home. police say 67-year-old robert lockridge repeatedly brought her bottled water containing chlorine. he allegedly told her it was a vitamin drink. nurses at the facility became suspicious and tested the water levels themselves before calling police. the school principal accused of dealing drugs on the side is expected back in court this week. eric lewis made his first appearance before a judge yesterday. the principal at montague elementary school in santa clara was charged with five felonies, including the sale and distribution of controlled substances. investigators say after searching lewis' apartment they found a number of surveillance cameras, including a hidden camera inside a teddy bear. they're now going through his hard drive and his computers. there is new hope the finances -- the father of 18-year-old kyle joseph nolan raised more than $8,000 to bring

his son's body home for an autopsy. the teenager died in late august while taking part in a ritual after taking a concoction used by amazonian people. they admitted to burying his body. an autopsy yielded no cause of death. toxicology results are pending. nolan's father wants to bring his son's body home to have it reexpected. alameda police still looking for an armed suspect who held up a shopper in the middle of the day. the robbery was sunday afternoon at the alameda center on south shore drive. the suspect held up a 51-year-old woman walking near a starbuc starbucks. he stole her $600 necklace before fleeing the scene. that victim happily was not hurt. from science fiction to reality. car that say drive themselves could soon be roaming bay area streets. bob redell is live at google's

headquarters where governor jerry brown will sign a new law for autonomous cars. good morning, bob. >> reporter: yeah, good morning, laura. officially the bill is sb-1298. senate bill 1298. unofficially known as the robot car bill. this bill will allow companies like google to test self-driven cars as long as a human is in the driver's seat monitoring the car's operation. it will also require the dmv to come up with rules to govern these cars. they have always needed special permission from local authorities but no longer the case once the bill becomes law starting next year. the bill is not without its critics. there are privacy concerns because in the future autonomous cars would have to share data with other autonomous cars to avoid collisions on the road. we're talking about gps and sensor data that would be

collected and disseminated from a central location. basically tracking your movement and letting people know where you're at. an amendment to the bill wants to tell drivers how they share that information but a group called consumer watchdog thinks the amendment needs to do a better job to protect car owners from hackers. they also don't believe the bill would adequately address the issue whether the gps information would be available when not in autonomous mode. governor brown here later today for that bill signing at 1:00. bob redell, "today in the bay." it is 5:04 right now. one east bay city is drawing up new rules for pot clubs. san leandro leaders drafting an odor noons medical marijuana dispensaries to operate in that city. a moratorium on pot clubs expires at the end of the month. city leaders are using both oakland's and the state attorney general's guidelines on pot clubs as the model for their new law. well, san francisco holding

a final vote today on its clean power sf program. that program would set aside $19.5 million to secure a contract with shell energy north america to provide renewable power to people who pay a premium for it. now, this is significant because it would break pg&e's decades-old monopoly on the consumer power market in san francisco. if clean power sf is approved, san francisco would join marin county in a community power choice program. as the presidential race nears the finish line, a third party candidate wants to make sure her voters hear her message. green party candidate dr. jill stein will be visiting the bay area today. she'll visit sonoma state university this afternoon. she then heads off to napa valley college before making a final stop in palo alto. recent polls show only 1% of voters are backing stein. also in the bay area today the presidential candidate from the libertarian party, gary

johnson, will host an event at uc berkeley. johnson says his campaign is, quote, for those who are more liberal than obama on social issues and more conservative than romney on financial issues. if you feel like you're living in a box right now in san francisco, just wait. that space could get a lot smaller. christie smith is live in san francisco where the board of supervisors right now is looking at a proposal to change the city's building code. i guess it would be called downsizing, christie? >> reporter: yeah, absolutely. we were just wondering if any of these units come with a garage but you would really have to trim the excess to make this work. we're south of market here in san francisco. this building has units that are about 300 square feet or less. but today the board of supervisors could change city code that would allow units to be even smaller, among the tiniest in the country. 220 square feet with about 150 square feet of living face.

