today, then very cold weather settles in. rain showers in the forecast as well. we will sort it all out for you. i have got that commute across your freeways and your brims but we are also watching that impact that bob's effect -- bob's shooting has on that -- bob and the shooting just has a local impact. all right, mike. now, a nice clear look over san francisco. that is the palace of fine arts out there on this monday, november 5th. this is today in the bay. good morning, everybody. right now, we have an update on a developing story we have been following this fremont. a police officer involved in a bizarre overnight shooting and we have learned it may ultimately affect your morning commute and that would be for thousands in that east bay. "today in the bay's" bob redell right now is live in fremont with more details, including how this will be impacting commuters. bob, good morning. >> reporter: good morning to

you, john, good morning to you, marla. this taking place here central near glenmore. we are at glenmore and central, looking down toward logan. and to the left there might be difficult to see, but there's a home where this shooting took place around 11:00 last night. police were called to the home because a man, completely naked, no clothes on, was outside with a knife and he was apparently threatening his wife, who had been living in this home with a roommate, it was the roommate who madet 911 call. when police showed up, there were two officers, they tried get the man to drop the knife, according to the police department, he didn't and he was shot and killed by both of those officers. he was taken to the hospital where he was later pronounced. the information we have on him is that he was 37 years old and from san jose. those two officers, which is standard in a situation like this, have been put on paid administrative leave. one was new to the force, having been with the fremont police from three years. the other was a 20-year veteran.

as far as the wife was concerned, we know that she was not hurt, physically not hurt. we don't know her status if she is on the scene or perhaps down at the police department being interviewed now you can see there are still several squad cars out here as the police investigate the scene. one officer says they could be out here for quite some time, suggesting that maybe this road could be shutdown for part of the morning commute. so again, if do you have business in fremont, central shut down here at glenmore to logan. so, you're looking at one city block that is shutdown. could be quite some time before they are able to get a reopened. live in fremont, bob redell, "today in the bay." closing arguments in the case of a former school district worker accused of three violent sexual assaults in san francisco's mission district. frederick dozier is accused of attacking three women from behind and dragging them to secluded areas to sexually assault them along san francisco's 24th street corridor.

the attacks happened between june and december of 2011. dozier once worked as a food server with the san francisco school district. dozier was arrested in january after investigators matched his dna to evidence from the crime scenes. jury deliberations resuming this morning for the san jose principal on trial for failing to report child sex abuse allegations involving a former teacher. jury deliberated there for six hours on friday before leaving for the weekend. they are trying at this point to decide the fate of lynn vijay endrehn, the former principal at whaley elementary school in san jose. vijay enrehn failed to take action when a parent approached her with concerns. a teacher at that school was being inappropriate with his students. if convicted, she could be sentenced up to six months in jail. new this morning, investigators on the scene of a fire at a strip mall in pleasant hill. it happened overnight on contra costa boulevard right off the

exit from 680, near the buchanan field golf course. the fire was put out quickly but it's the cause that has investigators hunting for possible suspects this morning. christie smith is live in pleasant hill with more on what firefighters found near the building. christie, good morning. >> reporter: good morning to you, marla. arson investigators are still here and so is that suspicious device that they found here overnight. the fire damaged the center of this strip mall where crews were called in about 11:15. they saw smoke. but what stood out most was the device, something like a moltov cocktail. fortunately, it did not explode. that was single-alarm fire and crews are able to knock it down rather quickly with help from the sprinkler system here but a number of businesses were affected. this son the 500 block of contra costa boulevard, at least affected by smoke. what they don't know is who would want to do this. >> a lot of smoke coming out, sprinklers going off. when the first engine company see fire in the center of the

building and at this point, we consider it suspicious and we have an investigator on the way. >> reporter: fortunately, the businesses were closed at the time, obviously, so no injuries to report and no arrests. crews will be here for quite some time. i don't know if you can see it there in the distance but that is actually the device they picked up here overnight. live in pleasant hill, christie smith, "today in the bay." san francisco right now pitching in and helping out those victims of hurricane sandy. the city's emergency manager, one of eight in the state of california deploying to new york to try and help with that recovery effort. the effort is all part of a national agreement allowing states to share emergency resources. this morning, contra costa county will continue its battle against the west nile virus. weather permitting, vector control is planning the ground fogging at the former naval weapons station in concord. the area is bordered by sassoon bay, kinney boulevard, port chicago highway and stevens road. the fogging is scheduled to start just before 6:00 this

