it's going to make nascar on the water happen as we've been seeing this week. it's been pretty wild. partly cloudy skies later on. right now a lot of mist with low clouds. san francisco across the bay, 50s out there. near 50 in santa rosa. it's chilly. look at the wind in fairfield, southwest wind at 25. if it's that windy in fairfield, it's a breezy day around the bias well. satellites pretty interesting. it's late august here but you see the system there, heading towards pacific northwest fall-like pattern when you see cold fronts pass by to the north. scoop ul the sea breeze, make it stronger as we wrap up the weekend. temperatures inland towards the tri-valley, dublin, danville, highs in upper 70s to near 80 today. temperatures cooler heading towards tomorrow. so we'll have a full look at an interesting forecast coming up. >> thank you, rob. new this morning highway patrol is trying to figure out what led to a deadly car accident in concord. two cars crashed after 10:30 last night on highway 4 near the

sill la cilano way off-ramp. calls are tipped off the chp to a black honda swerving across the highway at varying speeds. then someone called in reporting one car in the highway center divide and another off the side of the road. the hoyway patrol reports that at least one person died in this accident. this morning, investigators are trying to piece together what caused a man who was recently laid off to carry out a deadly shooting at the empire state building. two men are dead, nine people injured. and now new york city police are releasing surveillance video. we have to warn you, it is not easy to watch. this video shows jeff johnson in a suit walking calmly until he hears police behind him. then he pulls out a gun. the nypd released the video to show why two officers fired their weapons, though that suspect was in the middle of a crowd. johnson was shot and killed. several bystanders were also

hit. before this happened johnson shot and killed a former co-worker in the street during rush hour in manhattan. commuters and tourists ran for cover. >> i heard five, six shots. i saw people running. i heard somebody yell, saying he's shooting, he's got a gun, he's shooting. >> nine other pedestrians were likely injured by ricochet and graze wounds from shots fired by police. here at home a man is dead and a child is recovering, victims of gun violence in oakland. shooting happened around 8:00 near sycamore street and san pablo avenue. police found a man shot and a 7-year-old boy who had been grazed by a bullet. that man was taken to the hospital where he was pronounced dead. the boy is at oakland children's hospital and is in stable condition. it is unclear what the relationship is between the man and the boy. in san jose, it is one of the deadliest summers in history and today, top lawmaker will meet face to face with san jose

police chief to figure out some way to stop escalating violence. abelong the topics, cities plan to use overtime to help fight crime. george kiriyama reports. >> reporter: san jose police chase down an armed robbery suspect in the neighborhood just south of downtown. they made sure he didn't get far and arrested him near virginia. no homicides friday night but numbers are staggering, eight dead, six injured in the past 11 days. >> every day i look at the paper or i get online, i'm seeing a title that talks about another homicide in the city of san jose. >> reporter: assembly member and speaker pro tem has been pushing the san jose police to ask the chp for help. friday morning the chief said no to the proposal. >> i hope he has a better plan and able to address the high number of homicides that continue to rise in the city of san jose. >> reporter: part of chief moore's man to pump $800,000 into the overtime budget.

that will keep officers on the street. gang prevention advocates note taking back neighborhoods will be a challenge. >> the children are going to school, middle and high school, saying we have to get the scraps. that's what the word is out there. >> reporter: she'll keep pushing the city of san jose. >> our residents in the city of san jose should know that when they walk out their door, when they go to the grocery store, that they are safe. >> reporter: george kiriyama, "today in the bay." >> again, state assembly woman will meet with the san jose police chief chris moore about safety in san jose 10:00 this morning at city hall. we'll be there as well. we'll bring it to you. and is a jewelry gang at work? there have been a string of recent armed robberies at bay area jewelry stores. the latest on thursday in san pablo. this is surveillance video of it. the robbery in progress. you can watch the suspects go into the store, demand money, smash the glass cases and grab