right now the city code allows apartments to be about as small as 290 square feet. that according to one yonline publication. there are debates between the supervisors over whether these tiny town apartments would make the city less desirable for families. others argue that the small units would be an affordable option where rents already run about $2,000 a month for some studios in san francisco. these units might be more like $1200 to $1700 a month. the supervisors are going to consider it. these mini apartments when they meet at 2:00 this afternoon. reporting live in san francisco, christie smith, "today in the bay." >> can you even have a roommate? >> i think the question is it depends on how big the roommate is. >> how much you like that roommate i think is more like it. >> bunk beds. >> you pick that up, no, you pick that up.

hey, let's check the forecast right now with christina. >> good morning to you. nice and cozy for you and your roommate this morning. 52 degrees in san francisco. that's snuggle up weather. 45 in novato and santa rosa. temperatures this morning are crisp. it's going to be on the warm side later. the only difference between yesterday and today, i ramped up numbers up by a couple degrees but a nice sea breeze will pick up and you can see that on your futurecast key. you notice where you're getting the yellows, that's where we're expecting the stronger wind speeds all the way from oakland to concore, livermore and san jose getting some nice breeze out of the west as we head throughout this afternoon and that carries in the cool air from the ocean. so things start to change as we head through the weekend. that means offshore flow is in the forecast. so 89 today in livermore. this is one of the coolest days of the week. 70 in san francisco and 81 in san jose. by tomorrow temperatures come up even more so as high pressure gets stronger. we'll show you that seven-day forecast. that tells the story as you're trying to make those weekend

plans. you've got to work for the weekend. mike is here to help you get there. >> no problems getting to the bay bridge and across the water you see a nice flow at the toll plaza. no big surprises either. we had 24 with construction right on the orinda side of the caldecott. a smooth drive for 980/580. that interchange does have crews but we have that connector open as well as 880 heading up toward 980. we do have a smooth flow of traffic passing 23rd. no incidents and no slowing. we do see the yellow but that's just speeds toward 60 on the southbound side. not a big deal. live look outside shows you how things are shaping up across the bay. here westbound is moving smoothly. eastbound, you lose a lane, there's that flashing arrow telling you to move over to the right. a little tremble to the camera but wind not a factor for drivers. here's more construction at university for 101 but it's off in the construction zone. all lanes are open. there's san jose, guys.

welcome back, everybody. 5:13 right now. a former intel executive will not have to go to jail for revealing secrets about his company. scott mcgrew is telling us this is all about the huge insider trading case. >> reporter: a case that gets surprising little attention here in the bay area. a judge has said that he has to spend two years on probation for revealing secrets. he recruited many silicon valley execs in an insider trading scheme. he is serving 11 years in prison. the u.s. government calls this

silicon valley case the biggest insider trading case ever in u.s. history. facebook shares fell in monday's trading by nearly 10% to $20.79. this is not the lowest they have ever been, but they were enough to trigger special circuit breakers this morning on the nasdaq that restrict the way facebook shares are sold by traders who are holding short positions. it's very complicated. if i spend five minutes explaining it, i would trip my producer's circuit breaker so i shall not. i will instead toss it over to cnbc and bertha coombs. good morning, bertha coombs. >> reporter: good morning, scott. seriously, facebook sets records but not the kind you usually want if you're an investor. futures are kind of flat. we had an anemic session for the markets on monday. the dow was down yet again. this morning we'll be watching for data in terms of the home

price index. we'll also get some consumer confidence data that's probably going to set the tone for much of the day. the big thing this week will be spain and greece, their bumgdge, and how that's going to impact the debt crisis. the nasdaq was up four points to 3179 thanks to the fact google hit an all-time high. toys r us is getting ready for the holidays. it is hiring 45,000 temporary workers. that's 5,000 more than last year. in part to deal with a lot of its online sales. also the fact that it's moving into technology. it's unveiling a new tablet and, believe it or not, already there is a lawsuit claiming patent infringement. the folks over at toys r us unveils a tablet which they are calling the tabio. there's a children's technology developer that says, hey, that

