>> i'm jon kelley. good morning, everybody. the ship is seaworthy but it's not going anywhere until the pilot answers tough questions about how and why this crash happened. the crash struck the so-called echo tower which is one of four towers beneath the middle of the western span. with that in mind, let's bring in "today in the bay's" christie smith live at treasure island right now with a look at what investigators are planning to ask that pilot today. christie, good morning. >> reporter: good morning to you, jon and laura. the coast guard is looking at human error as just one possibility behind this crash. the truth is right now they just don't know what went wrong when the tanker that you see out there hit a tower of the bay bridge as it headed out to sea late yesterday morning. they are going to be interviewing the pilot of the empty tanker called the "overseas reymar" this morning first thing. the pilot identified as 61-year-old guy kleess will report to the state board of pilot commissioners conducting its own investigation into this. caltrans says the impact didn't

damage the structure of the bay bridge but a tower fender was ripped off. investigators say the vessel is double hulled so no leaks. it was empty but an oil spill response was activated just as a precaution. the coast guard is reviewing audiotapes and was in contact just before the crash. >> the ship's captain they were in an outbound transit obviously and the coast guard gives an advisory to those folks. were in communication with them just prior to the accident. >> reporter: now according to the mercury news, state records show that in 2009 kleess ran aground in sacramento and that same year also crashed into a cat walk near stockton and the following year was found at fault when a tug boat he was sailing ran aground in the richmond inner harbor. a spokesperson for the bar pilots association says that kleess passed an alcohol test

but the results of a drug test are still pending. reporting live on treasure island, christie smith, "today in the bay." thank you, christie. the crash is all too farm after the massive container ship crashed into the bay bridge tower five years ago on a much lesser scale. >> that's right. the crash of course led to an environmental disaster and it smashed into the delta tower which is located next to that echo tower which was just hit yesterday. the crash spilled 53,000 gallons of oil right into that bay. investigators determined the pilot navigating that ship was impaired by prescription drugs. he served ten months behind bars and had his pilot license revoked. >> seemed like that just happened yesterday. the fbi's evidence team is responding back and heading back to a farm in linden this morning digging for more victims of the so-called speed freak killers. crews will spend the morning excavating an oil well there. the site is near an abandoned

well where four bodies were found nearly a year ago. investigators think the bodies of linked to the speed freak killers for a drug fueled speed during the '80s and '90s. herzog committed suicide last year. investigators say it will take three weeks to hand sift through that soil. a family is learning who may have killed a 21-year-old woman nearly 30 years ago. the body was found in a dumpster in the shopping plaza parking lot on january 28th, 1985. 53-year-old daniel garcia was arresteded this past friday. he was caught after the santa clara county crime lab developed a dna profile from fingernails and eventually matched it to garcia. garcia has been booked on suspicion of murder. there may be a child predator on the loose in gilroy

this morning. police are just now warning parents after a strange man in a green minivan offered an 11-year-old girl a ride. it happened december 30th right next to rainbow park. police say when another car approached the two, the van sped off. police say they are looking for a 2000 model chevy astro forest green in color. your commuter habits tracked and you might not be aware its happening. "today in the bay's" marla tellez is live in san jose with a look at a study about traffic headaches that might get you a little hot under the collar. marla, good morning. >> reporter: jon, good morning. the study is different from all of the other traffic studies that we have seen before because for the very first time researchers tracked drivers unanimously using their cell phone gps technology. so if you happen to use this route, northbound 101 in south san jose where we are this morning, you may have been one

of those drivers. the study done by researchers at both uc berkeley and m.i.t. found that this area northbound 101 in south san jose is one of the four most congested shots in the bay during the morning commute. southbound 101 traffic through san rafael and castro valley and westbound 580 traffic and southbound commute through san ramon on 680 also. the study concludes if 1% of commuters from these very specific outlying areas canceled their trip during rush hour commutes, that would reduce the extra travel time for all other drivers by 14%. which turns out to save about eight minutes an hour. valuable time according to some drivers we talked to this morning. >> you might get a burst of no traffic for a short period of time but then it always -- you hit it. you just keep hitting it.

