>> no. good morning to you, marla and laura. the temperature most certainly dropping like a rock. i can tell you that we dropped by three to five degrees since i arrived at 4:30 this morning. temperatures are going to continue to drop off as we head through the next hour. we have showers on the radar. if everything times out just right any of those cells move over twin peaks where i am in san francisco, yeah, we could be talking about potential for flurries. there's a slight chance. it probably won't happen. if it does, we do not want to miss it. look at what's happening out there right now. you see the flash of pink skyline boulevard. a mix of rain and snow down to 2,500 feet. let's take you over to the highway 17 summit where we're getting another very active cell. you see that pink there as well with low snow level. you want to travel cautiously. in addition to the mix of rain and snow over 17, we also have icy conditions out there. it's a frosty start to the day

and black ice is possible, which is bringing me now to mike inouye. have we had problems out there so far this morning and what do you expect for commuters as it gets colder and frostier? >> we have had reports or at least potential for black ice conditions reported by our systems which are integrated. no spinouts reported by chp. it's not cold but heat. a car fire causing wo lanes to be blocked. looks like flares we main. may have cleared in the last couple seconds. we lost a signal. when it came back we see cars driving through the zone that was closed west 580 approaching it crow canyon road. this scene here with flares remaining. all cars using all lanes will show you the maps where the backup is the scene of the earlier car fire. it was smoldering. a few minutes ago looks like activity is calming down. right there in the backup up the dublin grade a fender-bender

that happened. it will take a few seconds to clear. that will add to the backup off the dublin interchange where these folks join into the party coming out of livermore which has a typical commute. it's folks heading from dublin into castro valley that have unusually heavy slowdown there. meanwhile the rest of your bay area looking normal for a thursday. we'll look at the bay bridge toll plaza where we have backup forming and cash lanes to the left and lanes to the right are fastrak. backup forms and we'll look for metering lights over the next 10 to 15 minutes. back to you. >> thank you very much. 6:03. there could be a settlement announced later today in the case of a dog ordered to be euthanized after it attacked a police horse. the dog's owner is asking a judge to step in and spare the life of his dog. city officials say the dog is vicious and should be put down. "today in the bay's" monte francis live at christie fields with more on what charlie's owner has to say this morning. a lot of people vocal about

this. >> reporter: i just spoke to the dog owner about 15 minutes ago. he says there's a settlement conference scheduled in federal court at 1:30 today. he says this whole ordeal could come to an end. this stems from an incident when a 2-year-old american terrier named charlie attacked a police horse. the dog bit the horse more than once. an officer was thrown from the horse during the attack and charlie's owner was charged with not having control over his dog and police say the dog is vicious and should be put down. since the attack charlie has been in the custody of animal control. more than 100,000 people have signed an online petition asking the city to spare the dog's life. the city attorney offered a deal to send charlie to an animal sanctuary instead of being put down but his owner refused saying he wanted charlie to come home. the owner since filed a lawsuit against the city claiming that his civil rights have been violated. >> if we can come up with a fair

and reasonable solution, i'm willing to drop everything in this case. i just want my dog back. >> reporter: the attack left the horse with injuries requiring stitches. at today's conference the dog owner tells me he's making a proposal to the city. he wouldn't go into specifics. he called his proposal both fair and reasonable and depending on what happens today, there's a hearing scheduled in that same federal court on friday. at that time the judge could decide to toss out the police department's findings. monte francis, "today in the bay." san francisco police are hoping surveillance video will help them catch a suspected killer. police say this video right here shows a clean shaven man with long hair walking with 46 year old cruz back in october. that man was seen entering cruz's apartment in the city's tenderloin. later that night officers responded to a report of a disturbance at that apartment

and found cruz stabbed to death. as of now investigators say there is no motive for the killing. anyone with information regarding the suspect is asked to call san francisco police. a south bay family is marking a painful anniversary this week. two years ago a hit-and-run driver plowed into a girl as she was trying to cross the street in san jose. the 17 year old was left with brok broken pelvis and traumatic brain injury. her mother says although the driver may never be caught, she's certainly learned a great deal from her daughter and her struggle. >> if we can't get him, we can't get him. he's probably never going to live a really great life. i learned from my daughter that strength is incredible. the will to live, the love will keep you together. >> strong family. san jose police are still looking for that driver.

