commute without you even knowing about it. a new traffic study is out this morning shedding light on the worst commutes in the bay area. "today in the bay's" marla tellez live this morning with a look at the traffic study that is surprising some. good morning, marla. >> reporter: the new study out is different from all of the other traffic -- >> all right. unfortunately we lost marla's signal out there this morning. we'll have a look at some of the worst commutes in the bay area particularly in the south bay coming up. also this morning, a family learning who may have killed a 21-year-old woman nearly 30 years ago. the body was found in a dumpster in mountain view on january 28th, 1985. mountain view police arrested 53-year-old danny garcia of fresno this past friday. he was caught after the santaa county district attorney's crime

lab developed a dna profile from the fingernails and matched it to garcia. >> it's a big relief. we were wondering always who is the one that killed her. >> friends and family say they didn't know garcia and they still do not. garcia has been booked on suspicion of murder. police on the peninsula now say the millbrae teenager shot saturday night was the victim of a drive-by shooting. they say she was hanging out with friends in front of a home near cappuccino high school when a high school pulled up. someone inside the car opened fire. the girl is expected to recover. there have been no arrests and police are still looking for a motive. an autopsy will take place today for the petaluma teenager found dead in south lake tahoe in a snow bank. investigators say 19-year-old alyssa byrne was disorientated when she left a music festival on new year's eve. took a wrong turn and at some point took off her jacket.

it was less than ten degrees out that night. the utility worker found her body on january 4th not far from the concert venue. investigators do not suspect foul play. meantime the coast guard launching an investigation this morning trying to figure out exactly what caused a tanker to hit the bay bridge. the ship rammed the span's middle tower as it was heading out to sea. christie smith is live right now in treasure island with more details on this ongoing investigation. christie, good morning. >> reporter: good morning to you, jon. the coast guard is looking at human error as just one possibility behind this oil tanker accident. i want to step aside. you can see it out there lit up on the bay this morning. the coast guard also plans to interview the pilot of the empty tanker called the overseas raymar. the bridge itself is okay. no injuries with this. investigators say the ship is

double hulled, seaworthy. no leaks. the coast guard is trying to figure out what went wrong here. the bar pilot has been identified as a 61 year old on the bay since 2007. the coast guard will review audiotap audiotapes. they were in contact just before the impact. >> the ship's captain they were in an outbound transit obviously and the coast guard gives an advisory to those folks. in communication with them just prior to the accident. >> reporter: state records show that he ran aground in san francisco in 2007 and in 2010 again. he passed an alcohol test, drug

tests are still spending. reporting live on treasure island, christie smith, "today in the bay." >> all right. thank you very much. let's check the forecast now with meteorologist christina loren. we're not teasing when you say possible 70s today. >> we're going to get close to it. we like to round up. i speak from the high end of the glass always full in my world. 39 in gilroy. 42 in sunnyvale. changes are just around the corner which is why i highly urge you to embrace the day. when temperatures are going to be mild. by tomorrow we drop off into low 50s. we bring in rain. very light. it will get cold around here. enjoy while it lasts. the one thing we have to deal with this morning is thick fog. that's starting to dense up in places like livermore down to three-quarters of a mile of visibility. a quarter of a mile from santa rosa through napa and down south to concord. in fairfield, you have pockets where you can see for hundreds of feet. my message to you this morning is give yourself extra time. even though your city is reporting a good visibility

reading, ten miles or better, doesn't mean you won't encounter thick pockets on the way to work. we stop on future cast. between 6:00 and 10:00 all of the fog clears out of the bay area. lots of sunshine on tap. temperatures will reflect that sunshine. look at these numbers. 66 degrees in gilroy. 65 in livermore. 64 degrees today even on the east shore in fremont it will be comfortable. 64 degrees in san francisco. make those outdoor lunch plans because it will be too cold to do so for tomorrow. we will take you through that forecast coming up in my next report. let's check on the drive. the commute is back. >> it will be back in full force this tuesday after all of the vacations are wound up here. we're looking at the bay bridge right now. a very calm look. look at the approach coming down through berkeley and emeryville. a nice smooth flow of traffic. no delays as far as sensors are reading right here on the maps. you do have a couple road crews on the bridge itself and approaching off the merge from richmond san rafael bridge. the issue here is the orange that we're highlighting. green on roadways show you speeds are fine. orange potential for that patchy

