northbound 101 at 680. i do have two accidents to point out. north ten 1 101 at hellier and 85 approaching 237, an accident there has been on the shoulder for a while. sounds like paperwork but no slowing there either. back to you. new this morning a memorial service being held in san francisco today for chris stevens. he is the u.s. ambassador to libya who was killed in a violent terrorist attack just last month. stevens grew up in the east bay and graduated from uc berkeley. he died on september 11th when a terrorist agroup attacked the u.s. consulate in benghazi, libya. today's memorial service will be in the rotunda of the san francisco city hall at 4:30 this afternoon. several state and national dignitaries will attend,

including thomas pickering, a former ambassador chosen by hillary clinton to review security arrangements in libya. some experts say this is a strategic move by the obama administration. since he is conducting the investigation, he will not be able to comment on this case. and this morning secretary of state hillary clinton is taking responsibility for what some call lack of security at the u.s. embassy in libya. in a series of interviews monday clinton stressed the white house is not involved in making those particular security decisions, it is the state department that makes the call. >> that's what i was very much working on, you know, day and night to try to make sure that we intervened with governments, we did everything we could to keep our people safe, which is my primary responsibility. >> she added that tragedies like benghazi should not be turned into political battles of blame. >> laura, there's a very good chance the libya attacks could

come up tonight as president obama and mitt romney meet for their very second debate. >> this one takes place in new york with a different format than we saw a couple of weeks ago. tracie potts has more on the candidates' final preparations. >> how did it go, senator? >> great. >> team romney, full of confidence. >> mitt is prepared. mitt is confident. mittth got a good presence about him. >> team obama with a cheerleader in the wings. >> i'm smiling, i'm giving a thumbs up if he can see it. i assume that he can so i make sure that i'm always giving him that positive love. >> reporter: this second debate is a town hall format with questions from the audience and the candidates pushing their own agendas. >> these debates are giving us the ability to cut include the clutter and give people a very clear choice. >> there needs to be a more compelling economic argument made tomorrow night about why the obama/biden ticket is really the one that's going to keep the

country moving in the right direction. >> reporter: aides say the president will bring up romney's vague tax map and the 47% he dismissed in remarks caught on camera. romney is sure to bring up the administration's snafu on libya, initially calling the death of four americans there part of a riot. reuters daily tracking poll still has president obama ahead by two points, essentially a tie. and after the debate, former secretary of state condoleezza rice campaigning with paul ryan and former president bill clinton and bruce springsteen for the democrats, all of them in ohio. tracie potts, nbc news, washington. >> of course you can watch the entire debate right here on nbc bay area. that will start tonight at 6:00 sharp. governor jerry brown begins a big push for his tax initiative today. governor brown will be at ucla talking about the effect proposition 30 will have on students. the measure would raise the sales tax and income taxes on california's highest earners.

brown says the tax increases are necessary to fund public schools and higher education. nbc bay area political analyst larry gerston says college students are a natural target for the governor's message. >> these people will suffer directly, as will k through 12 students, if in fact prop 30 fails. if it wins, not only will the bleeding be slowed, but in fact they may get a tuition rebate for all the increases that they have paid the last couple of years. >> proposition 30 is facing direct competition from proposition 38, which would raise income taxes on all but california's lowest income earners. the port of oakland is launching an independent investigation into allegations its maritime director misspent thousands of dollars and did it at a strip club. the investigation centers around a $4800 expense from back in 2008. it shows the maritime director took a dozen or so shipping executives to an upscale strip

club in houston. port commissioners held an emergency meeting last night to take action. >> they passed a resolution authorizing the retention of outside counsel to conduct an independent outside investigation of the alleged improper expenditures. >> now, this investigation does come at the very same time the port is involved in a labor dispute with maintenance workers over a new contract. >> 4:37. a controversial cell phone tower may not be going up next to a south bay elementary school after all. neighbors have collected more than 800 signatures opposing a plan that would put a verizon cell tower near the campus of evergreen elementary school. verizon has already agreed to lower the height of the tower but neighbors are demanding a different location away from students and away from the school. there will be a public hearing on the issue before the san jose planning commission next week. the giants faithful feeling the magic this morning and we have continuing coverage of the major league baseball playoffs.

a great bounce back for the san francisco team last night evening the series at 1-1. the g-men beat the cardinals 7-1, their first at-home victory of the postseason so far this year. it did not come without some drama in the first inning. wouf the slide into second base. matt holliday goes out of his way to knock down marco scutaro. the giants say he has a left hip injury. the giants go on to win that game and head to st. louis later on today. game three of the series is set for wednesday. >> very nice. of course fans were thrilled to see the giants win at home. they're dressed in orange and black. many even carried good luck charms hoping to send some extra luck onto the team. >> we're going to do it tonight because i have the monkey. >> it was absolutely amazing. it was the best thing.