no closure but some relief for a hayward mother whose daughter was kidnapped in 1998 and never seen again. a bone fragment found in a well does not match the dna. it is believed to be a dumping ground for the speed freak killers. in a blog post, the mother says she feels disappointed that there is still no answer as to what happened to her daughter. she goes on to say "the overriding feeling i experienced was a sense of relief." coming up, morning glory for oscar gold. we'll tell you who made the list of contenders for the academy awards just ahead. >> why the animation category is controversial among animators. >> reporter: i'm bob redell. back here live to the south bay for silicon valley international auto show. what the latest and greatest you are looking at. newest electrical car to hit the

integration. this has a system that is an app you buy for your car. unlike other systems where you pay $1,000 for something for the application, what you can do with this one is upload from your smartphone to the car. you just go smartphone link. look at that. your system will show up from the smartphone into the car and you can use it like an oem map system. >> reporter: what's the range on one charge? >> we expect it to be the best in its segment. keeping some information close to the vest. we expect it to be the best in its segment. >> reporter: ten years down the road and you come to a car show like this, do you think half of the cars will be all electric? >> you know, i don't think so. we still have a long way to go with the internal combustion engine. if we draw the parallel to hybrids, they have been in market for a long time now.

north korea. >> good morning to you. that's right. as you know, schmidt touring north korea alongside former new mexico governor bill richardson. this is schmidt's comments as he was mobbed by press. >> the government has to do something. they have to make it possible for people to use the internet which the government in north korea has not yet done. >> a lot of attention on google earth where bloggers are posting satellite photos of north korea and prison camps for political prisoners. the new satellite images are doing more to open north korea to the world than schmidt's visit. closer to home, talks that microsoft ceo steve ballmer may buy a nba team and move it to seattle. yahoo! sports calls it a $500 million deal and says it's not sure in ballmer would keep the king's name. the supersonics recently moved to oklahoma city. this would not be the first

microsoft team. the portland trail blazers and seattle seahawks are owned by paul allen, microsoft founder. and earlier the pixar movie "brave" was nominated for an oscar in category of best animated feature. congratulations to them. let me let you in on a secret. the men and women at pixar and most animators don't really like that category. why? because some see it as a way of keeping them out of the best picture category. now honestly "brave" wouldn't have made it into that category this year. back in 2003 the best picture of the year was "lord of the rings return of the king" and "finding nemo" won best animated picture and people would say that is one of the best movies of the last 10, 15, 20 years. >> they are so much more than animated. >> they are not cartoons.

they are fmovies and many think we ought to be in the big boy or big girl category. >> i vote for "shrek." >> exactly. is donkey supporting actor then? >> thanks so much. we'll check in with mike for a look at the morning commute. >> i think about cartoons. not animated features but "tom and jerry" type cartoons. a nice smooth drive through the south bay. this commute we do have a couple key issues in key spots. here look at this. north 101. we do have a crash just around mckee. that took five minutes. just five minutes to clear from the roadway but that caused the backup to kick off. some folks bail out and take 280 northbound. heavier flow. a little earlier slowdown heading down through downtown possibly leading to more folks and then cutting back up 87 down to the original route. there you go. it will affect this triangle through san jose and heading up toward the airport for at least the next 20 minutes. we'll track that and let you

know how things shake up for the south bay. we have an issue with folks out of livermore valley toward dublin interchange typical pattern and sunol typical thursday. here's the problem. west of there from foothill road over toward crow canyon road with earlier car fire which cleared from the roadway. all lanes are open. flares in the road that have to burn out so folks are distracted. in the backup that formed around dublin grade we have another crash that quickly cleared to the shoulder but again more issues complicating your drive from dublin over into castro valley. there's not really a good alternate for you other than b.a.r.t. which is running on time. it's great if you take the rails. it keeps castro valley y moving smoothly and no major issues as far as your approach toward the bay bridge or the san mateo bridge just a little slowing which is traditional there. we'll look at the bridge itself. picking up volume in the westbound direction across that commute for 92 over to the peninsula which is moving smoothly as well. we'll also look at the bay