i don't know if there's really a way around it unfortunately. >> reporter: now, to the controversial part over a three-week period researchers tracked more than 350,000 people using their cell phone data again without them knowing but they say this information will be kept confidential. the study was published in the december issue of scientific reports which is an online publication. live in san jose, marla tellez, "today in the bay." a lot of cars and pollution out there. it is another spare the air day today. want to check the forecast with meteorologist christina loren. >> it is. you also have to wonder how they factor in the weather to that report. thick fog is going to force you to drive slower than the speed this morning throughout the tri-valley. pockets where you can see only a quarter of a mile and even more reduced visibilities coming into places like fairfield. we stop the clock on future cast. whatever fog is lingering will be concentrated around the san francisco bay. by 9:00 a.m. completely sunny

skies prevail over the greater bay area. beautiful day shaping up for your outdoor activities and this is the only day where we'll see highs in the 60s for the next seven. enjoy it. 66 degrees inland today. bayside, 65 degrees. same for you at the coast. san francisco beautiful day for outdoor lunch plans. it will feel more like a spring afternoon than january wintry afternoon. what i can tell you is things are going to change dramatically tomorrow. your temperatures drop by 10 to 15 degrees and the rain comes in. lots to talk about in your full forecast. mike is back in action this morning. the commute picking up out there. >> no more taking naps between every six-minute report. hope you are well rested. you'll need patients and extra time over here because the commute is back. the backup forming just after 6:00. all lanes look like metering lights are turned on. reports of a stalled vehicle over at the incline. i turned the camera to the incline and you can see that in our next shot here. that's the stream of red lights from left to right up toward

treasure island. you see them all moving. no flashing lights. that stall may have cleared to treasure island i hope. we'll follow that. stopping of the lights you see from time to time because of the digital signal not because of the traffic flow. it's still moving smoothly. back to maps we'll show you what we're talking abo as far as flow down the east shore freeway. close to the limit again. we see there's a disabled vehicle on the maps just at the top of the incline which may be cleared by now. accident there blocking the fast lane and also on the right shoulder. two cars involved there at the crash at san pablo causing a back backup. fog out of the north bay into the east bay on highway 4. watch that. the south bay by comparison really calm right now. the build is on. slowing we saw for 680 north on 101 we do have that smoothing out now. the volume of traffic is there. we'll see slowing kick in over the next 20 minutes to northbound routes. back to you. >> thanks a lot, mike. time is 6:09. coming up, released from behind

a man linked to an attack on the u.s. consulate in benghazi, libya, has been released from behind bars. a judge ruling there's not enough evidence to hold him in custody. the investigation into that

attack has just stalled in libya due to the weak power of the central government in the face of powerful militias. u.s. ambassador and bay area native chris stevens along with three other americans died in the attack last september. 6:13. lawyers for casey anthony are back in court this morning appealing separate counts of lying to authorities. they say her statements were made before she was informed of her right to remain silent. though anthony was acquitted of murder in the death of her 2-year-old daughter, she was sentenced to a maximum of four years in prison on the charges of providing false information to law enforcement officers. right now it's 6:13. time for a quick check on the day's top stories. the u.s. coast guard today interviewing the pilot of the oil tanker that crashed right into the bay bridge. guy kleess was at the helm during that collision yesterday morning. the tanker had damage but did not spill any fuel. nudists are planning a protest at san francisco city hall today as the new board of

supervisors holds its inaugural meeting. they voted to ban nudity in the city last november. the ban is set to take effect on february 1st. the federal government right now going after hybrid cars because they're just too quiet. the national highway traffic safety administration says hybrid and electric vehicles should meet minimum noise requirements to pedestrians and bicyclists can hear them approach. oracle sailing team getting its wings back today. the new wings for the team's 70-foot racinining vessel will delivered today. >> the damaged boat isn't the only hurdle oracle team usa is dealing with. an international panel found the team guilty of spying on an italian racing team during a practice run in new zezealand.

