it is just about 4:31 on the nose. good morning, i'm jon kelley. >> let's start out with a look at the forecast. >> we just saw san francisco, we got the low clouds, good strong sea breeze again today and it's another cool summer afternoon. 60s, oakland, san francisco. only 71 in san jose. looks like one more cool day tomorrow, then a warmer day friday, as we watch the space shuttle "endeavour" fly over for friday morning. looks like some clearing skies around that time. >> you're going to have a lot of folks on the freeway distracted as well. we're looking at north bay right now. a sig alert just issued for highway 37 as you come out of vallejo. reports of at least one big rig blocking the two lane there. looks like on the area just west of highway 29. the rest of the north bay, we have construction.

it's countercommute. heading out of the area northbound, right there at the junction. we see slowing likely because of those bright lights, guys. a police chase ends up in the east bay. >> it ended in union city. that's where "today in the bay's" christy smith joins us. >> reporter: freemont police are still trying to piece this together and figure out a motive. the whole incident ended here. they pursued a suspect. they say that he got out of his truck right about here. they tackled him and were able to make an arrest but it started actually in freemont. late last night. by some apartments. police are telling us a man tried to kidnap three young men all ages 19 to 20 years old. these apartments are right near the freemont police department where police say this man in a

dark truck approached the young man who ran and spotted a police officer who then saw the truck. while the three were running, this man actually stayed persistent. >> as the officer was speaking to the boys, the boys were giving a description of the male suspect. they noticed the vehicle about a block away and pointed it out. officers tried to flag down the vehicle. attempted to do a trough being stop. the suspect took off in his vehicle. >> reporter: now, again, that driver didn't stop but took down that vehicle on freemont. police say he bailed out of the car here in union city and ran. both of them actually injured and taken to the hospital to be checked out, including that officer, hospitalized for an ankle injury. the charges include attempted kidnapping, resisting arrest and evading police.

at this point, police are unclear exactly what the motive is. reporting live in union city, christy smith. the santa clara police are investigating another overnight high speed chase and crash. the chase started near the intersection of 101 and san tomas expressway. it ended when the suspect crashed into a pole just outside the gas station at the intersection of della cruz and trem bull. we're waiting for investigators to say more about why they were pursuing that driver and how seriously that driver was injured in the crash. a freemont woman is shaken up after she says she was robbed and beaten by four men in her home. it happened earlier this month. the victim says she woke up to find four men voushding her bed she says the men grabbed her and punched her repeatedly. the victim says it appears four men got through an unlocked door and were inside the home for 15 minutes before finally taking

cell phones and leaving. >> i have nightmares. i see them and what's happening all over and i'm jumpy. any little noise scares me. >> police hope to have a sketch of the suspects as soon as today. they remind everyone to make sure your windows and doors are locked. all coming to a head at competing public meetings in san jose last night it. >> san jose has become a magnet for the criminal. does the police department have the ability to handle the crisis based on the resourceses? >> dozens showing up at the council meeting to express concern over the recent increase in murders, rains and burgla burglaries. dozens more gathers at another meeting hosted by the police

officers association. attendees at both meetings appear to have the very same message. >> i think i'm angry at the people that run the city that really aren't listening. >> in addition to dealing with a surge in crime, san jose's now looking for a new police chief. monday, chief chris moore announced he would retire at the end of january. the city says it is now conducting a nationwide search for his replacement. >> investigators say a bay area man who disappeared on a train ride to chicago may have fall be off the train. his family says a passenger saw 69-year-old charles dowd near a door of the train thursday night about 10:00. an hour later, another passenger found an exterior door opened. dowd suffers from restless leg syndrome and may have gotten up to stretch. he was taking the train to visit relatives in montreal. dowd's family and friends are focusing their search along the amtrak line between nebraska and colorado. >> 30 days and counting. that's how long the san francisco board of

supervisors now had to decide if the suspended sheriff stays or goes. suspended without pay in march on official misconduct charges. the ethics commission submitted its final recommendation to the board. ultimately triggering the 30-day deadline. the supervisors will use the commission's findings to determine if he should be fired in the wake of a domestic violence incident that left his wife with a bruised arm. the decision to permanently remove him from office would require the approval of 9 of the 11 supervisors. a dog sentenced to death. a dog sentenced to death for attacking a police horse in gold gate park is now getting a reprieve. a judge has now decided to stay the execution of charlie. he's an 18-month-old pit bull. after the dog's owner appealed a city order to have charlie euthanized. he started chasing a police horse, biting it sfeveral times.

