good morning. >> good morning. we think of lance armstrong as a fighter because he conquered that grueling bicycle race seven times. and before that, he beat the long odds of testicular cancer. but now he says he's no longer going to fight these charges. and while he is not admitting to doping, he says he refuses to participate in a process that is unfair. >> reporter: never quitter. lance armstrong was an historic seven-time tour de france winner, cancer survivor and activist. but now he says he is through fighting a battle that has dogged him for years. charges that he used banned performance-enhancing substances as far back as 1998. in a statement released on thursday, armstrong says, there comes a point in every man's life when he has to say, enough is enough. for me, that time is now.

if i thought for one moment that by participating in usada's process, i could confront these allegations in a fair setting and once and for all put these charges to rest, i would jump at the chance. but i refuse to participate in a process that is so one-sided and unfair. in an exclusive telephone interview with nbc news, the chief executive of the u.s. anti-doping agency, travis tigert said -- >> he will be immediately disqualified from all events that he participated in from august 1st, 1998, forward through the present, and he will be permanently banned from any future competition. and it's a powerful reminder to athletes that doping never pays. >> reporter: according to the world anti-doping code, armstrong can be stripped of his seven tour de france titles, his olympic brons medal from 2000 and all awards and money he won since 1998. a two-year federal investigation was closed last year without any charges. but months later, the u.s.

anti-doping agency said it had evidence that armstrong used banned substances including e-mails from former teammates floyd landis who was stripped of his 2006 tour victory and later admitted to doping. in an interview with ann curry in 2006, she asked armstrong if he had ever used performance-enhancing drugs in any of his previous races. >> absolutely not. never. >> not once. >> not once. >> reporter: the 40-year-old armstrong who retired from competing last year lost a court battle on monday that challenged the u.s. anti-doping agency's authority. in his statement, armstrong said, "i know who won those seven tours, my teammates know who won those seven tours, and everyone i competed against knows who won those seven tours." but it may not be over yet. the international cycling union is likely to appeal usada's ruling. and if it does, it goes to the court of arbitration in switzerland which could be months away. so this story is not over. >> anne thompson, thank you.

we want to get to the latest on tropical storm isaac. it's expected to dump heavy rain on parts of the caribbean today. but stitt still have florida and the republican national convention in its sights? al's outside at our new window on the plaza. al, good morning to you. >> reporter: well, good morning, savannah. this is the latest on isaac. right now tropical storm, 175 miles south-southwest of santa domingo. and at 50-mile-per-hour winds, it's starting to strengthen a bit. it's moving west at 15 miles per hour. as you can see, already we're seeing lots and lots of raincoating and covering puerto rico. they've already gotten about four inches. some areas could pick up another six to ten inches. bad news for haiti, a lot of rain and winds for hundreds of thousands still living in tent cities. here's the path. makes its way onto cuba sometime saturday on into sunday. once it gets over land, it will probably weaken, but then it comes back out into the waters, makes its way through around key west early monday morning and

then starts to intensify over the warmer waters of the gulf, making landfall sometime wednesday early as a hurricane a minimal category 1. is tampa out of the woods yet? no. as long as this warm water is going to provide energy for isaac, this is such a sprawling storm, it's very disorganized right now, but the rain bands will spread way out. right now in diameter, this is about 1,000 miles. so we could be looking at anywhere from four to eight inches of rain throughout much of central and southern florida over the next few days. and as we know, a couple of months ago when we had tropical storm debby, that was a minimal tropical storm that dumped a lot of rain in tampa. they had a lot of flooding problems, matt. >> thanks very much. we want to do a little more on that side of the story now because nbc's kerry sanders is in tampa with the latest on that. kerry, what can you tell us? >> reporter: as we just heard, the flooding in tampa is the

