least five incidents that have made headlines. problems from electrical concerns which grounded at least one dream liner in december to just yesterday when one of the 787s had a fuel leak while on the ground at boston logan airport. an aviation expert will address concerns on "today" this morning. here is a preview. >> oubd 787 at any time i have absolute confidence in the airplane. there are going to be problems with the new airplane. it's common. >> the dreamliner earned so much fanfare because it is the first commercial aircraft to be made mostly of light weight carbon composites rather than the typical aluminum and steel. the 787 burns 21% less fuel than planes of similar size. now of course i have calls in to the spokesperson with sjc. i'm waiting to hear from her to find out if they will take

precaution their measures in light of the recent problems. by all accounts the dream liner is set to take off from san jose international. 11:45 friday morning. >> we are getting a warn aing from petaluma police to parents and students. police say a man driving a newer chevy suv tried to convince a 14-year-old girl to get into his car near mckinley elementary school. when the girl refused the driver apologized, told her she was beautiful and continued to ask if she needed a ride. the girl flagged down a passer-by for help and the suspect drove away. the man never threatened the girl and never got out of the car. >> this morning a cleaning woman who was sexually abused by a security guard while working at the electronic arts offices is suing the company. the lawsuit claims electronic arts is responsible because the assault occurred inside the company's building. the suit says the company failed to keep the premises safe for

the woman and security footage should have been closely monitored. the suit names the security guard and the firm he worked for as defendants. the guard pleaded no contest to felony rape and was sentenced to nine years in prison in october. electronic arts not commenting on the lawsuit. >> a man accused of trying to poison his kboif won't face charges. robert lockridge was arrested in september. police say he tried to slowly poison his girlfriend by bringing bottled water laced with chlorine to the nursing home where she was a patient. he told investigators he bought the liquid online as a health supplement. the district attorney said there is insufficient evidence to pursue charges. >> the fate of pot clubs is up in the air this morning. last night the city council approved a recommendation to ban dispensaries because of concerns over possible crimes they bring with them. a final vote is expected later this month. last year city leaders adopted a

moratorium stopping current pot clubs from operating. that ordinance is set to expire in april. >> 5:04. will e he or won't he be inducted into the baseball hall of fame this morning. we are talking about barry bonds. his stats should make him a shoe-in. controversy could keep him looking from the outside in. kristy smith joins us. good morning. >> good morning. when barry bonds was asked about chances of getting into the hall of fame he said it would be sad if it didn't happen. he's going to get his answer in a couple of hours. the former giants slugger has started a heated debate with some charging that cheaters should not be part of the hall of fame. the baseball writers association has to decide where bonds and other big name players should be denied or not.

bonds denied knowingly using steroids. he was convicted of obstruction of justice. one sports column nis wrote that the hall of fame is an honor reserved for the best and brightest. he said he won't vote for clemens, bonds, or sosa. but barry was a great hitter. >> he's done a lot of great things such as a. he broke a lot of records. still got to hit the ball far. >> another sports writer said really he was just part of a steroid era. he gave the example of in the 1970s amphetamines may have created statistical anomalies there. why draw the line now? he's expected to find out at 11:00 this morning. reporting live in san francisco, kristy smith, "today in the bay." >> interesting to see what's

decided there. >> a polarizing figure. now christina loren joins us to tell us about not as good as yesterday. cold throughout the day but not bad. you don't have to carry the umbrella with you. a 20% to 30% shot. it will occur during the coldest part of the day. we're talking about it this morning and tracking thick pockets of fog, especially in the east bay. the fog is drifting around everywhere. even as you walk out the front door and it's clear you will likely encounter a deep pocket on the way to work. we'll check on the drive in a moment. mike is standing by. 56 degrees inland. 10 to 15 degrees cooler at the coast. 54 degrees. area of low pressure comes through. not passing a lot of moisture. packing cold air. as it moves into the bay area it will drop the snow levels to