whatever they want. police estimate they took more than $400,000 in jewelry. stores in oakland, newark, have also been hit recently. investigators are comparing cases and notes to see if any are related. a home invasion foiled by two kids. a fast-thinking 16-year-old girl and her 11-year-old brother are being credited with stopping a burglary and, more importantly, saving themselves. fremont police say the kids called 911 after three men broke into their home on nutman avenue thursday afternoon. the siblings locked themselves in an upstairs choose sweat called police. >> they were ringing our doorbell a lot and knocking on the door a lot. and then my sister went to go down and look to see and one of them had a crowbar and they apparently broke a window. >> the suspects were arrested a few blocks away. police say a vehicle found near the home had stolen property in

it from a separate and unrelated burglary that happened earlier that day in newark. the men are due in court next week. and now to decision 2012. president barack is spending the weekend at camp david but mitt romney and running mate paul ryan will be on the campaign trail. they will be stumping for votes in the key state of ohio today. the rally in ohio is expected to be romney's final public appearance ahead of the republican national convention in tampa, florida. we'll talk politics with our political analyst tomorrow morning. and in ohio, a major medical slip-up. a health commissioner says a nurse accidentally threw away kidney from a living donor. the university of toledo medical center suspended its kidney transplant program after the botched transplant earlier this month. the newspaper reports that the kidney donated by a man to his sister was accidentally thrown away as medical waste.

apple prevailed over its tech rival samsung in a billion dollar verdict that will impact the global smartphone market. a federal jury ruled yesterday that samsung did steal ideas from apple when creating its own line of smartphones and tablets. the jury made that decision inside a san jose federal courtroom yesterday. then awarded apple more than $1 billion in damages. samsung issued a statement reading, quote, the verdict should not be viewed as a win for apple, but as a loss for the american consumer. it will lead to fewer choices, less innovation, and potentially higher prices. samsung is expected to file an appeal. no word yet on possible product bans. shortage of reasons to be in san francisco this weekend, if you're planning on taking caltrans, you won't be alone. america's cup world series sailing race and the san francisco giants are in act at the same time. caltrans expects some trains may

reach capacity at peak times. giants fans who ride the train already say hopping aboard after a game is already tough. >> it is crowded. people are sitting on like everywhere on the floor, you're like all up the stairways. >> caltrain adds additional trains for giants games but the agency does not have more equipment to help overcrowding for this within with the two big events going on. saturday's giants' game is 1:15, of course today's america's cup racing starts at 2:00. on this schedule for the america's cup sailors they will race each other two more fleet races which is when all of the boats are on the water. it will also be a fight to the finish in the semifinals in the match racing when the boats compete one-on-one. best viewing sites are from chrissy field to marina green. this is what happened on day two of the america's cup world series in san francisco bay. the very start of fleet racing yesterday, a crash ended the day

syria running through the fences between the syrian/turkish border at a checkpoint today. armed men used trucks to help some of the refugees cross through check points between two countries. yesterday, turkey's foreign minister said that syrian president bashar al sad's regime would be gone within months or weeks. some syrian refugees in turkey are not as hopeful. more than 44,000 syrian refugees are living in turkey, a country which has turned into a fierce critic of syria's president. in south america, a huge explosion killed at least 19 people and injured dozens of others. a venezuela biggest oil refinery, this is video posted online showing flames rising oak the refinery on the peninsula. venezuela's oil minister said that a gas leak created a cloud that ignited around 1:00 in the morning local time. it is unclear to what extent that explosion might affect oil

shipments from venezuela. a rabbit bat prompting a warning for owners near lake merced. the health department is distributing flyers and alerting residents. the danger that is someone or their pet might find or touch a sick or dead bat and possibly contract rabies. bats are the most common way people and animals catch rain byes in the u.s. a good time to make sure the cats and dogs are up to date on rabies shots. high food prices are here to stay. the u.s. department of agriculture released its food forecast saying elevated prices on items like beef, pork, dairy are expected to remain high through the end and into 2013. through the end of this year i should say. the midwest drought which is the worst in decades driving up corn and soybean prices which in turn cause spikes in prices. beef prices expected to go up 5% next year.