>> good morning, scott. the futures, they are lower, the market is coming off a down week, the dow and the nasdaq ending in negative territory, not surprising it was the utility and energy stocks that were lagging in the wake of monday's super storm. also, stocks giving up early gains we saw on friday despite that better-than-expected jobs report you mentioned. the dow dropping 139 points on friday to 13,093, nasdaq close at 2,982, losing 37. this morning, data on the nice's services or non-manufacturing sector. keep an eye out for that scott? >> thank you very much. speaking of stocks, one year, john and marla this year, since the first trades in groupon. the chicago-based company turned 1-year-old as a publicly traded company. it has been a rough year. groupon traded around $20 on this day, confetti, yay! trade around $3.80, an all-time low today, down around 80%. >> no more confetti. >> no. >> got to save money. a way to get confetti to go

californians are facing big-time decisions here for many of them on election day here in the state. among the most con strollers, prop 34, i would would repeal that death penalty. political analysts say voters don't seem to know much about 34 focus instead on measures regarding tax increase and local state and nationwide elections. most recent polls show prop 34 slightly ahead here. innocence bay area's political analyst larry gerston says a long list of voters remain undecided. >> unfortunate that so many important issues like these are below the radar because, in fact, so many questions are put before the voters all at once. >> spores of prop 34 make their case saying getting rid of the death penalty would save the state more than $100 million. california has 728 inmates on death row, more than any other state. and only 13 inmates have actually been executed over the last 34 years. prop 34 opponents say the solution is to streamline the

appeals process. an nbc bay area investigation is raising questions about house to a suddens of names on our voter rolls. the reason, the names belong to dead people, some who are still vote egg. now, our investigation is prompting election officials to take a closer look at voter rolls. investigative reporter steven stock joins wuss details. >> reporter: we found more than 25,000 questionable voters on california's rolls. why? they share the same name, date of birth and zip code as someone who is dead. is it fraud? human error? a problem with the system? well, it appears the answer is all of the above. we compared the state's voter registration rolls to the u.s. social security master death index. we found thousands of questionable matches. and we confirmed dozens of those themes, names that should have been removed from the rolls. >> this is embarrassing.

>> reporter: steven weir is the contra costa county clerk and recorder. >> this is something we should have caught. >> reporter: we sent him a questionable names we found, names of people that appeared to have voted after their death. so, why are they there? weir says there could be several reasons. someone voted by mistake, a misplaced signature or his office simply did not check the rolls. >> if there is fraud taking place, it is anecdotal and family oriented it is family members voting other people's ballot. >> reporter: not just a problem here. this study di by the pew senter on the states found nearly 2 million dead people still on active voter rolls nationwide u >> it's actually hard to imagine this not occurring, given the fractured data that we have throughout this country. >> reporter: david becker supervises election research, analysis and reform efforts at the pew center on the state. >> this isn't a democratic problem, this isn't a republican problem, this is a problem for our system. >> reporter: we reached doubt several election supervisors here in the bay area and they

plaza now in light of tomorrow's election. of course, we will have live complete coverage, in depth coverage of election day decision 2012 tomorrow, november 6th. 5:24. dramatic scene off the coast of marin county, seven people, including two kids, rescued after their boat overturned just north of point reyes. the coast guard says the 25-footnoter boat got caught in heavy surf and rolled over yesterday afternoon in bait. two children, both under 6 years old, were trapped inside the cabin in an air pocket. rescuers stood on the boat and talked to the kids as they were towed to shore. then the hull was cut open and the kids were safely removed. both were okay but very cold. >> the two children that were in the water the longest were transported by the petaluma ambulance paramedics to petaluma valley hospital to be treated for hypothermia. everybody was talking. they were alert. and the best of my knowledge, they were uninjured besides being in the water for an