citigroup, wells fargo and capital one. security researchers say the hacks are too sophisticated for amateurs and they announced no money was stolen which they say is evidence of safe sponsor attacks. i.t. officials believe iran may be retaliating for the u.s. imposed sanctions. >> this morning a group of san francisco city employees will ask their employer to stop

supporting wells fargo. at this morning's city employment e retirement board meeting they will encourage the board to stop investing in wells fargo. the group accuses the group. word on what the board plans to do. >> even major league baseball is ditching the old land lines. wireless phones that communicate between the dug out and the bull pen. the phones will have docking stations in both the home and visiting team dug outs and bull pens. managers and coaches will be able to car ary them around. the signal will shut off if the phones are taken outside of those areas. the switch could happen as soon as this season. >> the company that's famous for letting you vacuum with a robot now taking robotics outside. scott budman.

excellent stuff. we'll have more. i'm scott budman, nbc bay area news. >> scott, thank you very much. it's 5:15. apple looking to make the iphone more affordable. we can also tell you earnings season is now under way. for a look at the news before the bell let's turn things over to courtney reagan live at cnbc world headquarters. courtney, good morning. >> good morning to you. futures are slightly higher this morning. that could be due to alcoa which had decent results to kick off earnings season. stocks fell as investors awaited the first set of numbers from the aluminum giant. the bulk of the reports will be rolling in next week. the dow fell 55 points yesterday to 13,328. the nasdaq losing seven points to po 91. apple is reportedly working on a cheaper iphone that could hit the market this year. the wall street journal says the device may use less expensive materials like a plastic shell.

it could mark the first time apple diversified the smart phone line with a different model since it launched the first iphone in 2007. they are facing competition from samsung and other phones powered by android of the ware. if apple makes a less expensive iphone it will be a departure from what steve jobs philosophy was. he was more concerned with profit than scale. tim cook is now at the helm so it could be a new era for apple. >> we'll keep an eye out for the change. thank you, court any. >> maybe a new era for chicago as well. the city is closing in on a record. if they don't get snow today it will break the 72-year snowless record. that's 319 days without an inch of snow on the ground. mixed blessings for the city. they are saving money on ice removal and snow plows but they can't use winter favorites like the good old ice rank rink. >> it's a drag for kids who like

increase. overcast before we finish the day. thursday, rain and snow in the forecast. let me show you what i'm talking about. this is a moisture starved system. we saw it at noon. most of the shower activity north of santa rosa. by it can a stray shower. by 6:00 p.m. light showers across the peninsula into the silicon valley. through tomorrow morning this is where it gets interesting. we'll open the window for the potential for snow flurries between 3:00 a.m. and 7:00 a.m. the future cast is picking up cells at that time. if the cells cross over higher elevations in the vicinity of 1,000 feet the precipitation will come down in the form of snow. exciting for us. otherwise it will be cold and cloudy for today with the showers moving in late. 56 degrees in livermore. 56 in fremont and 56 in beautiful san jose. get ready for a colder day. yesterday was nice. i turned the heater off. today you will need it again.

thursday into friday, temperatures stay on the chilly side. if you want to make plans this weekend, looking okay. saturday will be a better day than sunday. nonetheless it will be chilly. let's check on the morning drive. good morning. >> you turned off the heater. my daughter is always taking her socks off. they're too hot, she says. a lot of parents know about that line. south 880. a smooth drive shows slowing. we have a crash through san jose where we are looking at the south 101 toward blossom hill. over here to berkeley, traffic flowing smoothly westbound down the east shore freeway. at the limit from the bridge to the bay bridge. you are going to see fog across the bridges. we'll talk about it in a second. southbound 101 at blossom field, the car crashed into a ditch. there are flashing lights and a crew there. minor injuries reported. that's the good news if there is any. west 580 and south 680.

a smooth drive. this is the area where christina talked about quarter mile visibility. across the bridges as i talked about. areas north of here getting light, patchy fog as well. one live shot as we look at the san mateo bridge. an easy drive westbound. you can see the high rise. back to you. >> we have breaking news that we are following from atlanta. tragedy where four children, including an infant, are dead after a duplex caught fire. the children ranged in age from 8 months to 7 years. a 6-year-old child survived without serious injuries after his mother threw him from a window to safety. the mother is said to be severely burned and is in an atlanta hospital. the grandmother made it out of the home without injury. the cause of the fire is under investigation. >> what a sad story that is. changes now coming to how california measures success at our elementary and high school.