looks like our knobby. both products are wi-fi enabled, both have a soft protective frame. now you've got apple and samsung. now you've got toys r us and -- but you're not anybody unless you're being sued for patents these days. >> i want to make sure, it's the knobby that's suing the tabio? >> reporter: yeah. that's what everybody wants for christmas. you know, i have one of these kid's tablets here. these are not -- these are interesting, but i suspect these are not going to be a big deal this christmas because, jon and laura, there's so many older ipads out there. lots of parents that have said i want to move up and passed those down, there's kind of a glut of tablets that kids can be using. >> that's true. >> and it proves how durable the real ipads are because our kids throw them at the walls and they're still holding up.

and this weekend. but we'll see a few 90s, most temperatures in the upper 80s. livermore 89 degrees there, 87 in concord and 70 degrees, another gorgeous day in the city by the bay. 79 degrees in los gatos. we'll see a rapid warm-up between wednesday and thursday. tomorrow a touch warmer and we jump to 94 degrees on thursday. climbing even more so as we head through your friday. up to 95 degrees. it is going to be jam packed over 17 this weekend. 97 degrees inland, 85 degrees in places like oakland and you'll hit 80 in santa cruz on saturday. if you can imagine, it's going to be busy out there. the news is, though, next week it looks like wednesday into thursday a little system might sneak into the bay area. so we're not calling it an indian summer just yet. we're watching this guy out in the eastern pacific for now and let you know how that looks as it continues to track closer to us. 5:18. let's check that drive. it's getting busy out there.

>> the altamont pass, typical east bay spot is the first to show the slowing. so west 580 into livermore, it's got a little build now. this is fremont southbound, nice easy drive with all these headlights. we're looking at the truck scales, north from mission and up towards the other fremont exits and a smooth drive on the nimitz freeway into oakland. on the maps, northbound is your commute in the south bay. not a big concern. christine aiz talking about highway 17. that will be a factor as folks head to the beach because it's fall in california. that's what we do. looking over here for a nice easy drive as well. palo alto, earlier construction at university is just clearing. let me show you the san mateo bridge from the hayward side. we had some flashing lights right about here. they may have just started moving away. another life look outside and we'll show you the golden gate. here some low cloudses in ling right on that deck level and

along mon tara. that's where the fog will touch you, right along that water's emg. back to you. california wildfires turn deadly this morning. firefighters found the body of a man in a home destroyed by a fast-moving wildfire in southern california. neighbors reported the man missing when they saw his car parked at his home. they say the victim thought it was safe to stay inside his house. so far the shockey fire has burned at least 2,000 acres, leaving more than 20 homes near the san diego/mexico border. the fire was started two days ago and no word on what sparked it. it's about 10% contained. a list of military leaders are hoping to use their influence to get junk food out of schools. more than 300 retired generals and admirals releasing a report called mission readiness. they say junk food is the cause of childhood obesity and it eventually leads to many young adults who cannot serve in the military, putting national

we're talking upper 80s inland, 70s at the bay and 60s at the coast. we're seeing an early burst of traffic for the south bay but i'll show you where you're tapping the brake lights even now. right now we take you live outside to give you a look at downtown san jose. the calm before the traffic starts picking up on this tuesday, september 25th. this is "today in the bay." good morning to you and thanks for joining us. 5:30, i'm laura garcia-cannon. >> good morning, everybody. i'm jon kelley. uc berkeley police this morning asking for your help trying to catch a man wanted in a pair of robberies. we have a look at that suspect in a photo. police say kody alan smith pretended to sell magazines to two different women just hours apart back on september 10th. he allegedly threatened both women with violence if they did not withdraw cash from an atm inside the golden bear cafe.

