overnight in the east bay. good morning to you and thanks for joining us. i'm laura garcia-cannon. >> and i'm jon kelly. good morning, everybody. we begin with breaking news impacting your morning commute on two major east bay freeways. bob redell is live in pleasanton where 680 south was shut down completely after a deadly accident there. bob, good morning. >> reporter: good morning to you, jon. only the left shoulder is open right now. all four lanes are still shut down. chp telling us they hope to have those lanes opened within an hour, though that timeline could be sped up. what happened is somebody was struck in the middle of the road around 3:30 this morning. you can see the coroner's van is here. they just removed that body, which seems to be a little bit sooner than was expected so it's quite possible the road could be opened up sooner than expected. what still needs to happen is the fire department needs to come out here and/or caltrans and do a quick cleanup. there's also a couple of cars that need to be removed. a person in a small car hit this

person in the middle of the road. it was a man. around 3:30 this morning. it was not a hit and run. the driver of the car did stop and is cooperating with chp. it does not appear that the person who was hit was a driver who had a stall or a road emergency or anything along those lienes. it was just a person who happened to be out here. chp is still investigating. don't know what they were doing. as i'm looking southbound towards stoneridge, they just removed the vehicles on the side of the road so that's progress right there. i'm looking at chp to the left and some other people who are doing some sort of pickup. so another indication that maybe they'll be opening up these lanes sooner than expected. the far left shoulder is open but if you pan to the left, remember this happened about two and a half hours ago, you have quite a backup that extends northbound on the southbound lanes of 680. this is also affecting 580 westbound for people who are clearly trying to get on 680

southbound. we've got traffic anchor mike to tell you about the latest. >> if you're heading through the area, definitely, definitely plan on at least 20 minutes to half an hour extra time because look at this zone. bob is talking about 680 southbound coming from the top of your screen, very slow. it's been jammed all morning, unexpectedly slow. about 6:00 we still don't expect to see this much backup. westbound 580 is also affected. here is your alternate that we suggest, heading west on 580. continue over to foothill road. take foothill south and stoneridge drive east back on to 680 or continue on foothill south a little further. now, talking about the backup, here it is. jammed out of livermore. very early for this amount of slowing. more folks might be trying isabel as an alternate through livermore that would congest

city streets as well. likely to have slowing as people decide based on whatever the updates are over the next few minutes whether they're going for 580/680 or head down through livermore as well. we'll follow this and track it. back to you figuys. also new this morning, police searching for a man who shot and killed a man in antioch. it happened on sycamore drive near lemon tree way late last night. the antioch man who died is 30-year-old maurice wagner. investigators are following some leads but do not have a suspect description or motive for that shooting. parents at a south bay elementary school are still in shock, extremely surprised over the arrest of their school principal. this one involves drugs. marla tellez is live in santa clara with more details on the police sting that ultimately led to this arrest. marla, good morning. >> reporter: jon, good morning. a spokesperson for the santa clara unified school district says everyone is really just

stunned by the arrest of eric lewis who has been the school principal here at montague elementary for seven years now. this morning while his students get ready to start a new week, he happens to be getting ready for his very first court appearance. lewis was taken into custody friday, booked into jail on suspicion of having methamphetamine for sale and offering to furnish narcotics. the 42-year-old was arrested at a caltrain station in san francisco, which is where he lives. officials say they began investigating lewis after getting a tip that he was involved in drugs. well, that tip led to an undercover operation that resulted in his arrest. ultimately, parents we spoke to and his colleagues are not sure what to make of all this. >> mr. lewis has worked with us for a number of years, five years, and he's been a good principal. other than that, this whole thing was a shock. it was not something we ever saw coming and quite surprised. >> of course i'm always concerned my son, but more the

teachers are the one that directly work with him. it's not the principal. >> reporter: authorities say they seized a quarter ounce of meth and other drug paraphernalia from his san francisco home. meantime loewis has been placed on unpaid administrative leave. he is set to be in court today. back here live i wanted to show you what's painted on the side of the school that greets students every day. it reads, quote, at the end of the day be ready to say i'm proud of what i did today. now, the irony here is that we're told that this is the principal's message. that principal being, of course, eric lewis. live in santa clara, marla tellez, "today in the bay." 6:05. potentially crucial new evidence has surfaced in the police shooting that led to the shutdown of last week's oakland city council meeting. the "san francisco chronicle" is reporting that police have new lab results from the deadly may 6th shooting of 18-year-old alan

