jon kelley. >> i'm laura garcia-cannon. new this morning a man is dead following an overnight police chase through the east bay. police ended up shooting him on the roof of the house. he was hiding on. it happened around 3:00 this morning in antioch. another twist as well. christie smith is live in antioch to tell us what officers found in his car. good morning. >> reporter: good morning. well, they found a child but i'll get to that in a minute. can you imagine being inside your home and then hearing gun fire and realizing that is coming from your own roof. that's what happened here overnight. in what started as a domestic dispute call turns out that suspect ended up shot and killed up on that rooftop. but the trail started across town. antioch police called on a

domestic dispute. the the man was fleeing with a gun. police say they tried to stop him but he rammed two patrol cars, crashed and jumped out. throughout this whole time there was a toddler inside that car. the man jumped onto a rooftop and inside they heard the gun fire. >> on top of my roof and like -- like a clapping. it was boom, boom, boom. >> reporter: it was a chp helicopter that spotted the man on the rooftop near a chimney. what he did was pointed a gun at officer who is opened fire. he died on the roof. i speak with one officer who tells me that toddler is safe at this hour and the contra costa

county's district attorney's office is is investigating this shooting. i also spoke with an officer. several streets will be shut throughout the morning and perhaps midday. reporting live, christie smith, "today in the bay." >> 6:03. the man who will be san francisco's catholic archbishop has a date with a judge. the archbishop elect was arrested at a dui check point saturday night. he was driving with his mother when he was pulled over. he is current think bishop of oakland and was appointed to archbishop. father says as soon as the archbishop needs support. >> this is a moment of understanding and a moment of compassion, you know, and i think that they would certainly give, you know, the benefit of the doubt. >> late yesterday the bishop

released a statement apologizing for his error in judgment. he is set to be sworn in on october 4th and in court october 9th. >> the fbi is hoping a death row inmate will lead them to victims of a violent crime spee. wesley shermantine led agents on sunday to several locations in linden which is just east of stockton. he claims he and childhood friend buried victim there is. investigators searched four locations. shermantine was sent to death row. most of the charges against her zag were dropped. he committed suicide before shermantine tipped off investigators about the location of several of their victims. >> turning deadly for a second cam amor who contracted the

hantavirus. there are three cases with two deadly. a fourth potential case is being investigated. the virus is spread by rodents. all four people have stayed at curry village. park officials want visitors to be aware of the symptoms especially those who have stayed in tent cabins from mid june flew the end of august. symptoms include fever, aches, disiness and chills. it can take weeks for symptoms to surface. >> the republican national convention will move forward now that isaac is west of tampa, florida. the convention is being compressed into three days after yesterday's postponement. chris christie took time yesterday to take shots at california governor brown, calling brown a retread that is not helping california's economy. mitt romney's wife ann will also

take the stage tonight. more on the convention. >> for the latest on tropical storm isaac. we've got a live look at the storm on radar coming up. the storm still over the gulf of mexico but it is inching closer to the gulf coast, moving about with 12 miles an hour. the storm is expected to make landfall sometime tonight. now bracing for the approach of isaac. that's where danielle lee is right now. good morning. >> good morning. in the last minutes that we are now starting to get rained on here so estarted off feeling the winds, seeing the clouds move by quicker and quicker. all signs that the runt of isaac is on the way. many businesses if you walk with me along canal street didn't

7:00. and for updates you can always log on to our website nbcbayarea.com. >> our meteorologist christina loren knows a lot about hurricanes and tropical storms, what is the latest from your perspective? >> well, i'm watching this eye because whenever the eye becomes more clear you can see the ocean, that's what we're talking about. if we head through the next couple of hours we get the next advisory from the hurricane center. at 8:00 a.m. we'll be able to tell you whether or not his plain thins. the tightest winds are here around the center of that storm. we talk about landfall where the eye comes on shore so. let's set this in motion and talk about what we are expecting when it comes to the next 12-24 hours and isaac. it looks like as we head through the next six hours isaac will intensify to a hurricane when

the national hurricane center is saying right now. but then it looks like it's going to show down. that means louisiana and new orleans, yeah, we're concentrated could be experiencing hurricane force winds, as we head throughout 24 to 48 hours, so the damage is hard to gauge. here in our own neck of the wids, another story to tell. a day in the 50s, 60s, 61 in san jose. headed toward a comfortable afternoon. 89 degrees at 4:00 and 74 bay side and 63 at the coast. help you make those weekend plans. it is the final within of summer for many but we're noticing already a lot of kids out on the roads with their parents. how do they look? >> probably looking tired. that's the way i would head to school. hillsborough starting their school year so we're looking to

