through the first round of rain. we've got three more significant batches to get through before all is said and done. and the next two systems are packing quite a punch. so you still have time to clean out your storm drains and get ready for that next round of rain. we'll time it out to your doorstep. highways are slick in spots, especially areas with poor drainage. >> good morning, good morning. we'll take you out to oakland where i drove on 880 this morning through fremont and i did see patchy, wet pavement. but over here in oakland, flashing lights at the top of your screen. just over that high street overpass there is an accident. we had a backup there. you see that orange and a little red just north of the coliseum. that looks like it's starting to move but you saw flashing lights. we're circling where the warriors are playing tonight. southbound has similar construction, but nothing unexpected near the maze. breaking news on the peninsula. a manhunt under way in palo alto

near high and hawthorne just two blocks from the palo alto caltrain station. marla tellez is joining us right now. she arrived on scene just a moment ago and has brand new details for us. >> reporter: i just got briefed by a police officer who gives us brand new information, as you just mentioned. he said that a woman in this apartment complex, living in this apartment complex at the intersection of high and hawthorne street, where you can still see plenty of police officers this morning, this woman called police at 2:20 this morning saying that a man -- she woke up to find a man in her apartment. she screamed, she called 911 and the man allegedly just took off on foot. there is an active search going on right now. they let out the police dogs, this is what they tell us, for a canine search in the area and did not come up with any suspects at this point. the good news is that the woman

is downtown at the police station right now giving police a better statement. she is not hurt so that is the good news here. in terms of information regarding this male suspect, police were not able to give us any information. this is still very early on in this investigation. i know i mentioned where this is exactly and you also mentioned, jon, this is right near the palo alto caltrain station. we're just a couple miles from university avenue and only a mile and a half from stanford university, so certainly this is not a bad neighborhood by any stretch of the imagination. so at this point a woman wakes up to find an unknown man inside her apartment. initial reports were saying that this man was wearing a mask but the police officer on scene could not confirm that to us at this point in time. we're going to stay on this story to bring you the latest information. live from palo alto, marla tellez, "today in the bay." also new this morning, a san francisco parolee behind bars

again after a standoff with police. police say the man barricaded himself inside the home in a bech bernal heights neighborhood. after running for officers. officers tracked him to the home where the standoff started. >> the police department's tactical team and crisis negotiators responded to the scene. a perimeter was set up. when the police department made contact with the suspect, he surrendered peacefully without further incident. >> police say the man was on parole for gun violations and has ties to san francisco gangs. laura, a search is under way in oakland for a 16-year-old girl considered at risk. cheyenne white walked away from a group home tuesday night. she was last seen near the intersection of international boulevard and 34th avenue just one block away from the fruitvale b.a.r.t. station. she is considered at risk because police say she has the mental capacity of a 9 to

12-year-old. anyone with information on this case is asked to please call oakland police. 4:35. a closed door meeting with the safety of the new bay bridge may soon be open to the public. the "sacramento bee" is reporting agency officials will work with lawmakers to improve public access. that decision came at a hearing yesterday. senators say they're concerned because the panelists meet in private and have financial and professional ties to caltran. well, apple play be planting some roots in santa clara. the tech company is breaking ground on a mini campus just north of stevens creek boulevard. it's just a stone's throw away from cupertino. the site will reportedly have two buildings and house 1200 or more workers. apple right now is custom building that campus with the first building slated to be done mid-2014. apple has outgrown space in cupertino and already expanded into sunnyvale. a vigilant homeowner and can

a bear spray helped nab a man accused of stealing packages off people's front porches. that man will be in court later today. peach people say they have been trying to get him for a while, snapping photos of him but it was never enough for arrest. >> if you add up all the package that say people on this block alone of lost, it's quite a number and quite frustrating. >> so one matter took neighbors into her own hands setting up a camera and arming herself with bear spray. the blog posted the video that shows the man opening the woman's gate, taking the package. another video shows the woman chasing after him dousing him with bear spray. police say the 51-year-old man was arrested with orange bear spray on his face. interesting there. 4:37 right now. across the bay area people bracing for that next wave of rain and wind. that's because the next storm is expected to bring with it a

