just hours, the company is set to unveil its next best thing. while the company isn't saying much, everyone else is convinced it's the next iphone. scott, you are all over this story. >> reporter: well, good morning. not saying much other than an invitation. i can't tell you how many times i've stood outside the center for the performing arts and got ready for one of these apple presentations but just take a look at how beautiful this is. we actually have two cameras out here on howard street this morning. we can look at the other one. you can tell mike that there's no parking and a lot of traffic on the street as at least a dozen satellite trucks and news crews get ready for this announcement. some of the media from all over the world gathered outside this facility as we wait just a few

assaulted him as a child. the one-time suspect in that beating case will now meet with prosecutors. good morning. >> reporter: good morning. the d.a. wants to hear from william lynch before deciding whether he will file perjure charges against father jerry litner. lynch was acquitted of that beating earlier this year. it was in that trial that father litner took the stand. he denied molesting lynch or his brother even though the prosecutor virtually admitted it. once father denied the molestations, lynch's lawyer jumped out of his seat and told the judge to get the priest an attorney because he had just perjured himself. harris accused the pl ed the prf

setting up the priest to commit perjury. he will meet told here at the center with several people including lynch and his attorney pat harris. lynch told nbc bay area the d.a.'s decision not to do anything was, quote, unacceptable. father jerry litner sleeps in his retirement home not knowing if the d.a. will haul him back into court. that meeting should take place here later on this afternoon. for now, we're live today in the bay. a preliminary hearing continues for an oakland teenager who admits to killing his adoptive parents. a dramatic video played yesterday. it shows moses admitting he killed his adoptive parents in a fit of anger after he was

suspended from school for smoking marijuana. he was 15 at the time. he's 16 now. the teen is being prosecuteled an adult. we're now learning the final heroic act of a fallen officer has given some new life to four people. he was shot and killed while performing a traffic stop near alamo just last week. the officer was an organ donor and his right kidney went to a 52-year-old bay area woman who had been waiting for a transplant for ten years. a 29-year-old bay area removed his left kidney and pancreas. a 63-year-old bay area woman received his liver and a father of four in southern california was the recipient of his heart. now, the official memorial for the officer will be held at the mission church in backville.

that will take place tomorrow morning. we're also learning more about the man detectives say shot the officer. detectives recency searched the county home of 36-year-old christopher lacy. they seized a handgun safety certificate there, a gun carrying case and three shooting targets. we've also learned the software engineer had been hired by a mountain view company through the recruiting agency mine source. lacy was shot to death by youngstrom's partner just moments after police say lacy shot officer youngstrom. check your windows and doors. that's the critical message being given to everyone in palo alto as police release troubling new statistics about a surge in ho home burglaries. almost 20 in just the past six weeks. >> reporter: good morning. these numbers are surprising. we're not talking about a small

increase but they're up 50% from last year in palo alto. sometimes the people who did this are breaking a window but most of the time, police say what they do is just walk right in or climb in through an unlocked door or window. palo alto police have released a new crime map for the past two months showing most of those ho homebu burglaries were happenin. 151 so far this year compared to 97 last year. we found quite a few neighbors just leaving their doors and windows wide open. police are started a lock it or lose it campaign. reminding homeowners to lock up. they've increased patrols during the day when most burglaries are happening but also at night. that's when car break-ins are happening. more homes are empty in the day as kids head back to school.

that's part of it. neighbors are understandably worried with watch groups considering adding video cameras around and buddy systems to watch each other's homes when people are away. reminding neighbor that the best chance they have to catch these buthese burglars is to call 911 if anything looks suspicious. members of council considering a new proposal to crack down on medical marijuana clubs that have not been paying taxes. today, a council meeting is set up. to consider the new proposal which will give the city the power to shut down delinquent clubs. the city could be losing out on millions of dollars in tax revenue. san jose estimates last year nearly half of the city's 158 dispensaries only partially paid or skipped out on their taxes.

