los angeles dodgers. the landmark lawsuit that has one giants fan caught right in the middle. so if you miss the dance, don't worry, there's going to be an encore. >> and why cyber monday 2012 might not be all it's cracked up to be. give you a live look outside, that is the south bay on this monday, cyber monday, november 26th. this is "today in the bay." good morning to you. it's almost 4:31. i'm marla tellez in for jon kelley. >> and i'm laura garcia-cannon. let's first check that forecast with meteorologist christina loren. good monday morning. >> hey, good monday morning. we've got a lot of fog to contend with on your drive to work this morning so give yourself plenty of extra time. the thickest fog is up in the north bay.

this morning you're in 39 at santa rosa, 40 in san jose and 40 in livermore. but the fog is so widespread that you're likely going to encounter at least one dense patch on your way to work this morning. we'll tell you where it's going to clear the quickest and we have a lot of rain to tell you about coming up. first, let's check on that morning drive. >> hey, we'd like to illustrate what christina is talking about but the fog is in so we doent that. you see these cars disappearing off into nothingness. the bridge is still there but you can't see it past midway. we'll show you that my sensors are showing you're going to have mist and drizzle over toward the peninsula side. farther north where you see the orange highlighting, that's where there may be slick conditions because there may be a drizzle situation. it's just heavy fog coming across the bay bridge as well. couple of other advisories coming up. back to you. >> fog, fog, fog. you should definitely pay extra

attention this morning. it's rolling into the bay area. after a deadly weekend on california roadways that claimed 27 lives, including six from the bay area. one of the crashes happened on saturday night near placerville when the driver of a prius swerved into the path of a minivan. three members of a bay area family in that prius died. a 4-year-old placerville girl in the minivan was killed. five others were hurt in the crash with minor to serious injuries. investigators are looking into the cause. >> there is no information leading to any impairment of that driver. >> witnesses say the cause might have been a deer. they're often seen in the area and drivers are often forced to swerve to avoid them. new this morning, east palo alto police are searching for an armed suspect who shot a man sitting inside a car. shot spotter pinpointed it near addison avenue just off 101.

the 49-year-old victim was shot multiple times around 8:00 last night. police have not updated his condition. investigators believe one or more suspects who were on foot walked up to the victim and attacked him. the trial for a teenager accused of shooting a 3-month-old baby in east palo alto last year is set to begin this morning. prosecutors say the 18-year-old fired on a mother and father as they were leaving a baby shower in june of last year. a bullet hit the couple's baby boy. isaac jimenez, killing him. the mother was trying to shield her other child in the back seat of the car. he mistook the family for rival gang members. he's been charged with murder and attempted murder. the teenager accused of kidnapping and assaulting a 65-year-old woman is due in court today. 14-year-old caviar king will be tried as an adult. on november 15th he carjacked and kidnapped a woman at a

shopping center and then assaulted her before leaving her bound and gagged by the side of the road. that woman is still recovering. the 15-year-old man linked to a series of crimes in the south bay is expected in court this week. police finally caught him in concord on friday after a week on the run. police say he killed a man in a carjacking and tried to kill a san jose police officer. they are not releasing his name because he is a minor. his accomplice is 26-year-old jonathan wilbanks. wil banks is being held without bail and is new back in court on december 5th. investigators are trying to find the source of a carbon monoxide leak that sickened 11 family members in san francisco. the family called 911 at 7:00 after a carbon monoxide detector went off inside their home on portland avenue. they could not find the source of the carbon monoxide but everyone, including three

toddlers had high levels of carbon monoxide in their blood. fire officials say the carbon monoxide detector likely saved their lives. >> carbon monoxide detectors are very important because it's odorless. you can't smell it. and you won't know it until you start getting signs like a headache or something like that when you're already exposed to it so it's very important to have one in your house. >> starting last year state law requires any home with an attached garage to have co2 detectors. multi-unit buildings have until january 1st to comply. the hospital that treated bryan stow for months after he was brutally beaten outside the stadium last year wants the dodgers to pay up. san francisco general hospital is suing the dodgers for more than $1 million in reimbursement for the brain trauma care provided to stow. the hospital lawsuit comes after stow's family filed their own suit against the team and its former owner in u.s. bankruptcy court. the case could set a new precedent for whether sports teams can be held accountable