city officials say charlie is vicious and aggressive and needs to be put down. a lawyer says the city doesn't have the right to order charlie's death. a hearing will be set in the coming weeks to try to determine what will be happening next. a musician is hoping you can help find the person who stole his cello. the suspects were all caught on tape. police say this young couple walked into the san francisco conservatory of music on sunday, casually walking out with a cello, worth thousand, of dollars. it belongs to 23-year-old adam young. he says he left that instrument in an unlocked locker for a couple hours sunday afternoon and when he returned, it was gone. >> it's an empty feeling now. criminals rummaged through my stuff and took my most valuable possession. >> the thieves took handwritten music young composed and kept in that case. there's a reward being offered for the safe return of the

cello. police say the thieves can return it to st. mary's cathedral, no questions asked. >> pretty clear videotape so hopefully they'll nail them very quickly. we check our wednesday forecast. what's happening outside? >> it's looking a lot like monday and tuesday where we got a lot of low clouds. it's jacket weather in napa. 45 degrees. the wind, concord, fairfield, blowing good this morning. if you're heading across the screen niche sha bridge, it is pretty brisk. some fog in the north bay valleys, about a half mile visibility now. you'll run into that. yes, highway 17, you'll be driving through the clouds. radar view, fairly quiet. clouds off shore. an upper low will spill our way

entitlements, he says. he said, those people are always going to vote for his opponent. in a new interview yesterday, romney concedes some of those not paying taxes are not victims but are instead wealthy americans who should be paying. the initial comments led to very heavy criticism. even some from his own party. president obama also responding. commenting during an interview on "the late show" last night. >> my expectation is if you want to be president, you got to work for everybody, not just for some. >> i think in the context of what governor romney was saying is we need to get people off of subsistence. that means job creation. >> well, a new associated press poll shows the two candidates are still in that dead heat. a separate poll shows a third of low-income voters support romney, while more than half support president obama. today is back to school day for 350,000 students in the nation's third largest school

district. 25,000 chicago teachers have tentatively agreed to accept a new contract proposal from the city. under the deal, teacherses would see a 7% pay raise over the next three years and will be rated on how well students score on standardized tests. it could still take weeks to determine if the teachers will ultimately approve that deal. for the rest of the news before the bell, we go live to cnbc. >> thank you so much. futures are higher after stocks ended mostly lower on tuesday. the dow managed a fractional gain. investors reacted to a mixed bag of news. it gave home builder incentives showed improvement. asian and european markets higher at the moment.

we do get that out this morning on housing starts and building permits as well as existing home sales here in the u.s. the dow did rise 11 points in yesterday's trade. the nasdaq falling less than a point. here's our big story. target planning to hire 80,000 to 90,000 seasonal work erbs this holiday season. that's actually down from the retailer last year. 30% of those temporary workers stayed on at the company for year round positions. kohl's plans to increase its hiring by more than 10% last year. retailers expect holiday sales to be on par with last year. generally a good indicator of how confident stores are with their seasonal business. back to you. >> all right, good to watch. thank you very much. we check back in with rob. it's kind of like we're on the record skipping. it's kind of the same over and over. >> it feels like tuesday morning

tonight. not a concern now but get those quake colors ready. we're looking to 101 northbound. you lose two lanes heading up to old middlefield. we also get a live look outside. looking at the dunn barton bridge. one set of flashing lights, that signals the crew. there's a construction crew late night. very slow. >> dozens of customers at two restaurants in the north bay getting hit with their charges months after actually buying their pizza. thousands of credit and debit card transactions were delayed at the restaurants. in some cases, that delay was as long as nine months. now those transactions are starting to come through all at once. one man, he was hit with a $300 charge for a series of purchases

dating back to february. the restaurant manager tells the santa rosa press democrat there was a little problem with the bank that process the the transactions. he says he didn't even realize there was a problem till he noticed a large slump in revenue at the restaurant. visa officials say some of the charges may have typed out and they're encouraging customers to talk with the banks. >> those breadsticks can come back and get you. >> shuttle endeavor starting that final flight. >> yeah, very cool. >> from the kennedy space center just after 4:00 this morning. quite a sight. it was strapped to the back of a 747. what a load. at the beginning of a massive cross country good-bye tour. today "endeavour" will fly along the gulf coast and fly over nasa sites in missouri and new orleans before eventually touching down in houston. then it's on to sacramento. before a big finale on friday that will include a low altitude