whole new set of problems. high winds knocking down trees all across the bay area yesterday. it was rough out there with the ground all saturated. downed trees could be more of a problem today and tomorrow. in san jose crews have sandbags all ready. they have also checked all of the city's storm water pumps just to makeuring. >> certainly we're prepared for it. so if it does get worse we'll have crews ready to go and be there to respond. >> all the wet weather made driving treacherous out on highway 17 in the santa cruz mountains. with more wet weather on the way, the chp right now reminding everybody to please just slow it down. >> yeah, clearing your own gutters and whatever you can do as well to prepare, because there's more coming our way. we want to check the forecast now with meteorologist christina loren. >> yeah, we've got a lot more coming our way. good morning to you, jon and laura. good morning to you at home. let's go ahead and talk about what we do have out there right now. not much. a little batch of very light rain to the north of santa rosa.

we're another one pushing toward novato the next few minutes so keep that in mind. as we progress throughout the day it's mostly going to be dry, especially areas to the south of the golden gate bridge. i did want to draw your attention just to the west of tracy. we have an unstable air mass overheard and three more rounds of heavy rain to get to but it's going to take quite a while for this next wave to get through. look at this, mostly dry over the greater bay area, mostly cloudy. we stop it at 5:00 p.m., that's when it starts to get active. we'll start to see a little activity from san mateo to palo alto. then the heavier rain arrives tonight into tomorrow morning. i think the bulk of the moisture from the next wave will come through right in the heart of your morning drive so prepare yourself for that. this morning it is rather calm out there. 65 in livermore today, 65 in santa teresa and about 63 degrees in downtown san jose.

i'll have your full forecast. we're timing out the next three heavy rounds of rain. your seven-day out look is ready to go in our next report. aftermath is a problem. the winds were strong out on the roads today. >> definitely report those to us and chp so far no big reports going on on the freeways. light volume of traffic, not many callers out there. the camera that we have in emeryville shakes a tad bit. you know the department of transportation does give a little high wind advisory for the bay bridge but so far we haven't heard of any problems from chp. driving okay there. just south approaching coming through oakland the arrow shows you the area where we're seeing recovery after the earlier traffic breaks and the accident just north of high street. there's still some activity there. south toward the san mateo bridge traffic moves nicely. we showed a little slowing but

there's a light volume of traffic and maybe the sensors are picking up a couple of slower cars. you're looking over here to the south bay as well. i'll give you a wider overview coming up, guys. we now know two people with will split the huge powerball jackpot of nearly $580 million this morning. but the big winner could be californians later today. final arrangements are being made right now that could bring powerball to california by 10:00 this morning. about 24 hours too late. but the state lotto commission expected to vote and if approved, the first tickets could roll out in april of next year. today's vote comes just one day after last night's record jackpot. two players won the $579 jackpot. one in arizona and one in missouri. >> very nice. you know what i always remind myself to feel better about not hitting it. you know after taxes, $580 million --

4:44. thursday morning. no agreement yet but both parties still fighting to compromise. top white house negotiators head to capitol hill today to continue talks about avoiding the fiscal cliff. tracie potts has the latest on the fight to keep your tax breaks from disappearing. >> reporter: treasury secretary tim geithner and white houlegis chief rob neighbors bring the deficit-cutting plan to capitol hill today. >> i'm very open to a fair and balanced approach to reduce our defic deficit. >> reporter: republicans want to know does that approach include the government spending less money. >> we put revenue on the table as long as it's accompanied by serious spending cuts. >> reporter: white house negotiators are meeting with boehner and top republicans and democrats, executives from big

companies heard the plan wednesday at the white house. at least one thinks there could be a deal here. >> if i were involved in negotiation like this and everybody was purporting to be where they are, i would say that an agreement is reachable. >> i'm hopeful but i wouldn't put me anywhere near optimistic. >> reporter: one conservative republican is suggesting while negotiations continue on whether the wealthy should pay more, congress should stop tax rates from going up on the middle class now. >> we're not going to raise taxes on those people and i think we ought to go ahead and make that abundantly clear to anybody and take them out of the negotiation. >> reporter: bottom line, no deal yet. both sides are still talking. tracie potts, nbc news, washington. and a little bit of positive news coming out of washington has investors feeling a little optimistic. that of course is affecting the futures this morning. foe details we turn it over to miss bertha coombs live at cnbc world headquarters. good morning. >> reporter: good morning, jon.