bl blueford. those tests reveal the teen's fingerprints were on the handgun he allegedly pointed at an oakland police officer. police say the teenager was fired on only after aiming the gun at officers. his family denies that. a san francisco man is in jail this morning accused of trying to kidnap a young girl near an elementary school. police arrested 25-year-old bradley morzak saturday morning. they have linked him to an incident at parkside elementary as well as two other schools. on friday he allegedly tried to kidnap a 9-year-old girl from parkside. she said she was fortunate she was able to escape by kicking him and running back to the school to tell the staff exactly what happened. police say earlier in the day he was spotted an two other schools. investigators say they have a better picture of what may have caused the recent death of an sfo employee. police say the driver of a food service truck somehow veered off the road at the airport early saturday morning.

he then struck a parked business jet on the tarmac. the 60-year-old daly city man was the only person involved in that accident. some new safety and maintenance rules will soon be in place for california's natural gas pipelines. governor jerry brown signing three new bills into law that not only strengthen safety laws but also ensures utilities do not cut corners on upgrades in order to give bonuses out to executives. assemblyman jerry hill sponsoring the bill after the crestmore neighborhood in san bruno was devastated when a pg&e gas pipeline exploded back in september, 2010. hill will also hold a news conference starting at 10:00 this morning to talk about the new bills. the governor also signing into law a bill which would make bus company drivers and chaperones responsible for underage drinking on party buses. this would impose fines up to $2,000. assemblyman hill also sponsoring the measure in memory of

19-year-old brett studebaker of burlingame. he died back in february of 2010 when he crashed his car after hours of drinking on one of those party buses. the party bus and pipeline bills do go into effect january 1st. you know what else goes into effect? it's the first monday of fall. you're saying 90s inland, christina? >> yeah, it's going to be hot today in some cities. but you know what, that translates to 70 grows right here in san francisco. taking a look at the palace of fine arts, you can actually see it this morning and that's the reason y we're going to get a lot of sunshine right off the bat. you can see the sun starting to peek over the horizon here in san jose. full sunrise between 6:30 and 6:58 this morning. that's when you'll get the best view. that is your window. if you head to work at that time, lots of reds and oranges. 52 degrees to start you out in san francisco. we're at 55, good morning to you, in sunnyvale. we'll be at 80 degrees inland by noon and 88 degrees at 4:00 p.m. so we are going to be warm today and we get even warmer as we

home in san francisco. he is now on unpaid leave from montague elementary school. a deadly crash shutting down lanes of a major east bay freeway this morning. the chp says a car struck and killed a person on 680 near stoneridge early this morning. it's up enclosure what the pedestrian was doing on the freeway before the crash. a criminal investigation is now open against chevron. the "chronicle" reporting the feds are looking into whether the company let pollutants bypass monitoring equipment at the refinery in richmond. 6:13. toyota announcing plans for a new slate of hybrid cars. the japanese automaker says it has plans for 20 new hybrids in the next three years, including a new electric car later this year and a fuel cell vehicle by 2013. an electric version of the rav-4 suv will go on sale later this month. a sequel to carmageddon.

southern cal planning a closure of the 405 freeway. last year's closure very much successful and incident-free with hundreds of thousands of drivers choosing to find other routes to stay away and go on other roads. carmageddon part 2 hits the 405 freeway coming up. >> we're so dramatic. >> 6:14 right now. motorcycles are usually pretty good at getting through stopped traffic but scott mcgrew says not electric motorcycles. >> reporter: our own bay company motorcycles make electric motorcycles but they're recalling some of those bikes because of an electrical problem that can cause the things to just stop right in traffic. the company will fix the problem for free this morning. another silly picture for you this morning from apple's new maps showing the tacoma narrows bridge. remember this from science class? apparently it collapsed again. washington state transportation agency actually tweeting this picture out. the bridge, of course, is

perfectly fine. now, silly mistakes on apple maps, and there are hundreds, distract from the real problem that apple maps don't work properly. a columnist in "the new york times" over the weekend asked the very tough question, the question that feels a bit raw. if steve jobs were alive, would the new application on the iphone 5 be such an unmitigated disaster? an example of a real-world problem, the london transportation authority now offering apple customers paper maps so they can find their way around london. now, while the software side of apple has a series of tough meetings this morning, the hardware side is celebrating. apple just tweeted out five million iphones were sold over the weekend. an absolutely flabbergasting number. >> no kidding. how far we've come. thank you very much. 6:15 right now. a texas mom spent the night in jail for doing something many parents do every day. letting her kids play outside.