"today in the bay's" marla tellez live this morning with more on the traffic study that's surprising some. good morning, marla. >> reporter: this traffic study is different from all of the other studies that we've seen previously because for the first time researchers tracked drivers unanimously using their cell phone gps. now, if you happen to drive

northbound 101 in southeast san jose where we are this morning, you may have been one of those drivers. researchers -- the study was done by researchers at uc berkeley and m.i.t. it's one of the four most congested spots in the bay area during the morning commute. the other three hot spots include southbound 101 traffic through san rafael, westbound 580 traffic along the castro valley y and southbound commute through san ramon on 680. researchers tracked more than 350,000 drivers using their cell phone data to pinpoint these trouble spots. the study concludes that if just 1% of commuters from the specific outlying areas canceled their trip during the heart of rush hour, that would reduce the extra travel time for all other drivers by 14%, which turns out to save about eight minutes an

hour. researchers say, sure, this information is valuable but exactly how they would cancel out these trips is yet to be determined. one last note, researchers say that if your cell phone was tracked unanimously, that data is confidential. live in san jose, marla tellez, "today in the bay." >> all right. thank you very much, marla. it's 5:13. starbucks thinks all of those small business people meeting in their stores for a cup of coffee need something more than just a shot of caffeine. scott mcgrew joins us. starbucks selling credit card machines? >> yeah. starbucks has that tight relationship with san francisco based square. it's the company that developed the square credit card readers. starbucks says it will start selling those readers to anyone who wants one for ten bucks. dog walkers, baby sitters, girl scouts selling cookies, anyone can use square to accept credit cards. starbucks and square say they figure so many small business people use starbucks stores for meeting places, it's kind of a

thank you very much. >> it's a good day when scott mcgrew is quoting l.l. cool j. christina loren always has flavor in the weather. what's happening outside besides that sunshine. >> fog will knock you out first. it's going to be kind of a widespread dense morning to start. you know that fog that creeps in from the delta. the tule fog. it's creeping in right now in livermore. you're dropping off significantly started out at 4:30 with two miles of visibility. down to a half mile. temperatures are starting to drop off just a little bit but we're not expecting them to fall below 32 degrees this morning. 39 degrees in gilroy. you're headed toward maybe 67 degrees. that's what it looks like right now. temperatures are going to be comfortable. fairfield, you have pockets where you can see for hundreds

of feet. travel cautiously. be advised there are areas out there of thick fog. we'll see a nice sunny finish with temperatures above seasonal averages just for today. mostly sunny conditions prevail by 11:00 a.m. we'll warm up into widespread mid 60s. temperatures upper 60s in some cities. we'll show you where in just a minute. we'll stop clock at future cast at noon. you can see lots of sunshine coming in. foggy throughout the central valley. heading down into l.a., travel cautiously headed south. we stop the clock for you again at noon. as we wake up and meet back here tomorrow morning, it will be cloudy. between noon and 4:00 p.m. we have a slight chance for maybe a stray shower or two. not expecting a lot. and most of the moisture looks like it will skirt the coastline. here's where it gets interesting though. when we wake up and meet back here on thursday morning, the coldest time of the day, we have a chance for some showers to move over the higher elevations and that is going to make for some very interesting weather.

we could get some snow down to 1,500 feet. that's what we'll be watching for on thursday morning. nonetheless, if you are trying to get outdoors, today is the best day to do so throughout the extended period with highs at 67 degrees in gilroy. 66 in redwood city. 64 in san francisco. temperatures are going to drop like a rock as of tomorrow and stay cold all of the way through monday. just keep that in mind and get out there today if you can. let's check the drive. good morning, mike. >> good morning. we have a very nice drive right now northbound route through the south bay not a problem. we do expect a heavy commute. traffic tuesday and the day that a lot of schools and parents are back at their normal schedules. 101 is one of the worst commutes. 680 toward 880 for that build coming up. only concern for the south bay, construction blocks a couple lanes northbound 85 from evelyn up to 101. you see no slowing here. we'll go out to palo alto. along the peninsula where we see a smooth flow of traffic as well.