bridge where we do have a backup forming as metering lights turned on. a good flow of traffic as you see in the distance here and we'll have fastrak and cash lanes. cash lanes just over to the right for some reason aren't backing up quite as much. we'll see it fill in. and one more shot for the north bay. if not, i'll catch it coming up. back to you. >> quick shot of it there. looks like it is moving along. thank you very much, mike. we are keeping our eye on that very cold weather. we're going to give you some live looks outside. this is golden gate bridge. traffic is moving fine. i'm sure people have their heaters cranked up to as high as possible. temperatures are dipping this morning. >> throughout the bay area probably no one knowing that better than christina loren. we're expecting frosty conditions and even some snow in some of the higher elevations this morning. you are certainly feeling the chill, i bet. >> reporter: i certainly am. i got to tell you, ladies, it's easier to talk about these temperatures from the comfort of that warm studio.

it's so-call cold out here and warmer area across the bay area. twin peaks highest elevation hoping that some of these stray cells that we're tracking will move over this location and bring us a burst of some snow flurries. what is interesting is we do have a little bit of action already on the radar. it's very low levels. look at skyline boulevard with a mix of rain and snow. snow level at this point is down to 2,700 feet. as we continue to drop off in temperatures and look at where temperatures are right now. santa rosa at 31 degrees. that's cold enough for snow if any precipitation moves over santa rosa it's going to come down not in the form of rain, in the form of snow. and look at that. you see that little pink flash. it's likely as we heads throughout the morning hours. 42 in oakland. 37 degrees in san jose right now. i don't want everyone to grab their cameras where it's cold and you see showers on radar.

i don't believe any of the snow is going to stick below 1,000 feet. the chance is there. it's very rare to have this occurrence of the perfect ingredients at the right time. that's what we watch for. by the time we get through 9:00, our chance for showers diminishes. we'll close the window at that point. the coldest point of the day is still about an hour and a half away so it's only going get more interesting as we progress throughout the morning hours. highs will be cold warranting a jacket all day long. be ready for that. the seven-day outlook shows you that we'll stay cold all the way through the remainder of this week. tomorrow is friday. looking forward to that. temperatures are going to be cold for finish to the week and then this weekend staying on the cool side as well. into next week the sun comes out in full force starting monday lasting through wednesday and that will start to warm us up right around average as we kick off wednesday of next week. we have cold days to get through first. a live look at the city by the

nominee ever for "beast of the southern wild." she's just 9 years old. the oscars will be held on february 24th. mark your calendars. sounds like the plot of a woman. a dozen killer whales trapped beneath a vast stretch of ice but it's a reality in canada. the whales gathered around a single hole in the ice no bigger than a truck. scientists say a sudden drop in temperature may have caught the orcas off guard. the canadian government is sending specialists to come up with ways to help those whales. in denver a dog needed some help after falling through a half frozen pond. a rescue crew was sent to pull the dog from safety. the dog appears to be just fine despite icy conditions and shook it off to dry himself off afterwards. tough guy. he even wagged his tail as it

a commuter bus on the way to new york city. this is according to wnbc in new york and a school bus. those two collided. we're hearing it doesn't appear to be any children involved in this crash. still plenty of personnel on scene. we're waiting to find out about injuries. something that we will be looking for in the very near future. we'll bring you the latest. >> good morning. thanks for being with us. i'm marla tellez. jon kelley is off today. >> i'm laura garcia-cannon. in offices and schools across the country, lots of people calling out sick largely due to the flu. flu is much worse than last year with widespread cases seen in 41 states. that means emergency rooms are seeing overcrowding. "today in the bay's" tracie potts is live in washington, d.c. this morning. where do we see the worst impact so far? >> reporter: i can tell you it's not california. i was taking a look at the latest info from the cdc. california and montana are the two states with the lowest

