today on this tuesday, october 2nd. this is "today in the bay." 5:00 on the nose on this tuesday morning. very glad you could join us, everybody. good morning, i'm jon kelley. >> counselors at albany middle school will meet with students about the sudden death of a middle school teacher accused of molesting a student. christie smith joins us live in albany where a memorial grew overnight for james izumizaki. good morning. >> reporter: good morning to you, laura. it really is a tragic end to a horrible situation. as you said, counselors within the district that already work here are going to be talking to students today, helping them deal with their grief as they come to school this morning. and there is a memorial, there are candles, a lot of notes from student athletes saying that they love and miss their coach.

the alameda county sheriff says a family member found james izumizaki dead yesterday in a car near the hayward airport. he was just 28 years old. his death being investigated as a suicide. he was a sixth grade teacher here and a sports coach. very popular. last week he was arrested, accused of having an inappropriate relationship with a former student. the school will inform the student body today of his death but word is spreading very quickly on social media. parents got the word last night. one former student says that he's going to encourage mr. i's athletes to compete in his honor. >> get through this because he was a really good coach. >> reporter: now, the d.a. did not file charges against izumizaki because police were still investigating the matter so albany police will have to

decide the future, where this case stands. the superintendent plans to make a statement about this whole matter to the media at 8:30. reporting live in albany, christie smith, "today in the bay." we are learning more about a man who was stabbed to death outside a popular south bay bar over the weekend. police say daniel marichular is involved in a motorcycle club known as the henchman. somebody pulled out a knife and stabbed him to death. it was the 34th homicide of this year. so far no word or suspects or arrests. criminal proceedings against the man accused in the mass kelling at oikos university. his lawyer raised questions about hi competency. he was charged with killing seven and injuring others at the university in april. before the trial can resume, two psychiatrists must look into his mental state and report their

findings. if goh is found competent, a preliminary hearing is not expected to take place until early next year. the trial for the woman accused of killing nursing student michelle le continues today. during opening statements yesterday, prosecutors accusing 28-year-old gisele esteban of killing le out of jealousy, hatred and rage. they say esteban blamed le for ruining her relationship with her daughter's father. esteban's attorney did not deny the allegations, admitting there's a mountain of evidence against her client. but she says esteban did not plan to kill le but instead she simply snapped as a result of extreme provocation and the heat of passion. le disappeared from kaiser hospital in hayward back in may of 2011. her body was found four months later in a remote area between sunol and pleasanton. the trial is expected to last one month. law enforcement officers and

firefighters from east contra costa county will be honored this morning during a special church service. the blue mass will begin at 10:30 a.m. organizers say the mass is a nondenomination celebration to honor, recognize and thank the men and women whose job it is to keep the community safe. chp officer kenyon youngstrom who was shot and killed last month will receive a special harp as well. a family-owned store that's been serving the bay area over a half century will soon be closing its doors. marla tellez is live with more details on the closure of the race street fish market and what the owners are now planning to do next. marla, good morning. >> reporter: jon, good morning. i can tell you this is one of those places that you can drive by any given day and there's going to be a line out the door. this place is always packed. people fixing to get their hands on the freshest fesh and meats in town. it has been in business since

1947. take a look for yourself, it certainly has that old-fashioned feel inside. after 65 years, its four owners, all second generation family members, say the market will close in less than two weeks. they say it's just time to retire. this means its thousands of customers will have to find another place to buy their turkey this thanksgiving or that fresh crab come christmas. the doors close october 14th. one owner tells us they have sold the wholesale division to a corporation based in texas. >> it's going to be bittersweet. i'm past retirement age. i'm happy to be able to retire. on the other hand, i'm going to be sad that the family business will be no more. >> you can't, no, no. no, you can't!