plan to disrobe should supervisor scott weiner be elected president of the board. he proposed legislation that would ban nudity on public streets just last year. the ordinance doesn't take effect until february. a court date is scheduled for opponents to fight for an injunction against this new law. oracle's sailing team gets its wings back today. they will be delivered this afternoon. you may remember back in october it capsized during a training run on the bay as the team was preparing for the america's cup race. the massive wing was shredded. today new wing will arrive at pier 80 from new zealand as the team finishes repairing its g t boat. the damaged boat isn't the only hurdle they are dealing with. the team is found guilty of spying on the italian team. an international panel determined oracle's team came too close to italy's boat when

good morning to you. thanks so much for joining us. it's 5:30. i'm laura garcia-cannon. >> i'm jon kelly. the coast guard meeting with the pilot of the "overseas reymar" as part of its investigation to figure out why the empty oil tanker crashed into the power of the bay bridge. "today in the bay's" christie smith is live at treasure island right now with the latest on what we've learned overnight. >> reporter: good morning to you. i can tell you that a fireboat is out there right now and so is the coast guard. mainly as a precaution. i want to step aside so you can see it out there in the distance in the bay. this is the "overseas reymar" that hit the fender on tower 6 of the bay bridge late yesterday morning. the question of course, what went wrong? the coast guard plans to interview the pilot of this empty tanker this morning and ask him a number of questions.

they'll inspect the hull above and below the water. the owner of this ship, osg ship management says there was no reported loss of steering and initially no water leaks reported as well. caltrans says the bridge isn't damaged though a section of the fender was ripped off. the pilot has been identified as 61-year-old guy kleess of san francisco. after the impact an oil response was activated just in case. >> there was some crushing of that outer hull. there was no indication of any damage to the inner hull. >> reporter: according to the san jose mercury news, state records show that in 2009 kleess ran aground in the sacramento shipping channel and crashed into a cat walk in stockton and then in 2010 apparently a tug boat that he was sailing ran aground in the richmond harbor. according to the bar pilots association, kleess passed an alcohol test. the results on a drug test are

still pending. christie smith, "today in the bay." 5:32. san francisco police say they have captured the man they say poured gasoline on his girlfriend and then set her on fire. 22-year-old dexter oliver was arrested at an oakland hotel last night. he attacked his give on sunday in the bay view district. star lamar remains in critical condition this morning. she has severe burns to her face and chest. family members say oliver became enraged when lamar broke up with him. there may be a child predator on the loose in gilroy this morning. police warning parents after a strange man in a green minivan offers an 11-year-old girl a ride. police say when another car approached that man and young girl, the van just sped off. police right now looking for a 2000 chevy astro van that's

forest green and this man is hispanic. a man will be in court later today. prosecutors say 19-year-old david morales killed two people after speeding away from officers new year's day. officers say he t-boned a parked car pushing it into a store in the mission district. one person died in the car. the other victim was killed while walking into the store. morales was on probation at the time of the crash for gang activity in san mateo county. a san francisco cyclist back in court this morning accused of a deadly crash with a pedestrian. charged with felony vehicular manslaught manslaughter. the 36 year old cyclist sped through a busy crosswalk killing an elderly man crossing the street. prosecutors say that he was

