>> gotten our hopes up, gotten let down. so we are skeptical until something concrete is shown. >> kevin's mother said she's in the wait-and-see mode as she's been in this situation a few times before. >> a bay area man is suing the boy scouts of america claiming he was sexually abused by a scout master as a teenager. the alleged abuse happened when the victim was 14 years old. now the victim is a veteran of the u.s. coast guard. the lawsuit will be announced in san francisco this morning. >> pro gun activists set to hold a rally in san francisco this morning. speaking out against a proposed ban on assault weapons. the western presentation political action committee holding a press conference at 10:00 today. the group claims anti-gun legislation will not have any effect on crime rates.

around santa 'caucruz for thurs and friday. plan for clouds and cooling. right now the satellite radar view shows high pressure keeping us dry. any chance of rain north of portland. not just today but probably through the next five or six for the bay area. hour by hour, patches of low clouds near the coastline. mostly sunny skies through the afternoon. you can see not a lot happening on the future cast. no rain. not much in the way of clouds. temperatures today like yesterday but add three to five degrees to the high yesterday. low to mid 60s in san jose. close to 60 in san francisco. 65 degrees around santa rosa for the afternoon. warming today and the temperatures will probably peak for the coast on thursday into friday. the weekend, more clouds spill in but the dry weather holds up monday into tuesday of next week. >> that's good scooter and bike

a judge ruled against the company in the battle against samsung. for that we go to jackie deangelis at cnbc. good morning. >> good morning. all eyes on blackberry and rim. also hitting milestones. the muchs are higher after stocks resumed the march higher. investors shrugged off a report saying consumer confidence dropped this month. tech got help from amazon. quarterly earnings, missing forecasts. but the stock still jumping in after hours trading. we'll get data on private sector jobs and fourth quarter gdp. the dow a stone's throw away from 14,000. it hasn't hit the mark since 2007. we saw it rise 72 points yesterday to 13,954. the nasdaq slipping to 3153. a federal judge rejected apple's request to increase the $1

dry air to the coast from the hill tops. eventually warming up places like santa cruz. here is an update from new orleans. 72 degrees now. look at the wind. south at 25 miles per hour. the weekend will look fine for super bowl plans. today is a different story. we have active weather from the west. this is a line that produced tornadoes to the north. within the next hour or two it looks soggy there. you can see the line of thunderstorms rolling into new orleans. completely different story here. we have high pressure acting like a gigantic wall in front of california here. storms coming in off the ocean. glancing off to hit the pacific northwest. that's a pattern for the next few days. it's tough to get clouds to come through. you can see patches of clouds near the coast. again, mostly sunny. temperatures warming each of the next couple of days. today should be in the 60s. mid to upper 60s southbound toward santa cruz.