sweater early on. >> and afternoon, if you head out to marina green and watch the america's cup world series or if you're around parts of the east bay, we've got cool temperatures to start your morning off with low clouds. numbers near 56 right now in oakland. 54, san francisco. misty skies. 50 in santa rosa. 56 san jose. also have low clouds into the santa clara valley this morning. winds tell the story. good news if you're on a 45-foot super elite catamaran around the san francisco bay. you'll get the wind today. fairfield, strong sea breeze, that's a sign of the ocean air-conditioning keeping temperatures down. head out to the ballpark today, firing up the giants' theme music there, 60 degrees around first pitch time. cooling off as the game goes on. cool there. on the opposite side of the water off marina green, flying into that temperatures today in the upper 50s. breezy and cool, misty skies at times. winds increasing towards the

afternoon. they love it there. at least the crews that aren't capsizing like that. that weather should get boats quickly through the water today. around the bay area, stratus quo, peel back to the coast for the afternoon. the mild pattern will stick around through the weekend. and it's interesting on the satellite what happens happening. in addition to low clouds on the coast which moved inland the system to the north, not going to bring us rain but reinforce and strengthen that sea breeze as we go through the end of the weekend. so, the pattern of low clouds for morning going back to the coast for the afternoon. it's going to repeat by the evening. look what happens here towards 6:00. low clouds are already in towards hayward setting us up for a cool infifinish to weeken terms of temperatures. 75 in san jose. areas south of san jose, still close to 80 degrees. head up to sunol, pleasanton, danville and alamo, numbers in the upper 70s, close to 80. some of the warmest spots around

pleasanton in the east bay. north bay, southerly winds, temperatures in the low 70s. this does not look like august in term of the weather. we should see 90s in the valleys. just not going to do it with the sea breeze today. tomorrow the same story, maybe a notch or two cooler. towards the middle part of the week, temperatures will start to climb on up. warmest days of the week, perhaps wednesday and thursday. even by our standards upper 80s for livermore not bad. comfortable temperatures. good for air quality. great for the america's cup. and we've got indycar in sonoma this weekend. a little bit of everything going on the weather looks good. but a light jacket's fine for the bay area. >> windbreak. >> indeed. >> a story that had rob and i talking. a woman who tried to restore a painting of jesus ended up making the fresco look like a portrait of a monkey instead. the 80-year-old woman in spain tried to restore this 20th century fresco of jesus in her

catholic church. it did not go well. when the fresco was done it was nearly unrecognizable, jesus having a monkey-like appearance. the descendants are devastated. they were about to donate money. but experts, what you're seeing the portrait has gone viral and people have been putting it on all kinds of works of art. sad for the church. seven tour de france titles stripped away from his legacy in tatters. what's next for lance armstrong? how is his doping scandal impacting the fight against cancer and and his sponsors? >> reporter: after more than a decade of doping allegations, cyclist lance armstrong gave up the fight to clear his name thursday night and the u.s. anti-doping agency wasted no time today reacting. >> it's a powerful reminder to athletes that doping never pays.

>> reporter: usada had up to ten of armstrong's former teammates ready to testify about his doping activity. armstrong chose not to challenge the organization, saying in a statement that its process was one-sided and unfair. >> u.s. anti-doping agency doesn't bring these cases frivolously. they're 58-2. he was facing an uphill battle. >> reporter: this work a texas judge threw out a lawsuit armstrong filed, challenging usada's authority. armstrong had the option to force the agency into international arbitration but chose not to. >> to rebut the charges, there's serious charges, mean that he's effectively acknowledging they had substance. >> reporter: but armstrong has always insisted, including during a 2006 interview with nbc's ann curry he never used performan performancen hancing drugs. >> not once. >> not once. >> reporter: even in the wake of today's action, armstrong's longtime sponsor nike said it would stand by the 40-year-old cancer survivor and the live

strong organization, that armstrong founded to assist cancer, care and research, also voiced its support. >> we might see a temporary effect. long term, within the cancer community, lance armstrong is the hero. >> reporter: but armstrong's heroics in cycling are now, at least officially, no more. mark barger, nbc news. >> armstrong is not backing out of the public eye today. he's scheduled to ride in a mountain bike ride in aspen, colorado and run a marathon there tomorrow. here at home, a bay area cancer survivor is rallying the community to help others fighting the disease he beat. 14-year-old britain swisher's hosting a bone marrow donor drive today. he was battling lieukemia a few years back more than 100 donors gave blood in hopes of finding a match. the blood drive held at church of latter day saints in brentwood. those participating have to swab the inside of their mouth and names will be placed into a