they'll have to pay a $15,000 fine and forfeit five practice sailing days. starbucks think the business people meeting in their stores for business need more than just a shot of caffeine. >> starbucks says it will start selling the square readers to anyone who wants one for $10. dog walkers, baby sitters, girl scouts selling cookies, anyone can use square to accept credit cards. starbucks and square say they figure so many business people use starbucks stores for meeting places, it's kind of a logical place to teach them about credit cards. the consumer electronics show continues in las vegas. lots of gadgets to talk about and we will a few minutes from now. the latest consumer report

report is bad news for apple rating the iphone below several android phones and samsung said it sold 62 million smartphones yesterday. apple estimates only 45 million. this is a news item worth keeping an eye on. you may have seen the news that an airliner parked at boston's logan airport had a small electrical fire. no passengers onboard at the time but the plane is three weeks old. the government says the new planes are perfectly safe. this is not the first time a dreamliner an electrical problem. this is not a cause for alarm if you were to fly on one i would not be concerned. the government says they are safe. it is worth keeping an eye on with the new airplanes. >> thank you, scott. let's keep an eye on the skies and weather outside with christina loren. she's here to cover it all for

us. >> we certainly have that possibility of a flight delay this morning. right now not looking all that likely because the thickest fog is through the inland valleys. good morning to you. watch out though. you might be slowed down by some very dense pockets of fog as we progress through the next two hours. at about 9:00 a.m. we expect full sunshine over the bay area. this is our only day as we head through the next six to seven where we'll hit the 60s. 50s arrive as of tomorrow. i'm talking about low 50s. enjoy the warmth while it lasts. you have a half mile visibility in livermore right now. quarter of a mile in concord. and pockets where you can only see for about 50 feet in fairfield. travel cautiously there. also want to point out san mateo dropping off at this point. we'll continue to drop off as we head throughout the next two hours. as we head throughout the day today, temperatures will climb nicely. one of those days where you can make those comfortable afternoon outdoor lunch plans. 36 degrees in livermore. 38 degrees in gilroy. even as we get closer to sunrise

the coldest point of the day, temperatures will not get near freezing except napa at 36 now. may drop to 34 degrees. we take a look at the satellite imagery and cool picture here. you can see the storm track coming well into the pacific northwest and staying out of the bay area just high clouds filling out. throughout the day, high pressure will nudge the storm track further to the north. we'll see very few clouds throughout the day. it will be nice as a result. temperatures warming into the mid 60s. i'm talking about widespread mid 60s getting close to 70 in some cities. i'll show you city by city breakdown in one moment. want to take you to future cast. we stop the clock at 1:00 p.m. full sunshine for today. look at the changes on the way for tomorrow. lots of cloud cover. cold air. a few showers as of 1:00 p.m. in the north bay. we stop the clock for you again between 3:00 and 5:00. very slight chance for a stray shower in the south bay. it gets interesting. when we meet back here on thursday morning, coldest time of the day, we might get showers over the bay area and snow levels at that point will be between 500 and 1,000 feet.

we could get some very low bay area snow. 65 degrees. enjoy the warmth while it lasts today as the cold is on its way. 65 in livermore. 64 for fremont. 65 in san jose. here's your seven-day outlook. want to help you make those plans. today you can actually go for short sleeves. tomorrow, you'll need the long sleeves and thick coat. by thursday, probably carrying that umbrella with you to work and into the weekend temperatures are going to stay steady in the 50s. our next chance for rain will be on sunday. let's check that drive, mike. i notice every time i check more people out there. >> more people and let me get out of your way. our chopper just arrived. this is a bus that's in your third lane from your left over here north 880 at high street. is major commute spot north of the coliseum. we saw a lot of smoke coming out from that bus. reports of a bus fire. we don't know about any folks on board. it looks like flashing light may have out of service sign. we see someone just arrived. looks like chp. this is causing a bottleneck just north of the coliseum heading up over the high street