amount of flu activity so far. most of what we're seeing is along the east coast and midwest and in the south as you said. those 41 states where flu activity seems to be much stronger than last year. >> why do you think this year's strain is so severe? >> reporter: a couple of things. because it started earlier and a lot of scientists think it may last longer because the particle strain of flu that's prevalent this year, many different types of this virus but the strain that they are seeing a lot of is a particularly severe strain so even though they say the vaccine is a good match, it's still making a lot of people sick. >> i know people are trying to get that vaccine. are they seeing a shortage? >> reporter: not a shortage. if you need to get a flu shot if your doctor is out, call somewhere else. a lot of retail outlets are offering them. some even free. boston has all free now and declared a public health emergency up there. it's probably not going to be a

problem to get a flu shot. what could be a problem is if you get sick and show up in an emergency room and you need this. this is tamiflu. it's one of the medications they give people when they have the flu. in some areas that seems to be in short supply or they are holding it for people who are sicker or who have chronic disease and need it most. >> all right. good health to you. thank you very much, tracie. this morning we are watching the weather the other big story of the day as we give you a live look outside. double the pleasure here. san francisco and oakland. san francisco of course the bay bridge looks very clear there. plenty of traffic in oakland. it's a cold start to the day. bundle up. you better bundle up if you are going to head outside. >> no one knows that better this morning than our own meteorologist christina loren. she joins us live from twin peaks in san francisco. how are you holding up? >> well, i would be a lot better off if i was sitting next to you two in that warm studio. i am out here because we have a very exciting chance.

i did want to start by showing you a picture that was sent in from professor stan lucas of what twin peaks looked like when we had snowfall in 1976. we're not expecting anything like this. isn't that impressive? look at all of that snow on the trees, on the hills, it is going to be cold enough for that to happen. what is happening is the moisture is not as robust as it was in 1976. the chances not as good. we don't expect that by any means. i want to show you where we could see snowfall this morning. the coldest temps right now petaluma at 27 degrees. cold enough for snow there for sure. same for boulder creek at 32. los gatos at 34 degrees. we could see flurries there. same for mt. hamilton and twin peaks we have fallen to 37 degrees. have not yet hit the coldest point of the day. if we get any active cells in this area it could happen and that's why i'm out here live this morning. as we head throughout the

morning hours it will get colder and colder before 7:30. we're already getting a beautiful sunrise this morning. just make sure you got your winter coat ready to go. you can see on the radar we do have low snow levels already. right now at about 2,300 feet. we're going to keep updating you as we progress throughout the morning hours. we'll take a look at your drive. there's a possibility of some black ice out there this morning. good morning, mike. >> good morning. especially that 27 and petaluma in the hills and smaller roadways in the north bay. just keep that in mind. no reports into chp about that. still quite potential for that. the bay bridge we have the backup because meerting lights are turned on. backup in all lanes filled in back to the end of the parking lot and actually farther for the approach off of the berkeley curve. not so bad for thursday. we'll show you maps in the area. speeds are slowing through berkeley and emeryville as typical pattern. 880 and 580 through oakland look nice. 580 through castro valley continued drama after the

earlier car fire at crow canyon road and earlier crash cleared to the shoulder at the dublin grade. backup continues over starting at dublin interchange over and past the scene and now rush is on toward the castro valley y and north 238 experiencing more traffic flow. south 880 past san mateo bridge and into fremont with a live look where we see volume picking up for headlights heading down past the truck scales and toward mission boulevard. speeds close to the limit but 55, 60 coming past the dakota area, dumbarton bridge, watch that slowing starting up. south bay itself earlier drama north 101 around mckee. maps will show you what we're talking about as far as flow to traffic here. northbound direction still slow but the accident cleared to the shoulder and as we said it may cause slowing on 87. sorting itself out between 280 and 101. that triangle is the one that's affected when any roads get in an accident here. rest of the south bay northbound routes look okay. over the santa cruz mountains,

