good morning. >> reporter: jon, good morning. we're live outside the san jose police department. this crime still has many unanswered questions. in fact, the police department here, police say they're still trying to figure out if this man was shot or stabbed. as you mentioned, it happened outside los palapos restaurant on south side road after 11:00 last night. police say the chef was on his break when he was jumped. police arrived to find him on the ground with serious head injuries. he was taken to the hospital where his exact condition is not being released this morning. the lieutenant on scene says police are talking to witnesses trying to find out how many suspects they're actually looking for. >> the reports were that several males fled from the area. we're trying to determine if it was one or two suspects or more. >> reporter: this crime happened in area that has been plagued with violence. you may recall just last month a man was stabbed to death inside

the safeway store on story road. that safeway is only a half mile from last night's incident. now, again, no arrests have been made in this latest crime to hit east san jose. police say they're still trying to determine if this attack was gang related. live in san jose, "today in the bay." big safety changes are coming to a elementary school after a student was abducted. police will learn of those changes just a few hours from now. now, more details. gro good morning, bob. >> reporter: good morning, laura. police have questions about how this man was able to get on the grounds, grope a 9-year-old student and then abduct her from campus. this morning the superintendent and chief of police will meet with parents to address their concerns regarding changes.

parkside elementary has installled a new lock. gates, cameras. and all the principals in the district are reviewing safety procedures. police arrested a man on friday. the 25-year-old man allegedly followed this 9-year-old student into a school bathroom, globed her below the waist and then covered her mouth as he dragged her to a house a couple of block, away. she escaped by kicking and throwing rocks at him. >> she took steps followingth advice that her mother had given her about what to do if ever in a situation where somebody inappropriately tried to do something with her. >> reporter: the district attorney tells us that earlier in the day a school secretary escorted him off the campus because he was acting suspicious. he traveled to bay side where he allegedly asked a middle school student if she was a virgin. he also gave two boys there sips of vodka.

morasic was charged in court yesterday. he's expected to enter a plea to two felonies and six misdemeanors next week. reporting live, "today in the bay." the man accused of killing a teen will not be in court today as originally planned it he was scheduled to enter a plea today but decided to waive his appearance. garcia torres being held without bail. jury deliberations continue this morning in the trial of his father. he is accused molesting two family relatives. prosecutors say both were under the age of 10. christopher butler, the private investigator at the center of a scandal involving dirty duis and stolen drugs was sentenced to eight years in federal prison. nbc bay area was the first to obtain this undercover video, showing butler and the former commander in the drug enforcement team.

allegedly taking part in an apparent drug deal. butler admitted he teamed up with him to steal drugs from police evidence lockers and then sell them back on the street. he's willing -- he was willing to testify in court which garnered him a lighter sentence. he has pleaded not guilty when scheduled to go to trial in january. the search is on this morning for an armed gunman involved in a high speed shootout that shut down a busy freeway. the attack happened on i-580 last night. today in the bay's christy smith is live where police say the car riddled with bullets was left on the side of the freeway. christy, good morning. >> reporter: good morning, jon. a very strange situation. i just spoke with the sheriff's spokesperson. he tells me this morning they're asking for the public's help. anyone who saw this shootout take place. they think now it's possible bullets were actually flying from two different cars on the freeway.

this shootout happened last night around 7:00. ended up shutting down lanes on a two-mile stretch of 580 westbound while the chp investigated along with the county sheriff's department. what they know is a burgundy ford taurus was found shot up on the side of the freeway and abandoned. it's believed some people got out right after the shooting and ran possibly tworsd the bart station and they think a second car may have come and picked some people up on the freeway. the only description they have of the other car is that it was white. sheriff's deputies tell me they did call hospitals around the area to see if anyone was hurt. so far, they haven't found anyone that was hurt. reporting live, christy smith, "today in the bay." san francisco is reporting its first confirmed human case of west nile in seven years. the department of public health says the man who was stricken by the disease is recovering at his home. it's likely he was ineffected in

the bay area. this latest report comes amid what will probably be the largest west nile outbreak in the nation since that virus actually arrived 13 years ago. >> angry shoppers at mi pueblo looking to stop the chain from using a new federal program that checks the immigration status of its workers. they plan to rally at our lady of guadalupe in san jose at 4:00 this afternoon, and then march to mi pueblo store. organizers are vowing to boycott the store if m spa pueblo's owner does not change his mind. the company says that it only affects new hires. >> time to check the forecast. it's a hot one. >> yeah, it is, oddly enough. the first official week of fall. feeling more like summer. we have more of a climb to go in terms of where your temperatures are headed. so make sure you're ready for

