happy labor day. it's now almost 4:31. i'm jon kelley. >> i'm marla tellez in for laura garcia-cannon. good morning to you. let's get a look at the forecast with meteorologist christina loren. good morning. >> hey, good morning to you. yes, some of us have to work, laboring on labor day. temperatures are going to be comfortable. i volunteered to work today so yeah, no one's in a worse boat. everything that you normally associate with labor day your water sports, barbecues, you'll be able to do. a couple things you need to know so stay tuned. first want to check your drive. good morning, anthony. >> good morning. we have an accident on 80 eastbound at willow avenue. a deer has been struck in the location. it's not slowing traffic tremendously but if you use the route at least in the next ten to 15 minutes allow extra time. other than that traffic is slow and smoothly. and i think it will continue to do so as it's labor day,

obviously. >> thanks. new this morning, the powerful car bombing attack on a u.s. government vehicle in pakistan killed at least two people. at least say they were pakistani bystanders. 19 others were hurt including two americans. it happened in northwest pakistan after the u.s. embassy vehicle was leaving the u.s. consulate. the city is the main sanctuary for taliban and militants. >> closer to home here, vandals leaving their mark on a sculpture that honors the homes and lives lost in the oakland hills fire. >> this is is not the first time this has been targeted. christie smith is live with a look at what's being done to restore the memorial. good morning. >> reporter: good morning. this is really upsetting for people who live in the oakland hills particularly those who remember that day who lived through the 1991 fire storm.

well, this is the complete garden here. this is the sculpture put up. once again someone has vandalized this. i say once again because this is actually the third time that the fire storm memorial garden sculpture has been vandalized according to a committee that maintains it. sometime this weekend someone cut off five metal bars on the north end of the sculpture which represented trees that have grown in after the 1991 fire storm. of course, more than 3,000 homes were lost, 25 people died in the fire storm. there is a video surveillance system that they hope will provide some clues to whoever did this, exactly why it was damaged is unclear. but in the past they said that it could be to sell some of the metal. the committee is trying to raise about $5,000 to try and maintain their video surveillance system but also to repair this sculpture.

christie smith, "today in the bay." >> a family of a firefighter who suffered a heart attack fighting a fire says he is making progress. dozens of friends and family have been holding a vigil for 41-year-old frank ryan outside regional medical center every day since thursday's incident. he remains in critical but stable condition. yesterday about 75 people held a prayer vigil for ryan, giving thanks to all first responders who risk their lives to help others. >> these men and women put their lives on the line for us constantly. call 911, they're there. they called 911 for the church we wanted to be there to show them the love and support they show us. >> ryan's family saying, quote, frank is progressing in a positive way, we are taking it one day at a time given the circumstances surrounding his condition. >> there are also prayers for frank ryan at st. patrick's cathedral, the church where he nearly died. more than 200 parishioners

packed the gym at the church's school where they had to hold sunday mass because the main church was so heavily damaged by thursday's fire. >> this is their church, this is their family and this is where they come every sunday to worship and be with each other as a community. so, the church is no longer but the community still remains very strong. >> the cause of the fire is still under investigation. there's no estimate yet on when repairs to the cathedral will be complete. >> fighting back against violence. residents of san jose plan a peace march to try to unite the east side communities. today's march starts at the safeway store on white and story roads, it will continue to lake cunningham park near raging waters. this was the scene of the 31st homicide last week. coming up bob redell will have a live report surrounding the rally. >> protesters angry over the

chevron refinery fire plan to spend labor day marching and rallying. the fire on august 7th sent 1,000 people to the hospital and sparked lawsuits. what they want is for the energy industry to be nationalized and run under community control. speakers include cindy sheehan and the vice presidential candidate for the peace and freedom party. >> registration is down for this year's susan g. komen race for the cure, down 50%. the race is going off on sunday along san francisco's embarcadero. you may recall the organization sparked outrage nine months ago when it refused to fund planned parenthood. a day later it denounced that move. donations to local chapters also down by nearly 65% this year alone. >> good morning. it's 4:36.