scheduled to be sworn in october 4. >> bay area drivers issued tickets from red light cameras may be able to fight them like never before. new legislation passed that changes the rules for red light cameras across the state and it's the drivers who will benefit. arturo santiago is live in fremont with a look at the legislation and what it means to commuters. good morning. >> reporter: good morning, and there are a number of facets to this bill. it tries to make sure that municipalities are not using these as a way to make money and to make sure that they are only used to improve public safety. also it makes it easier for drivers to challenge a ticket. sometimes you don't even know that the cameras are at an intersection until you get a citation in the mail. the state legislature does have its eyes on these cameras, one state senator introduced the bill that would require locations for cameras to be chosen using only safety

consideration. the cameras would be prohibited from being used as a tool for revenue and the cities and counties would have to follow one set of standards and mandatory to put up signs that let drivers know the cameras are around and in use. the legislation would set up an easier process for drivers to overturn citations that are handed out if they think they are lawfully given. the governor has until november 30 to act. he has veto add similar version of this last year because he wanted local government to take the lead in overseeing these cameras. live in fremont, arturo santiago, "today in the bay." >> 6:16. car companies say no to politicians eager to use their factories as a backdrop. >> scott mcgrew says you won't see president obama making a chevy visit. >> car companies set their factories will remain neutral in this fight. remember, the election battle probably will come down to a few

states home to lots of car companies, places like michigan and ohio. money magazine reporting that gm and chrysler both of which took bailout money, do not want to serve as backdrops for the presidential election. they will forbid both candidates from visiting or using the property as a backdrop in campaign ads. the faa says it will look at airline policies prohibiting gadget use during take-off and landing. we probably won't hear any decision until late spring and cell phones will still be forbidden. you have heard the announcement, anything with an off button has to be turned off. the problem isn't that an ipad is going to throw the plane off course, lots of pilots use ipads but there are so many gadgets with so many coming out all the time airlines created a blanket policy. you remember the new social

network for people who thought facebook took too many liberties. quite the rage in the media. the organizers of the project calling it quits. the website will stay up but they won't be working on it. google has struggled to make google plus relevant and is worth $200 million you can see their problem. wall street, we expect a quiet day. on the nasdaq yesterday, the least amount of trading all year. very calm for the end of august. >> a lot of traders on vacation. >> spending that money. meteorologist christina loren, looking at our local forecast but also keeping your eye on si isaac. >> happy to report this is the first day without flight delays that the hour out of sfo courtesy of a mostly clear start. if you're not around your television you might want to walk in just to peek at what awaits you.

a gorgeous start. you can clearly see the bay. this is from high atop san bruno mountain. you can see for miles. we expect low clouds to start to develop and push inland. that almost looks like a painting. a beautiful sun rise. your sun sets at 7:45. our days are shorter. 50 in santa rosa, 61 in san jose. as you head throughout day we have comfortable conditions ahead. first, i want to look at your morning drive. mike inouye is standing by. additional traffic out there, you notice more volume because of schools? >> we're going to show you this flow because we have a couple of incidents that we're clearing from the toll mass. i marked there is a fender-bender going on. that in addition to looked like a mechanical issue on the approach. down the berkeley curve. we had an issue, and now the

fender-bender which moved to the soulder. but both can com pine a couple of distractions. see how things are shaping up. you see all of these lanes are filling in now that is because of the metering lights have been turned on. you have a flurry of activity they thurn those on to be sure. the 880 overcrossing, no big surprises other than it's pretty smooth. we'll get a look down toward the peninsula and on the peninsula, northbound 101 moves sleuthly past university avenue. look at this, the crews arriving, you see a lot of activity and slowing as folks pass. but that's off to the right shoulder. another live look. how things are shaping up. north through san jose, here 101 and sorts itself out.

580 continues with slower drive toward livermore. >> thanks so much. 6:21. a kidnapping suspect sin custody after a 6-year-old girl's mother and neighbor chased him down. >> he put his hand over my mouth and my mom came down and he runned it. >> he runned it all right. this happened sunday in portland, oregon. the girl hit the guy with a stick but he ran. neighbors saw and they gave chase. >> i look out the window and there are all of these girls chasing this spanish guy. so we walked out here. and there was cars trying to run him over. >> neighbors caught up with the suspect. even the mother was seen kicking him on the video. the 17-year-old in juvenile hall. >> we're going live to tampa for a preview of tonight's kickoff to the national convention.

of the stage. if you are looking at a camera over the audience, over from the stage. but tonight in addition to the entertainment, we're also going to be hearing from ann romney for the first time. this is really part of an effort by the gop to focus on mitt romney as a person. mitt romney as a dad, mitt romney as a husband, an employer and a friend. these are some of the things you're going to be hearing. they are trying to make sure that they can connect with the average american. the other speech tonight originally the key note speech ending tuesday is going to be new jersey governor chris christie. he will talk not only about what he thinks new jersey has done but also what he thinks mitt romney and paul ryan can do to change the direction of the country. >> interesting to see how they really condense it down because of tropical storm isaac. thank you. >> i know you are tracking tropical storm isaac for us. >> i certainly am.

