bond. he flat out says all of the accusations are untrue. 24-year-old francis ngissah tells our nbc station in sacramento the four students who went to police are the same ones who recently were told they were being cut from his college prep academy that focuses on elite basketball training. ngissah started the school this past fall in roseville run out of this home. according to his website, it has just nine students. most are teenagers from overseas. police say ngissah would push students by restraining them with zip ties for long periods of time and attach clothepcloth to their nipples as punishment. >> if you look at the students, there is just no way one of those players would let me do

anything to them at that level. >> on the academy's facebook page, the school posted a statement saying that we also ask for all who have followed this story to please remember there are two sides to every story and we ask for a fair opportunity to bring the truth forward. ngissah is facing child abuse punishment, battery and false imprisonment. in the meantime, roseville police believe there are more victims so they are expanding their search today. one last note according to the website, they were supposed to play their next basketball game this coming friday against another prep school in las vegas. safe to say that's not going to happen. >> thank you very much. police this morning need your help finding one of the men involved in just a violent south bay home invasion. investigators say a man resembling this sketch beat up an elderly woman and her daughter when they caught him and his accomplice trying to break into their car friday

morning. the men then chased the women back into their home and assaulted the 74-year-old mother there. you can see how badly she's bruised up there. so tough. the women escaped to a nearby home. police say the man ransacked that home and took off. police at this point have not released a description of the second suspect. a vigil will be held tonight for an off-duty san mateo county sheriff's deputy killed while riding his motorcycle. eric mertl died last week when a car turned in front of him while riding had e ining his motorcyc burlingame. police say the driver said she didn't see him. she wasn't arrested. the 51-year-old leaves behind a wife and a 12-year-old son. tonight's vigil will be at 6:00 in millbrae. new details this morning on that bus crash down in southern california that killed seven and injured dozens more. the ntsb expected to begin an investigation into that deadly crash today.

safety inspectors say the bus had a history of brake and maintenance problems which may have played a role in this crash. that crash happened sunday in the san bernardino national forest. now this bus was carrying a group of tourists from tijuana returning from big bear lake. some california cities are battling the state over medical marijuana and for the first time the state supreme court is getting involved. the court will hear arguments today on whether local governments can ban medical marijuana pot clubs even though it's legal at the state level. "today in the bay's" christie smith joins us live at the court building in san francisco this morning. a lot of people paying attention to this. >> reporter: that's right. medical marijuana advocates up and down the state will be watching this one really closely. already about 200 cities and counties in california have a ban in place on pot dispensaries. for the first time the state supreme court is going to step in to decide whether cities can legally have the right to restrict these dispensaries. nearly three dozen bay area

cities have bans or limitations in place. some arguing that cities really need to be able to control when and where these businesses operate. the impacts aren't always positive. dispensaries like amsterdam garden in san jose, many people believe that if the state sides with a city's right to ban it, it could be a slap in the face for california voters. >> very disappointing. as a voter i wouldn't feel like my voice is being heard. this is something that's being decided 16, 17 years ago, 1996. >> reporter: california voters legalized medical marijuana here in 1996. the seven justices expected to hear those arguments at about 11:00 this morning. reporting live in san francisco, christie smith, "today in the bay." >> thank you, christie. >> i kind of got spoiled by the 70s and 60s and that sunshine out there. >> a taste of spring. >> reality christina loren is telling us more in check. reality of 50 degrees, right?

a jeep colliding head-on with another car. a woman stole a vehicle from his home minutes before the crash. that women sadly died in the accident. the san francisco board of supervisors is considering a proposal that would require owners of older buildings to retro fit them for earthquake safety. the law would apply to wood frame buildings built before 1978 and retrofitting would have complete by 2020. scott mcgrew joins us now. silicon valley has been waiting a long time. >> the valley has been pushing for all kinds of new visas to keep educated, talented workers here. yahoo! ceo marissa mayer one of the representatives from high tech meeting with the president along with former aol chief steve case and the head of qualcomm as well. the president will also meet with the labor side of the equation. not always as supportive of

sport. people can play for a long time at a really competitive level. you'll see olympians who are in their 20s and olympians who are in their 50s. >> reporter: do you expect all modesty aside that you could get to the olympics at some point in your life in the sport of curling? >> i really hope to. i spend a lot of time every weekend through fall and wenter traveling to train and compete. i would love to do it. it's a lot of fun. people are great. it's out there. >> reporter: i'm sure you know we have known gabrielle forever. you started seven years ago. was this on a lark? you heard about the club? is that right and here you are? >> a plug for our station i saw it on our station while doing a show that they were going to have an open house. i came out with my brother as a joke. we thought we would point at each other and laugh and take funny photos and i was hooked instantly. >> reporter: the biggest misconception, it's not easy. >> it's golf where you can get good enough to play and have a