reason they've already started to give out sandbags to local residents. further south in the keys, they've announced schools will be closed monday. and the republican party leadership says they have not ruled out the possibility of postponing the convention if public safety is at risk. with 50,000 people headed for the republican convention, isaac could cause weather-related problems even if tampa dodges a direct hit. already this week, a thunderstorm with 60-mile-per-hour winds knocked down some of the tents that now crowd the tampa bay times forum that's hosting the republican gathering. party leaders knew this was the height of hurricane season, but they went forward with tampa as the host city anyway, in part because the area has not taken a direct hurricane hit for more than nine decades. the 1921 hurricane was a category 3. it left the region devastated. were isaac to follow a similar route to tampa, it would be up to the mayor to call for an

evacuation. >> the odds were small. we haven't been hit for 90 years. we plan for hurricanes every year. that's what we plan for here in florida. >> reporter: eight weeks ago debby caused flooding and major road closures that disrupted the area for three days, and that was just a tropical storm. police have trained for more than a year. they expect tens of thousands of protesters. with 4,000 officers on hand -- >> you have ten minutes to disperse. >> reporter: -- many on loan from other search's offices, tampa police say they're ready. just one potential problem. if isaac hits hard, some of those loaned officers may have to stay home to help victims in their own communities. the tampa police chief says they have a contingency plan for that, the national guard. matt? >> all right, kerry sanders in tampa for us this morning. thank you very much. we'll have the latest on isaac all throughout the weekend, and i'll be in tampa for next week's republican national convention. we want to get a check of the day's other top stories.

natalie morales is over at the news desk. good morning. >> good morning, everyone. justice in norway as anders breivik has been convicted. he was deemed sane and found guilty of terrorism and premeditated murder. the maximum prison term allowed under norwegian law is 21 years, but the 33-year-old received a special prison term that allows authorities to keep him behind bars as long as he is considered dangerous. new details this morning about james holmes, the man accused of opening fire at a colorado movie theater last month. when holmes was a student at the university of colorado, the school was concerned enough by his behavior to run a background check on him. in june, holmes failed an oral board exam. he then withdrew from the school three days later. prosecutors argue that the events in holmes' life leading up to the july 20th massacre could help them pinpoint to a motive. terrifying video from boston when a woman carrying her

4-year-old child walked straight off the platform, falling onto the tracks below. she told transit officials that she thought she could board the train across the tracks from her platform. good samaritans jumped in to save the mother and son. they were fine, but she says she is never taking the subway again. and after winning two gold medals at the london olympics, she thinks that nothing would make gabby douglas nervous, but she admitted that throwing out the ceremonial first pitch for the mets/rockies game on thursday actually gave her the jitters. and gabby gave a little bit of a wild throw there, but she won the crowd over anyway with that golden girl smile. she is a sweetie. it is 7:19 on the west coast. back over to matt, savannah and al. >> natalie, thanks very much. >> matt still tried to sign her, though. >> just evolving with that one. >> on the east coast. still a little for the west. >> thought better of it after the letters were coming in. >> what's going on?

>> good morning to you. 7:26. i'm laura garcia-cannon. we're following developing story in san francisco where people are being allowed back in their homes after an overnight scare. police evacuated an apartment building in the tenderloin for a few hours this morning because of suspicious devices found in the basement. 75 people woken up, forced out on the street and the bomb squad was called in. >> there are 12 to 15 sections of pipe cut and capped and contained a substance, i don't know the specific substance at this time but the bomb squad working with the fire department hazmat team determined that the sections of pipe and the contents were not explosive and not hazardous. >> streets were shut down twill the bomb squad investigated. the streets have reopened and

7:30 on the west coast on this friday, august 24th. you're looking at the scene of a deadly shooting right outside the empire state building. >> fbi sources are telling us that two people are confirmed dead. one bystander and the alleged shooter. nbc's jeff rossen is on the scene. jeff, good morning again. okay. actually, jeff, we're having a little trouble with your audio. let's try and bring people up to date. we know that around 9:30 local time here in new york city,

someone began to shoot either just inside or just outside the empire state building. we have reports that up to five people were hit. we now have confirmation that two are dead. one was a victim of the shooter. the other is the alleged shooter himself. and apparently that entire area has now been cordoned off by the police. >> we're getting some reporting from our reporter jonathan dienst who works for our local affiliate that says law enforcement officials are telling him that this may have been a disgruntled employee, somebody who worked at the empire state building. dienst is also reporting it is possible that this employee has been fired the day before. >> actually, jonathan dienst is now joining us by phone. jonathan, what else can you tell us? >> reporter: yeah, it appears that the suspect was shot and killed by police after he opened fire in the vicinity of the empire state building. all this happening after 9:00 this morning. the gunman is dead. one other person also shot and killed at the scene according to