i can see that neither of us had those winning tickets from last night so we will continue to work here the rest of the week. futures this morning a little higher after stocks advanced going into the closing bell. yesterday investors reacting positively to comments from president obama and house speaker john boehner about the likelihood that congress will reach a budget deal to avoid that so-called year-end fiscal cliff. today we'll get data on unemployment claims, we'll get pending home sales and a revised estimate on third quarter gdp which may show the economy grew more than previously thought this summer. the dow jumped 106 points to 12,985 while the nasdaq was up nearly 24 points to 2991 on those positive comments. meantime small businesses hit it big on cyber monday. digital research firm big commerce says a surge in orders drove overall revenue for small chains and mom and pop stores up 25% over last year's cyber monday. the average order price was 8% higher.

satellite radar shows you very light showers, mostly to the north of santa rosa. the bulk of the moisture arrives later on this afternoon in the north bay and then those showers spread to the south as we head throughout the second half of the evening into the overnight hours. one thing all these storm systems seem to have in common is the bulk of the moisture comes through overnight into the morning and you get a nice, dry evening. we'll time those out for you but look at this. this one is nothing to mess with. a lot of red, a lot of orange in here. heavy rainfall on the way to the bay area this afternoon with not a whole lot of drying time between now an then so we are expecting more and more flood reports to come in. also storm reports in terms of downed trees. now we have grounds that are saturated. those winds are just going to batter trees for several hours as we head throughout tonight into tomorrow morning. when we wake up, 4:00 a.m., look at this, we're looking at a rough commute and potential for flooding and highways blocked by trees. look at this, a lot more rain on

the way. friday night we start to get a little bit of a break. we'll dry out. for the most part saturday looks good. we'll get another little wave of moisture saturday morning. then overnight sunday, the next most potent system arrives. this one will pack a real punch because at this point we're going to have potentially 3 inches of rain on the ground in parts of the bay area. if this does tap into that subtropical moisture, we could double those totals, potentially pick upwards of 7 to 10 inches in parts of the north bay. 65 in livermore, 64 in fremont and 65 in redwood city. yesterday's storm system was more of a wind event. the next one is going to be more of a rain event so get ready for that. as i widen out, you can see we are just seeing those storm systems line up out there in the pacific. so three-day forecast looks like this. sunday a.m. rain and then monday the sun comes out at least for a

couple days. by wednesday we're talking more rain chances so keep that umbrella out. we'll time these systems out for you and let you know as things change throughout the morning. back to you. it's 4:50. new this morning, a mountain climber in oregon is safe after an overnight rescue operation. the climber was on his way down when he was stranded in a snowstorm yesterday afternoon. he was able to call search and rescue on his cell phone. he wasn't hurt but was cold and wet. rescuers brought him food and dry clothes before eventually bringing him down to safety early this morning. not a good place to be stuck. call it a mini shrine to george lucas by george lucas. the filmmaker has filed a permit to demolish a building in downtown san anselmo to build a park in its place. the park would be home to two bronze statues, one of indiana jones, the other of yoda. in order to build the park the town must complete a historical a analysis because there is a

on a thursday morning we give you a live look over sfo. that rough wind all day yesterday and some rain causing some big delays out there, but today christina says it with will calm things down so if you're heading to the airport, you're probably on time today but do keep checking it. it's 4:54. apparently, no, it is not the best coffee in america. that at least according to the u.s. patent and trademark office. the office rejecting dunkin donuts position to try to trademark the phrase "best coffee in america" saying that slogan is too generic to warrant a trademark. dunkin donuts says it's going to have a cup of java and consider its next steps, including whether to appeal that ruling. the massachusetts-based coffee chain has 2600 stores all around the world and sells 1.5 billion cups of coffee every year.
