january 7th. this is "today in the bay." it is 4:30 on the nose. good morning, everybody. happy you could join us. i'm jon kelley. >> i'm marla tellez. laura garcia-cannon is off today. let's get right to the forecast with meteorologist christina loren. good morning. >> good monday morning. back to work for most people as we head throughout the morning hours. temperatures are going to be cold. cold enough for some patchy frost and we have fog out there. 40 degrees to start you out in san jose. 35 in livermore. 43 degrees in san francisco. we got a warmup on the way for today. a mild stretch of weather as we head throughout the week. slight chance of rain. we'll detail that for you. troublesome fog this morning. let's find out what else we're watching out for. >> we're watching out for return of your commute. probably today we're going to ease into it. tomorrow hitting harder. right now 101 moves smoothly here through san jose. you see the low clouds in the

distance kind of silhouetting the freeway overpass for 680. the map shows you the south bay looking good as far as speeds right now. so far no incidents reported. a smooth drive for the tri-valley. that orange highlighting here is some of the fog that christina talks about. watch it here and patches through the north bay. vallejo and santa rosa in particular spots for morning fog. back to you guys. we begin with a brutal story this morning. san francisco police continue to search for a man wanted for dousing his girlfriend with gasoline and starting her on fire. they say 22 year old dexter oliver attacked her near hollister and jennings in the bay view district. 25-year-old star lamar is now in critical condition in the burn unit at st. francis hospital.

family members say oliver became enraged when lamar told him the relationship was the over. >> poured gasoline in a bottle. >> police say oliver is 5'10", 155 pounds, and has a haircut with a lightning bolt on one side of his head and fish designs on the other. also this morning, san jose police hoping new clues will help lead them to suspects in the city's very first homicide of the year. officers found the body of a man in front of a home on tripoli anticipate yesterday afternoon. that's just a few blocks from mclaughlin avenue. officers say that man was shot in the head but they do not have a motive for the shootings. he was in his 30s and related to those people inside the house. there were 46 -- a total of 46 homicides in san jose last year, more than any year since the 1990s. in just a few hours from now, an east bay lawmaker will introduce controversial legislation in the hopes of

curbing gun violence. skinner will announce plans to file a bill that will tighten laws on ammunition sales in this state. it's in response to the shooting in newtown, connecticut, where the gunman was found to carry high capacity magazines. it would ban magazines from being sold in oakland, california. the man accused of killing seven people in a shooting rampage at an oakland university is expected in court this afternoon. lawyers hearing from a court ordered psychologist on whether he is mentally competent to stand trial. in november another psychologist said he suffers from paranoid schizophrenia and could not understand those charges filed against him. he now faces murder and attempted murder charges for the shootings last april where he was a nursing student. turns out oakland police are not happy with the city's plans

to help the department. the chronicle reports the police union is upset about the city's plan to bring in ten alameda county sheriff's deputies and a sergeant to help out the understaffed department. officers think the $530,000 can be better spent on squad cars, better training and/or new hires. a special meeting being held to talk about the proposed closure of several east bay firestations. county supervisors voting last month to shut down a total of four stations in clayton, lafayette, martinez and walnut creek. they say the closures are needed to close a budget deficit. tonight's meeting starts at 6:30 at the lafayette veterans memorial building. 4:35. there's something new on the menu at schools in san francisco this morning. the school district is partnering with bay area based revolutions foods to offer healthier lunches for kids. revolution foods was started by two uc berkeley students in 2006

your afternoon run, marla. we know you like to go double time this time of year. 33 degrees in napa. 39 in sonoma. 43 in san francisco. i have already given up my new year's resolution like most of the country. 41 down in gilroy. let's talk about what's happening out there. throughout the day today not going to see a lot of frost. we do have patchy frost out there. temperatures in the low 30s and even coldest cities across the bay. a bigger factor this morning is the fog. down to a quarter of mile visibility in livermore and tapa. that fog is back. keep that in mind. temperatures are going to be cool to start. we'll warm you up by 5 to 10 degrees from yesterday's highs. stop the clock for you at noon and clouds will clear just a touch. we'll see nice sunny finish.

let's look at your drive with mike. >> we'll give you a look out here. this is east shore freeway where we were going to see a lot more cars hitting the roadway. today probably easing into it. a lot of schools back for the first day and parents like to see their kids off so we'll see a later commute and it's a monday. tomorrow be prepared. so here's your commute direction on the maps. we took a look at that for the live shot and easy drive right now heading toward the maze. upper deck shows yellow but that means speeds down toward 55 to 60 which you should across the span. look in the upper right-hand corner. orange out of vallejo. more fog reported there and parts of the north bay, santa rosa over toward the coast. 101 moves smoothly down through novato and into san rafael. a live look shows you san rafael. we'll track that and volume and sunol. we talked about fog. quarter mile visibility through livermore. not a great shot but it shows that you fog as you come 680 southbound under the street lights. back to you guys. 4:38. members of some bay area

churches say they are upset with the sunday switch they never saw coming. san francisco has started enforcing parking meters on sundays from 12:00 until 6:00. the city is happy saying sunday enforcement means an extra $2 million a year for the transit agency. some say it's at the expense of the community. >> we like to hang around. our kids play with the other kids. we have coffee. we chat. and it hurts the community feel if we're all sort of watching our watches and thinking i hope the sermon doesn't get overtime to avoid getting a ticket. >> some small business owners are also concerned saying it will drive people to shop at malls that have free parking. nonstop flights from san jose to tokyo begin this friday. japan's airways will offer the service. service will be five days a week to start off with. over the summer it will be

the preliminary hearing gets under way today against james holmes. he's accused of killing 12 people at that movie theater in aurora last july. during the preliminary hearing, the judge will listen to the 911 calls. he will also watch video clips and hear from various witnesses. the case will determine if there is enough evidence to try holmes for murder. good news out in new york and new jersey. help is on the way for the victims of superstorm sandy. the president signing into law almost $10 billion bill to help pay for flood insurance claims. the law increases fema's borrowing authority there. the white house says without that additional money more than 100,000 flood claim payments from sandy would be delayed. congress planning to vote on a comprehensive sandy aid package on january 15th. president obama's choice for defense secretary is facing mounting opposition in congress. the president is expected to name former republican senator

chuck hagel for the post. that's not sitting well with many of his gop colleagues. hagel is considered a moderate. the 66 year old criticized the iraq troop surge and also opposed sanctions on iran. hagel has made controversial comments in the past on the pro-israeli lobby and the gay community. >> he apologized for it. i think anyone that serves in my administration understands my attitude and position on those issues. >> chuck hagel would be the most antagonistic in our nation's history. >> hagel would oversee the winddown of troops in afghanistan. a war he first supported and then criticized. >> secretary of state hillary clinton is set to return to work today after a rough month of medical problems. clinton contracted a stomach virus early last month. she reportedly became dehydrated and fell hitting her head causing a severe concussion and during a follow-up exam, doctors

welcome back, everybody, on a monday morning. day one of the workweek. a live look over san jose. some nice colors out there. kind of maybe inspire you to get rolling as this is the official start of the workweek. it is 4:53. good news for shark fans. we could find out when the sharks will play the first game of the entire season and their first one of the year at hp pavilion. nhl expected to release a schedule for the 2013 season as early as this morning. terms of that ten-year deal that ended the lockout finally still need to be ratified by both sides. league executives want a 48-game regular season schedule that could start as early as january 19th. comcast sports net tells us why the lockout may actually give