this afternoon, the petaluma little league team will play tennessee in the u.s. finals of the little league world series. coming off a day off and what better way to spend that day than with ice cream. nascar boats on the water. and marina green, the america's cup world series continues today. thanks for joining us. i'm kris sanchez with meteorologist roby mayeda who says wind will make the sailors smile from ear to ear. >> you can see things more than it wants to take off with the wind sail. the wind out there for san francisco and fairfield. southwest win up to 25 miles per hour. cool marine air up to the valley to the south and inland across the bay into the tri-valley there is morning with low clouds. system spinning off to the northwest of us. that system will miss us to the north but pump up the sea breeze especially tomorrow and into monday and lead to a mild weekend. by lunchtime if you're out around livermore or pleasanton, low 70s. but look at san jose, lagging behind there. mid-70s for highs around the santa clara valley and near 80 in the warmest places inland. tomorrow, looks even cooler. what's good for the america's cup and the wind, not good for

violence. eight people dead, six others inured in the last 11 days in san jose. norah compose has been pushing the police department to ask for the help of the chp. police chief chris moore said no to the proposal. today they will meet face-to-face to try and figure out some way to stop that rising crime rate. >> i hope he has a better plan and that he's able to address the high number of homicides that continue to rise in the city of san jose. >> chief moore's using 800,000 from the city's general fund to increase his overtime budget to help keep officers on the street. the santa clara county sheriff, district attorney, and probation department vowed to step up and help the department, as well. charitable with himself, they the accusation against the 74-year-old man who is accused of gambling away thousands of dollars from the peninsula charity he was entrusted to run. ruperto reyes is the president

of the luzon visayas mindanao association. the organization lists this daly city home as its base of operation. san mateo district attorney says reyes used an atm card 188 times at the san mateo jockey club. the d.a. suspect his blew the money betting on horses. the d.a. says reyes withdraw $68,000, leaving only 19 bucks in the account of the filipino-american association which helps community members. reyes has pleaded not guilty and is expected back in court on september 6th. community members on the peninsula are vowing to fight the construction of a new jail in san mateo county. and they want to hear other people's thoughts on how to go about doing that. they're holding a town hall meeting today to talk about ways to stop the building of the 160 million jail. the event will run from 1:00 to 4:00 this afternoon at the free at last community recovery and rehabilitation services in palo alto. well, a very happy birthday

to the city of sunnyvale which is turning 100 this weekend and celebrating with a two-day festival. a parade will make its way through city streets this morning. sunnyvale incorporated in 1912 and back then it was filled with cherry orchards. now, of course, we know it as a high-tech hub with about 140,000 residents. here's a closer look at the parade route which will impact traffic in the area. kicks off from fremont high school and heads down sunnyvale saratoga drive toward the museum. parade starts at 10:00 this morning. much more ahead for you on "today in the bay." coming up, apple prevails over its tech rival samsung how will the verdict impact the global smartphone market? details coming up. favor. business and tech reporter scott budman gives us details of the verdict. >> the decision came ver quickly and very decisively in favor of apple which had a good year and things got a whole lot better this afternoon. indeed, a jury in san jose deciding that samsung had violated several of apple's patents, regarding the iphone design and decided that samsung should pay damages of slightly more than $1 billion to apple. we didn't get any reaction from the attorneys or jurors. they all left without speaking. but we did get reaction from the companies. let's start with samsung, they call the verdict not a win for apple, but rather a loss for the american consumer. saying that because of today's decision, smartphones may cost more in the future. the thought here is that companies may be afraid to innovate because they fear legislation from apple. apple, on the other hand, saying this was not a case about

innovation. this was a case about copyright infringement. they praised the decision and thanked those involved. expect a quick appeal of today's decision from samsung meanwhile reaction quick from wall street even on a friday afternoon. late posts market trading saw apple's stock soar after the decision came down to all-time highs. i'm scott budman, nbc, bay area news. >> at the same time, apple is making news over its long rumored apple tv set. there's evidence apple is veering away from the concept at least for now. in a meeting with an apple executive this week, a research analyst revealed apple isn't ready to wade into the complex waters of dealing with networks and international broadcasting. overhaul of the set top box could be in apple's future. and we still have more ahead for you on "today in the bay." coming up, tropical storm isaac strengthens overnight as it swirls towards haiti. a report from haiti on the

