good morning. i'm bob redell. i'll take you live to the peninsula where carbon monoxide has forced the evacuation of hundreds of guests from a hotel here. that story coming up. and bomb squad called into action in san jose overnight. we'll have the latest details on this next. plus the man accused of killing a hercules mother heads to court. and a controversial fast food restaurant about to open in the east bay and protesters are all set to picket. let's take a live look outside this morning over san francisco. change in the weather. we'll check the forecast with christina for this thursday, november 8th. this is "today in the bay." it is just about 4:31. good morning action everybody. happy you could join us, i'm jon kelly. >> no, i'm jon kelley. >> you sound a little like me

today. >> trying to keep up here with john or with mike. right now let's turn to christina for a look at the forecast. >> good morning to you. temperatures are looking good to start. it is cold out there in santa rosa at 48 degrees. we're expecting showers in a matter of hours. you do want to grab that umbrella as you make your way out that front door. let's check on mike and see if the congestion has cleared in his throat. >> i'm coming back up to kathleen turner, maybe kirstie allie level. looking at the maps let's look at the east shore. we see yellow, the highlighting right through oakland and that is where our weather system is reporting that there might be gusty conditions for the roadways so we'll keep that in mind. also heading over the carquinez bridge, it's not the wind, it's the construction blocking a

couple of lanes but we'll track that because it may last until 8:00. back to you. happening right now, a carbon monoxide scare forcing the evacuation of a nine-story hotel. this is on the peninsula and this one happening at the embassy suites in burlingame just a stone's throw from sfo. today in the bay's bob redell just arrived on the scene and has all the details. bob, what's happening out there? >> reporter: good morning to you, jon. they evacuated 400 to 500 hotel guests starting around midnight last night because there was a malfunctioning boiler inside the hotel. as it was malfunctions, it was releasing carbon monoxide, which is a very dangerous, deadly gas. so what they have been doing in the meantime, if you are able to see, they have been airing out all the rooms in the hotel. they had all the doors open, windows open and lobby doors open and did shut off the boiler. within the past few minutes the fire department was telling us they are in the process of

letting people go back in. they were trying to make sure the levels of co are at acceptable level, they have been letting guests go back up and grab their luggage in case they have a flight to catch but as far as people going back inside, they're still waiting on that. bottom line is no one has been hurt, no one has complained of any symptoms of co poisoning. what's interesting is the fire department received a call for public assistance around midnight. when they arrived here, they decided to do some air sampling and that's how they determined there was something be released that was something for nobody for breathe in. san jose police have reopened several streets near the matrix casino after finding a pipe bomb inside a car. we have amateur video from the scene. police were making a roune traffic stop on first street and matrix about 11:00 when they

noticed a suspicious package inside a car. the bomb squad determined it was a live bomb and detonated it. although the pabomb was close t the casino, no evacuations were done. a san mateo county judge dismisses a murder charge against gregory alams. he killed david lewis back in june of 2010. the judge now says police violated his fifth amendment rights by ignoring his repeated request for an attorney. investigators say he eventually confessed to the crime. lewis' mother says she doesn't know why they killed her son. they were actually childhood friends. >> i would like to see justice done. i would like to see him spend his time in prison.

>> he remains in jail on an unrelated charge. the d.a. will decide whether to refile the murder charge or appeal the judge's decision. a man accused of killing a hercules schoolteacher inside her home is expected to enter a plea this morning. darnell washington and his wife tania are charged with the murder of susie ko. they stole her car and then fled to washington state. darnell washington was extradited to conat that costa county and his wife is still being held in a washington jail. san francisco police want you to look at three men charged with vandalizing a muni bus. the first suspect was wearing a black giants sweatshirt and black baseball hat. the second suspect is caucasian and was wearing black clothes and a baseball hat. the third suspect is black, last seen wearing a red jacket with stripes. police arrested 19-year-old