the state superintendent of public instruction wants to change the star test for multiple choice to one requiring students to think critically and show greater depth of knowledge. it is believed the new test will provide real world skills they need for college or a career. the state legislation must approve the designed issue guidelines before the test can be rewritten. the new exams could debut in 2014 and 2015 school year. >> feeding squirrels and birds in the open in san francisco could cost you. bay area animal watch dog groups want city leaders to enforce the law banning the practice. current linen caught feeding wild animals in san francisco face a 187 dollar fine. activists say it's enforced. it says feeding wild animals could spur a population explosion or lead to aggressive behavior towards people. the city is addressing the issue

class of ticket. i expect traffic jams there. free drinks? all you have to do is pay a $35 fee and you are in the lounge. the old american airlines admirals club lounge was. >> cancer patients have new hope for a cure thanks to a law created by a bay area congresswoman. anna eshe will announce the passage of the bill today. research and survival rates for some of the deadly cancers like pancreas cancer which has a 6% survival rate. the bill was passed as part of the defense authorization bill and is on the way to the president's desk to be signed. >> christina loren is back. tell us about your wednesday. it looks like a nice day outside. not bad. >> not as nice as yesterday. but not too bad. what's interesting is with the system approaching the bay area, we have the chance for snow flurries, even in san francisco

bonds said it would be sad if it didn't happen. the voting is done by the baseball writer association of america. it has people fired up. bonds hit 762 homeruns and won multiple mvps. you've got sports writers voting saying they cheated, talking about bonds, clemens and others. bonds denied using steroids and he was convicted of obstruction of justice. one giants fan sees a real difference. >> i don't see why not. other people are probably in the hall of fame that were probably on steroids. they didn't prove that he was. >> another writer for mlb.com said he voted for bonds and others because steroids were so pervasive during that era that it would be impossible to know for sure who did or didn't. he said he's just voting for the best players and everyone should find out by 11:00 thrn this

morning. kristy smith, "today in the bay." >> maritime officials want more after the oil tanker collided with the bridge on monday. the raymar is anchored this morning. the harbor safety committee ruled that prevents shifts from moving in five critical maneuvering areas if visibility is less than a half mile. the bay bridge is not considered a critical area. that may all change. we have learned the coast guard sent a warning to the bar pilot just before the collision on monday. experts say there could be confusion between the pilot and the ship's crew. >> there could be problems with reading the instrumentation. >> the crew did pass alcohol tests, drug test results are pending. >> 5:32. pg & e reached a settlement with two victims of the san bruno

explosion. it forces pg & e to implement new safety measures. 44-year-old jacquelyn gregg and her 13-year-old daughter jane is ssa a were among eight people killed when the pipeline exploded in 2010. the mercury news says the agreement forces the utility to closely study the life span of its aging pipeline and gives the family progress reports. the family's attorney says it will help prevent another disaster. >> following a difficult day. surgery resumes this morning at alpha base in oakland after problems with the plumbing forced procedures to be cancelled yesterday. the hospital was without water for hours because of clogged pipes. it happened yesterday at 10:00. the staff was forced to call a code dry. this means no use of water except for urgent patient needs. as a precaution the medical center postponed elective surgeries for at least 24 hours. some nurses say yesterday's incident is one of a long list

of alarming problems over the past few years. >> there is a lot of supplies not being provided with at this hospital. those things, i think it's just accumulation of things over the years causing problems at this hospital. >> >> it's frustrating for us. very disheartening to see we are advocating for patients here and for patient safety here. and then we come to work and sometimes we don't have the tools to work with. >> the summit releasing the statement to nbc bay area news. it reads, at all times we had clean, clear safe water access for patients. elective surgeries will be resuming today. many one of the world's most advanced airplanes will call san jose home. but there are new problems with boeing's 787 dreamliner. ones that are prompting emergency inspections all over the world.