this area. a smooth drive here past the truck scales. the flashing lights at the truck scales. the freeway itself will be just fine to and from mission boulevard. >> looking good, thank you very much. a san francisco bay environmental group releasing its list of the biggest trash hot spots. the environmental group save the bay says right here in the bay area those worst spots include damon slew in oakland, baxter creek in richmond, the hayward shoreline and coyote creek. and the creek in santa clara. the save the bay report claims these five sites are so bad they actually violate the clean water act. the annual california coastal cleanup day is this saturday. a lot of volunteer events are scheduled throughout the bay area. visit coastal.ca.gov.

angry residents voicing their concerns about the recent series officer-involved shootings. relatives of victims expressed their anger at the city police force and at the mayor. many speakers calling for the fbi and california attorney general officer to investigate, saying they do not trust local law enforcement. there have been seven officer-involved shootings. five were fatal. 5:20. the suspended sheriff appears to have lost his latest bid to get the ethics commission to delay delivering its recommendation, to the board. the commission yesterday ralt f ratified its decision that the sheriff violated conduct. the board of supervisors has 30

this is today in the bay. >> it is straight up 5:30. thanks for joining us. >> at 5:30, the man who beat up a south bay priest who allegedly beat him is meeting with prosecutors today. the man was acquitted of severely beating father litner in 2010. live outside the d.a.'s office in san jose where that meeting is expected to take place. >> lynch admitted he beat up litner more than two years ago. he said it was pullback for the alleged molestation that took place 37 years oldier in the

santa cruz mountains. i was in court earlier this year as lynch described in disturbing detail how the molestation took place. in that father, jerry litner denied he ever molested lynch or his brother during that camping trip in the mountains. other children were also on that trip. lynch's attorney told the judge to get the priest a lawyer because he had just perjuried himself. the priest pled the fifth and no longer took the stand. in fact, he made that charge soon after the trial in an interview with nbc bay area. >> he perjuried himself pure and simple. >> the lawyer scheduled to fly

in for this meeting with the d.a. today. he even accused the prosecutor in the case of setting up the priest to commit perjury. that sympathetic jury acquitted lynch of beating up the priest even though lynch admitted it in the first place. we're live in san jose. >> a former student has now come forward to say he was sexually abused at that school. the alleged victim says jesuit brother abused him. this accusation is not the first. the society of jesuits sent a letter to faculty and staff that reads jess suette brother farrington was removed afteral gations surfaced from another

former student. he now lives under close supervision at the infirmary. his restrictions are viewed annually. the victim says he wanted to put the story out there as part of a healing process. it is apple day. the company is expected to unveil the iphone 5 at a press event in san francisco. sources at its rival samsung told a korean news. a that company may sue to stop the sale of the phone the moment it is introduced. what would it take for samsung to sue? >> reporter: it would take the filing fee in federal court for samsung to walk in there the

minute they see the iphone 5. the understanding is they're very upset. it is the high-speed connections that the iphone 5 we expect will be able to make. samsung owns some of those patents. it is possible the minute we hear about iphone 5 samsung lawyers will show up in san jose, one of the northern district federal courts, to file a new lawsuit. this has been done before when samsung introduced galaxy s-3. we've seen this tit-for-tat with samsung.

to do. >> reporter: neighbors here in palo alto have told police they're concerned there are more forced enter into entries going on. even though the numbers are going up, the burglars aren't change. most of the time they're getting in easily, going right through an open door or window. this year's numbers are the highest in five years. we took a look around and found quite a few people are leaving their doors and windows unlocked. police say more homes are empty during the day as children head back to school. so police are increasing their patrols in the day. but also at night when it looks like car break-ins are on the rise too. the department started a lock it or lose it campaign. to remind people to lock up. the home burglary crime report shows burglaries are up 50% from

california native was killed at the u.s. consulate in ben ganske, libya. tracie potts live with the latest. >> reporter: he was a northern california native born and raised there. also graduated from uc berkeley in 1982. we're talking about ambassador christopher who was killed in this attack. we're told initially it was a staffer but it was finally confirmed it was in fact the ambassador. he was a 21 year veteran of the state department but before that he not only went to uc berkeley but also got a law degree seven years after the uc hastings college of law so bay area ties here. we've learned in addition to him there were three others who were killed. one of them, sean smith who was a foreign service officer, a ten-year veteran of the state

