>> and giving awe live look, this is the san jose, that's hp pavilion on this friday, august 31, this is "today in the bay." >> it is 6:00 straight up in the morning. and final day of august. i can't believe the month is over. good morning. i'm jon kelley. >> i'm marla tellez in for laura garcia-cannon. we begin with breaking news out of new jersey. three people are dead including the gunman after an early morning shooting at a grocery store. the shooting happened at 4:00 a.m. in the town of old bridge, just about 25 miles out of new york city. the store was closed at the time. early reports say the gunman was a current or former employee wearing body armor at the time of the shooting. we'll bring you more details as they become available. >> new this morning, two years of construction goes on display 18 few hours from now.

san jose's trace elementary school opening up doors to show off brand new classrooms for if first time since a fire left the school damaged. bob redell is live in the south bay with a look at this morning's grand ceremony. good morning, bob. >> reporter: good morning. yes, out of the temporary classrooms into this beautiful new building, students who have been attending school at trace elementary for the past two years no longer have to see the construction nor the scars of the fire that took place two years ago. that was a fire that destroyed a good chunk of this school. it was a 5-alarm fire, it gutted a couple of buildings, causing $10 million of damage. since it happened july 5th of 2010 the fire department thought it might have been started by fourth of july fireworks but soon realized that was not the case, it was arson. two teen boys were arrested. both did confess to police and

at least one of them is serving time in prison. there's going to be a ribbon cutting with the school, talking about students, parents, teachers from the school district are expected to be here. around 1200 people, going to make this quite a ceremony, a ribbon cutting and speeches, in a few hours from now around 8:30 this morning. reporting live, bob redell, "today in the bay." >> this morning we're telling you about the san jose firefighter who collapsed from a heart attack while fighting a fire at st. patrick's cathedral. he is recovering in the hospital. frank ryan is in critical but stable condition. he was at the fire when suddenly he collapsed. his fellow firefighters were there to save his life. a registered nurse says he's lucky he was surrounded by people who knew how to restart his heart. >> the artery at this patient was blocked and it stopped the

rhythm, that is what we call sudden death and if it's not restored in moments you can lose the patient forever. >> a lucky man there. nobody else was hurt in the fire. investigators still examining the site to figure out the cause of the blaze. >> a developing story this morning, overnight a japanese court delivered its ruling in the patent fight between apple and samsung. scott mcgrew is here with all of the details. >> good morning. samsung won this, one of nine big cases that apple and samsung have been fighting around the world. in this case a judge decided samsung phones did not violate apple's patents with the way it syncs music and pictures. this is a different battle than in san jose federal court but the same war. though samsung is the top seller of iphones or phones in the world, it doesn't sell many phones in japan so it's not a

huge ruling but let's look at the scoreboard. apple with a win in the united states. it's won in germany as well. it gets japan in its first ruling. there are still trials in italy, france and the uk and future rounds in japan. courts take a look at each issue one at a time. coming up we'll hear from the foreman in the american version of this billion-dollar case who says not only did he not want to be foreman. he didn't expect to be picked. >> suddenly seems like more of a supporting event. thank you. the move to decision 2012. mitt romney hits the trail as the official republican nominee for president. >> and he accepted the nomination, last night the convention in tampa, he told voters the obama administration has failed but says he's got a plan to fix the country. >> you know there is something wrong with the kind of job you've done as president when the best feeling you had was the

now a tropical depression and will move over southern missouri later today. they need rain out there. at least three deaths are linked to the storm. more than 820,000 people still without power. >> not a pleasant holiday weekend. here in the bay area we are treated to a different story. let's check the forecast. >> good morning to you. i want to start with this live picture of san francisco. this is causing us flight delays out of sfo bat an hour and the fog is so thick we might be dealing with those delays possibly until noon. it's just as cloudy in san jose this morning. the marine layer penetrated inland so you're waking up with a full deck of clouds, in the 50s to start. a crisp way to start out friday, just before a holiday weekend. we'll see the thick low clouds, 10 to 15 degrees dropoff. from the 90s to the 70s inlarnd.