that. especially if you live in one of the hotter cities across the bay area. you know what i'm talking about. the trivalley will be hot. it's something we're noticing this morning. mostly clear for now. that will not be the case much longer. you can see we're already dropping off in santa rosa to a half mile visibility. you can see from this white shading up and down the peninsula getting a lot more fog than yesterday. that fog is going to cool you off. however, temperatures dropping off one or two degrees from yesterday. it's going to keep high temperatures from soaring. tomorrow, off shore flow pushes that marine layer back out to sea. as a result, our temperatures soar. this is the last relatively mild day in the extended period. 75 degrees in livermore. comfortable at lunch. hot by 4:00 p.m. 84 degrees in livermore at the end of the day. in san francisco, a lot more sunshine on the way. hotter weather as well. that means you're going to get some great beach days. yeah, coastal residents, get

november. the plans are on the table to alter current building codes to allow these units which measure 250 square feet total. that's 150 square feet if you don't approve bathroom space. supporters say this will provide affordable housing for tech workers but opponents say this will increase the city population which will ultimately strain services. overseas, we've been watching the streets erupt in violence in greece and spain. people there reacting to their government's austerity plans. scott mcgrunow. those people have a lot to use. so does the country. >> reporter: everyone does. they've grown used to easy credit. high pension payments. lots of government services. this is what it looks like when you take that away. 50,000 people joined a union organized march in athens. violence broke out. there a general strike there as well. and we are hearing about tremendous violence. these pictures just very new to

our newsroom this morning. 64 people were injured in a similar protest in madrid, spain. spain, greece, other countries are in serious debt. they're having trouble borrowing more money. because their interest rates are so high, no one will lend them money, at least not cheaply. that means something has to give. in this case, it's all the benefits the crowd got used to enjoying. curiously, germany, the most stable economy in europe, reported this morning it is having some trouble selling some its bonds. no doubt wall street will keep a careful watch on this situation. we'll continue with bertha coombs live at cnbc world headquarters. good morning, bertha. >> good morning, scott. yeah, basically that general strike called in greece ahead of what people anticipate are going to be some pretty dra kdraconia cuts to be announced by the government. in spain, folks are bracing for cuts as well. the markets watching all of

this. once again essentially the european crisis is what is setting the tone. it started yet, when protests in madrid got out of hand. some 5 dozen people were injured. 38 were arrested. the dow had its worst day of september falling 100 points to 13457. s&p also having its worst day, falling 15 points. the nasdaq had a rough day as well. falling 43 points to 3117. apple one of the big losers there. the futures again under pressure as we're watching that situation in europe. watching here for some housing data. so far, the housing data has been pretty good. yesterday, we had a pretty good case, you'll remember. we're getting new home sale numbers later on this morning. it has been five years since jk rowling last published the final installment of her harry potter series. she's back now with her first novel that actually is meant for

adults. a lot of adults read the harry potter books. this new one for adults called the casual vacancy. it hits stores thursday. 2 million copies ready to go. the largest print run of the year for the book group. little brown imprint is publishing the book in the u.s. it's already number two on amazon, scott, as far as preorders, but i'm not sure you want to let the kids read this one. i hear there's a lot of racy material in there. >> we'll have to take a look and make sure. thank you. says it will have to sell more stock. 5 million shares. investors hate when companies say that. new shares dilute the value of old shares. also, it raises a very big question this morning. why does tesla need more money? they snuck that announcement in at the time they announced new solar refueling stations. it is called a secondary offering. far bigger news than any refueling station. in a financial filing, they also said they will make fewer of

gusty winds as high as 40 miles per hour slowly pushing the large fire across rural sections of eastern san diego county. 11 homes have burned so far. at least one person has been killed. the fire has scorched more than 4 miles of land since it first ignited on sunday. so far, more than 1,000 firefighters have been able to contain about half of that flame. a new way to get around san francisco that is easier. scoot networks made its scooters available to the public. people can rent these scooters for a short time. little periods here and there. perfect for running around for errands. the first location will be mostly south of market neighborhood. users can sign up online and pay $10 to join. >> that hip little music follows you everywhere too. >> foot to hagot to have a helm.

today's not going to be that bad. by tomorrow, you'll start to feel the heat. then it really kicks in. hottest days in the extended period will be friday through sunday. today, 89 degrees inland. around 69 degrees at the coast. we're going to talk about what this hot trend of whether means for your fall foliage. when those leaves are going to start changing color. how's the drive shaping up? >> it's shaping up pretty predictably. here over in the east bay we have the dublin interchange, that orange just showed up. that's pretty typical about now as well. a new incident just reported on chp. we'll check to see if that's in lanes. a typical slowing pattern into livermore. orange where you're coming down toward 45 rather than 50. we'll get a live look outside.