>> reporter: that customer there has been coming to race street for his family's christmas dinner for 20 years. he says the holidays are just never going to be the same. again, race street is closing its doors as of october 14th. you know what, it's not all bad news. the good news is race street also has its seafood kitchen. that's what we're giving you a live look at. that seafood kitchen will stay open. in fact they are planning to expand. we're live in san jose this morning. i'm marla tellez, "today in the bay." >> you can grab us all a table for lunch. thank you, marla. the hot weather causing one south bay park to shut down. alum rock park will be closed today due to extreme fire conditions. they also want to reduce or eliminate fire emergencies. the closure is expected to last just one day. it is 5:06. speaking of all that heat,

christina loren, unusual. what's causing all of this. >> i don't know, but laura and i didn't want to be trumped by the heat so we wore red today. it is going to be hot out there. just think of fire if you want to dress appropriately. i say that it's going to be hot because we are not accustomed to this kind of heat even in the depth of the summer, but we are going to talk about the second tuesday of fall potentially smashing records yet again. when you talk about 100 degrees in places like santa cruz, almost unfathomable this time of year. 61 at concord right now, 61 in livermore. look at noon today, temperatures soar towards that 90-degree mark. livermore 87 degrees at noon time. so basically at noon we are going to hit our average highs for this time of year. in fact a little above average. we'll round out the day anywhere between 15 to 20 degrees above average. and then temperatures tumble. they drop like a rock as we head through the end of the week and we're talking about going straight from summer-like weather to winter-like

conditions very quickly. 94 in redwood city, 83 in san francisco. the seven-day tells that story. we've got it ready to go in my next report. >> we're going over here to the bay bridge where there's a nice flow over the water. we'll look at the maps and the flow is crazy easy right now. heading over the pay, construction 880, 24 typical sites and no major trauma through those zones. we will look at 24 where you do have a little more slowing than we saw before. that's westbound coming through the tunnel but the construction zone should clear in time for your morning commute. just kicking in on the right side, a little slowing out of the altamont pass. no major big surprises and no accidents through livermore keeping things moving smoothly there. there's the look coming into the east bay the bridges are smooth. a clear view of the roadways and we'll send it back to you guys -- oh, there's san jose, which is moving clearly. i'll follow that up coming up. back to you.

5:08. one of tinseltown's iconic landmarks is about to get a big-time makeover. starting today those giant letters of the hollywood sign will be stripped of all paint and during the next ten weeks workers will give it a fresh new coat of sparkling white. this project is being done, getting set for a big-time birthday bash. the hollywood sign looking good. going to be 90 years old next year. >> nip and tuck, a little pull here and there. it is also the start of an incredibly busy weekend across the bay. already talking the weekend. we're starting the weekend early because tonight the navy blue -- u.s. navy blue angels will arrive in formation at san francisco international airport. always a great sight to see. they're here to take part in this year's fleet week celebration. fleet week actually starts on wednesday and runs through sunday. pretty cool. >> and it's always awe-inspiring

this morning with more. good morning, bob. >> reporter: yeah, good morning to you, laura. we're talking about 11 teams competing on those ac-45s, those 45-foot long catamarans we saw here several weeks ago. they'll be back out here on the bay. it's coinciding with fleet week, which will be taking place this week. jenny, a competitive racer and commentator for the america's cup, good morning to you. >> good morning. i'm doing great, and yourself? >> good. you were just out here a week or two ago competing. >> yeah. >> what were the conditions like this time around? >> fall is a little different. it's much warmer here so it will be a lot less breezy, which is good and bad for the racers. there's a couple of new guys out on the boat so that will be easier for them. it makes it a little easier on boat handling. it should be warmer today, tomorrow and cooling off through the weekend, so good racing. >> reporter: i'm wondering when you're out there, this is one of the few sports that you have to