i want to check your drive. here's anthony. >> thank you. we do have an accident still on 80 eastbound and that's in the east bay around willow avenue on the off ramp. there was a deer struck. this is about 20 minutes ago so it's being cleared from that location. also in the north bay 101 southbound is slow, there was an accident about five minutes ago and that's slowing traffic heading into the city and so also we're looking at 101 south just north of there continuing to slow and if you are traveling this morning headed in to work or school, if you have school, oddly i don't know if you do, maybe an online class, dumbarton bridge is still closed until tomorrow at 5:00. >> thank you. speaking of that, workers have been at it all weekend and crews say they are making progress on the dumbarton bridge. the seismic retrofit. work to replace an old joint is going smoothly at this point and the project is on pace to finish by 5:00 a.m. tomorrow morning.

the joint can withstand stronger earthquakes. crews are taking advantage to knock out other improvements as well. >> we've been able to do reconfiguration on the carpool lane and now it's going to be open for fast track, before it was only open during carpool hours, now it will be open the entire day for fast track use. >> workers also patching pot holes, painted fixtures and installed a cushion for crashes. if you need to get from one side of the bay to the other before tomorrow the best is the san mateo bridge. >> celebrations continue for petaluma's little league national team. ♪ more than 15,000 turned out in downtown petaluma yesterday to salute their home team t 13 boys were just one win away from appearing in the little league world series title game. they ultimately finished third in the entire world.

home watching us right now. good morning to you. just about 4:44. a health warning for students at san francisco's state university. they may be at risk for contracting chicken pox after two students were recently diagnosed with that disease. school leaders are sending a letter to students. the first student with chicken pox visited campus monday and wednesday and was in the campus book store. the second student lived on campus and visited several buildings on friday including creative arts, ethnic studies, the library and student services. >> if you like to shop you might like this. the largest retailer speeding things up at the check-out line. walmart testing a system to allow shoppers to use their smart phone to scan items. when you're done shopping apple transfers the list of items that you grabbed to a self check-out counter. you'll not be able to pay through the app, it was designed to make scanning easier and walmart says the app will help

river which is rising could crest sometime today. >> you know what that means. decision 2012. democrats are gearing up for their convention in charlotte, north carolina while president barack obama is on the road stumping for votes. the president stopped in ohio and storm-ravaged louisiana today. in louisiana he is expected to visit st. john the baptist parish and tour damage and speak to reporters about the cleanup effort. yesterday in colorado he slammed last week's gop convention in tampa. >> a lot of talk about hard truths and bold choices but the interesting thing was nobody ever bothered to tell us what they were. >> mitt romney went to church in new hampshire on sunday and sent paul ryan on the campaign trail to respond to the president's claim that republicans are running on empty. ryan says the president is running on fear and frustration,

and republicans are offering a vision. meanwhile, two california delegates were sent home for unruly behavior at the democratic national convention. the pair arrived early yesterday morning and police say they were drunk when they showed up. one of them passed out in a hotel lobby allegedly and his companion got into an argument with paramedics. despite the rough start the 700-member california delegation will caucus this morning, hearing from house minority leader nancy pelosi. >> it appears it's game on. governor jerry brown is game for a cross country rivalry here with new jersey governor chris christie. >> a challenge governor christie to a three-mile race, a push-up contest, and a chin-up contest. >> as they say, get it on. christie fired the first shot last week telling delegates at the national republican convention that brown was an old retread. brown initially dismissed the

>> we have an accident in the northbound still trying to get clear around 101 slow through millbrae. if you're heading in at about the next 20 minutes from the north bay a heads up there will be slow going on the 101, let's get you over to the dumbarton bridge. it's closed until tomorrow at 5:00. that's when it will reopen. outside and show you the alternate route, the san mateo bridge and it is moving right along so no issues on your alternate route. >> thank you. the paralympics in london, one of the isolated countries in the world is participating for the first time. that being north korea. it's only represented by a 16-year-old swim here plans to compete tomorrow. the teen didn't know how to swim a few months ago. earlier the country was given a provisional membership to the games board. human rights activists have claimed the inhumane treatment of the disabled in north korea,

they say many are sent to detention camps or forced to live in isolation. >> 4:55. a year after being placed on probation for drawing too many the burning man festival wraps up. officials say the festival's peek attendance was 52,300 on friday. that's down almost 2% from last year and well under the daily cap of 60,900. the agency placed organizers on probation and threatened to pull their license for exceeding the limit at last year's festival. >> along with labor day, today is the last day to ride the hurricane roller coaster on the board walk. the ride will be dismantled and shipped down to a park in new mexico. all of the screams go with it. replacing it a new roller coaster. the attraction is a spinning roller coaster that changes