department. this all happened after the consulate was burned. it was looted. and we saw similar thing happen to the u.s. embassy in cairo. protesters ripped and burned a flag. another california tie because apparently all these protesters were upset about a californian who created a 14 minute trailer on youtube now a video they say insulted the prophet muhammad. as a result, we've seen all of this violence. reaction this morning from the president. who says he strongly condemns what he calls an outrageous attack. lots new information rolling in this morning. >> after a one-day break, both the republican and his campaign rival heading to the campaign trail this morning. yesterday, both candidates said they take a break.

into tuesday. by next weekend, we could be talking about the upper 70s and not great beach weather so get out there this weekend if you can. let's check your drive. >> we're look at what typically happens. right here, just about 5:45 every -- right around to the interchange. you see the slowing as well as we'll show you where that is. a little bit further, up towards the merge. folks are adjusting to schools back. so far, we're seeing a pretty consistent pattern for the south bay. we see this coming out of the pass through livermore. 580 slow, starting to stop around that isabel interchange into the 40s and also into the dublin interchange where there are reports of people on the roadway. some people reported on the side of the road so we're just giving

a word of caution as you approach the dublin interchange. we also had an accident. interchange. another deer hit here. sounds like there's still activity in the right hand lane so stay to your left as you approach the interchange out of lafayette. bay bridge toll plaza, just starting to pick up volume, but no slowing. >> it is 5:48 right now. milpitas police hoping newly released surveillance photos will help somebody identify the suspects who robbed and killed a 7 eleven store clerk. seconds later, police say, they shot and killed the 67-year-old clerk. this will mark milpitas' first homicide of the year and it happened two block, away from the police station. >> just shows you how brazen and willing these suspects are to

take risks to actually commit an armed robbery which eventually held to a homicide right down the street from the police department. >> the owner of that 7 eleven is hiring more security for overnight hours and the parent company is offering a cash reward for the arrest and conviction of the suspects. in san rafal, police releasing a video of an armed robbery at a convenience store. this all happened last tuesday at the shell gas station on second and fourth street. as you saw there. as you can see, the masked gunman demanded the cash and took off on foot. police asking anybody with any kind of information on this case to call them immediately and they also add there is a cash reward. >> new this morning at 5:49, we're getting a first look at newly released surveillance video. it shows the so called vapor cloud released moments before

last month's massive refinery fire in richmond. chemical safety board leaders released this video during a meeting with the richmond city council last night. investigators say they're still trying to determine exactly what the cloud consisted of and say that question is critical because at least 18 of the refinery employees were explosioned to it. investigators telling the council parts the pipe where the fire began had thinned to roughly the thickness of a penny. federal officials say they're trying to determine why chevron did not inspect the pipe back in november when another nearby pipe was replaced. hundreds turned out for a memorial for a 20-year-old from lafayette who authorities believed in a water tubing accident along the sacramento river. ♪ somebody's hands who >> you can see this candlelight

welcome back. it is 5:54. a california republican congressional candidate is now backing away from a recent remark in which he said women who have abortions are more likely to get cancer. doug lamalfa made the statement during a debate. the cancer society saying there is no scientific evidence to back those claims. yesterday, he retracted those comments saying he was misinformed. he is running for congress in district one and that includes redding, auburn and chico. >> 5:54. today is day three of that massive chicago school strike. it appears there's no resolution in sight.

in maran, call this an onslot. the film festival. ben affleck and billy bob thornton. they have films in there. this will make their debutses for each one of these stars. the festival includes 150 films from all over the world it the show runs from october 4th through the 14th. on the road, based on a 1950 classic novel by jack kay row back will open up the festivities. it will be closed by ang lee's new adaptation of "life of pi." one more hour of bay in the bay still ahead. okay, here's the plan.