through sunol south 680. a new crash reported just around the bend as you head past the golf course. three cars involved in the crash. they just moved to the shoulder. traffic started to move again coming over from that side of the screen. that's the southbound side. the map shows you that it actually is just for that short stretch through the area at the bottom of your screen heading into and through sunol right there. pleasanton is okay for the southbound commute for 680 and 580 traditional build through livermore. we'll see probably some more slowing start to build until they can move those three cars completely out of the area because folks will stop and call spectator slowing. we'll look over here toward castro valley y. a lot of folks 580 and north 238. typical pattern. we see slowing south 880 down toward the san mateo bridge. nothing unusual here. continue on. but we will give you a look at the roadways here in the south bay where north 101 has that second burst kicking in coming north 101 north of 680 and heading up to the airport past highway 87 for slowing.

"today in the bay's" tracie potts joining us live from capitol hill today. the president meeting with labor leaders and ceos. a meeting of the minds. who is invited to attend this one? >> these are two very big meetings and a number of groups are there. the first meeting is with labor leaders and progressive groups, civic groups, naacp will be the there. a number of other groups that focus on immigration and labor leaders from some of the big unions here and then separately he's meeting with business leaders and we mentioned business leaders among them marissa mayer of yahoo! and also goldman sachs, qualcomm, coca-cola, a lot of ceos meeting at the white house today. >> key issue is border security. always a hot topic. what are sticking points for president and republicans on this issue? >> the one big issue seems to be what do you do first? republicans especially

conservatives are insisting we have to focus on border security first. we have to secure borders before we do anything else especially put 11 million illegal immigrants on a path to citizenship. that's what the president has talking about. he's talked about border security. he's got janet napolitano, homeland security secretary down at the border this week looking at that. republicans are making the link that we have to do that first before we talk about citizenship for anyone. >> a lot to discuss here. tracie, not just the white house addressing immigration reform today. can you tell us who else is getting involved in this? >> we've got a congressional hearing, house judiciary committee is looking at that. we'll hear more as they are a republican control committee. we're likely to hear more about why they want to focus so much on first on that border security. >> all right. tracie potts in washington d.c. thank you very much for the update. 6:32. neighbors in los gatos are questioning gun sales in their town. hundreds of people crowded a

town hall meeting to discuss a new sporting goods store selling guns on university avenue. opponents say the city should not have approved permits for the store without a public hearing. the store owner says he's following all of the rules and is even promoting gun safety. >> we explain the laws to them. sewed them cable locks and showed them how to properly secure them. >> people talk about the nail stores that are coming in or retail stores that are coming in and it's a big production. and yet a gun store goes in and we have no say in the matter. >> after hours of public comment, the town council continued the meeting until february 11th to consider changing zoning laws and the permit process for gun sales. the council will also consider new gun regulation. today the san jose city council taking on the issue of marriage equality. several council members expected to request the council put a resolution supporting marriage equality on a future agenda. they will also call on the city to join a case currently before the u.s. supreme court that is aimed at overturning the defense

around san leandro with no slowing showing up yet but i'll track that. bay bridge toll plaza has pabacp and metering lights. 101 northbound with taillights. southbound with headlights. both sides picking up volume but no major delays into the south bay for those headlights. we'll give you a look at that coming up. back to you. >> mike, thank you very much. a new traffic study shows commuters at oakland and san francisco are delayed in traffic as much as commuters down in los angeles. the texas transportation safety institute says commuters in san francisco and oakland spent 61 hours a year stuck delayed in traffic. by the way, washington, d.c., that area there, the worst in the country for traffic. tallying 67 hours of delay per driver. just into our newsroom, a truck crash in philadelphia is snarling the morning commute. take a look at this. it's from our nbc station in philadelphia saying the truck was carrying fuel tanks under a railroad overpass when one of the tanks got knocked off onto

new details in an alabama hostage situation. an fbi agent says the little boy is doing well in the hospital and even laughing and joking this morning after being freed from an underground bunker as he was being held for seven days. the boy had been held by jimmy lee dykes is since last tuesday when dykes boarded a school bus, killed the driver and kidnapped that boy. police distracted dykes before raiding the bunker on monday.