bridge just on the north side. we'll track this considerable backup expected until they can move this from the roadway. we do need a special tow truck to get this off the roadway. not a standard tow. folks will have to pause to get around this. it will be an issue north through oakland past the coliseum. let me take you to the map and shows you what is playing out for sensors. right here we don't see slowing showing up but over the next few we'll see that. we'll track that. our chopper is on scene. once you get past that north into todowntown we have volume traffic heading toward the bay bridge. we'll get back to it. right now also want to show you the accident we're tracking. the crash has folks moved to the side of the road. one on your right-hand shoulder and one in the center divide west 80 around san pablo. the off ramp there. that has traffic jammed up. you can get over at san pablo avenue and get past the backup but that will get more traffic over the next 20 minutes as well. there's the delay. the orange on our maps shows where there is fog.

that's prevalent throughout the east bay and definitely for the north bay. watch that as well. now we get back to the approach to the bay bridge which is still moving smoothly. the earlier disabled vehicle sounds like it cleared from the incline. we have the backup at the toll plaza we'll show you that as well. toll plaza itself filled in very quickly just after 6:00 and now it is backed up in all lanes coming off 580, 880 off the overpass the slowdown quite a bit off toward the toll plaza. let me show you the peninsula. 101 where palo alto moves smoothly. that volume of traffic north and south and taillights and north of university a car fire report. no confirmation from chp and no delays showing up. that was reported from one of our fire agencies. i'llac track that as well. 101 and 87 and now 85 building. >> thank you so much, mike. >> let me get your opinion on this one. getting married up in the clouds

near heaven sounds romantic. >> heads in the clouds any way, right? this couple certainly had heads in the cloud. they exchanged vows in a hot air balloon. seconds later a gust of wind drags the newlyweds way off course. >> for better or for worse. the balloon bounces and crashes down hard in a cluster of trees and gets caught on a house. keeping it from being picked up again from those strong winds. luckily only one person suffered a minor injury and despite what they call a hiccup, the bride and groom were in good spirits. >> i heard of guys trying to get out of weddings. that's extreme. 6:22 right now. coming up, going for gold in 2020. we'll tell you which cities are leading the pack in the race to host the olympic games. ♪

connects wirelessly to your iphone or other mobile device. you can record movies from netflix allowing you to play them back later on your iphone. scott budman is in los angeles with a look at a gadget that's soft, cool and comfortable. >> here is perhaps the coolest piece of consumer technology if you just woke up it is a pillow that has speakers inside so you can hear the television and not disturb your spouse. steve, it seems like a great idea. is it really that simple? >> why do we do this? why do we take a couple speakers and put them inside one of our bestselling pillows. we did it because it's a problem. so many of our tv watchers have a partner in bed and they cannot watch tv without disturbing their partner. so many of us we lead ourselves toward wearing a set of headphones which are uncomfortab

morning. give yourself plenty of time to reach that destination safely special especially if you take the little ones to school this morning. visibility continuing to drop off. a quarter of a mile or less in concord, napa, santa rosa and even fairfield this morning socked in with fog. we'll continue to see this fog spread and become more widespread as we head throughout the next couple of hours. we stop the clock on future cast. you can see plenty of low clouds filling in inland valleys. silicon valley socked in with fog at 7:00 a.m. between 10:00 and 11:00 that sun comes out in full force leaving us with beautiful temperatures. the one thing that's not pretty is your air quality. we are sparing the air for today with unhealthy levels of pollutants and highest levels are coming in from the south bay. 66 inland today. bayside, 65. enjoy 65 degrees in san francisco today because we've got changes just around the corner as of tomorrow at 10 to 15-degree drop-off and we're bringing in the showers. we'll time that system out coming up. 6:34 as promised here's mike inouye and your drive. >> this view right here is 880