fire department and nypd officials. unclear who that second victim is at this time. officials are stressing that this appears to be a work-related shooting, perhaps by a disgruntled employee who may -- may have been fired yesterday and then returned today to the place of business today to carry out some sort of revenge. that is a preliminary information as they're still working to confirm the i.d. of this gunman of the suspect and to sort this out. but what's important to note is both fbi officials and nypd officials saying this does not appear to be terror related in this shooting outside the empire state building here in midtown manhattan. >> all right. jonathan dienst reporting on what is a developing story for us here in midtown manhattan. jonathan, thank you very much. >> we are also keeping a close eye on the weather. tropical storm isaac.

it's still posing some risk to tampa and next week's republican national convention, too. al's got the latest. >> reporter: just to update you on the location again, isaac, tropical storm with 50-mile-per-hour winds. 175 miles south-southwest of santa domingo. winds are west at 15 miles per hour. the path of this system right now -- and it's a fairly sprawling system -- you can see the rain now making its way over san juan. that rain will be making its way into haiti where they do not need it. we are looking at this coming across cuba early saturday. that will probably weaken. then it gets back over open water, makes its way across key west early monday morning. and then we expect to see some landfall somewhere between new orleans and pensacola early wednesday morning as a minimal hurricane, a category 1 storm. rainfall amounts at least through the caribbean. you can see those areas of white, that's beyond five inches. we're talking anywhere from six to ten inches of rain in those

areas. and those rain bands will stretch on into florida as we continue during the next several days as isaac makes its way through the caribbean and into the atlantic. that's what's going on around th >> 7:34 now. on a friday, i'm meteorologist christina loren. we have good looking conditions shaping up especially around the inner bay. 73 degrees in fremont, 77 for redwood city. comfortable in san jose at 78. a little cool and cloudy in san francisco. you'll hit 63 degrees and warper weather is on the way at the coast as we head through next week. a return of the 90s inland tuesday into wednesday. and that's your latest weather. matt? >> al, thank you very much. back now to jeff rossen on the scene of that shooting in midtown manhattan. we're hearing reports according to an eyewitness that the

shooter was a well-dressed individual carrying a briefcase, wearing a suit, and he walked up apparently and just opened fire and shot one of the bystanders in the head. it's unclear whether he knew that person, jeff. >> reporter: yeah, we're hearing actually the very same thing here on the scene. and actually, we're speaking with an eyewitness. we're trying to get to our location so we can speak with him firsthand so you can actually hear at home exactly what she saw. what we know from a law enforcement source, and jonathan dienst has been alluding to this, ten people shot, two people dead including that shooter who may have been incredibly well dressed. we're hearing that the shooting and a dispute happened along manhattan's fifth avenue right in front of the empire state building between 33rd and 34th streets. and here is what you have. we'll walk over here, and you'll bear with us as we show you a live picture. all of fifth avenue is closed where police activity everywhere you look. and you can see clusters of police officers walking all over the place, trying to figure out exactly where these bullet casings are, where the shooting

back now at 7:41 on the west coast with the first british newspaper to show those controversial photos of prince harry. this despite an attempt by the royal family to keep them out of the papers there. nbc's stephanie gosk has the latest. >> reporter: it's been three days since prince harry's wild vacation in las vegas was exposed. two photos taken in the privacy of his hotel suite spread as fast as the enter ninternet cou them, lightning fast. but it took until today for "the sun" to reveal the prince themselves. managing editor felt he needed to explain the delay. >> for us, this is about the freedom of the press. this is about the ludicrous situation where a picture can be seen by hundreds of millions of people around the world on the