nicholas hudson earlier this week. he is being charged with three felonies for his role in the fire that burned a muni bus. police also charged a man for smashing the bus window. anybody connected with this destruction will have to pay part of that $700,000 replacement cost. chevron is laying out its plan to fix the damage from a massive fire in august. it will use chrome al loi to replace the pipes. it hopes to get all repairs done early next year and have the refinery working back at 100%. some 3,000 intats in jail under the three strikes law could be resentenced or released altogether. proposition 36 passed in tuesday's election. we talked to one co-author of the new law and to a man who

fought against it. >> we were sending people away for life for stealing a loaf of bread, petty theft, simple drug possession. >> if they can see the train coming down the tracks yet the guy only stole a loaf of bread or he -- he -- he managed to get the purse away from the girl without putting a bullet in her head, then they're not going to be able to charge for three strikes. >> for the record the amendment could end up saving up to $100 million a year once the law takes effect. people are camping outside an east bay restaurant hoping to be fed for a year. there's a line at chick-fil-a in walnut creek. they are vying to be the first 100 customers to win a free meal every week for an entire year. protesters are upset over the owner's stance on gay marriage. attention all you serious shoppers out there.

a new retail outlet is opening up in the east bay. the paragon outlets in livermore opening up at 10:00 a.m. shoppers getting a preview of the 130 stores out there. yesterday they said it would provide a big-time boost to the local job market. in livermore alone it is expected to generate $2 million a year. perfect timing for the holiday season. well, it's going to be a good day to maybe be inside in the mall. rain is headed our way. let's check the forecast with meteorologist christina loren. >> good morning to you. temperatures are going to be cold this morning and the rain arrives for the second half of the day so grab that umbrella on your way out the door. we have an unstable air mass overhead and some pretty gusty winds ahead of that front. keep that in mind if you're crossing over any of the open water bridges and hold on to that steering wheel. we'll check on your drive with mike in just a moment. 53 in livermore, 54 in san jose and 54 in sunnyvale this morning.

it all works out like this when is comes to the timing of the expected showers. we'll see quite a bit. looking more like half an inch. areas north of the golden gate bridge. look at this, showers starting to push into the north bay. we stop that again for you at noon. starting to get our first showers from san francisco into the east bay. then they push to the south about 2:00 p.m. starting to alive in san jose. with cloudy conditions and cold air, highs are only in the 50s for most of your bay area cities including livermore today, 58 there, 68 santa teresa, 58 in san jose and 60 in redwood city. more rain and low snow comes into play tomorrow. first as promised, here's mike and your drive. >> as we were talking about you mentioned some wind. it's going to be an issue for your driving conditions. this is the san mateo bridge and the flat side. the camera is steady eddie and so is the traffic flow.

from time to time you'll see this camera shaking quite a bit. let me show you over here on the peninsula. it's moved a little bit but where it says nbc upper understand corner you see some yellow highlighting. that means gustier winds in the hills through san francisco. in the south bay there's just construction, losing a lane south 880 towards 101. the north bay also looking very clear as far as 101 goes. very light volume and a clear view. no mls cup this year for the san jose earthquakes. they lost to the l.a. galaxy last night at santa clara university 3-1. that ended the two-game series with a final score 3-2 in favor of the galaxy. that means the quakes are out of the playoffs and the galaxy moves on to the western conference finals. the nhl not even talking about or enthusiasticing about the postseason. the nhl players association actually heading back to the bargaining table today. that is a good sign, marking

three straight days of negotiations. fans were hoping to see at least some games this season at that shark tank. both sides say they are far from a deal but at least they're talking. until then sharks forward ryan chloe found a brand new place to play. it is possible he could play tomorrow night at the cow palace. a puppy stolen last month has been found safe and has a new home. violet, a terrier mix, was spotted in a neighborhood by an adoption center employee that. employee called police and the woman who had the dog was arrested. police are trying to figure out how he got the dog in the first place. the puppy is healthy and already living with a couple interested in adopting her before she disappeared. 4:41 right now.