with the stream of taillights north of the coliseum heading up toward the high street bridge. you see the lights at the top of the span where the chopper showed us that disabled bus. reports of smoke. i saw smoke coming from underneath the bus. driver told chp i think i was dragging something underneath the bus causing that. we'll see what develops. that bus right now still in your middle lane as you head over the span. that's the reason for the slowdown northbound 880 past the coliseum. that's your commute direction. traffic tuesday and we'll track that. no time on when they think they will clear it. i saw flashing lights heading to the scene over the last few. the backup is forming on our sensors. 580 is great alternate and international can take you past the scene and north into downtown. that's a surface street that will get more crowded as well. foothill boulevard north on the maps as well. we're looking at a flow of traffic toward the bay bridge and i'll show you that in a second. i want to skip north looking at

westbound 80 commute. the accident cleared from lanes or it seemed as though that's the case. things are moving clearly. chopper arrived toward hilltop. they saw flashing lights on the left-hand shoulder. we look at the commute and that's panning over. they are getting into the backup off the carquinez bridge. across the span west 880 into the area. there's the slow drive approaching highway 4. i'll get another live look at the bay bridge toll plaza. commute is back. approaching off 580 and north 880 and 580. and another shot outside at the maps. we'll see how things shape up for the south bay. northbound routes 101, 87, 85 and now 280 showing slowing. volume is back for the south bay as well. back to you. >> looks like vacation is officially over for folks. thanks, mike. 6:36 now. a reprieve for the nation's largest medical marijuana club. a judge says the landlords of harborside san jose and oakland locations have no rights to

force dispensaries out. last year a u.s. attorney threatened to seize the properties because they rented to cannabis operations. the judge also scheduled a hearing for january 31st on the city of oakland's lawsuit against the federal government. the city is suing to help keep harborside open. a lot of winter poisons. we'll talk about the investigation into why an almost millionaire was found dead just days before collecting his winnings. here you go little man. massive wildfires continue to burn in southeast australia. a total of 100 homes now destroyed as temperatures in that area soar to over 110 degrees. it's tough going there. so far there have been no deaths reported. one firefighter right now being treated for severe burns. five americans and two others dead after a deadly helicopter crash in peru. the helicopter went down yesterday shortly after takeoff. it was operated by a u.s. based group that specialized in heavy lifting for logging or oil exploration. there are reports the passengers had worked for a canadian oil company that focuses on latin america. a possible murder mystery going on in chicago right now after police discover poison in the body of a lotto winner who died just days before he was set to collect his winnings.

something else and take that into consideration. >> the bay bridge bumped by a tanker again. this morning the ship is not going anywhere until its pilot answers tough questions about how and why the crash happened. this morning the commute on the roadway over the bridge is still up and running despite yesterday's crash which struck an echo tower one of the four towers beneath the middle span of the western span. christie smith is live with a look at what investigators will ask that pilot today. good morning, christie. >> reporter: good morning to you. first thing this morning the coast guard will be interviewing the pilot of that tanker trying to figure out exactly what went wrong. one of the things that they are considering is just plain old human error as a factor this morning. you can see it sitting out there. they are looking into this after the 752-foot tanker hit a tower of the bay bridge on its way out to sea yesterday. that pilot has been identified as 61-year-old guy kleess and

we'll hear from the state board of pilot commissioners today. it's conducting its own investigation as well. the crash didn't impact the structure of the bay bridge according to caltrans. a fender was ripped off on the bottom made of wood and steel. no one hurt in this. the owner of the ship, the overseas reymar says there were no reports of steering loss. no initial water leaks either. the hull suffered scrapes and dents and even though there were no leaks, absorbant material was spread out on the bay as a precaution. >> the crushing of the outer hull, there's no indication of damage for the inner hull. >> reporter: according to the mercury ne, state records show that in 2009, kleess ran aground in sacramento and crashed a cargo ship into a catwalk near stockton and the following year he was found at fault when a tug boat he was on went aground on