internet but can't be seen in the nation's favorite paper. >> reporter: the palace went to the british press complaints commission to argue that the photos were a violation of prince harry's privacy. and the british media listened. not a single major news organization has used the photos. but in a statement today, "the sun" argues that the 27-year-old's behavior in las vegas was not that of a man jealously guarding his privacy. neither it seems were his security detail. the two metropolitan police officers on guard who let cameras or cell phones into the suite. >> this is a vip room with a potential head of state, and you just don't do that. that should have been checked, bagged, secured outside of the room. and when these people left, they would have got all their belongings back. >> reporter: prince harry's friend, arthur landon, who was with him tells "the daily telegraph" believes it may have been one of the guests invited into the room. an $8,000 a night suite like this one at the wynne hotel.

friends at work you weren't feeling too well. do you remember what happened next? >> i remember telling my friend, it was during our preshift meeting before we were going out to the stadium. i told her, i said i wasn't feeling well. i said if i pass out -- that's all i remember. i remember my friend saying, does anybody know cpr. does anybody know cpr. i had a look of stress on my face, obviously, because i was hearing everything but nobody was responding. and then jim was walking down the tunnel right where i was, and all of a sudden he came out of nowhere and he said, i know cpr and he took over from there. >> jim, had you ever performed cpr in an emergency situation before? >> just one time, matt, almost 30 years ago. >> did it kick in as instinct. i know you learned it as a lifeguard when you were 16. did it just kick in? >> yes, it did.

it was nothing more than in steenextinct -- instinct. i knew jayne was in trouble. when i checked her vitals, there was no pulse. i knew she was in a lot of trouble at that particular time. literally it was instinct that took over. >> just like we hear all the time, you did cpr to the song staying alive. >> i said it in my head. i don't know if i was saying it out live. i know it was in my head. that's the new cpr, that's the rhythm you do the chest compression to. >> you were rushed to the hospital. do you have any idea how long you did cpr, by the way? >> we kind of figured it was probably somewhere between four and five, maybe six minutes. >> jayne you got rushed to the hospital. they im planted a pacemaker. was this a heart attack? was this a seizure? what have they told you? >> no. i went into cardiac arrest.

i wasn't really a seizure. it was an erratic heartbeat that was malfunctioning in my heart, which caused me to go into cardiac arrest. >> jim, i know you had the chance to go to the hospital and visit with jayne. what was that like for you? >> i think it was pretty emotional for all of us involved. my wife kay was with me and jayne's brother john was there. i said a couple words and then the emotions just took over. i think it was maybe 30 seconds of downtime after that, because we all had to take a couple deep breaths and just catch ourselves. >> jayne, we are so happy you're okay. we're happy jim was walking down that hallway. it's another example. umpires are often the unsung heroes of major league baseball and now for a completely different reason. jim, it's good to have you in the headlines for all the right reasons. >> thank you, matt. there's also one thing i like to

suspected gunman among them. jeff rossman is among them. jeff, what have you learned? >> reporter: natalie, this is what we're hearing. law enforcement sources now tell nbc news ten people have been shot here outside the empire state building. two of them have died, including the suspect who we're told, according to the nypd, was a disgruntled employee from one of the companies inside the empire state building who showed up here today. the security guards would not let him into the building and so police tell us the shooting happened outside the building and i believe you're watching some aerials right now of exactly what the scene looks like. again, several people have been brought to several area hospitals here in new york city. all of midtown manhattan has become to a standstill. if you haven't been here before, located along fifth avenue in the 30s. so right now -- and we can come back to a live picture. right down the street across the

street is where one of the shooting scenes happened. the entrance to the empire state building just feet away. police are still trying to put all of this together. they are at several different scenes even within this scene where people have been shot. eyewitnesses say they heard shots over and over again. you can imagine on a busy weekday morning. once again, the nypd and fbi now on the scene also telling us -- and this is very important -- no connection to terrorism. this appears to be a workplace dispute with a man, again, it appears was fired yesterday from one of the companies inside the empire state building. and we can pan up here. you can see how close we are right under its shadow. there are several companies, obviously, that do business here. he worked for one of them, we're told. we're not sure which one but tried to get into the building when one of the security guards

good morning to you, it is 8:26. i'm marla tellez. david rosen is charged with two counts of vehicular manslaughter in connection with the deaths of 41-year-old solomon nuri and his 9-year-old daughter, odessa, back in april. police say rosen was driving an suv and speeding when he swerved and hit nuri and his two daughters. they were riding their bikes. 12-year-old hanna nuri suffered minor injuries. the nuri family wants rosen, who was 17 at the time, to be charged as an adult. time to check this morning's traffic commute. how is it looking, mike? the orange right here, marla, don't be alarmed.