we're happy to report neither woman was hurt. kody alan smith is 24 years old. he's 5'11" tall and weighs about 135 pounds. he has blue eyes and short hair. investigators say he also has a couple of accomplices. 5:31. the east bay private i at the center of the dirty cop case will learn his fate today. christopher butler will be sentenced this afternoon. he pleaded guilty earlier this year to seven felony charges, including drug possession. butler admitted to robbing prostitutes and setting up a massage parlor in pleasant hill that provided sexual services. a co-defendant in the case, former san ramon police officer louis lombardi was sentenced to three years in prison for his role in the scheme. we certainly live in an automated world and guess what, some day soon you might see computer-controlled cars in your morning commute. brace yourself. bob redell is live at google headquarters in mountain view and more on a new car law which

governor jerry brown will be signing today. bob, good morning. >> reporter: good morning to you, jon. it's appropriate that the governor will be signing this new law into law here at google headquarters because google is the company that pioneered autonomous cars, which some day will become widespread. the bill is known as senate bill 1298, formerly known as the robot car bill. it will allow companies like google to test these self-driven cars on the road as long as a human is in the driver's seat monitoring the car's operation. the bill would also require the dmv to come up with rules governing these cars. google has been testing autonomous cars for years now but has always needed special permission from the local authorities to do so. they'll no longer be the case once the bill becomes law, start of next year. the bill is not without its critics. there are privacy concerns because in the future autonomous cars would have to share data with other autonomous cars to avoid collisions on the road. we're talking about gps info,

probe into whether chevron was deliberately trying to deceive air officials about unmonitored releases of gas at the refinery between 200 fi5 and 2009. >> the amount is so small that even if it were metered, a report would not be required and it presented no public health risk. >> two years ago the bay area air quality management district fined chevron $170,000 after discovering the company bypassed monitors 27 times. at this hour police are still trying to find the identity of the man who was struck by three cars on interstate 680 in pleasanton. this is an update to breaking news we brought you yesterday morning. this all happened around 3:30 on southbound 680 at stoneridge drive. the man was hit by three separate cars and was dead when officers arrived. police right now trying to figure out why that man was out on the highway in the first place. the incident shut down all

southbound 680 lanes for nearly two hours. okay, think about this. just enough space for a foldout bed, kitchenette and maybe a tiny bathroom something but don't try to turn. if it gets the green light, you could soon call that small size, the size of an apartment. christie smith joins us live in san francisco where the board of supervisors will vote on a proposal that will certainly change the size of living space there. good morning. >> reporter: good morning to you, jon and laura. i was just reading an article from when these units first opened up here south of market in 2008 and it said that they're basically the size of about seven or eight ping pong tables back-to-back. we're at the cubix building south of market, about 250 to 350 square feet, each unit, that according to the chronicle. now the board of supervisors is considering a change to city code that would allow even smaller units than that, about 220 square feet. among the smallest in the

country. now, according to online reports this morning, this may be driven in part by developers who want to build more of these units in the city, but there is strong debate going on among the board of supervisors who will be considering this this afternoon, that this would do nothing to draw families into san francisco. on the other hand, it could be valuable and more affordable option for a young, single person. studios in san francisco can easily go for about $2,000 a month. these tiny units or shoe box housing, as some people call it, might go for closer to $1200 to $1700 a month. for that in some of these units, you might get a mini sink, cook top, half fridge, microwave, sofa bed, wardrobe but no closet. reporting live in san francisco, christie smith, "today in the bay." >> i bet there are winnebagos bigger than that. you see them on the roadways. >> if you don't mind living in a shoe box, you do less furniture shopping. >> there you go.

welcome back, everyone. good tuesday morning to you. 5:41. you know the number one issue for american voters is the economy these days, but the focus of the race for the white house is turning to america's place in the world today. president barack obama will address the united nations general assembly at 7:00 our time. governor mitt romney will give a foreign policy speech at the clinton global initiative. tracie potts is live on capitol hill this morning with more. world affairs so important. good morning. >> reporter: absolutely, laura, good morning. let's talk about both of these speeches in new york at that. first of all, the president at the u.n. we've got new details this morning on what he will say. we are told that he will address the crisis in the middle east,