that s-curve. no slowing just be careful coming over from san francisco to the oakland side. of course metering lights are on there. san mateo bridge slows down a bit. 101 north bay southbound side slow approaching north san pedro road. activity here. i'll check on that and give it to you coming up. 6:50 right now. the fight over medical marijuana heading to the state supreme court today. at issue here whether local governments have the right to ban dispensaries inside their jurisdiction despite the fact those dispensaries are legal at the state level. christie smith is live at the court building in san francisco with more on this story. christie, good morning. >> reporter: good morning to you, jon. medical marijuana advocates will be watching this one closely because it could impact where dispensaries are allowed to operate within city limits. many of them feel that if the state sides with local

government it would really undermine the will of california voters who legalized medical marijuana in 1996. but more and more bay area cities seem to be limiting pot clubs or trying to ban them all together. three dozen bay area cities do that right now and today the state supreme court will decide whether cities can legally restrict them. san jose city councilman supports limiting the number of dispensaries but wants cities to have the final say. >> disconcerting if the state rules the cities don't have ability to control when and how and where dispensaries operate. that's very important for a lot of communities. we know there are a lot of impacts of dispensaries. not all of them are good. >> reporter: right now 200 cities and counties in california have a ban on retail medical marijuana dispensaries. this case they talk about today comes out of riverside where the city used zoning powers to ban storefront marijuana shops and

one of the shops went ahead to sue to stop the city from shutting it down. seve justices expected to hear the case in san francisco at 11:00 this morning. reporting live from san francisco, christie smith, "today in the bay." >> 6:52. the u.s. government says sunnyvale high tech firm badly underpaid immigrant workers literally paying them pesos. >> scott mcgrew says this is flat out embarrassment for bloom energy. >> bloom accused of paying mexican workers to repair and clean power generators right in sunnyvale for the equivalent of $2.66 an hour. that would be a serious accusation against any company but this is a special company. bloom was an absolute media and investor sweetheart back in 2010 when it was the subject of a gushing "60 minutes" report and then investor meeting showing off technology. bloom makes these fuel cells at the time promoted as the energy production future.

the u.s. federal judge ordered bloom to pay the workers in question the wages they deserve under minimum wage laws. bloom did not comment on the accusations. taking a look at the market, the dow industrials up about 80 points after a terrible day yesterday. dell has been taken private for about $13 a share, 13 and change. michael dell, silver lake partners and microsoft all getting in on the bid. dell no longer a publicly traded company. >> all right. thank you. 6:53. santa clara officials say super bowl power outage like the one in new orleans would never happen at the new 49ers stadium. city leaders say after this weekend's 34-minute power outage at the superdome, electrical utilities are sure to be a consideration for the next super bowl host city. santa clara stadium is on the short list to host super bowl l in 2016. santa clara boasts its own power plant and electrical service and

the nfl will choose that host city in may. a lot of people may not think about it just yet but this week marking the one year and counting to those winter olympics in sochi, russia. the winter games celebrating the best out on the slopes and of course on the ice. >> and our own bob redell is getting into that olympic spirit this morning and joins us live on the ice with a curling team in san jose this morning. bob? >> reporter: good morning to you, jon and laura. can you believe that we're already a year out and talking about the winter olympics. it seems like we just got done with the summer olympics but the bay area curling club is a club that's been here in the area for several years now. they have 150 people out here. unfortunately no one from the club will be going to sochi, russia, and i hear gabrielle coleman, our friend and colleague at work so close and i know you have tried over the years. i think that just gives people a sense of just how difficult this sport is. it's new maybe to the american audience. i think we keep saying this is a

smooth over here through palo alto north or south down into the south bay, guys. back to you. >> thanks a lot, mike. 6:58. a final check of the day's stto stories for you. a tour bus crash in southern california that killed seven people and injured dozens others is under investigation. the tour bus had a history of brake and maintenance problems which may have contributed to the sunday crash. oakland police releasing more information in another deadly crash. one that may have involved a stolen suv. a jeep colliding head-on with a honda in the intersection of 36th avenue and foothill. the owner of the jeep says a woman stole his vehicle from his home just minutes before that crash. that woman ultimately died during the crash. faa may soon allow boeing to run deemliner test flights. boeing is trying to fix a problem with the aircraft's lithium batteries. it could take months before the commercial flights, however, resume. and finally this morning, a