left at least two people dead. one of those killed was a former co-worker of the suspect who apparently was the intended victim. the 53-year-old suspect then fired on police and officers shot back killing him. at least nine others were wounded or grazed by bullets in the cross fire. they are expected to survive. mayor bloomberg says the gunman jeffrey johnson was a disgruntled employee who worked nearby. he was laid off from his job as a women's accessories designer about a year ago. the streets around the landmark had been shut down as the investigation continues. meanwhile, the fbi and the atf are on the scene investigating. cycling champ lance armstrong will be stripped of his record seven tour de france titles and banned for life from the sport he helped make famous. thursday night armstrong released a statement saying, "enough is enough, as he decided to stop drop his challenge against the u.s. anti-doping agency charges that he used performance-enhancing drugs. armstrong says the usada does

not have the authority to strip him of his titles. the head of the agency denies that. more backlash surrounding a new book about the killing of osama bin laden. the author of "no easy day" is a former navy seal from seal team six that carried out last year's daring mission. according to the publisher, the author gives a blow by blow narrative of the raid and other details that have outraged the military community. if the book leaks any classified information, the author could be prosecuted. a girl reported missing more than two years ago has now been found in illinois. just 15 years old when she disappeared, the girl told police she escaped after being held captive for years and repeatedly sexually assaulted. police recovered her young child who she says was the product of rape by her captor. a 24-year-old man and his mother had been arrested in connection with the case. new details this morning about james holmes, the man accused of opening fire at a colorado movie theater last month.

when holmes was a student at the university of colorado, the school was concerned enough by his behavior to run a background check on him. in june, holmes failed an oral board exam. he then with drew from the schol three days later. prosecutors argue this could help them pinpoint to a motive. wildfires are scorching northern california. more than 60 homes have been destroyed and flames are now threatening almost 1,000 more. some 2,500 firefighters are on the scene battling the blaze. if you're going to wear the spider-man suit, you've got to commit to the part this video from poland is going viral and shows one guy who wants to be warsaw's newest superhero. he may not be ready for the silver screen, but he has the spidey sense to get people laughing. or at least to get one elderly subway rider angry enough to scold him saying, this isn't the olympics. it's now four minutes after the

hour. outside to al with a check of the weather. >> i don't think anybody was confusing him with the olympics. thanks so much. this is the latest we've got on tropical storm isaac. 175 miles south/southwest of santa domingo. 50 mile-an-hour winds and moving to the west at 15 miles per hour. we are seeing heavy rain making its way into puerto rico. as it does that rain is starting to see its way into hispanola. bad news for haiti where there are hundreds of thousands living in tent cities. this is the path of the storm coming up across and in between kingston into cuba. saturday morning it's still a tropical storm. makes its way over cuba, so that's going to inhibit the growth and intensification. then as it makes its way back out into the warmer waters of the gulf, it comes across as a tropical storm key west. makes its way into the gulf where the water temperatures are in the mid to upper 80s. that's more intensification and more fuel for that system.

good morning to you. it is 9:26. i'm marla tellez. taking a look at one of the stories we're following today, a san francisco apartment complex got a rude awake thng morning. police evacuated the building just outside the tenderloin for a few hours because of suspicious devices found in the basement. 75 people were forced out onto the street in the middle of the night and the bomb squad was eventually called in to investigate. >> well, there were approximately 12 to 15 sections of pipe that have been cut and capped. they contained a certain substance. i don't know what that substance was. but the sections of the pipes were not explosive or hazardous. >> just after 5:30 police gave the all clear and people were