rely on conditions beyond your roll, i.e. the wind. how much is skill? >> it depends on who you ask but a lot of sailing is about reading the water, read the wind, know what the water patterns are going to be and in the bay we have currents. so some of teams have bay area sailors who have grown up and are local and understand the way the bay works and tide works. that's a really hard task. i would say definitely 95% skill, 5% luck. >> reporter: for the fan who wants to come out here and watch this, marina green is actually wide open. you guys are by the yacht club. so the best place to watch would be marina green? >> marina green for sure. right now we're in the digital house, which is like our interactive media site. we have live racing running, twitter feeds and the rest of the marina all kinds of connectivity so when they're not racing, they can check out the rest of the america's cup public village. >> reporter: and the beauty is

they timed this with fleet week so they are practicing today, qualifying, competition starting tomorrow and running through the weekend. so you can come out, see the blue angels, fabulous racing on the water and they're not happening at the same time but piggybacking with each other so it should be awesome out here. bob redell, "today in the bay." millions of dollars are being refunded to american express card holders this morning. the credit card company will refund $85 million to about 250,000 customers and pay $27.5 million in fines. this coming after the federal reserve and the consumer financial protection bureau claimed amex violated federal laws prohibiting deceptive practices and charged unlawful late fees. american express said customers entitled to the refunds will be notified as soon as possible. facebook, meantime, trying to convince the government its like button is something special. scott mcgrew is here to explain. >> those like buttons are

everywhere. when you click a like button on a news article or picture somewhere on the article, even if it's not on facebook, facebook is tracking that data. now, that is a problem if the person doing the clicking is under 13. the children's online privacy protection act says you can't record what kids do online, so in this letter facebook wants the justice department to consider the like button part of a free speech right instead of just a way of collecting data. the irony in all of this is kids under 13 aren't allowed on facebook in the first place but facebook is being realistic here. it doesn't want kids as members but it knows there are kids there. and it is collecting the data, which right now is contrary to law. in russia, the like button clicks you. russian prime minister dmitry medvedev welcomed mark zuckerberg to moscow monday. zuckerberg will lecture at state university there. russia has a growing i.t.

help you beat the heat and plan accordingly when it comes to that cooldown after all. a lot happening. it's a great time to be in the bay area, columbus day weekend pretty much off the chain. taking you live outside, san francisco this morning completely clear conditions. this is beautiful. if your catching a flight, don't worry about flight delays due to low ceilings, but you can tack a beautiful, clear look at the city. a very rare occasion for early october. let's get right to it this morning. this is where we ended up yesterday, 103 in gilroy, 102 walnut creek, livermore hit 100, 96 in south san jose and san francisco, it was the coast that saw the hottest day of the year. 90 degrees in san francisco. highly unusual for the first day of october. as we head throughout the day today, i've taken your temperatures by a cup of degrees. novato 955 to start. no clouds out there this morning and a hot day ahead as a result. but here's where it gets interesting. we've got an area of low

pressure that is chugging right along getting closer to the california coastline. as it does so, it's carrying along about it some very cool air and a lot of moisture. so we're talking about not only a cooldown, our first showers of the season just day as way. 93 in san jose, 100 in livermore, 101 in gilroy. take off 10 degrees tomorrow, another 10 degrees for thursday and then look, we jump to the 70s by friday. now, saturday and sunday i think we will see a little bit of shower activity up in the north bay and drizzle is likely at the coast. so it's going to get very, very cold around here in comparison to where we're starting the week as we finish off the workweek and head into the weekend. yeah, you want to keep your summer wardrobe handy, your fall wardrobe handy and your winter wardrobe ready to go as well. >> good morning. yes, everything at the ready. we're ready for the morning commute, although the last couple of weeks after things settled down and school started really hitting hard all over the

bay. this morning northbound routes looking pretty good. we're looking at 880. the northbound slowing we had past the construction zone cleared from montague up toward brokaw or brokaw toward montana go -- montague, i should say. farther up we're looking at 880 through fremont. an easy drive past the truck scales on the side of the road heading north. both sides of the nimitz moving nicely. heading up toward the bay bridge, a smooth drive at well. light volume so far and no delays for the east shore freeway getting over the bay. we'll show you the north bay, picking up the volume southbound 101 through san rafael. no delays novato all the way down past the richmond-san rafael bridge. look at this peninsula shot, this is beautiful. it's so clear we can see 101 coming around, this is sfo and san bruno so not much traffic but a beautiful view.