off campus because he was acting suspicious. he traveled a mile to bay side stem academy where he allegedly asked a middle school student if she was a virgin. he gave two boys there a sip of vodka. he was charged in court yesterday. he's expected to enter a plea to two felony charges and six misdemeanors next week. reporting live, "today in the bay." the assistant head coach of uc berkeley's women's swim team is suing for sexual abuse she says she suffered back in middle school. 30-year-old kristin filed the civil complaint just yesterday. the lawsuit alleging negligence, fraud and emotional distress. saying school officials turned, quote, a blind eye to the abuse. even after learning of the complaint. she says she was raped more than 100 times. the school superintendent is not commenting so far on the lawsuit.

firefighters are keeping a close watch over a house that went up in flames. video was captured by a neighbor. three people were inside the house at the time. they managed to get out safely. the fire, however, ripped through the home's attic and the highly flammable wood roof shingles. neighbors helped put water on that fire using garden hoses till firefighters finally arrived. >> it's just a reaction, you know, one, to make sure if people are safe, everyone's out of the house. two, just, you know, try to save my neighbor's house. it's hard to think of losing your home, you know, whether it's 30 years, even ape year. but the most important, only thing going through my mind was the fact that all my family was out and everyone was safe. >> fire investigators say the fire started inside the garage. the homeowners have lived there for about 30 years and they say they plan to rebuild. this morning, we continue to follow developing news out of the south bay.

a san jose chef right now in the hospital after he was attacked while relaxing on his break. this happened outside of the los alapas restaurant on south bay road. live now with details. >> reporter: this all happened just about 6 1/2 hours ago. so far, no arrests have been made which of course means san jose police are still looking for the suspect or suspects wanted in this case. police were called to the scene after 11:00 last night. police say the first call was for assault and battery. that quickly upgraded to a weapons call. police arrived in front of the restaurant on south white road in mount vista to find a man with serious injuries to his head. he was lying on the ground in between the restaurant and the next door 7 eleven. police say he is a chef and was on a break when he got jumped. >> the vick tips at the hospital now were trying to determine if

he was stabbed, shot. we're not sure exactly. he's in very serious condition. >> the man was taken to the hospital where his exact condition is not being released this morning. police in the meantime, are trying to determine how many suspects they are looking for. witnesses say several males took off from the scene on foot, so they are tibing to speak with those witnesses this morning. the good news is they say these witnesses are forthcoming with information. so that means they're being cooperative. which isn't always the case in violent crimes investigations. i have a call in. i'm waiting to hear back. live at police headquarters in san jose. the teenage driver accused of killing a father and daughter in concord, we learned, may be changing his plea. he pled not guilty to felony

vehicle manslaughter. police say he was speeding through concord in april when he swerved, hitting the man and his two daughters. nuri and his 9-year-old daughter hadesa died. 12-year-old hanna suffered minor injuries. the nuri family says it will work with lawmakers to pass stricter laws for people involved in deadly car crashes. a memorial bench was unveiled. it will be placed at ignacio valley park. bart will hold a special meeting tonight explaining new ways it plans to handle public complaints and concerns about its transit police officers. the agency created an independent police auditor position and a citizens review board to monitor bart police officers. tonight's meeting will be from 6:30 to 8:00 at the richmond recreation center complex on mcdonald avenue. meteorologist christina loren points out mother nature

is not ready to release fall weather on us. >> we've got a good looking weekend. it's going to feel like summer. it's going to be perfect for that. as temperatures approach the century mark. and we're talking about a heat wave that extends into monday. then we get some stark changes. rain showers on the way next week. 55 degrees in liver moore to start. great looking day shaping up. it's going to be hot out here in the east bay where you're starting out in the 50s. you'll be in the 70s by noon today. and then by the end of the day close to 90 degrees. cool ocean air though. it's indicative wind speeds out of the west. west in fairfield. in livermore it starting to see winds shift to the northeast at the south end of the bay area. so what that means is between today and tomorrow our temperatures are going to jump by 5 to 10 degrees as off shore winds increase. 89 degrees today.

