the scene. all eastbound lanes were shut down for several hours. the man accused of opening fire killing a total of seven people will be back in court today. the court will receive a progress report every 90 days. earlier this month the judge decided that he was inkpet ept to stand trial. prosecutors say he planned the killing spree after becominging an angry with school officials over a tuition dispute. the retrial starts today after jurors could not agree to a verdict that she obtained drug by fraud or deception. madden's defense lawyers are arguing she did not deceive anybody in this case which is an element needed for conviction under the law.

san francisco's mayor ed lee delivering his state of the city address this morning. he will outline the plans for san francisco and that starts at 10:00 and of course you might imagine one reference to the big-time upcoming super bowl. the giants trophy tour continues tonight making an appearance in antioch. fans get a glimpse of the antioch community center. it will be there between 6:00 and 8:00 p.m. quite a sight there. hopefully in a little over a week we'll have a lombardi trophy for the niners to show off to everybody. >> what a year in sports. >> what's happening outside? >> what a year in weather. it's been a boring january so far. a wet december though and that's why we are still above average in terms of where we're running your rainfall totals for this time of year. we had a deficit this time last year. 39 degrees. chilly out there in livermore this morning. 40 in san jose. 38 degrees to start the day in gilroy. grab your coat.

4:44. another great staple of the south. 4:44 this morning. it's chilly out there. not as chilly as it is elsewhere across the nation. we're going to see a really comfortable week when you put things into perspective, it could be bitter cold. we would dodge heavy rain showers. not the case. we have a slight chance for showers as we head through next monday. that's our next significant chance for rainfall. this morning it's chilly enough for a coat. grab your jacket as you make your way out the door. plenty of upper 30s and 40s. no 20s on your temperature map this morning. i want to point out visibility is holding tight. however, we have ten miles or better for now. expecting coastal cities to drop off through the next couple hours. a lot of fog on the way. a strong onshore flow. that westerly breeze will come in all day long. it will be a breezy day. a little bit on the cool side if you are looking for the warmer days they arrive as of wednesday, thursday, friday close to 70. nice around here. two days when we have to get through 50s. today and tomorrow. 57 degrees in livermore.

a state of emergency declared in three separate provinces right now. 50 people have been killed across that country since the demonstrations broke out last week on the two-year anniversary of the revolution that ousted hosni mubarak. police firing rounds of tear gas into those crowds of protesters. current president, mohamed morsi, declaring a state of emergency late last night warning he would not hesitate to take more action to try to shut down that violence. protesters now accusing morsi of trying to monopolize power. secret hearings into the chandra levy murder case. there was a 2010 conviction in the case. a jury found him guilty of killing her after attacking her on a washington, d.c. park trail back in 2001. prosecutors had used testimony from a jailhouse informant who

claimed that he confessed to the murder. the next hearing set for february 7th. nearly three months after the megastorm hit the northeast, victims of hurricane sandy now about to get much needed relief. later on today the senate voting on the long delayed disaster aid package. the $50 billion plus bill was passed by the house of representatives last week. senate democrats have been trying to keep the republican minority from using a filibuster but the relief package is expected to pass when it gets voted on. also today, republicans and democrats are set to announce a major compromise on immigration. the small bipartisan group of senators has come up with a four-page plan outlining immigration reform. it includes a pass for citizenship for those that enter the country illegally. it includes an employer verification program. republicans hope it will b their ticket to winning the 2016 election. >> we're losing dramatically the

are down in new orleans right now getting ready for super bowl xlvii to take on the baltimore ravens. all kinds of coverage coming from that. we can tell you a film based on the true story of oscar grant taking home top honors of the sundance film festival this weekend. >> do you guys have plans for the night? >> that movie stars octavia spencer as oscar grant's mom and the film chronicles the 24 hours leading up to the 2009 shooting by b.a.r.t. police officer johannes mehserle. >> we knew that this movie would help us share with the world who oscar was. no one is perfect. i mean, we all should be entitled to some redemptive acceptance in our lives.

>> the film here well received and well accepted. taking home the grand jury prize and audience award. the first future length film direct directed. so far no release date has been set. basketball star and palo alto native jeremy lin stopped by sundance last night for the final screening of linsanity. lin and filmmakers got a standing ovation in that packed theater. the film leader says when he first approached lin about the documentary, he wasn't too excite d about it. he eventually warmed up. >> i'm not kim kardashian. i'm not reality. i don't want that attention. i'm just a ballplayer. you know, for me, i'm, like, you're a ballplayer with an awesome story.

a car crash north of the airport in kennedy park. took out a power pole so there will be power out in the area. 1,000 people without power right now. that will affect local signals. no details but be careful because it sounds like signals are affected at the dublin interchange a smooth easy drive. light flow of traffic here and across both bridges. commute direction is coming to the east bay. no problems out of the north bay right now. the bay bridge looks like an easy flow. for a while about 4:30 i had seen slowing on either side for cash lanes. looks like everything has been smooth for the last 20 minutes and a good flow of traffic. no issues getting over from oakland into the city. of course we'll probably see a crowd there. i'm going to guess. just judging past traffic. >> mike has his crystal ball. right now a related story. interesting results from a new study on the types of cars we drive. according to researchers from the oak ridge national laboratory in tennessee, fuel