marla is live in san jose now with the details. good morning. >> good morning. for starters united airlines announcing today it's going to inspect the entire fleet before it flies another dreamliner. this as san jose international airport gets ready for its dream liner. set to take off on friday. bound for tokyo and by all accounts the all nipon airways flight has plans to do so in light of the plane's recent problems. most recent yesterday at boston logan airports. one of the 787s started leaking fuel while on the ground. that plane had to return to the gate. it was the second technical problem for the dream liner in just two days. on monday a battery within the 787 caught fire again while the plane was on the ground. >> it was a moderate condition in the department that included the batteries and some of the

"today in the bay." >> the white house will try to keep momentum going on calls for tighter gun laws after the recent newtown, connecticut school shooting. tracie potts is live on capitol hill with information on what the vice president is doing today. good morning. >> good morning. the white house on the fast track trying to build on momentum. here's what's happening today. the president will be meeting with the nra and with those who say we don't need more gun laws. the white house supports an assault weapons ban. new policies promised by the end of the month from the group headed by the vice president. eight bills so far at least in congress. will they have time to deal with it? the pressure is on from the white house, former congresswoman gabrielle giffords who opened a new group on the two-year anniversary of the shooting in arizona that she was affected by and by others.

they won't have time to deal with this until later in the spring because first come it is budget and spending cuts and the debt and deficit. >> tracie potts, thank you very much. >> also a happening in washington today, the supreme court will hear arguments on forced drug tests for drunk drivers. they will decide if the test constitutes an unreasonable search which is prohibited by the fourth amendment. the case stems from missouri where prosecutors there have argued tests are needed because alcohol dissipates quickly in the body. police need a search warrant for drug tests on dui suspects. >> same sex marriage will take center stage at one of the nation's most prominent churches. church leaders from the washington national ka a the dral announcing it will now perform same sex marriages. the cathedral's dean said it was an opportunity to break down barriers. the first ceremony could be

within six months. the 105 a-year-old cathedral has long been a main stay in washington, d.c. hosting presidential inaugural services and state funerals. >> 5:44. rookie nfl sensation robert griffin, iii, set to have knee surgery today. after reinjuring his leg in washington's playoff loss espn.com says the quarterback will have to have surgery to repair a torn acl and lcl. the website says he will face six to eight months of rehabilitation after that. he should be ready for the start of next season. griffin sprained his lcl last month and reinjured it in sunday's loss to seattle. it hurts just to talk about that. >> a lot of debate whether he should have played. i don't think so but your career is at stake here. >> and the pains as you age. >> you don't have to tell me. my back hurts right now.

police this hour haven't found suspects. >> 5:49. the man accused of killing two people in a bar fight new year's eve could face the death penalty. 22-year-old carlito montoya appeared in court yesterday. the fight happened at a bar in old sacrament. prosecutors say it started when a man spilled a beer on the wife of montoya's friend. a fight broke p out. the man and bartender were shot allegedly by montoya. his friend and wife were charged with assault with a deadly weapon. >> a piece of california history worth close to a million dollars missing in oakland this morning. police trying to track down the thooef who is took it. burglars broke into the oakland museum of california monday morning to steal a gold rush era quartz and gold box reportedly worth more than 800,000 dollars. this marks the second time the museum has been broken into since november. the museum e releasing a statement last night saying the recent break-in is a loss not

humanitarian delegation including eric schmidt. we have been talking about touring the grand people's study house today. richardson is seeking a moratorium on missile launches and nuclear testing. he said he's pushing for more open internet access in that country. schmidt has not spoken publically about his purpose in joining the trip to north korea. he has talked about providing technology. >> the irs delaying the start of tax season until january 30, eight days later than originally scheduled. and this change is due to the last minute changes to the u.s. tax code made by the deal congress struck to avoid the ugly fiscal cliff. some households with residential energy credits may have to wait to file taxes until february or early march.