welcome back. here's the view of the boats before all of the action gets started. wow, look at the golden gate out there, just the bottom of it showing through the low cloud. misty skies. breezy conditions expected again today across the bay. good news more america's cup. we'll be watching that through the afternoon. a lot of events where we'll see cool temperatures. attention on the tropic. tropical storm isaac starting to move away from haiti now. you can see winds 60 miles per hour. path of the storm, we still think within the next 24 to 36 hours, will cross perhaps as a hurricane west of the florida

keys and eventually cross inland. maybe across the florida peninsula as we go through the first part of the week. so there you go, wednesday possibly category 1 hurricane impacting not only haiti this morning, parts of cuba, eventually south florida by the time we wrap up the weekend. something we'll be watching obviously closely across the southeast. you'll be seeing more of that on nightly news tonight. 50s across the board for the bay area this morning. again the sea breeze, the big player in the weather today. it's going to keep our temperatures down mostly 60s and 70s for almost the bay area. you have to head way inland to find spots getting into the low 80s today and tomorrow looks cooler before temperatures start to rebound as we get back to the workweek. right now, satellite deal, not much happening. off to the north a system here which is going to pump up the on shore winds tomorrow and with the low clouds in place and sea breeze sticking around all day long, even with the sunshine inland, not what you expect for this time of year. no 90s to near 100.

persistent sea breeze. a strong ridge of high pressure that stopped the sea breeze things would be tough. no possibility of that happening today. >> thanks, rob. this morning, speaking of weather, hurricane warning in effect for the florida keys south miami-dade and parts of the gulf coast as tropical storm isaac approaches cuba. the storm largely was -- spared haiti. nbc's mark barger joins us from port-au-prince. >> reporter: it's raining in port-au-prince but calmed down considerably since last night. when the center of tropical storm isaac crossed the southwest peninsula here, many miles from this area, there were still gusty wins and strong rains here in the capital. this morning, when the sun comes up, workers will be going out to make assessments. what they're expecting to find in that peninsula area, the southern claw, is extensive flooding in cities such as jeremy, jacmel.

the biggest concern for 400,000 people living in tens here after the earthquake 2 1/2 years ago. yesterday aid workers went through the camps trying to locate most vulnerable, sick, elderly, pregnant woman to move them into schools and into other buildings. the haitian government, however, has admitted there are few shelters in the country relatively few, for a country of 10 million people. most people had to ride out the storm wherever they were. there's also a fear for people who are living in the mountainside areas, in the shanty towns look one behind me here where they could be quite vulnerable to mudslides and flash flidiooding. we'll know more later today when we get out to see how people fared. >> isaac is not expecting to become a hurricane until monday, when it reach the gulf of mexico and threatens the u.s. possibly including tampa, florida, where the republican national convention will just be getting started.

bay area athletes made us plenty proud in the london olympics adding to gold medal count, women's water polo team. jessica steffans joins us with nutritionist arianna. we want to say thank you for letting us touch and handle your medal in the newsroom, like kids. what's it like? it's not the first olympic medal that you've won. what was it like to win gold? >> this medal is so special. we've been working for this not just the last four years but there's girls on the team that it's their fourth olympics. we wanted to really bring home the gold for them. >> in our household i have a 4-year-old and a 6-year-old and we talk a lot about sister power. you really have sister power. sister maggie on the team as well. >> yeah. that was i mean that was amazing. i'm sure any sibling can say you

fight, but you also love each other so much and there's just -- that was amazing to be able to play together in the olympic stage. >> we saw a video of, i think the men's water polo -- actually the women's and men's. what happens under the water you're moving constantly. constantly treading water and moving around and maneuvering. so i mean there has to be something to not just training but to how you fuel your body as well to keep that up. >> yeah. we are moving all the time. we hate to run but i'll tell you that being on land is easier than being in the water. so we are, you know, always snacking, always eating, trying to stay fueled for practice. >> right. you know right after the gymn t dabby douglas -- gabby douglas splurged and had a mcfufen.