tim came in from that area and he said no snow on the freeway but potential for hills and live look at the peninsula with an easy drive but a lot of company. back to you. questions this morning, could faulty radar be to blame for monday's oil tanker crash. nbc bay area investigative unit obtained documents indicating at least one raycon was not working. it sends signals to the ship's radar indicating where the center of the span is. that's where ships want to pass under the bridge. on the coast guard's weekly local notice to mariners, raycon b on bay bridge is lists listed inoperable. >> i've lost an important aid to me and need to find substitutes for that. >> caltrans is responsible for navigation equipment on the bay bridge.

we are keeping our eye on this story that's unfolding on highway in new jersey giving you a live look at the chopper that's on scene. it is air lifting somebody from the site of a bus crash that happened on a state highway in new jersey. a school bus collided with a charter bus and the best news here is that the superintendent tells our affiliate in new york that no children were on that school bus at the time. however, the charter bus is full of people. there are some injuries. the extent of injuries not known at this time. we are staying on the story to bring you the latest. it's 6:44 now. much closer to home, we're also watching the weather for you this morning. as we give you a live look at san francisco and san jose. sun coming up. temperatures are really dipping once again with a very cold

start to our morning. possibility as well of low snow. >> we are also watching out for return of the king tides which hit parts of the north bay especially hard back in december. meteorologist christina loren is braving those elements this morning. she's live atop twin peaks in san francisco. any snowflakes just yet? >> no. in fact dry as a bone out here. i'm going to tell you how it is. what's happening as the sun slowly starts to make an appearance out here in twin peaks, san francisco, at 900 feet is where i am. you can actually see we do have some mid level clouds overhead. really no storm clouds where we are unfortunately but let's show you where we are getting some low snow right now. take it right to the radar. we actually have good snowfall developing. a mix of rain and snow along the 17 summit. travel very cautiously headed that way. we've seen a few batches drifting around in this vicinity and that will be the case as

well. skyline boulevard also a mix of rain and snow for you. basically through the next couple hours we're getting into the coldest point of the day. it really is going to be determined by where these cells move onshore. they move onshore where we are where it's cold enough for snow flurries hopefully we'll be able to show you that and we'll keep on top of that for the next hour or two. now temperatures are certainly cold this morning. bundle up. break out all of the winter gear that you break out when it gets to be the coldest here in san francisco and the bay area. tomorrow even colder. likely the coldest morning of the year. and we just started that year. temperatures are going to drop to record lows as we meet back here tomorrow morning to finish the workweek. now, when we do head through 9:00 a.m. this morning, that's when the moisture supply gets cut off. we'll close the window for flurries in the bay area. highs today will remain cool in upper 40s and low 50s. make sure you bring your coat with you.

as we head throughout the weekend, it's going to be cold. we should see improvement in that area as we head throughout monday and tuesday of next week. temperatures are going to be on the cool side. a lot of sunshine to kick off next week slowly gradually starting to warm you up by wednesday into the mid 50s. upper 50s on the way. back out here live you can see i do get to bring you the best view the entire bay area just a beautiful start to the day. we can clearly see the bay bridge and golden gate bridge more visible as the sun comes up as well. at least we have a pretty sunrise to show you. so far though no flurries. let's find out how we're doing on the roadways. cold enough for black ice and that's something people need to take seriously this morning. good morning to you. >> good morning. that's great note for folks as we typically warn folks north bay with the mountains and smaller roadways through those beautiful hills keep that in mind coming over the santa cruz mountains.

so far no reports of any slow or slick conditions on 17. we'll watch that. we do have coming through these hills through sunol a slowing in the southbound direction those taillights things have smoothed out over the last few minutes but a burst of traffic heading south over the hills into fremont. we'll show you this area on the maps as well. we see the sensors slowing south into sunol. a typical pattern. you saw the view much better than a couple days ago where we had a lot of fog. smooth drive through livermore. still slow as you head west through castro valley off the dublin interchange up toward the dublin grade. earlier crash with activity off to the shoulder. still a distraction. getting clearing up toward crow canyon where we had an earlier car fire which is gone now and all these folks head over toward castro valley for the slowdown heading up northbound 238 but clearing when you get to west 588. south 880 you get company toward san mateo bridge. nothing unusual there. standard slowing heading south into fremont and into the south bay where traffic flows nicely into the area where northbound route. that's the commute direction.