and right now i can tell you it's getting a lot more active out in new orleans. you'll notice that from the live pictures when we bring those. 80 today in san jose, 89 livermore, 68 in san francisco. i wanted to show you your seven-day outlook. for us on the west coast especially northern california we're getting spoiled. it could be much warmer this time of year. we're talking the low 90s through thursday and the upper 70s on friday. here is mike and your morning drive. >> you know it's more clouded out this. look at this, the slower drive south of fremont boulevard. good volume down in toward the lower 60s and upper 50s as you travel south of the dumbarton bridge. a live look shows you the bay bridge where the backup continues to build. we see movement, that's good news. slow back from at the end of the parking lot to the toll plaza and a little fender bender has moved to the shoulder. the northbound continues south bound just building around the

>> good morning. just about 6:30. i'm marla tellez in for jon kelley. >> i'm laura garcia-cannon. a man is dead this morning after a bizarre police chase that ended with a man shot to death on a stranger's roof. it happened around 3:00 this morning in antioch. that is where christie smith joins us. >> reporter: good morning. it is strange and neighbors are starting to wake up this morning seeing all of this outside their front door wondering what is going on. some told us that they heard helicopters flying overhead and heard gun fire. it was an officer-involved shooting of a man who made it up to a rooftop of one of the neighbors here and that man was shot and killed up on that roof. in what started as a domestic dispute call around 11:15 last night and a pursuit with a toddler along for the ride. it started on sycamore across 4 and police say a man left a home

and had a gun, hopped in a car and refused to stop. they say he rammed two patrol cars, then crashed, got out and started hopping fences, climbed up on a roof. >> sounded like clapping, boom, boom, boom. there was like put the gun down. i'm like -- going to start shooting. >> that man was spot upd on a rooftop by a chp helicopter. police say the man had a gun up there and pointed it at officers, they fired, hitting him once. i spoke with one officer who assures us that the toddler is safe at this hour. the district attorney's office is investigating which is customary in officer-involved shootings. christie smith, "today in the bay." >> now for the latest on tropical storm isaac. we are expecting it to become a

hurricane any time this morning. >> check in with meteorologist christina loren, she's tracking the latest on where that storm is now and when it is expected to make landfall. how's that eye? >> oh, well, laura and marla, right now we are watching the eye and also checking the buoys out there in the gulf. what i can tell you is the buoy clocked a wind speed at 72 so it does look like tropical storm isaac is gaining strength. we'll get the official update from the national hurricane center at 8:00 a.m., finding out whether or not it has intensified to a category 1 storm. i want to point out the future track and intensity when it comes to isaac. it's got winds of 70 miles per hour, those are right around the eye where the strongest winds circulate. as we head through the next 24 hours it's going to get dicey. look at that cone. there is an east side, west side and down the middle. that's the projected path down the middle where the national hurricane center says isaac will make landfall. to the east and west a lot of

uncertainty. it could make landfall off of mississippi coastline or closer to the louisiana/texas border. there is uncertainty. we'll keep watching it. we expect isaac to slow down and that is where the major damage could come into play. we'll have a look at your local forecast in a few minutes. right now back to you. >> thanks. >> red cross volunteers from the bay area are in the gulf region this morning. the silicon valley chapter sent a second wave of volunteers yesterday, prepared to run shelters, arrange food donations and provide counseling and emotional support if necessary. >> i'm being deployed for a specialty, we deliver dry goods to the folks after the storm has hit and passed. everything from cleanup kits to diapers. whatever they need. >> ahead of isaac's arrival,

president obama has declared a state of emergency in louisiana, freeing up federal money for emergency services. >> the man who will be san francisco's roman catholic archbishop has a date with a judge less than a week before he is to be sworn in. he was arrested at his dui check point saturday night in san diego. he was driving with his mother when he was pulled over. he is currently the bishop of oakland and appointed by pope benedict to be archbishop of san francisco. he released a statement apologizing and expressing shame. he is scheduled to be sworn in as archbishop of san francisco on october 4. >> 6:34 a. judge is barring oakland's police union from participating in meetings related to the probe of the police department. the squ says theianion has no

right to participate in the proceedings regarding court ordered reforms. the union's attorney says officers want a lois in the reforms. if it fails to fully implement the reforms which were supposed to be completed four years ago. >> former oakland police chief anthony bass is getting a new job in baltimore. our nbc station in baltimore confirms bass will be named the new police commissioner. he left last fall after major cuts to the police force and butting heads over reforms. >> the rules of the road are changing when it comes to red light cameras. new legislation makes it easier to fight those tickets in court. that's not all. arthur ro santiago.