>> yes, he was charged with child entarngment for allowing her kids to ride scooters around her neighborhood cul-de-sac. her name is tammy cooper. she spent 18 hours behind bars after a neighbor called police and reported her kids were playing outside unsupervised. cooper was actually sitting outside in a lawn chair but by the time the police arrived they said they didn't believe her story. those charges were eventually dropped. cooper, however, now suing the local police department. >> won't hear the last of that one. >> you don't want to make a mom mad. >> that's for sure. and you don't want to mess with the kids either, you want to look out for their safety. so interesting. well, mother nature. it's fall but she still likes summer. >> she can't make up her mind, a typical woman. good morning to you. yes, you want to keep your summer fashions handy and hold off on those fall fashions until at least next week when things are going to change. they look like they'll change dramatically, as a matter of fact. 6:16, starting you out in san jose.

what a beautiful morning as the sun starts to make its way over the horizon. the next 15 minutes and 45 minutes will be spectacular. we're at 51, good morning in oakland, and with all that fog in santa rosa, give yourself a little extra time. it's going to take a while for the fog to burn off but otherwise there's pretty good visibility except for north bay wine country. high pressure is moving in. this will warm us up and we'll really warm up towards the end of the week. the mid-90s returns. temperatures today will be comfortable, mostly clear inland. we'll get a warm breeze later on this afternoon. as we head throughout the day, if you don't have ac open up the windows, good air quality today. you might actually be needing that ac as we head through the end of the week and the mid-90s return. 88 in livermore, 80 in san jose, 70 san francisco. and the warmest city will be fairfield, way out in the east, at 90 degrees. look at this, seven-day outlook shows you that warmup feeling more like summertime for the

first week of fall. but things will start to change. we'll dive a little deeper into that forecast coming up. 6:18. let's check the drive with mike. we'll start out with this live look at 680. this is where bob redell is continuing to give us updates. he just told me that the coroner's van has left the scene south 680 approaching stoneridge drive. a number of cars have been pulled away from the scene as well. it looks like the fire departments have hosed down part of the roadway and some of the flares are being allowed to beg your pardon out. we still only have the shoulder open. the traffic volume is really building. it looks like the all clear may be before 7:00. now let's look at the maps, the extent of the problem this is creating for the flow of traffic. really jammed up coming out of san ramon, through dublin and to stoneridge. stay away from 680 and take foothill road south to sto stoneridge drive and back over past the scene and then continue south where there's a smooth drive. look at all this, this problem for 580, there's not much of an

alternate coming out of livermore. it is stacked up from 1st all wait through livermore and into pleasanton and there's no real good alternate for you. maybe take isabel if you're headed down towards sunol. watch holmes, isabel, stanley and the like. now taking a look further over toward the west. we have a jam at castro valley and the y. heading south on 880 there's an accident at a street getting cleared from lanes making this early slowdown even worse than it typically is. over here on hayward, we have an office-involved shooting that continues with an investigation and so that intersection has traffic control as well. a lot going on for the east bay. the south bay by contrast is moving very smoothly. just typical slowing for 101. a quick look at the bay bridge toll plaza with the backup of course there as well with folks backing up to about the ebb of the parking lot for the cash lanes. back to you. >> mike, thank you very much. a quick check on some sports

now. the raiders pick up their first victory but the win was overshadowed by a dangerous play sending wide receiver darrius heyward-bey to the hospital with a neck injury. this all happened in the fourth quarter. the steelers defensive back ryan mundy delivering a helmet-to-helmet blow. heyward-bey laid on the ground about 12 minutes. he was then taken off the ground on a stretcher. but he did manage a thumbs up sign as he was carted off the field. the raiders anoubs that heyward-bey is in eden hospital in castro valley for evaluation. he is listed in stable condition. we wish him well. meantime it was a stunner, not a good day for the 49ers. the team losing to the minnesota vikings 24-13. the upset a big-time blow to the 49ers who started off the season strong. many considered them the best team in the nfl as they beat the packers and the lions and the vikings had their number. >> shake it off, shake it off. still talking baseball too.