welcome back, everyone. a good thursday morning to you. it's 4:45. jared loughner, the man who pleaded guilty to shooting congresswoman gabby gifr eby gid 18 others will be sentenced today in tucson. 13 people were hurt, including giffords, who suffered a gunshot to the head. loughner will receive a life accept tense without the possibility of parole. he had been undergoing psychological treatment at a missouri prison facility. now that the election is over, it's right back to work for president obama. officially the only thing on his agenda is his deal briefing, but unofficially the president has a big-time problem on his hands and this one has to do with your money. nbc's tracie potts has details on the nation's looming fiscal

cliff. i am looking forward to reaching out to both parties and meet the challenges we can only solve together. >> reporter: fresh off his election victory, president obama has already been on the phone with top democrats and republicans in congress urging them to compromise before america falls off the fiscal cliff. what's that? long-term unemployment benefits and 2% payroll tax cut expiring. a big cut in medicare payments and your taxes going up january 1 if congress doesn't act. plus another $500 billion in cuts at the pentagon. boeing, the military's second largest supplier, already announced a second round of executive layoffs. >> nobody wants to see this fiscal cliff without a deal, because the cuts are severe and the tax increases are severe and so we've got to find a path forward. >> reporter: on capitol hill, leaders signalled compromise. >> compromise is not a dirty word. i want to work together but i want everyone to also understand you can't push us around.

we saw the s&p 500 dropping 33 points to 1394. the nasdaq falling 74 to 2937. wal-mart is releasing some black friday promotions today and has deals on three hot electronic items that attract shoppers. the company will give away $75 walmart gift cards with the purchase of an apple ipad 2 but shoppers must be in line between 10:00 and 11:00 p.m. the night of thanksgiving to get that deal. they are putting the price on a 32 inch emerson tv selling it for $148. also selling a $38 blu-ray dvd player as part of that promotion. >> we're already talking turkey. what did we decide, two weeks away now? >> yeah. >> cool weather, feeling like fall out there. get the fire going. >> put that football on layaway at walmart as well.

you've got to love layaway. 4:49. good morning to you. temperatures are looking good right now and the rain has not yet arrived. right now you can see the leading edge of ou front pushing toward the northernmost portion of the state. that front will start to slide  to the south. we're not expecting showers in the noon time, especially south of the golden gate bridge. so i want to talk about what is very, very potent. we're already getting snow showers in the tahoe area and snow levels are expected to fall until 2500 feet. we're expecting a little snow on top of mt. hamilton so very slick conditions. if you're planning to tahoe make sure you have those chains or four-wheel drive ready to go. we stop the clock at noon. showers starting to spread south of san francisco into san mateo and also into the east bay so take that umbrella on the way out the front door. we'll start to see that front move into the south bay. san jose getting showers about

2:00 p.m. we'll have quite a bit of activity through the overnight showers. tomorrow morning count on slick conditions. tomorrow morning is the best chance for seeing that snow on mt. hamilton. as we head throughout the second half of your day, and saturday morning we clear you out. we hit 92 in gilroy. yes, it was a very warm tuesday in gilroy. as we head throughout your thursday, we're talking about the 50s. 59 degrees. so from the 90s to the 50s, that's pretty dramatic. make sure you're ready for that. 58 in fremont and 59 in san francisco today. we keep on dropping off as we head into friday and saturday because behind that front the very cold air trails behind and that's going to settle in and take a while to mix that. we'll we in the low 60s sunday and mix it up in the beginning of next week. watch out for gusty winds. christina telling us about the bay area getting hit with 18

heading into the weekend but that is nothing compared to people in the northeast. heavy rain, strong winds and snow pounding areas still dealing with that ugly aftermath of superstorm sandy. in new jersey and new york hundreds of thousands of residents who just had their power turned back on are now back in the dark. for many, just the constant beating from mother nature is making life miserable. >> cold! very cold. you sleep at night with blankets and socks and everything else on. and it's just horrible. >> imagine right there. the new storm forcing airlines to cancel thousands of flights in and out of the new york area. that will include flights coming out from sfo, but scary out there. this time of year being cold, having no power. it's 4:51. coming up, the best of the best. the bay area country that's making the best automobile in 2013.