speeding in an attempt to break a record for riding through the city. they say he has a pattern of breaking traffic laws and had a pattern prior to the collision. your smartphone or gps probably provided data for new traffic study without you even knowing it. a new traffic study is out today that could have major impact on rush hour traffic. "today in the bay's" marla tellez live in san jose. one of the most congested areas of the south bay. good morning, marla. >> reporter: laura, good morning. where we are this morning one of the most congested spots according to this new study. we're right along northbound 101. these are headlights you are seeing right here. right near 280/680 interchange. you know how ugly it can get during the heart of the morning commute. the study concludes that it gets so backed up here because many commuters travel here and not just from san jose but from outlying areas like morgan hill and santa cruz to get to silicon valley and they happen to do so of course at the same time every

day. the study out of uc berkeley and m.i.t. finds a similar story for drivers on 101 through san rafael. southbound 680 through san ramon. what's different about this particular study is for the first time researchers tracked drivers unanimously using their cell phone gps technology over a three-week period. this method is raising eyebrows but researchers say data collected this way is more accurate than gathering information from the u.s. census bureau. they also say if you are tracked without knowing, your driving pattern is confidential. this is according to researchers. so what does this mean for your morning commute? even the head researcher out of uc berkeley is scratching his head as to what to do with this new information. i can tell you that they did talk about adding more metering lights as an option. live in san jose, marla tellez, "today in the bay." >> thanks, marla. let's get a check on that

tuesday forecast and say a warm good morning to christina loren. >> i'll accept that. good morning to you. it's cold out there. 42 degrees in sunnyvale. 36 to start in livermore. 38 degrees in gilroy. although not as cold as yesterday and temperatures are going to stay above 32 degrees above freezing throughout the next couple hours. however, it's cold enough for patchy frost to develop and we do have some really thick fog out there that will force slowdowns on your morning drive. we'll check on that with mike in just a minute. watch out for half mile visibility in livermore. quarter of a mile in concord. pockets where you can see hundreds of feet. if you are traveling throughout the interior valleys even in the south bay, just travel cautiously to the silicon valley and especially the tri-valley this morning. stop clock on future cast. we'll clear you out by 9:00. sunshine coming in so early will warm us up nicely. look at numbers today. 67 degrees in gilroy. 65 degrees in san jose. i love to be the bearer of good

news. 64 in san francisco. major changes just 24 hours away. we have rain in the forecast and much cooler weather as well. we'll detail that and time it out in our next report. here's mike and your drive. >> i have major changes probably in the next 25 minutes over here at the bay bridge. the toll plaza starting to show a few more cars over the last five. more headlights streaming in off the east shore freeway. approach out of berkeley into emeryville. westbound traffic with these headlights filling in the lanes now. we expect to see your heavy tuesday commute returning to closer to normal levels. we've seen a break the last couple of weeks. we'll see it again today. the map shows you no major concerns as far as crashes or incidents approaching the maze and smooth flow close to the limit throughout the approaches to the bay bridge. one of the issues here as you come down past hill top drive, an accident with a crash reported westbound in your commute direction. there's slowing. i'm waiting for details from chp as they approach. we're also watching for fog

linden this morning digging for more victims of the so-called spe speed freak killers. bodies were found in the area nearly a year ago and they think the bodies are linked to the speed freak killers for the drug fueled spree they went on during the '80s and '90s. herzog committed suicide last year. shermantime is on death roll. investigators say it will take three weeks to hand sift through the soil. the california public utilities commission today discussing the fate of a nuclear power station located on the central coast. the power plant has been shut down for a year after a pipe started leaking radioactive steam into the air. the utilities commission has been investigating that plant to determine when or if it is safe to reopen. the commission will discuss the

investigation later on today. several environmental groups are there planning a demonstration outside of that meeting to oppose the reopening of that plant. california is asking the federal government to ease off the court ordered prison reduction plan. the state filed papers late yesterday saying it has the prison overcrowding problem under control. federal courts ordered a cap on the number of inmates in state prison to ensure proper health care. governor jerry brown's administration says it has made substantial progress in cutting down the numbers and wants the court to withdraw its requirements for further reductions so the state is not forced to release dangerous or violent prisoners. we had a couple this year and now today is another spare the air day. that means that you cannot burn wood or other fire logs indoors or outside. this marks the third spare the air day of 2013. good morning to you. a great looking day shaping up.