evacuations are in place for people who live near those fire lines. so far no injuries have been reported. the cause, still under investigation. also in southern california, firefighters battling a 60-acre wildfire in the town of marietta. about 200 firefighters are on scene battling this blaze as we speak. an evacuation center has been set up. this is at a local high school there. so far no word on the cause of this fire. we want to check the forecast right now with meteorologist christina loren. how are we looking? >> we actually have elevated fire danger here in the bay area this week as temperatures are going to be abnormally warm for the first week of fall. 88 degrees in places like livermore, which is actually something we traditionally see late august. so it's going to feel like summer today. 76 bayside, 70 in san francisco today and 69 in pacifica. your full forecast in just a few moments. let's check on that traffic alert. mike has been busy this morning. all right, you know what, we're looking at this jam here south 680 approaching

stoneridge. i just got word from bob that chp says they think they can have lanes clear in the next ten minutes but right now we only have the shoulder open and that causes the backup. west 580 a horrible drive out of livermore. this will probably last all morning for that tri-valley. once this starts, you can't enclosure it until the end of the commute. we're looking at the backup at the toll plaza. the metering lights are on. standard backup toward the maze, though. that's better news for a monday. 6:26. the star of an nbc sitcom getting plenty of buzz in the blogofe blogosphere after a stunt at the emmy awards. jimmy kimmel asked tracy morgan, then kimmel asked viewers not watching to tweet out tracy morgan just passed out onstage. turn on the emmys now. morgan laid there about ten minutes. the twitter fakeout actually

now. >> yes. bob is over at the scene. let me take you to the maps and we'll show you what we're talking about. we have 680 -- there's bob on scene right now. in fact it looks like he's trying to talk to us. are we going with bob or should i take it from here? >> reporter: good morning to you, mike. yeah, they just reopened southbound 680 here at the dublin interchange. we're just southbound south of 580 north of the stoneridge accident. you can see the wet pavement. that's where the person was struck around 3:30 this morning. we'll show you videotape of what the scene looked like. this person for whatever reason, chp doesn't know yet, was out in the middle of the road when we're driver came by, hit this person. it was not a hit and run. that driver did pull over to cooperate with the investigation. apparently the person in the middle of the road was a man, an adult. did not have a car out here so it does not appear like they had a road emergency.

but we still do not know why that person was out here. the coroner came and removed his body a short time ago. adds you can see, the road literally reopened within the past two minutes or so. if you look to your left, you're looking north in the southbound direction. you do have a lot of traffic. it did cause quite a traffic so there might be some delays if you're coming southbound from san ramon heading toward san jose because of the residual backup. also 580 westbound had delays and that's why we have mike with his traffic maps and his intel to tell us what you can expect as you're trying to get into work this morning. >> thank you for that update. they just reopened lanes. there you see the traffic flow. let's take you to the maps and show you that this backup has been in place and been going on since just before 4:00 this morning. that's why all of the slam down traffic south 680 out of san ramon and dublin heading to the scene just around stoneridge drive. we have west 580 as welch is a

problem. if you can get over to foothill road, stake that south to stone ridge because that is a lot clearer than those freeways. look at the slammed down traffic westbound 580 through livermore. allow an extra half hour is that is your commute because it is not usually this heavy. expect more traffic congestion for isabel, stanley and holmes. west, if you're heading toward the castro valley y, we have a big backup south 880 at a street so 580 slow on both sides of the interchange near the westbound commute direction. back to you. new this morning, an early morning bar fight leads to a deadly police shooting in hayward. this one all started at the dirty bird lounge around 1:00. a man who had reportedly shot somebody in a bar during a confrontation drove off. responding officers finally caught up with him and police say the man reversed his car right into officers and the officers were then forced to