"the washington post" says he has an eight-point lead in that important battleground state which means mitt romney may have ground to make up. he'll be there today as well. he's been talking about taxes. he's been talking about jobs. the jobs issue may not resonate as much with ohio voters because their jobless rate is actually less than the national average. watch the ads to.

the tv ads. a couple new ones rolling out today. the president will focus on mitt romney and the 47%. the people who don't pay taxes that he says romney simply dismissed. romn romney's new ad focuses on an area he wants to get more support, the struggling middle class. also watching close as the president is ahead by 4% in florida so you'll see some concentration there as well. laura. >> amazing to watch. thank you, tracie. iran in the international spotlight at the united nations. iran president ahmadinejad expected to address the u.n. national assembly. ahmadinejad says the nuclear program is being used for peaceful purposes but israeli leaders fear iran is building weapons of mass destruction and they're calling for delegates to boycott that speech. the search continues today for more victims of the speed freak killers. fbi agents were doing what they

call a site survey. it was the area where the remains of several victims were found earlier this year. no actual digging took place but agents used a backhoe to investigate the soil. two men were arrested for several murders in the 1980s. last month, he was escorted out of the prison to actually try to pinpoint the location of more remains. there was a high speed shootout. police are looking for the gunman that shut down interstate 580 in castro valley. "today in the bay's" christy smith is live near where that shooting happened. what did you hear? >> reporter: good morning. a sheriff spokesperson says they're asking for the public's help because they haven't been able to speak with anyone who was involved in the actual shooting even though there was gunfire out there on the freeway on interstate 580 last night.

and they found a burgundy ford taurus abandoned on the side of the road westbound on 580 in castro valley. the shooting happened last night after 7:00. that car taken into evidence. it may have paper plates on it. investigators tell me. which is making it a little harder to trace. what they do know is that someone opened fire, pose bring in a white car. that ford was hit several times. it's unclear if anyone inside the car fired back. but they tell me that people inside the car ran. maybe ran toward the bart station and got picked up by another car. chp and sheriff's deputies investigating. they tell me they've checked area hospitals to see if anyone was hurt in all this. so far, they haven't found any victims. reporting live, christy smith, "today in the bay." >> thank you, christy. christine loren joins us to talk about soaring temperatures this week. >> we have them to talk about.

a story to tell in the weather department. it's been pretty similar as we've had the past couple of months. hasn't been too extreme this summer. fire season hasn't been that bad. yeah, it's still going to be hot. i do want to refrain from saying that just yet. you really want to be on your best when it comes to fire safety. it's going to be hot. we're talking about triple digits. i want to start with a live picture over san jose. city hall looking good. we have some clouds overhead. they're going to clear quickly. look at this though. down to about a half a mile visibility in santa rosa. you'll see here where the shading is starting to develop, that's where we're expecting the fog to get the thickest. and through your interior valleys up in the north bay. temperatures this morning are comfortable to start. they're going to soar as of noon in the east bay. we're going to get a little bit of cooling particularly at the coast. 54 degrees in san francisco.

59 degrees in sunnyvale. we've got a robust on shore flow this morning. for us, that means the fog is going to hang around longer. temperatures will be cooler with limited sunshine for the first part of the day. high pressure really takes control. this guy is moving in quickly. it's going to clear our skies completely. we're talking about stellar sunshine. in fact, sizzling sun out in the east bay as we head through this weekend so 88 degrees today in livermore by sunday. 98 degrees. getting very hot rapidly. 95 on friday as we head through the weekend. next week, things really change. 91 degrees on monday. tuesday, you'll see clouds increase. starting to feel like fall. we get some showers late wednesday into thursday. we'll keep you updated on that forecast. let's check your roads with mike. >> pretty typical flow. typical build here for a wednesday. nice flow of traffic in the northbound commute direction. we're looking at 101 and 87. both from about the 680 area.

that stretch for both of them shows you the slowing coming down into the upper 50s, sometimes 50, as you're getting tworl towards the interchanges. over here in the peninsula, 101 moves smoothly. 92 shows some slowing. over from the peninsula side, we see that westbound, we'll pick up the volume a little bit. eastbound, you see that construction site. forcing folks over to the right one lane. i saw a lot flashing lights moving east. that was enough mood distraction to trigger those sensors. just a little slowing. over on the side, we catch up with the folks, and i've been watching for the flooding lights heading towards us. another truck in the back of somewhere there. another 10, 15 minutes and this completely clears. bay bridge toll plaza. this completely starts to fill in. no metering lights just yet. about 6:15, we'll see that really change, guys. back to you. >> all right. money versus safety. that's the debate in an east bay

city this morning. city of oakland discussing whether cameras make the streets safer or rake in dollars for the city. the debate took place at a public safety meeting last night at city hall. oakland police told the city there is proof that since 2008 collisions at 11 intersections in oakland have decreased. >> the police department's experience in terms of personnel, this is one way to help us as a force multiplier and be there at those dangerous intersections. >> local act investments roger jones says red light cameras don't make intersections safer. he believes extending the timing on yellow lights is what helps cut down on accidents. bart is releasing some pretty amazing video. showing an explosion earlier this month. this scene shows a flash and then people falling backwards along with a cloud of smoke there. we'll play this one again. if you look at the top of the screen on the right, you can actually see what looks like an