for third party actions at their events. well, you'll feel it if you walk out the door, temperatures certainly dropping across the bay area, forcing thousands of homeless to look for a place to escape that cold. tonight they'll be able to get a bed and warm meal at three cold weather shelters opening up at 6:00 tonight. 275 shelter beds will be available in san jose and the national guard armory in sunnyvale and gilroy. for the first time a portion of the beds at the baccardo center will be for homeless and veterans. the shelters will stay open through the end of march. 4:37 now. good morning to you. cold temps mixed with heavy fog. >> you've got to be careful before you head out the door. we want to check the forecast with meteorologist christina loren. >> good morning to you, ladies. good morning to you at home. hopefully you had a fantastic holiday. now this week back to reality, back to work. and we do have some dangerous driving conditions weatherwise

to tell you about this morning. thick pockets of fog also. we're getting that drizzle, that mist, so in addition to the reduced visibility, you have slick conditions, bad combination. take it easy if you're taking little ones to school this morning. we'll see a nice, sunny finish but not until 1:00 p.m., especially up in the north bay where you can see we've got deep pockets and you can only see a quarter of a mile and that's going to drop off the next couple of hours. high pressure compresses that moisture and we're not just dealing with the fog here, we're talking about really thick fog for the central valley. so if you have family or friends or even yourself heading to southern california or northern california, you really want to take it easy. very deep fog pockets along the fog corridor up and down. we're also seeing it creep in through the delta this morning. we stop the clock at 1:00 p.m., mostly sunny conditions at that point. temperatures will be warmer today than any other day of the week. we've got a lot of rain as of wednesday. 65 degrees in concord, 66 in san

francisco today and 66 right here in beautiful san jose. i've got your full forecast coming up in a few minutes. we'll time out that storm system. we're basically going to be dealing with the rain, though, for five out of seven days on your seven-day forecast. so stay tuned fojr that. it's going to get messy around here. mike is here to help you through the fog. >> it's thick enough you have to use the windshield wipers in many spots, like approaching the golden gate bridge from the north. with we can see the bridge and some of the lights but not much beyond so visibility for drivers is an issue. you have to slow those speeds because you have less stopping distance. just keep that in mind and we'll look at the maps. i've highlighted the roadways where you might find those slick conditions all throughout san francisco. the golden gate bridge. again, those windshield wipers indicated you might knees those crossing the span there. looking at the north bay and no brakes coming all the way up. coming out of santa rosa and petaluma and highway 37 from vallejo has well. over through core delia and

fairfield, especially around fairfield and vacaville you'll have to watch those speeds and visibility. we'll look over towards san jose as well. a little bit of a break as far as on the roadways but at the top of your screen you see the silhouette of 680 and also see that there's low clouds around the area. like christina said, just be prepared for that and we'll track your changing conditions. back to you. 4:39. today is cyber monday, a day when internet deals are supposed to be too good to pass up, but experts say don't be fooled by all the hype. like black friday, cyber monday is a big marketing strategy. while the deals are good, it's not the last time you'll see them before december 25th. >> stay in your favorite stores, websites when you get to work but don't tell your boss and look for those great deals because they're going to be there monday and they'll be there tuesday and wednesday and they'll be there all the way up until and including christmas. >> good advice. well, while you may not need to log on today, a study finds

welcome back. a good cyber monday to you. take a look at this. that is the distribution center for amazon. you wonder how everything goes out all orderly? bet you've got a lot of worker bees there. no doubt they'll be pretty busy. cyber monday, so many people jump online but it's turned into a season of jump online all the time finding those good deals. we'll have more about that coming up in just a bit. this morning lawmakers on capitol hill say they are working hard and fast to avoid that so-called fiscal cliff. if a budget deal is not met by the end of next month, automatic tax increases and spending cuts