offshore. the fog not going to be so much of a factor this afternoon. offshore flow means complete sunshine in the city by the bay and that will bring your temperature up into the 70s. 79 in redwood city. right around 80 degrees in los gatos and santa cruz. whenever you get this offshore setup, almost uniform temperatures so just about as warm today in san jose as right by the bay in oakland. we've got changes on the way. we'll warm you up into the mid-90s, even triple-digit heat possible as we head through thursday and then the rain moves in. stick around for the next couple of minutes. i've got your seven-day forecast ready to go in my next report. let's check on your drive. >> a great morning for some of these folks on 101 because they're finishing up their work day. i zoomed in, this is northbound 101 right at university just under that sign for the shopping center there. you see these folks doing their work. they're blocking all but two lanes as you see the cars coming through. the volume is light, we do see some slowing. they're putting down some new

the mountain view city council will consider tonight whether to allow a chick-fil-a to build a drive-through restaurant on el camino real. residents say the drive-through will create a safety hazard for passing cars and cyclists. of course there has been some controversy over that company this summer when the opener said he supported traditional marriage. the owner has since retracted that statement and that issue has seemed to quiet down. the city of palo alto is fighting back in a surge of home burglaries. the city has seen a 50% increase in the number of break-ins compared to this time last year. one man says he knows what it's like to be a victim of crime. thieves broke into his car twice in his own driveway. with a rise in burglaries, neighbors are holding meetings and installing new security systems. he hopes being proactive will help solve the problem before it gets worse. >> it's not so much the property that we're concerned about, but the possibility of violence

against people. this sort of thing can escalate. >> palo alto police report 160 pittsburgh larrys this year. yesterday's rally on wall street seems to be spreading. amazon already hiring for the holidays. for those stories and the other stor e stories before the bell, we say hello to bertha coombs live at cnbc world headquarters. >> good morning. we've got the futures pointing higher. we're starting to get in some earnings. we had a modest rally on monday. stocks rose on the better than expected data on retail sales and also positive earnings from citigroup. asia and europe hire as a result, following our move. and this morning we're going to get some data on consumer prices and industrial production as well as housing coming up later. earnings already to come in. united health just posted better than expected earnings and it

looks like johnson & johnson also topped estimates as well so that could keep the momentum going as far as the futures. the dow was up yesterday as was the nasdaq. yes, it's beginning to look like halloween but amazon is putting out the help wanted sign for the holidays. the online retailer plans to hire more than 50,000 seasonal workers. it expects thousands of those people to eventually stay on full-time. full-time workers get benefits and stock grants. it follows similar news from macy's which is hiring 80,000 seasonal workers while walmart plans to add 50,000. a lot of folks will likely pick up a few extra hours on those. a lot of those folks do end up being full time. >> that's good news. bertha coombs keeping us up to the second. always appreciated. we'll see you a little later on. >> before it's beginning to look

a lot like christmas, but still feeling like summer out there. >> we've got a warm-up on the way. >> here we go. >> if you haven't had a chance to jump in the ocean or the pool during the course of the summer, you'll get another chance. very short-lived but opportunities coming in quickly the next couple days. today just a touch warmer than yesterday but the heat is really on from wednesday into thursday. temperatures this morning are crisp. grab the jacket, 58 degrees in napa, 68 in novato and 59 degrees in petaluma. those microclimates right now are playing a factor. as we get offshore flow later on we're not as concerned because temperatures will be uniform. what happens is we get those winds and they almost negate the marine influence. 55 degrees in san jose. as we head throughout the day today,his is what we're expecting in terms of cloud and fog. we stop the clock on your futurecast. getting a little cloud cover at that point hugging the coastline. and that will maintain all day

welcome back, everybody, on a tuesday morning. how about a live look outside on the embarcadero. always a sight for your morning eyes trying to get rid of the bloodshot there. it is 4:53. you know, it has been seven months, hard to believe, since morgan hill teenager sierra lamar disappeared on her way to school but her friends and family want to make sure she's not forgotten. the 15-year-old vanished the morning of march 16th after

leaving her home in morgan hill. since then hundreds of volunteers have joined search parties scouring the south bay in hopes of finding clues. tonight a fund-raiser will be held at kaenyama japanese restaurant in fremont from 5:00 to 9:30. the restaurant will donate 10% of all the dipper proceeds to the search fund. moving to a little nba news. the warriors meeting with their new neighbors in san francisco. team officials getting a little sneak preview of their vision for a new waterfront arena at piers 30 and 32 in san francisco. that arena includes glass walls, access to the bay and large open terraces. sounds pretty nice. the architects say the site was designed to preserve the views. the preliminary designs are being unveiled early in an attempt to win over the support of the concerned neighbors. >> let's see if you're concerned about that morning commute on a tuesday morning. is it still light right now? it's early, mike.

>> it is light. we care about the roads and 101 past university avenue, crews on the move, starting to clean up some of the activity but you're still down to one lane and the hov lane as you pass by this exit. actually this is a pretty long stretch of construction, about a quarter mile here. so we'll follow this and any delays. we'll get a look at the maps and show you the south bay where the earlier accidents have both cleared from 101 and 85. i'll zoom in here and we do have overnight road work blocking your connector from 280 north or south onto 85 so you'll use foothill expressway an that will connect you back to 85. shouldn't be much of a problem or much of a delay. north 880 past 237, again past montague, earlier construction crews sound like they're on the move and light traffic throughout this portion. 237, that red just popping up. i'll check out what that is. back to you. 4:55. we know it's that type of year, the great pumpkin charlie brown,