a little bit warmer but not by much. downright hot as we head through sunday and monday. temperatures swinging back in the up direction as we head throughout the weekend. we'll have that number coming up, help you make your plans, depending on what the temperature is in your city that's going to dictate. head to the beach or the mountains, maybe some camping. 6:07 first i want to check on your drive. a lot of people trying to get out of town. >> we have an accident right around san francisco airport. on 101 northbound at the off ramp there is a car on its roof. so the ambulance is trying to get to that. if you use that route keep in mind that it's going to be a slow go trying to get out of town in that location. another area of concern is 880 northbound and southbound, debris in the roadway here, so that's causing slowdowns. just got off the phone with chp, it's still there, working on it. in the east bay, 580 and the

alta mont pass, two accidents there. one at doherty road an also in almost as i mentioned that one is at dreamville avenue off ramp. if you're an early commuter take it easy. things are getting going. >> he knows he has won millions but not come forward yet to claim his prize. this video here of a man buying the $52 million winning mega millions ticket in fremont last month. he has physically checked his ticket several times at bay area stores but for some reason he has yet to claim the money. we talked to the cash year who sold him this ticket. >> yeah i know him. he used to come almost every week. he has a year from the date of the draw to claim the prize or lose that money.

school seriously damaged. >> samsung winning the latest round of the pa tent battle against apple. a japanese court rejeking the claim. a three-judge panel awarding legal costs to samsung, last week a u.s. court did award apple more than $1 billion in damages. >> 6:13. fallout from isaac is making its way to the pump when millions are hitting the road for a long holiday weekend. christie smith is live in hayward with a look at how drivers in the bay area are dealing with the jump in the gas prices. christie, they don't seem to mind or at least they say they can't do anything about it, right? >> reporter: yeah, that's what they tell us. $4.19 a gallon for regular here and $4.17 across the street, filling up is expensive especially if you think of driving this weekend. one of the pumps, $90. another $150. the average in california now

$4.15 a gallon. that according to aaa. on wednesday alone the national average jumped 2 cents in one day alone. the number of reasons for this including concern over hurricane isaac impacting refineries. aaa is saying that more people are expected to drive this labor day weekend up 3% from last year. i spoke with one driver who told me that it's not a good thing but you actually get used to paying this much. >> you got to get around. there are more cars and people on the road. you can raise to the 5.19 and it's not going to change. >> you think so? >> i think so. >> reporter: i thought this was interesting. even with what people tell us they say that they would consider going somewhere but right now they don't have any big plans to leave. reporting live in oakland, christie smith, "today in the bay." >> a lot of people filling up the tanks and heading to

yosemite for the long weekend but greeted with bad news when they get there. the number of hantavirus cases linked to the park has now increased to six. park officials closing nearly 100 cabins in the curry village. officials believe campers were staying in the cabins when they were exposed to the virus through deer mouse droppings. two people have died from the disease, four others are now recovering. >> new this morning, germany's national airline is canceling hundreds of flights, a strike by its cabin crew is grounding these flights. thousands are stranded. flights to and from the u.s. are affected but none in and out of sfo. >> to the ball yard, the giants kick off a series in the windy city. that game against the cubs starts at 11:20 at wrigley field this morning. the giants picked up a sweep in houston. they won in the seventh inning. giant goes on to win the ball game 8-4.

>> pet a who ma's little league all stars get the a's started tonight. the oakland a's will honor the petaluma little league team which finished third in the little league series. there will be a special pregame ceremony at the coliseum tonight. the a's helped raise money for the petaluma team to travel to pennsylvania to compete in the world series. >> ready for football, the raiders wrapping up the preseason schedule in seattle last night. the seahawks honored marty malloy and others before that football game. silver and black, not looking too good on the field. fourth quarter, terrelle pryor sack bid bruce irvin and later on the radars trying to run -- that's a touchdown by seattle. raiders lose 21-3. the raiders hit the field september 10 to kick off the season on monday night.

have you? you'll want to know, trying to make plans for you and your family. we've got an interesting forecast. it's really going to dictate what you want to do as we head through saturday, sunday, monday, things will be different each day. so we'll get to that. i want to start with what's happening now. the flight delays at one hour out of sfo and the only other major airport reporting delays is philly. about a half hour delay right now. that's just due to the volume out there. a lot of people heading out of town. sfo, we have delays there, no delays reported out of san jose. we'll let you know when that changes if it does. it's just as cloudy in san jose as it is in the city this morning. the low clouds will continue to lower as we head through about 8:00 a.m. temps are comfortable to start, pretty uniform for the time being. they will separate as they typically do. 56 in fairfield, 57 in oakland, 57 degrees in san francisco. we have real time flight delays