the richmond harbor. kleess has passed an alcohol test though results of a drug test are still pending. reporting live on treasure island, christie smith, "today in the bay." >> we can also tell you caltrans credits massive fenders at the base of the towers from keeping that crash from becoming much worse than it did. wood and plastic fenders are attached to each of the bay bridge towers. caltrans says they worked perfectly to stop that tanker. still you can see 30 to 40 feet of those fenders are now damaged and will need to be replaced. >> the crash too familiar after the massive container ship crash about five years ago. >> that led to an environmental disaster out there. it smashed into the delta tower next to the echo tower hit yesterday. the crash ultimately spilled 53,000 gallons of oil right out into the bay. investigators determined the pilot navigating the ship was

impaired by prescription drugs. he's now served ten months behind bars and had his pilot license revoked. want to get a look at that forecast for today. a possible warmup on the way? >> a great looking day shaping up. the fog probably played a factor in that. it's thick out there this morning as well. it was unusually foggy yesterday. unusually foggy this morning as well. concord now at about a quarter of a mile of visibility. can only see for hundreds of feet or less in fairfield this morning. but nonetheless that sun will break through early today. we have a great looking finish. temperatures approaching the upper 60s getting close to the 70s in january. very unusual. the reason why high pressure taking storm track to the north building in taking that storm track even further north today for us. that means mostly sunny conditions over the greater bay area between 9:00 and 11:00 a.m. we'll warm you up by five to eight degrees from yesterday's highs. a great looking day shaping up

once we get rid of that fog. things change through tomorrow. as of tonight we stop the clock on future cast at 9:00 p.m. an area of high pressure will arrive on thursday. it will deliver cooler weather and cloud cover and showers up in the north bay at 11:00 a.m. on wednesday we stop the clock for you again. 6:00 p.m. partial clearing and throughout thursday morning we'll see showers offshore but here's what's interesting. it's going to be cold enough for snow levels to fall to anywhere between 500 and 1,000 feet. what does that mean? it means we might actually see snow in the highest elevations of san francisco. twin peaks at 922 feet. fair game for a stray flurry or two throughout thursday morning. we'll be on top of that on thursday. the chance is slight nonetheless. we like to bring every little whim of weather to your attention. 67 comfortable day in gilroy.

a slowdown and marla talked about that being the worst in the bay area. south 880 at 92 should be moved to the shoulder but added distraction and volume slows traffic to the san mateo bridge and continuing down in toward fremont for south 880. we're looking at west 580 as well through the orange area where fog likely to be very thick through livermore in patches and slow speeds over toward the dublin interchange. 680 through sunol slowing partly because of the build of the traffic and also right there in sunol there's a pocket of fog right around that golf course and there it is. that's cars coming down around this area they'll travel up southbound up the hill into fremont. san jose also shows a good build. volume of traffic back this morning. north 101 here at 680 is slow up to the airport. starting around tule we have 85. i'll show that to you in the next report on the maps. i want to give you a glimpse of the east shore freeway which is still slow.

speeds in the 50s through berkeley but worse pinole to san pablo because of the earlier crash that cleared now from hill top. back to you. today an autopsy is scheduled for a petaluma teen found dead in south lake tahoe. police say alyssa byrne got lost on new year's eve after leaving the snow globe music festival in south lake tahoe. less than ten degrees out that night. a utility worker found byrne's body on the side of the road a few days later. a test will determine if alcohol or drugs were in her system at the time of death. investigators do not suspect foul play. in san francisco a man suspected of starti ining his girlfriend on fire is under arrest. officers found dexter oliver at an oakland hotel yesterday. in the meantime, 25-year-old star lamar remains in critical condition at the burn unit at st. francis hospital. she has severe burns to her face