will kick in for all americans. danielle leigh is here with signs of a compromise. >> reporter: back from their turktu turkey dinners, lawmakers say they are refreshed and ready to compromise. republicans have been unwilling to raise taxes and democrats have been refusing to cut social security and medicare. now all that has changed. >> i'm willing to generate revenue. it's fair to ask my party to put revenue on the table. >> reporter: republican senator lindsey graham says he'll violate a plan not to raise taxes and democrats are open to reforming entitlement programs they have been pro teching. >> bring entitlement reform into the conversation. >> reporter: but it comes with contingencies. many republicans still want to raise revenue by capping tax deductions or closing loopholes, not by increasing taxes on the wealthy. democrats are still trying to

keep some entitlement programs out of negotiations. >> social security set aside, doesn't add to the deficit. when it comes to medicare and medicaid, protect the integrity of the program. >> reporter: distance from a deal still evident, even amid signs the gap between lawmakers is closing. lawmakers say they'll not only get a deal done before the year is out, they may have a compromise before christmas. i'm danielle leigh, nbc news. meanwhile that fiscal cliff is making investors wary this morning. for a look at how futures are trading, we turn things over to kate at cnbc headquarters. kay kayla, good morning. >> reporter: good morning to you. much optimism was over the strength of retail sales and black friday. investors will be keeping an eye on the geopolitical tensions in the middle east and that ongoing fiscal cliff and the talks continuing in washington. we get economic reports this week on durable goods, consumer

confidence and new and pending home sales. the dow 172 points friday to 13,009. the nasdaq up 40 to 2966. you can now add seven swans, six geese and five gold rings to the list of christmas gifts that are more expensive than they were a year ago. pnc wealth management is out with its annual christmas price index that tracks the cost of items in the 12 days of christmas song. if you bought everything once your bill comes to $25,431, up nearly 5% from last year. if you follow the song to the letter and by all three 64 items, it's a whopping $107,300. some things didn't go up in price but geese jumped 29% as the severe drought led to higher feed prices. maybe don't follow the song exactly. >> yeah, probably good advice. thanks, kayla. >> where does one find a lord a leaping, hmm? it's 4:47.

with thanksgiving weekend officially over, the bay area is all ready for christmas, thanks to christina loren. he helped light things up. a lot of local tree lightings going on. christina was out at ghirardelli square on friday night. very nice, staying up late for a great cause. >> it's funny, whenever you're around santa, i don't care who you are -- >> did you get a little nervous? >> i got a little nervous, i got a little nervous. you know, we have some history, he and i. and the kids don't care about anything but santa. >> he is the star of the show always. >> except when you bring chocolate in. turns out they like chocolate a little bit more than santa immediately. good morning to you. hopefully you had a good thanksgiving. hopefully you're not too tired from having to entertain guests this morning because we want to make sure you're nice and safe as you make your way out that front door. good idea to have an extra cup of coffee this morning and stay alert. we've got some really thick fog. the way fog works, it kind of

drifts around. you encounter a thick patch on the highway and you lose it just like that, so take it easy out there. 40 in livermore, 43 in san jose, 37 to start in gilroy. really we're seeing the thickest fog in the east bay in the tri-valley region. it's creeping in from the delta. that tule fog is thick this morning. in novato and san francisco, you've got pockets where you can only see for hundreds of feet. take it easy, these numbers will go in and out and we're expecting the fog to be at its most widespread point at 7:00 a.m. so a couple more hours to go of that fog developing. right now i just want to show you on your futurecast it's all the way down in the central valley. it's going to be a little bit dangerous if you're leaving right now. you want to keep that in mind. you always want to use your low beams. some people don't actually know that. 8:00 a.m. we stop the clock on your futurecast, you can see still mostly cloudy but only towards the east bay. we stop the clock at 12:00, 1:00 p.m., becoming sunny later on over the greater bay area and