to report out of sfo at one hour f. you true i to get into the airport, anthony let me know they have a couple of accidents at the airport as you try to get in so we'll get an update. you might need those delays with the accidents. it's going to be jam-packed. flout the week temperatures are going to stay pretty comfortable as we head throughout the afternoon. 79 is not too bad. probably not need the ac in livermore. you have it cranking by the weekend's end. sunday, 98 from 78 today to 98 on sunday. monday, about as warm, 97 degrees, the heat is on. and we're going to see rough seas so it's not a great weekend to hit the boat. a lot of wind expected. if you want to hit the beach should be phenomenal. 75 degrees at the beach. i'm talking half moon bay come monday. let's get that update on the accidents. see what else is happening on a getaway friday. >> you said earlier we have two

accidents, 101 northbound right at the airport. san francisco looks like the north access off ramp there is completely blocked due to debris in the highway and then another accident, the east millbrae avenue off ramp, a car is on its roof. if you're trying to get into the airport you want to allow extra time. not only for your commute now but also for those foggy delays. also on the altamont pass, 580 into the bay, you can see slowdowns, one in livermore and one in çdublin. there is also a stall on the shoulder, 880 north, right around san jose's airport. those are going to be packed. just allow lots of time on your friday. >> thank you so much. >> apple has said no to an app which keeps track of drone strikes. >> scott says the developers are confused why. >> yes. apple shies away from overtly political apps and controversy but in this case this app called

undersea quake hit off the shore of the eastern philippines. we'll update you on this breaking story as soon as we can. to give you good perspective here the famous 1906 earthquake that hit in san francisco, that was also a 7.9 quake. >> moving to other news right now, today marks 15 years since the death of princess diana. you recall a car crash in a paris tunnel killed diana on august 31 back in 1997. she was only 36 years old. still remembered for all of her hard work with dozens of charities and her support of the international campaign to ban land mines. >> the pentagon informed a former navy seal it's considering legal action against him. the former seal is the author of this new book detailing the raid that killed osama bin laden last year. the pentagon says the author violated agreements to not reveal military secrets. the book goes on sale tuesday.

craig courten attended a meeting to reassure neighbors their safety a top priority. >> home is their sanctuary. it is the place on earth where we should all feel secure. and the fact that somebody entered while people were home made it that much more serious. >> neighbors say they realize the police cannot be there every second so they are going to watch themselves. the suspect is due in court next tuesday. >> police now teaming up with the fbi trying to identify a woman whose body was found stuffed in a trash can three months ago. police releasing the sketch of this victim but it's generated no leads. investigators now searching data bases and fingerprints and dna to try to identify the woman. investigators say the woman is likely in her 20s and either asian or hispanic. her death being investigated as

students and teachers here at trace elementary an opportunity to have a new start, also to erase physical reminder of that tragedy that took place two years ago. for the past two years some of the students have had to go into temporary classrooms but starting this year no more. you can see why this beautiful building that will be dedicated in a couple of hours from now. it replaces the structures destroyed in a five-alarm fire that gutted part of the school. causing $10 million damage. since it did happen on july 5th of 2010 the thought initially was perhaps these had been started accidentally by fireworks. turns out that wasn't the case. authorities realize that this was arson. two teen boys were arrested for starting the fire. both ended up confessing and at least one is serving time in prison. that ribbon cutting will take place at 8:30 this morning. the district and the school is making a big deal out of this

into the 70s as we head through about noon inland, 79 at 4:00 p.m. 69 bay side and 60 degrees at the coast. your daypart forecast looks pretty good. let's check on the drive. looks like the cars are flowing nicely in san jose. what are you tracking? >> the traffic collisions and the northbound 101, right around the airport area. both cleared so we're not hooking at accidents going to the airport. north on 101 southbound now we have two sents to report. another at the san bruno off ramp, try to avoid those, and another accident continues to cause slowdowns westbound at greenville and livermore there is an accident there and on the south bay you can see traffic that's moving the best, smoothly along the south bay area. >> still ahead pg&e's settlement is revealed accidentally.