don't always get that, guys. it's 5:21. laid-off firefighters could soon be back on the job. the east contra costa fire district received near low $8 million in federal grants. that means 15 positions that were originally cut will now be filled. fire officials say they'll also hire an additional dozen other people and three fire stations that were closed to budget cuts will now be reopened. the next big quake has some east bay water officials very worried this morning. that's why they're planning to upgrade an eight and a half mile stretch of drinking water pipeline. it is currently buried along the hayward fault line between fremont and union city. the digging there is expected to begin next summer and the project should be done by late 2014. 5:21. coming up, a fire ball caught on tape. a massive fire burning through the night. hear what nearby homeowners say happened just moments before those flames broke out. here you go little man.

good tuesday morning to you. taking a live look outside. pretty clear across the bay area this morning, pretty hot as we. those temperatures, boy, are they going to turn around. it's a forecast you'll want to watch. stupid, christina has a look at it coming up. this morning in winnipeg, canada, firefighters say they have the upper hand on a massive fire. crews have been able to control this blaze that tore through a large tank holding racing fuel. it's been burning since yesterday afternoon. the fire produced several loud explosions and fire balls and nearly 100 homeowners were briefly evacuated. nurses at a north bay hospital walking off the job and this happened just about 20 minutes ago. today, day one of a two-day strike for nurses at santa rosa memorial hospital. that strike started at 5:00 this morning and will end at 5:00

thursday morning. union leaders say recent pay cuts and wage disagreements are at the center of all this. the hospital says hundreds of replacement nurses have been brought in just to keep up with the hospital needs and open during the strike. we want to check the forecast right now as promised with meteorologist christina loren. it was so hot yesterday, did we break any records? >> we broke numerous records. i think the most substantial record of note is hayward, 95 degrees. just smashing the old record which was 82 degrees. as we head throughout the day today, we're talking about another scorcher, but when you hit 95 in hayward and not much warmner places like santa rosa, your valleys, it's an indication of offshore flow. basically the marine influence has been negated by offshore flow so it feels as though we are inland and not getting any of that pacific marine influence. 100 degrees today, 90 bayside, 80 at the coast. big-time changes ahead many we'll dive right into winter and show you that on your seven-day forecast. first we want to get you out

christie, good morning. >> reporter: good morning to you, jon. i just spoke with a father, his daughter goes to the school, spoke hwith him off camera. he said his daughter is home crying right now. he thinks this will be a heart-breaking day for students here at albany middle school. there are kangdss and notes left out here today. counselors will be here to speak with students. the school will officially inform students of what has happened. many already know and are saying on these notes that they will miss mr. i, what they called him. the sheriff's department says 28-year-old james izumizaki was found dead in his car yesterday morning near san lorenzo. this is being treated as a suicide. izumizaki was a sixth grade teacher here, very popular and well liked, but he was arrested last night on suspicion of performing a lewd act on a child under 14, a former student. parents got a call last night about his death. one parent told us kids really

need to tell the truth. >> you can either make or break a kid in middle school. you know, hopefully this doesn't do any damage to any of the kids. >> reporter: now, he posted bail and was released shortly after his arrest, but the d.a. didn't file charges. police still investigating the case. but a spokesperson for the d.a.'s office told us earlier that the case could have been presented again later in october. now albany police will have to decide where this whole thing goes from here. the superintendent expected to make a statement to the media at 8:30 this morning. reporting live in albany, christie smith, "today in the bay." a search will continue for a fisherman still missing after the boat he was in capsized sunday near half moon bay. he was with three others at the time. two of the men survived and swam to shore to get help. the body of the other missing man was found yesterday afternoon by his family not far from pillar point. the coast guard says the two men who survived were wearing life jackets at the time. laura, the cleanup continues