open fire to try to stop him. that man died at the scene. now, the person who was shot during the altercation at the dirty bird lounge is expected to be okay. 6:33. a former san francisco crime lab technician accused of stealing drugs on the job goes to trial today. debra madden used to work as a lab tech for the san francisco police department back in 2009. she's facing federal charges of stealing cocaine from the facility, and could face up to four years in prison if convicted. the alleged left happened -- it led to the closure of the crime lab and the dismissal of hundreds of criminal cases by prosecutors. the trial is set to start at 8:30 this morning in san francisco. also from san francisco, police are holding a town hall meeting this morning to talk about the recent violence in the mission district. an officer in plain clothing shot and injured a suspected gang member thursday night after that man allegedly aimed a gun at the officer. the shooting sparked violent

demonstrations and protesters ended up vandalizing several buildings, including a police station. today's meeting will be held at 11:30 at the cornerstone church at 17th street. a south bay school principal is in serious legal trouble after police catch him in a drug sting operation. marla tellez is live with more details and reaction from the school. >> reporter: laura, good morning. i just hung up the phone with the spokesperson with the department of justice, which is handling this case. she says that principal eric lewis was only being investigated for about a week before he was arrested at the end of last week. she said they got a tip that he was involved in drugs, so they set up an undercover operation. that resulted in the 42-year-old's arrest at a caltrain station in san francisco where authorities say lewis arranged to meet an undercover agent he contacted through a gay dating website for

some sort of a drug deal. he was booked into santa clara county jail on suspicion of having meth for sale and offering to furnish narcotics. the school district is shocked by the arrest. colleagues say lewis is well liked. >> no sense that there was any connection between what's being alleged to have happened in san francisco and what was going on here on a daily basis nochlt connection whatsoever. >> reporter: the department of justice spokesperson said agents seized a quarter ounce of meth from his san francisco home. they also seized some ghb which is a common drug found in rapes as well as some other pills. lewis has been the principal at montague elementary for seven years and school officials tell nbc bay area that during his tenure he has helped improve student achievement scores. now, ironically at this school itself, montague is plastered, covered with all sorts of motivational quotes, really to inspire students to be the best

they can be. this one here says character is doing the right thing when no one is looking. eric lewis is going to make his first court appearance for arraignment in santa clara superior court today. live in santa clara, marla tellez, "today in the bay." it is 6:36. a list of criminal charges looming against chevron this morning. the epa is in the middle of a pollution probe of the company. the feds are looking into whether the company let pollutants bypass monitoring equipment at the refinery. those pollutants were then apparently burned off into the air. the investigation apparently not related to the massive fire at the refinery back in august. a special community meeting about that fire will be held at the richmond memorial auditorium starting tonight at 5:15. and state agencies will update people on possible future action against chevron. 6:36, first day of fall. christina says we can still head to the beach. >> in fact, you can do so this weekend as well. look at this, laura.

6:44 this morning. students of one south bay elementary school will be without their principal for an indefinite time after police arrest him during a drug bust. marla tellez is live in santa clara with details of that arrest. good morning. >> reporter: laura, good morning. the department of justice is handling this case and a

spokesperson tells me that they got a tip that principal eric lewis was involved in drugs and that's when the investigation began. she says an undercover operation resulted in the 42-year-old's arrest in san francisco at the end of last week. she said lewis arranged to meet an undercover agent for a drug deal. officials say then they got a search warrant and found a quarter ounce of meth, other drugs and drug paraphernalia inside his home in san francisco. he is being held in santa clara county on suspicion of having meth for sale and offering to furnish narcotics. colleagues say lewis is well liked, so they are just stunned by his arrest. >> mr. lewis has worked with us for a number of years, over five years, an he's been a good principal. other than that, this whole thing was a shock. it was not something we ever saw coming and quite surprised. >> reporter: an interim principal is now in charge of montague elementary in santa clara and lewis is on unpaid administrative leave.