a court accidentally posted the settle emt documents on line revealing the company paid a teenager $1.8 million in damages. and $677,000 for her attorney fees. another victim of the blast says the settlement is hardly enough. >> $1.8 million covers anything that this woman or young woman had to go through. >> the disaster killed eight people and destroyed dozens of homes. pg&e says it will likely spend $455 million on all of the san bruno lawsuits. the chairman and ceo tony earley announced the company will spend $250 million on short-term safety and equipment upgrades in san bruno. >> we are following that earthquake out of the philippines. 7.6. we got an update that the

tsunami warning that had been in effects for japan and qualm and new gouinea that has been canceled. let's throw it over to christina loren now. >> it's hard to tell with the underwater earthquakes at a high magnitude because they can trigger an underwater land slide hence you get tsunami. thanks for that information. throughout the day temperatures are going to be just about perfect inland where it has been very hot. we have the 90s yesterday. wanted to point out we're dealing with delays trying to get out of town sfo, we have fog and drizzle. delays at one hour. everything on time out of oakland and san jose. you want to give yourself extra time on the local bridges, if you take the bay bridge or the san mateo to work where we're getting pretty steady drizzle and that will likely slow you down. the official word from anthony slaughter covering traffic and he's around the corner. breezy conditions today. much cooler. you might need to dust off the sweater or jacket.

we're only expecting the upper 70s and warmest cities across the bay. through the second half of the weekend temps are going to soar. 60 in san francisco, 69 in oakland. throughout the next couple days pretty much something for everybody in the weather department. we'll be at 82 degrees inland tomorrow, 74 bayside and 65 at the coast. so not great beach conditions on saturday but look at sunday and monday. 77 degrees in half moon bay. yes, there's going to be major traffic headed toward the beach as we head through sunday and monday. >> we still have the accident on 101 southbound near the airport, again at paul avenue and san bruno avenue. two accidents, separate ones, that are not causing slowdowns but if you are making plans to head to the airport avoid that or find alternate routes. as far as the east bay we have 88 that is starting to slow and

christie smith, "today in the bay." >> i want to mention we have an update regarding the quake that struck right near the eastern shores of the philippines. tsunami watch was infect for hawaii but that has just been canceled. a tsunami watch in effect for hawaii is no longer infect following that 7.6 quake. >> back in the bay area, anxious homeowners in foster city, keeping an eye on a teenage are charged with burglarizing two homes and assaulting a young neighb neighbor. the suspect is back home less than a block from the homes police say he broke into. last night the police chief attended a neighborhood meeting to reassure neighbors their safety is a top priority. >> it is the place on earth where we should all feel secure. and the fact that somebody entered while people were home made it that much more serious. >> neighbors say they realize

the police cannot be there every second so they are going to watch the suspect closely. shing is due in court tuesday when she expected to enter a plea. >> police teaming up with the fbi right now to try to identify a woman whose body was found in a trash can. police releasing the sketch of the victim in june. so far no leads. federal investigators searching data bases of fingerprints and dna to try to identify this woman. dental records are also examined. investigators say the woman is likely in her 20s and is either asian or hispanic. her death being investigated now as a homicide. but so far no cause of death has been determined because her body was so badly decomposed. >> alameda county court has -- the judge there, has ruled against the defense motion to exclude some of the evidence against the woman accused of killing michelle le. the defense claims that

statements from esteban where she was on the night le disappeared were gathered during an illegal search. the judge ruling the officer's conduct was justified and that the trial is expected to begin september 17, exactly one year after le's body was found. >> a new hope and optimism out of san jose community this morning. trace elementary school is opening the doors to new classrooms, a couple years after the campus was hit by an arson fire. bob redell is live in san jose with more on this morning's ceremony. good morning. >> reporter: good morning to you. yes, with that there's no more physical reminders of the ç five-alarm fire that gutted a good portion of trace elementary here. in its place stands this brand new building that will be dedicated a little later this morning. this building's been open for a couple of weeks, ready for the start of the school year.

the two years prior some of the students, many of the students had to rely on temporary classrooms. today they will rededicate this building, this of course was the old building was destroyed in a fire two years ago, july 5th of 2010. the initial thought when that fire gutted these buildings and caused $10 million in damages, that might have been a july 4th fireworks that did that. but authorities did realize it was arson. two teenage boys were arrested, both did confess and at least one right now is serving time in prison. that ribbon cutting and the enormous ceremony they plan will take place at 8:30 this morning. teachers, students, parents and officials with the school district are expected to be here. reporting live at trace elementary, bob redell, "today in the bay." >> 6:54. a lot of people heading to yosemite for the long weekend will be hit with bad news. the number of hantavirus cases
