are headlights coming towards us. not a lot in the southbound direction it's because it is so early right now. again, as you head through the morning 101 southbound one lane right now. jon, marla. >> thank you. there was a lot of empathy but not a lot of action, that's the take away from last night's neighborhood meeting with foster city's police chief who came to hear complaints from nervous residents upset a teen suspected of burglarizing homes and assaulting a neighbor is home and down the street. george kiriyama was at the meeting. >> reporter: in front of the neighborhood watch sign. >> your safety. >> reporter: a neighborhood came together. concerned, frustrated, a little scared and asking the city's police chief for answers. >> folks' home is their sanctuary. it is the place on earth where we should all feel secure. and the fact that somebody entered while people were home made it that much more serious. >> reporter: police say that

somebody is this man, 18-year-old justin shing, he is accused of breaking into two homes in the past weeks and one of them police say he entered a bedroom and touched a girl while performing a sexual act on himself. shing faces sexual assault and burglary charges. >> watching out for each other and for our kids, i think, we can do lot to protect ourselves and also to let him know and his family know that we're not going to put up with that. >> reporter: shing is out on bail and at home. literally less than a block from the homes police say he victimized. parents are outraged he is back. the chief says he understands why they are upset. >> the frustrations that we feel in law enforcement sometimes are reflect what you folks are probably feeling now but that's the way that the system is. >> reporter: in the meantime, neighbors are keeping a close eye on shing's every move. >> i have got an lot of text messages, he's outs, with his dog. we know where he is. >> police say they will pass by

shing's home as often as they can. >> we'll make passing checks. >> reporter: george kiriyama "today in the bay." >> 4:34. people heading to yosemite for the long weekend have more than bears to worry about. the number of hantavirus cases linked to the park increased to six. park officials have now indefinitely closed almost 100 signature tent cabins in curry village. officials believe campers were in the cabins when they were exposed to the virus. in the past weeks two people have died from the disease and f four others recovering. >> san jose firefighter is hospitalized after suffering a heart attack while fighting a fire. frank ryan remains in critical but stable condition right now. he was at the fire yesterday when he collapsed. his fellow firefighters jumped into action and saved his life. registered nurse drake who works in the dard ycardiac unit says

lucky people knew how to start his heart. >> the artery stopped the rhythm. that's what we call sudden death. if not restored we can lose the patient. >> good news, nobody else was hurt during the fire. investigators right now still examining the site for the cause of the blaze. >> in a couple hours from now a south bay school damaged by a massive fire will once again reopen. trace elementary school will hold a grand reopening of sorts for its new campus building. the structure replaces the school's original main building which was destroyed during an arson fire back in 2010. two teens were found guilty of starting that fire which caused more than $10 million in damage. teachers and students used portable classrooms while the new building was constructed. >> police are teaming up to identify a woman whose body was found stuffed in a trash can three months ago.

police released this sketch of the victim in june but so far it has not generated leads. federal investigators are searching data bases and finger prints and dna to try to identify her. dental records are being examined. the woman is likely in her 20s and either asian or hispanic. her death is being investigated as a homicide but so far no cause of death has been determined because the body was just so badly decomposed. >> a superior court judge ruled against a defense motion to exclude some of the evidence against the woman accused of killing a nursing student, michelle le. they claim statements about where she was the night le disappeared in may of 2011 were gathered during an illegal search. the judge ruled the officer's conduct was justified. the trial is expected to begin september 17th, one year after le's body was found. >> moving to decision 2012, mitt

romney back out on the road today campaigning on his first day as the official republican candidate for president. the final night of the republican national convention was full of scathing attacks on president obama, romney telling that the obama administration failed and he's got a plan to fix the country. he hit on all of the big issues, schools, foreign policy, the national debt, jobs and taxes. as he made his case to connect with the middle class. >> president obama promised to begin to slow the rise of the ocean oceans, and to heal the planet. my promise is to help you and your family. >> romney and paul ryan now head back out on the campaign trail with a stop today in virginia. of course it was mitt romney's night last night, a surprise speech by that man, clint eastwood people are talking about this morning, the award

winning director's speech, let's say it was unscripted. some say disjointed. even used an empty point to conduct his mock interview with president obama. criticizing the unemployment rate and the timeline for bringing soldiers home from afghanistan. >> i think mr. romney asked the only sensible question, he said why are you giving the date out now. why don't you bring them home tomorrow morning? i thought yeah, there's -- i'm not going to shut up. it's my turn. so anyway. >> nobody tells dirty harry to shut up. last night the romney campaign issued a statement describing eastwood's ad libbing as, quote a break from all of the political speeches. >> president obama's campaign responded to eastwood's empty chair interview tweeting this picture of the president in a chair with the caption, quote, this seat taken.