all of the protests against the u.s. embassies and americans there, saying that we need to take a deeper look at the cause of the crisis and will denounce the vie leolenviolence. no video he'll say justifies the attack. he's also expected to talk about iran preferring diplomacy but saying iran getting a nuclear weapon is not a challenge that can be contained. meantime mitt romney criticizing the president for those bumps in the road will also speak today about all the foreign aid that we're giving developing nations. he will say we need to tie that to those nations breaking down trade barriers so small businesses can get in there not only to be profitable but also to create jobs. two important speeches in new york by both candidates today. laura. >> and we will be watching. thank you very much, tracie. new this morning, we're getting fresh, new video from china on that huge brawl that took place at an iphone factory. a worker claiming this video was

shot the day after those riots broke out. chinese bloggers say more than 2,000 employees broke into a fight after one employee was reportedly beaten up by a security guard. foxcon disputes those charges and now says it was a private dispute. it actually had nothing to do with workplace conditions. the company ended up shutting down production for a day. a popular pigout food may soon be harder to sign. an overseas industry group for pig farmers says there will be a pork and bacon shortage next year in europe. they blame drought conditions which damaged corn and soybean crops. farmers are finding it too expensive to feed their animals and have been forced to reduce the size of their herd. what this means to european consumers is that the price of local pork products at local grocery stores could go up. i guess you could say the garden state is trying to control the situation when it comes to starting a reality show in one of its cities. a state assemblyman introducing

the so-called snooki bill law on monday. no joke, the snooki bill law. the new law would let new jersey municipalities impose certain conditions on shows, such as requiring crews to pay for additional police officers. now, this law, of course, is named after the one and only, there she is, the always tanned snooki, one of the stars of "jersey shore" which begins its final season next month. never too soon for that. >> snooki mama now, i guess. >> she's probably honored that there's a law named after her. >> i'm sure she is. >> there's some jealousy amongst the other members as well. good morning to you. it's going to feel like california, the way we like it out here this morning. it feels crisp. we're actually starting out on track with our seasonal lows, but our highs are going to be warmer than average for this time of year. i wanted to show you this live picture of san francisco. you can kind of see the fog lurking in the background but ft

time being visibility is pretty good. we're expecting the fog to be at its worst between 6:00 and 8:00 this morning. we're looking pretty good right now. i did want to point out between gilroy and morgan hill you'll find thick pockets of fog. you can see that indicated by the shagt heding here. take it really easy as visibility drops off as you head up the hills. so calm conditions more or less from napa to santa rosa. we've got a westerly wind at 5 miles per hour novato. whenever you see that westerly flow, that's cool ocean air coming off the pacific moving into your inland valleys and that will be the case for today. that's going to keep your temperatures feeling a little more comfortable by the day's end when the winds ramp up at their strongest. so warm conditions for today, even warmer tomorrow. high pressure just keeps on gaining strength and moving in as we head throughout the week and that means we keep on climbing gradually up until about saturday. so today we're talking the upper

80s. we'll trade upper 80s in for low 90s tomorrow. and then by saturday we're talking about the upper 90s. potential for triple digits across the bay area. that means you want to head to the beach. sunday and monday temperatures start to drop off. we might get a storm system next week, guys. hard to believe that. we are watching a system out in the pacific. let's see what mike is watching at 5:46. we're watching the volume of traffic starting to build. it's traffic tuesday so we expect early slowing. there's a really good volume of traffic but still speeds close to 60 for 101 north of 680. 280 starting to build up as you come over toward the highway 87 interchange. and building over toward the 880/17 interchange as well. slowing showing up headed north. no problems between here and the summit, a smooth drive here. we will look at some live