means you can hit the beach before things really start to change. 6:47. as promised, here's mike and your busy commute. >> we were hoping things would start to change here. south 680 starting to recover after the earlier accident and complete closure of the southbound side of 680 has cleared at stoneridge. south 680 and west 580 look at this jam. speeds into the 20s where it's red. all the way over to the dublin interchange. that's likely to last all morning. now a new accident south of pleasanton in towards sunol causing more slowing as you head south toward the sunol grade. we'll track that as well. meanwhile on the other side of the dublin interchange, there's slowing through castro valley. we had a big backup at the y caused by an accident at "a" street. now a new accident at redwood road in the eastbound direction causing more folks to slow down as well. that's problem number two for the east bay. the bay bridge toll plaza has

the metering lights on so the backup is past the 880 overcrossing and going back into the maze but the east shore freeway moves smoothly approaching the berkeley curve and the south bay we have the backup as well. north 101 builds here tully up towards 880. but 85 and north 87 both showing that slowdown we've seen the last couple of weeks. it's here to stay, guys. back to you. 6:49 right now. we've been following breaking news all morning long impacting your morning commute on two major east bay freeways. bob redell is live in pleasanton where 680 south was shut down after a deadly accident. bob, it looks like it's flowing a little smoother now. >> reporter: well, the road is back open. good morning to you, jon. we're on 680 south just south of the dublin interchange. you can see the 580 overpass back there in the background. echoing what mike was saying, we are still seeing some residual effects of the shutdown. the road shut down around 3:30 this morning because a man was hit an killed in the middle of

the road. this happening just before the stoneridge drive exit. a woman in her car was heading southbound when she accidentally hit and killed him. she did pull over and is cooperating with chp. it does not appear this man who was hit had his car with him. it's quite possible he was out here on his own. in other words, it was not a roadside emergency that he had. but chp does not know why he was out here and that's going to be part of their investigation. the road was shut down for roughly three hours. they did have the left shoulder open for the last half hour to let traffic at least trickle on south. as you can see, all four lanes of southbound 680 are reopened. we are right now, though, seeing part of the residual effects of having that road shut down for three hours during the morning commute. reporting live here in pleasanton, bob redell "today in the bay." new this morning the pakistan government is disappearancing itself from a

bounty placed on the filmmaker of an anti-islam movie. officials say they are rejecting the $100,000 offer by a government minister. they say his remark goes against official policy. the minister was upset over the youtube movie "innocence of muslim." it has sparked deadly violence in many muslim countries, even leading to the death of the u.s. ambassador to libya. the u.s. state department has called the minister's bounty inflammatory and inappropriate. laura, in the race for the white house, while the president is gearing up for a meeting with the united nations, mitt romney kicking off a three-day tour of the all-important battleground state of ohio. even romney's biggest offenders concede the past few days haven't been a high point. he's still trying to recover after a secret video was released last week and now the president is reloosing a new commercial focusing on comments record ein that video. >> mitt romney attacked 47% of americans who pay no income tax, including veterans, elderly, the

disabled. >> my job is not to worry about those people. >> doesn't the president have to worry about everyone? >> and that ad will start airing in ohio. brian moore is live on capitol hill with more on the presidential race. brian, good morning. >> reporter: and guess who's going to be in ohio today? none other than mitt romney and running mate, paul ryan. they're hoping that a change of scenery will lead to a change of subject. that 47% dogged romney and his campaign all of last week. and that may not have even been the worst of it. he released his tax information on friday, which of course did absolutely nothing to silence his critics. and then there were those poll numbers in ohio, and other battleground states. the latest poll shows romney is losing a little ground. so they're hoping that in ohio today there's a bit of a reset and they're hoping to change message and go on the offensive. >> you can't change washington from the inside, you can only change it from the outside. we're going to give him that

with japan in a sign of anger over the dispute. on the subject of china, new this morning, the chinese company that makes the apple iphone is temporarily suspending production because of an internal riot. foxcon says it made that move after nearly 2,000 workers were involved in a fight at a campus dorm. 40 people were injured in this big-time brawl. the company investigating what triggered the fight but they deny it was work-related. chinese bloggers on the other hand completely disagree and say that it erupted after a security guard allegedly hit an employee. they plan to resume production tomorrow. facebook investors paying close attention to a new report that says the stock is far overvalued. >> and apple this morning says, guess what, it sold five million iphone 5s. scott mcgrew watching all the bay area companies this morning. >> reporter: good morning to you. yeah, baron's said facebook stock is in its opinion still overpriced at $23 a share.