a knife is about to make a lot of people late for work today. bob, good morning. >> reporter: it was that the townhome a man was threatening his wife with a knife. she had been living there without her husband but instead, with a roommate. it was the roommate, also a woman, who called 911 around 11 to say this argument this altercation was going on. it was good timing police showed up when they did during their arrival, they say the man, completely naked, was chasing his wife out of the home with that knife. they say they told the man to stop, drop his weapon. when he refused, two officers shot him. the man, who was 37 years old from san jose, died later at a hospital. >> we are very lucky that she was able to get away, it happened so quickly. she was able to get out of that unit. officers arrived at the exact

time and she was not injured further. >> t rad >> reporter: the woman and the roommate were not physically hurt, but taken to the hospital for precaution. one officer with the police force three years, the other more than 20 years, paid administrative leave which is typical when you have an officer-involved shooting. could be time before they were able to reopen. right now, give the a block of central shutdown. starting at glenn more, where we are at, going one block that way toward logan. and it could be into the morning commute before that road, this road, is finally opened. live here in fremont, bob redell, "today in the bay." also new this morning, firefighters at this hour investigating an overnight fire at a shopping center in pleasant hill. they say this one was no accident. suspicious. good morning. >> reporter: good morning to you, john. i just spoke with the arson investigator on scene and he tells me what they are doing right now is looking for an accelerant but they have narrowed down the area where this fire started, that is on the left side of the burn, a salon here. what they found outside was quite disturbing, what appears to be a moltov cocktail that did not explode. i spoke with that investigator, said where was this? he said it was right outside the frond front when they came here. at the scene of this single-alarm fire at a strip mall in pleasant hill, the 500 block of contra costa boulevard, started 11:15 last night and took about 20 minutes to knock down. of course, they are calling this one suspicious. >> the first arriving engine company came on the scene, seen heavy smoke from the front of the building. a sprinkler system was going off. made an day tack through the front. >> reporter: arson investigators

say he is looking for the evidence of curved, broken glass that might suggest there was a second bought that will may have exploded inside. can't tell me if he found that or not. there was a woman sleeping in a massage studio at the time. want to find out what she heard or saw by the time the arson investigator its got here, she had left. they also tell me new information that looks like the other adjacent buildings here, the salon and then this day spa here are fine. the fire did not spread. reporting live in pleasant hill, christie smith, "today in the bay." four people are dead and seven more hurt after a head-on car crash near sacramento it happened on interstate 5 in elk grove sunday. the sacramento bee reports the ford expedition was carrying nine people when it veered out of control and crossed the center divider, crashing into a honda accord. both cars flipped and people were thrown from both cars. the driver and two passengers in the ford and the driver of the

accord were killed. all of the hurt are in critical condition. a controversial new abortion law in arizona heading to federal court today. the ninth circuit court of appeals in san francisco will hear that issue today laut would make it a mismeaner arizona to perform abortions after 20 weeks of pregnancy. the aclu is fighting that ban which it says violates the federal precedent setback in 1973. an arizona judge upheld that law in july but the appeals court put it on hold while it hears the case. for the first time notice 77-year history, the workers at rayleigh's are on strike. workers walked off the job sunday morning at midnight. 7,000 workers at rayleigh's knob hill and bel-air markets are walking the picked lines. they say they cannot afford the benefit cuts management is demanding. >> families, fighting for our

thank you. more on the local scene, some big names politics will be out in san francisco today showing their support for proposition 30, which would prevent billions of dollars in cuts to education. governor jerry brown, senator dianne feinstein and san francisco mayor ed lee will be out, get voters ready for a ral think afternoon at the embarcadero. yesterday, teachers manning phone banks and they went door to door to encourage people to vote. lieutenant governor gavin newsom telling a crowd in fremont, the future of the state's public schools is on the line tomorrow. >> we can't afford to make these cuts to the most vulnerable. heck, i'm a democrat, like i imagine many of you, because we want to eliminate poverty, ignorance and disease. we have got to step up and step in and support proposition 30. >> prop 30 would increase income taxes on individuals who make more than $250,000 a year and it would also increase the sales tax. its rival measure, prop 38, raises income taxes on everybody and also funds education through