>> this morning we're at the intersection of mission and warm springs boulevard. and they have red light cameras in every direction here at this intersection. the goal of this legislation is make sure these improve safety and are not being used as a way to make money. it would make it easier for drivers who do get tickets to challenge that. the bill would require that locations for red light cameras be chosen using only considerations for safety. it would prohibit municipalities using them for raising revenue and when it comes to where the cameras are placed, cities and counties would be required to follow a standard set of rules and mandate putting up signs that let drivers know the cameras are around and in use. there is also a provision that would set up a smoother process to over to turn a wrongful citation. >> shouldn't be up to anybody who wants to put a camera out

there to try to give you a ticket. >> there is some opposition to the bill because it would allow information that's collected by the cameras to be admissible in a court. the bill did pass the state senate 34-0. the governor does have the bill. he has until september 30 to act on it. arturo santiago, "today in the bay." >> thank you. >> we've been looking at stunner shots from our live cameras. let's check the forecast. >> i feel a little guilty as we're tracking isaac. this is what we're waking up to this morning. and the entire state of california is going to get spoiled today. we told you the low clouds would roll in. you can see that is the case. between the hours of about 7:00 and 9:00 we'll get mostly cloudy. the clouds last over the bay and the coast until about noon. for the first day you don't have

flight delays out of sfo. 50 in sunnyvale an 61 in san jose. your hour by hour forecast, looks like this. about 78 degrees at noon. a little too hot for outdoor activities. about 89 in the heat of the day. 74 bay side, 63 at the coast. that is pacifica. santa cruz, comfort there. you know what, let's find out how you are on the roads. a lot of congestion out there? >> you know, let's say you should get comfortable because things are starting to slow down. we'll look to the roads, give you a preview. note if you are using 237, this will be the issue. a commute west bound. we have an accident blocking a lane and is a distraction. that's adding to the slowdown into milpitas. northbound 101 north of 680, a live look. see that at the intersection the

>> it's 6:45. we're tracking tropical storm isaac over the gulf of mexico this morning. >> the national hurricane center will update us on the storm in about an hour but this is the live look at that radar. you can see the storm inches closer to the gulf coast. isaac moving about 12 miles an hour. storm surge already pushing water over the banks of lake pontchartrain in new orleans. isaac could abcategory 1 hurricane by the time it makes landfall tonight. people in new orleans say they are going to stand their ground. >> going to stick it out. we have the sandbags that may

help. >> there are some who say they are happy to see isaac. people in the mississippi river valley north of the gulf coast welcome the rain. parts of arkansas, missouri and illinois hope to get two to six inches of rain. not enough to end the summer drought, however, but it's much needed. one arkansas rancher says his area is short 17 inches of rain this year. >> and no foreseeable rain in our local forecast. yus gorgeous conditions today. >> really nice. the one difference between yesterday and today, the winds will be stronger especially at the coast so you want to account for that if you're headed to the beach. a lot of kids headed back to school after this upcoming holiday weekend so. yeah, it might be your last hurrah. ladies, we're getting down to the last couple weeks you can wear your sundresses, tank tops, you know what i'm talking about. take advantage of that. this is a live look starting here san jose.

beautiful conditions, starting to see low clouds, though, creep over the mountains. we'll see partly cloudy conditions to start throughout the east bay and the south bay valleys. this is a live look at san francisco overlooking the city from high atop san bruno mountain. the atmosphere is getting mixed up by winds, that's preventing the thick fog but we have low clouds especially at the coast. that will be the case until about noon. comfortable conditions on a tuesday morning. you want to hit the beach today you're going to get really, really great conditions in terms of sunshine. we stop the clock at noon, mostly clear over the greater bay area but we want to threat run until tonight starting at noon. look at that, no clouds to talk about, all the way through probably 6:00 a.m. tomorrow morning. that's when the low clouds redevelop so a great night for checking out the star that's what you're into. i know mike inouye is. 80 in san jose, 86 degrees in

there are a number in this bill. the cameras are not used as a way to raise revenue and only as a way to improve public safety. it also makes it easier to challenge a kikt. you a you are -- it was introduced that would require locations for cameras to be chosen using only safety consideration. again it would be prohibited to use the cameras as a tool for revenue. the cities and counties would have to follow one set of standards and would be mandatory to put up signs that let drivers know that the cameras are around and in use. the legislation would also set up a an easier process for drivers to overturn wrongful citations. the governor has until september 30 to act. last year he rejected a similar bail. he wanted local government to take the lead in overseeing