patents. the jury in that case awarded apple more than $1 billion in damages. >> after being grilled over policy of rounding up the total on customer bills this morning mexican chain chipotle will only round down. they had been rounding up or down to the nearest nickel to try to save time and only in some high volume restaurants. but that policy was never posted. when it was exposed in a report consumers complained. the company now says it will only round down and do that in customers' favor. >> a new iphone is set to hit the market but this morning we're learning there could be problems before it rolls off the assembly line. we turn to kayla tausche. good morning. >> good morning. there's always a story with apple but we're going to start with the stock futures, higher after stocks fell sharply thursday, the dow lost its gains for the month of august and the

nasdaq had its worst day 18 month on investor jitters over europe and ahead of a key speech by ben bernanke later this morning. he's expected to acknowledge that the fed is ready to take action to stimulate this economy but may not offer many more clues ahead of the fed's next meeting in a few weeks. data today on manufacturing, consumer sentiment and factory orders with the dow dropping. the nasdaq losing 32 to 3048. apple is reportedly set to unveil the new iphone 5 in about two weeks but there may be issues getting it to stores. reports say sharp has yet to produce the screens snapping a potential supply problem. sharp is one of three asian suppliers that will make the screens for the iphone 5. everyone wants this so hopefully they can get it rolled out. >> kay la, thanks so much. >> great christmas gifts. >> one question, where is your red jacket? >> at the cleaners.

red velvet so i have to take care of it. correct me if i'm wrong it's friday. >> it is. and that's a little red riding hood, we want to make sure you get that cloak picked up from the cleaners. good morning, you might need to cloak yourself with a jacket if you're waking up with us, in san francisco it's chilly at 58 degrees, which is really no different than yesterday morning at this time but what i can tell you the thick clouds are going to prevent the sunshine from coming in so you're holding on to the 50s in san francisco. probably until about noon, maybe 1:00 p.m. today. and i'm only forecasting a high in the city of about 60 degrees so a stark contrast between yesterday's temperatures and what we expect today. it all works like this. high pressure is taking a hike for a couple of days, though, move to the south, area of low pressure ushers in the strong onshore flow. it's going to be kind of ugly, gray for the first part of the day. our temperatures will be much cooler inland. you'll not need to use your ac if you can take 79 degrees today. in places like livermore, a

travel day, a lot of people trying to get out of town for the holiday weekend and we are expecting delays out of sfo at about one hour. we should start to get those at 6:00 a.m. what i can tell you they are not reporting flight delays. temperatures look like this. 77 in concord, perfection out there. and 75 degrees right here in san jose. as we head throughout the next couple days we do get changes, a little bit of thunder is possible. keep that in mind if you're camping tonight. especially if you're going to be headed up to sierra nevada at the lake tahoe area, that's where we expect some of that thund sore keep that in mind. through saturday, sunday, the wind picks up. our temperatures in the 80s on saturday, the 90s return on sunday. rough seas but conditions perfect on the santa cruz, about 74 degrees on sunday. we'll have more updates coming up, which beaches will be the

best this weekend. >> thank you. there is a bill aimed at cracking down on underage drinking on party buses and it's now on the way to governor brown's desk. the the california state assembly approving the bill which was written by peninsula assemblyman jerry hill. the bill would make party bus operators responsible for underage drinking in their vehicles. hill authorized the legislation after a burlingame teen was killed in 2010 when he crashed on a party bus.ours of drinking hill says the need for the legislation was heightened when a 25-year-old girl died after falling out of a party bus while fighting with a 20-year-old young woman. both had been drinking at the time. >> also, going to governor brown's desk the much talked about bill to give nannies, house keepers and care givers added benefits, it would allow overtime, breaks and other state labor protections. opponents say it's needed to protect domestic workers against