in the central valley this morning after not one, but two train crashes happened just miles apart. the first involving an amtrak train traveling from oakland to bakersfield. that train derailed near hanford, about 30 miles south of fresno. less than four hours later just 17 miles away, a freight train and tractor-trailer collided, causing that train to derail. now, the driver was injured as well as almost two dozen people on that train. crews working through the night trying to repair the tracks. an amtrak spokesperson says the truck's driver pushed through the crossing bars and right into the train. she says the flashing lights and bells were working at the time. 5:33. the man accused of walking into a peninsula elementary school campus and abducting a 9-year-old student is expected in court later today. 25-year-old brad low mrozek could answer to charges this afternoon. police say on september 21st he walked into parkside elementary

school campus and grabbed a young student from the bathroom. she managed to fight her way free and ran to tell school administrators. parkside has since increased security measures since that incident. over six decades, customers who wanted the biggest catch headed to san jose's race street fish market. in just a couple of weeks the store will close its dorz for good. marla tellez is live in san jose with what's behind the closure and what the owners are planning to do next. it's really a san jose fixture. >> reporter: it's a tradition, you are right, laura, but it's not all bad news. chicken, seafood, beef, pork, you name it they have it here. they have had it here since 1947. but as laura says, they are going to be closing this family-run market. these doors here, october 14th. the owners, all family members, tell us it is just the right time to retire so they went ahead and sold the wholesale division of the market to a

texas-based corporation. to think the market that served thousands of clients throughout the bay area today started in a small house on race street, thanks to a nephew, uncle and brother-in-law back in 1947. hungry folks have been coming here for their fresh holiday meats and seafood all along, so diehard customers are pretty distraught race street is closing. >> christmas eve it's an hour, it's christmas. it's part of my christmas to be here. >> a lot of memories for a lot of people. but the memories will live forever, you know. so we'll always have that. whether you're a customer or an owner. >> reporter: that owner there, jim, tells us that race street will close in 12 days on october 14th. that is a sunday. now, i mentioned there's a little good news, let's get to that. the seafood kitchen, the race street seafood kitchen, that's what you're looking at this morning, that portion of the business will stay open. in fact the owners say they have plans to expand the seafood kitchen to take over the market

i tell you what, if congress doesn't act fast, almost 90% of americans will see their taxes go up in 2013. and it's a big deal here. that could be an annual tax increase of $3500 per household. brian mooar is live on capitol hill right now with what needs to be done to save your money. brian, maybe a wing and a prayer is needed here? >> reporter: perhaps a little bit more than that. we're going to wake up january 1st with more than a hangover from all the celebrations. a big bill that uncle sam is going to stick us all with if the folks here on the hill and the president can't agree on some kind of compromise. we're talking about a huge across-the-board tax increase. every tax cut enacted since 2001 is going to just go snapping

right back on january 1st. it's called the fiscal cliff. lawmakers sort of decided to push a bunch of decision-making down the road and that road ends right about then and there if lawmakers can't do something about it. the problem right now is lawmakers are in full campaign mode. nothing getting done until after the election. the big question mark is whether lawmakers who have lost their job will be willing to come back here and wheel and deal, compromise or a short-term basis, kick that can down the road a little more, whether they will do a long-term big fix deal for everyone or whether they'll just say, no, i'm taking my ball and going home. we're talking about the bush era tax cuts going away, the social security tax payroll cuts, which are making your payroll checks a little fatter every week or every two weeks. but this isn't something that just affects poor people. they're getting hit, they're losing their credit. it also affects wealthy people. they're really getting slammed. 20% increase on the dividends. capital gains are going up. it's just an across-the-board