cameras coming down into the area for 880. fremont shows a nice flow of traffic. here's southbound heading over towards mission and heading up into hayward, a smooth drive for 880. the volume building so expect speeds to start dipping through oakland in the next 20 minutes. another live look outside shows you the peninsula side of the san mateo bridge. the volume really builds for this westbound commute direction but no major slowing. there's construction crews blocking one lane but they're starting to move the sign truck. expect a little slowing for the next ten minutes until it clears the bridge. the golden gate bridge, foggy conditions here, likely also for mon tara, el granada on the peninsula and in the north bay, bodega bay right along the water. the bay bridge, no problems, guys. easy flow. back to you. 5:47 right now. oakland police say they have a second man in custody in connection with a deadly restaurant shooting near jack london square. officers arrest lag mmar fox

earlier this month. they say fox and clem tompkins fired assault rifles into sweet jimmi's restaurant. two men died during the shooting and five others were injured. both fox and tompkins are now waiting trial. 5:48. san francisco's board of supervisors will decide today when to harry the official misconduct charges filed against suspended sheriff ross mirkarimi. the board is considering a special meeting to hear those charges on october 9th. mirkarimi was suspended after a domestic violence event left his wife with a bruised arm. mirkarimi would be removed from office if nine of the 11 supervisors vote against him. san francisco mayor ed lee filed those misconduct charges against mirkarimi but the board hearing could put him in the hot seat. a san francisco examiner reports some current and former city officials claim the mayor perjured himself when he testified to the ethics commission back in june.

mirkarimi's lawyers asking the board to subpoena four officials for the october hearing, including former board president aaron peskin. peskin says a member of lee's staff approached him and asked if mirkarimi would be willing to step down as sheriff and take another job. mirkarimi agreed if he was named the undersheriff. peskin said lee refused. right now we have good news, very good news regarding raiders wide receiver darrius heyward-bey. it looks like he's going to be okay. he was released from eden medical center just yesterday and he's at home resting comfortably. actually has a concussion and a little bit of a neck strain. he is expected to make a full recovery following that brutal hit. he was injured during a helmet-to-helmet hit on sunday. as he was being carted off, he managed to give that thumbs up. he's getting a thumbs up from doctors. slowly recovering, but good news. >> just 13 years old, a san

francisco boy serving as inspiration of beating the odds, not to just his piers but everybody, including his mom. he was awarded a medal of courage by general colin powell. at two weeks old he was diagnosed with a rare congenital heart complex that makes it very difficult for blood to circulate in and out of the left side of his heart. he's undergone at least three surgeries, including two open heart operations. up until a couple of years ago he was having major problems breathing and was forced to stay in the hospital at least once a year. >> it's kind of hard because i never really -- like i didn't want to be in the hospital and i never really knew when i was going to get to come back home. >> like every boy loving baseball, soccer, his dream is to join his favorite sports team, the giants. he hopes to touch other kids, especially those who are struggling with his story of survival. >> what a great story.

an apple map user walks into a bar or possibly a bowling alley or cornfield, he's not really sure. google chairman eric schmidt says google has not submitted a new google map app to the apple app store. he made that statement to reporters in japan this morning. many apple iphone users had hoped google was going to come rescue them from apple's own maps. now, why would google deny people a very good map app that everybody clearly wants? perhaps because google sees this as a huge gift, sort of like that nfl call. you can have yourself a google map app, you just have to buy an android phone. google hit an all-time high in monday' trading. wall street examining the latest house price numbers this morning. facebook shares under restriction. we'll talk about that as bit more in a bit. samsung has filed court papers alleging the jury foreman in that billion dollar patent case in san jose should not have

brought his own experience into the jury deliberations. bell hogan is an engineer. he told reporter, including our panel on press here, that he did use his own experience in obtaining his own patents to better understand the case against samsung and he did use his experience to explain what was going on to other jurors who were confused. samsung in court papers say jurors should not bring their outside experience into the jury room, they should rely only on the evidence they were presented. of course samsung is trying to reverse as much as a $3 billion lawsuit judgment against them. >> they could have had that juror thrown out perhaps. >> still a lot of chapters to unfold in this one. >> very interesting when it comes to those juries. all right, what about the forecast for today? we want to check it with christina. >> we've got a good-looking day shaping up and the first part of the day is going to be comfortable inland. 89 degrees. 76 bayside and 69 at the coast.