then the fog rolls right back in tomorrow morning. not expecting it to be quite as thick because we'll have wind as well. then the rain arrives. look at this, we stop the clock at 4:00 a.m. wednesday morning. look at all the rain we have to get through for your morning drive and that's just the first round. we've got two additional systems on that one's heels so it's going to be very dangerous getting to work the next couple of days. take it easy out there. of course mike is tracking anything to slow you down. 67 in livermore, 66 in fremont and 66 in los gatos today. that fog is going to be out there probably until about 11:00 and then the sun will break through between noon and 1:00. breezy showers wednesday. we get another system thursday into friday and these systems are coming up from the south. you'll notice your temperatures aren't that cold, but these systems are going to be packing a lot of moisture. we've got a subtropical moisture tap associated so we could be measuring the rain in inches before all is said and done and that translates into a heck of a

lot of sierra snow. 4:50 right now. back to you two. 4:50 now. it looks like the niners are still in the middle of a quarterback controversy. colin kaepernick helped the niners beat the saints last night 31-21. it was the second straight win as the starting quarterback. but after the game, coach jim harbaugh would not say if kaepernick or alex smith would start next sunday's game in st. louis. instead he said his staff would look at the game tape and then decide. and meantime to college football where san jose state is now ranked 25th in the bcs standings. it's the spartans first-ever appearance on the list since the bcs rankings started back in 1998. this is also the team's first national ranking since 1990. san jose state is 10-2 after beating louisiana tech on saturday. head coach mike mcintyre says his team is looking forward to a bowl game. >> it's been a whole process. our coaching staff, our

administration has really bought into building a program, not a team, and that's what you see has built. now that we have 85 scholarships, it's really helped us be able to compete week in, week out at a national level. that's what we're going to keep doing. it's been a lot of fun and we're looking forward to our bowl game coming up. >> mcintyre really helping to build up that team. he's in fact a semifinalist for the 2011 maxwell club college coach of the year award. in the meantime the stanford cardinal are gearing up for the pac-12 championship. it is friday night at 5:00 at stanford. 4:52. coming up, they lived to tell about it. a couple survives a small plane crash in southern california.

welcome back, everyone. the ntsb looking into the cause of a plane crash. miraculously the couple in the

plane made it out with only minor injuries. the husband was flying the plane from novato to john wayne airport in orange county when the plane lost power over the san fernando valley. the plane tore through a fence, flipped over, came to a stop on a sidewalk near cal state northridge soccer field. two roommates on their way to church stopped to help. >> we get the girl, she asked about her husband. we got him, he's like i'm fine, i'm fine, he has blood all down his face. >> the couple taken to the hospital and treated for minor injuries. the cause of the crash is still under investigation. can you imagine, they just walked away. >> and lucky that he was standing by to help. let's see if there are any crashes right now. fie mike, it's early. >> there are no major crashes right now but the issue is visibility to avoid any problems. here we're looking at palo alto, our camera looking at willow. you notice the cloud cover at the top of the screen, how dense that is.

you see how the light is bouncing off the city lights and making a bright reflection. that's why christina said you don't use the high beams, standard or fog beams if you have them. we're looking at crown plaza just a few hundred yards from the camera itself. how tough it is with those bright lights and the reflection as well. and the bay bridge, a light volume but heavy fog, guys. back to you. >> thanks so much. well, a couple of nfl cheerleaders are doing all they can for a good cause. this is a good story. during yesterday's indianapolis colts game, two cheerleaders saved off their hair in support of head coach chuck pagano. pagano has been on medical leave battling leukemia. the cheerleaders had promised to cut off their locks if fans raised $10,000 by game time and the fans did and they kept their promise. >> that's very nice gesture. it's 4:57. they have your stuff. police in one south bay city looking for the victims of a pair of serial burglars.

i'm damian trujillo live at the berryessa community center where san jose is looking for a new police chief. i'll have some names for you coming up. >> reporter: possible headaches for your morning commute. i'm bob redell. i'll tell you about the dense fog advisories in place for many of the bay area bridges. that story coming up. most of the bay area, as a matter of fact, widespread fog. it's actually good visibility where bob is. you can only see for hundreds of feet in other spots. we'll tell you where it's the thickest, where it will clear first and lots of rain on the way. i'm showing you what's going on for the san mateo bridge. i'll give you a couple more warnings issued by the chp coming up. from san mateo to a look at the south bay, it looks nice