they're going pretty fast. jenny a sailor herself and with the america's cup, how fast do these boats go. >> these boats go up to 30 knots which is probably three times as fast as typical boats have been in the fast. it's really, really fast fun and wet for the sailors. this week it may be a little less because it's a little less windy, but still they are flying. >> reporter: for people who haven't watched this, what do you think is the allure from a fan's point of view? not from a sailor's point of view but a fan's point of view? >> the boats are really extremely cool-looking and really, really physical now. the level of talent that we have here, we're seeing the fastest sailors and it is true. for the average fan that doesn't necessarily know sailing, it's a lot more intriguing to look at than old white try angina -- triangles we had floating around. >> they will be sailing out here in the bay, alcatraz, golden

they are going to get a little help from the winds but they're going to shift. let's start with what we're dealing with right here, right now. beautiful, beautiful start over the city by the bay. what is more beautiful that yesterday as we're dealing with better air quality, we don't have as much haze out there so you can actually see for about ten miles. it's just gorgeous out there. now, temperatures are going to be hot yet again and part of the reason why is a very mild start we have. 63 in monterey where they almost hit the century mark yesterday. we're at 58 in sunnyvale. what you'll notice, these temperatures are almost uniform. throughout this afternoon they will be uniform yet again. livermore starting out at 63, but the hottest city in the east bay was pleasant joopleasanton. they hit 103. you're fair game for breaking more records this afternoon. high pressure is the reason why, driving those winds offshore. they pump from land to sea, warm u and dry out along the way, pushes the marine layer way out

into the pacific. for us, we're talking about a 10 to 15-degree above average day yet again. dealing with better air quality and have a high fir danger. but major changes ahead. we've got an area of low pressure tracking closer to the coast. this thing is actually getting some pickup. so as it moves closer to us, it's carrying a lot of moisture, it's carrying cool air, it's going to bring temperatures down by 20 to 25 degrees by the end of the week. the patchy fog returns, the drizzle at the coast returns and so we're basically jumping right from summer-like conditions today to winter-like conditions toward the end of the week and i'm talking friday. so 72 hours ahead we have some major changes. 96 in santa teresa, 102 degrees out in gilroy. it's going to be hot. 93 as we head through tomorrow. here's the details. 102, take it down about ten degrees for tomorrow. take it down another ten degrees for thursday. by friday we're in the upper 70s inland. saturday and sunday, the choulo

the bimg toll plaay bridge toll. cash lanes are starting to back up. a little warning for some pb & j fans. a massive recall for a list of popular peanut butter brands expanding this morning. new mexico-based sunland adding more store prabrand names to it recall list. they provide peanut butter to major chains. some of the brand names through target archer farms, safeway open nature and fresh & easy to and a quarter a few. also on the list, nature valley, earth balance and serious food. this recall first started after some people started getting sick after eating trader joe's brand peanut butter. centers for disease control and prevention says there are at least 30 cases of salmonella illnesses across 19 states. 5:51. coming up, new worries for parents. why there soon may be a diaper shortage. no shortage of ipads.

yahoo!'s ceo is very busy at work but she's taking a little time off now, some well deserved time off to spend with her new baby. marissa mayer giving birth to a baby boy sunday night. both mom and baby we're hearing are doing just fine. so far no name has been announced, but there are some rumors she's been e mailing her friends and family asking for name suggestions. mayer took over yahoo! in july. she says she plans to take a few weeks off of working, maternity leave. >> she's got work now. parents are being warned about the possibility of a

worldwide diaper shortage. it all stems from a weekend explosion at a japanese chemical plant. the plant is the world's largest producer of acrylic acid, and that acid is actually the main ingredient in those super absorbent polymers which is the key in making those disposable diapers. the plant supplies the makers of huggies and pampers. plant officials would not comment on whether there would be a shortage, but no doubt parents keeping tabs. new surveys show one out of every four adults in america uses a tablet computer. >> and a fast one. two and a half years ago there was not such a thing as an ipad. but now it includes e-book readers like kindle as well as any kind of tablet. for instance, the samsung galaxy tablet. there are more galaxies out there or will be. a san jose judge on monday lifted a ban on sales of the galaxy 10 put in place after apple complained it violated patents in that now landmark