we saw earlier issue and crashes at mckee and up by the airport. those cleared from 101. 85 at the bottom of the screen. 101 and 87 kicked off with earlier slowing. orange is a problem into downtown from capital. we'll get a live look outside and show you how things are shaping up for the peninsula. a lot of company on 101 both directions. northbound toward willow. southbound toward university. close to the limit throughout san mateo. oakland looks good heading up past the coliseum toward the toll plaza where the metering lights are on and backup because of folks heading down east shore freeway approaching that area as well. back to you. >> thank you very much, mike. it is 6:49. later today we will find out the fate of charlie. he's the dog ordered to be euthanized after attacking a police horse in san francisco. we spoke with charlie's owner this morning. morning. i spoke to the dog owner this morning. he tells me there's a settlement conference scheduled in federal court today and this whole ordeal could finally come to an end. it stems from an incident back in august when a 2-year-old american terrier attacked a police horse in an off-leash part of the park. charlie chased the horse and bit the horse more than once. an officer was thrown from the horse during the attack. charlie's owner was charged with not having control over his dog and police say the dog is vicious and should be put down. since the attack, charlie has been in the custody of animal control and more than 100,000 people have signed an online petition asking the city to spare the dog's life. the city attorney offered a deal to send charlie to an animal sanctuary instead of being put down but his owner refused saying he wanted charlie to come home. the owner since filed a lawsuit against the city claiming that his civil rights have been violated. >> i just want what's fair and from what i learned over the

last five months how they are treating me and my dog is not fair. i think charlie deserves another chance. >> reporter: the attack left the horse with injuries requiring stitches. at today's conference which is scheduled for 1:30, the dog owner tells us he's making a proposal to the city although he wouldn't get into specifics. he called his proposal both fair and reasonable. depending on what happens today, there's a hearing scheduled in that same federal court on friday at that time the judge could decide to toss out the police department's findings. live in san francisco, monte francis, "today in the bay." 6:51. the oakland zoo will give us an update on the condition of an alligator found guarding a stash of pot. alameda county sheriff's deputies were conducting a routine probation check at a castro valley home yesterday when they came face to face with mr. teeth. that's the name of this guy. a five-foot long cayman alligator. he was in a tank apparently

guarding 34 pounds of dried marijuana. mr. teeth's owner says the gator is about 16 years old. oakland zoo officials say he's very sick. his owner is under arrest. 6:52. a plot by a cheating wife has led to a bizarre ending in a home invasion in pittsburg. police say the woman, her boyfriend and two others staged a burglary to intimidate the husband to force him to move out. the husband called police tuesday to report a man breaking into his apartment on leyland road. then the husband stabbed and killed the intruder after a fight. it turned out the intruder was carrying a replica gun. the husband was not hurt and will not be charged. a woman accused of setting his girlfriend on fire will be in court today. officers and u.s. marshals arrested dexter oliver on monday. his girlfriend, 25-year-old star lamar remains in critical

condition at the burn unit at st. francis hospital. she has severe burns to her face and chest. family members say oliver doused lamar with gasoline and set her on fire after she broke up with him sunday. new details this morning in a rush hour ferry crash that injured dozens of people in lower manhattan. investigators say the ferry had recently undergone a major overhaul that gave it new engines and a new system. the ferry was making a routine rush hour run from new jersey yesterday morning when it hit the dock. the ntsb is investigating the crash. today vice president joe biden will meet with the nra and other gun advocates and merchants as part of a task force aimed at curbing gun violence. yesterday the vp got input from more than 30 governors, mayors and other officials about gun violence. the task force has an end of the month deadline to come up with