and chest. family members say oliver doused lamar with gasoline and set her on fire after she broke up with him on sunday. starting in san francisco, a teenage driver will be in court charged with killing two people during a high-speed chase with police in the mission district. officers say 19-year-old david more morales will be in court. a court hearing set for a bike rider accused of running down and killing an elderly man at a busy intersection. chris bucchere was attempting to break a riding record through the city when the crash happened. he's now being charged with felony manslaughter. in colorado a preliminary hearing continues against the man accused of killing 12 people inside a movie theater. prosecutors say they plan to show clips of video covering the shopping center and movie theater on the night of the shooting. during the first day of the

hearing, officers testified they found james holmes standing quietly outside the theater on the day of the shooting with his hands on top of his car. holmes' public defender say the 24 year old is mentally ill. meantime today marks two years since a separate mass shooting that killed six people and injured 13 others including former congresswoman gabrielle giffords. giffords was at a political event at a grocery store in tucson, arizona. giffords announced an initiative aimed at curbing gun violence. in an op-ed published today, they say americans for responsible solutions will raise money to support greater gun control efforts. california is asking the federal government to ease off orders. papers filed late last night jerry brown says the state has an overcrowding problem under control. courts ordered a cap on the number of inmates in state

prisons to ensure proper health care. the state is asking the courts to withdraw a requirement for further reduction so the state is not forced to release dangerous and violent prisoners. dozens of gay and lesbian military service members discharged under don't ask, don't tell will receive the rest of their severance pay. the settlement approved in federal court covers more than 180 veterans who received only half their severance pay. if you recall, don't ask, don't tell was repealed last fall. the google chairman getting a look at north korean students using the internet. they toured the university in pyongyang today. the students showed the visitors how they search for documents using google and wikipedia. the visit is all part of a private humanitarian trip. north korea is widely considered to have the world's most

restrictive internet policies. we've been talking a lot about the big consumer electronic show going on in las vegas all morning long. >> one of the hot technologies. your current tv will work fine. >> ultrahigh definition. this is better than regular hd. and these televisions will be in stores soon. the problem is tv stations aren't broadcasting in ultrahd and don't have any plan to. there's very little to watch. keep in mind when it comes to regular old high definition, some networks are still broadcasting in the old 720 format. they haven't even gone to full hd. nbc does full hd and you remember 3-d television. not useful. very few things are shot in 3-d. as we watch and we find out about these new cool televisions, boy, are they pushing televisions, remember it doesn't matter what your

television can do. if there's nothing available to watch. we'll continue to watch ces but tvs are definitely the big news coming out of las vegas this year. >> okay. you're watching that. who is watching you? tracked and tagged without you even knowing about it. this morning a uc berkeley study looking at four of the worst bay area commutes has some drivers very upset. not because of what researchers found but more so people upset over the way the data was collected. "today in the bay's" marla tellez at one south bay hot spot to explain. good morning. >> reporter: good morning. this story certainly rubbing some people the wrong way. first of all here is what it does as you said. it highlights the four worst commutes in the bay area. this considered one of them. this is northbound 101 traffic through south san jose right now. starting to slow down. we can assure you in another hour or so it will be pretty much stop and go. we can assure you of that. the other three nightmarish commutes according to the study,

the drive through san rafael southbound 101. the westbound 580 commute through the castro valley y into hayward and 680 southbound through san ramon. the study out of uc berkeley and m.i.t. may be not be earth shattering to you if you drive one of these routes you don't need a study to tell you how bad your drive is. it is the way researchers gathered their data that has some people we talked to upset. researchers tracked drivers unanimously using their cell phone gps technology. here's a sample of what we're hearing. >> strips on the road. they can count, you know, what the counts are. i don't know. like i said, i don't want to be tracked personally. my business is my business. where i'm going and what i'm doing is my own thing. >> reporter: the study was done over a three-week period. more than 450,000 drivers in the bay area participated without even knowing. researchers say if you were one of them your driving patterns will be kept confidential.
