minutes. pistorius reportedly left the courtroom shaken and during the hearing he was said to be so distraught he spent most of the time sobbing. the prosecution is arguing he shot and killed his 29-year-old girlfriend in an act of premeditated murder. prosecutors say pistorius fired through a bathroom door where steenkamp had locked herself in after the two got into an argument on valentine's day. the defense says it was all an accident. pistorius thought she was a robber. at one point pistorius spoke saying "i picked reeva up as d had been told not to wait for paramedic paramedics. she died in my arms." steenkamp was laid to rest in a private funeral this morning. her coffin draped in a white cloth covered in white flowers. her uncle spoke to the press saying the family will do its best to uphold her legacy which includes standing up against

metropolitan cities. a look at oakland right now getting moderate to heavy rainfall. that's going to continue to be the case as we head throughout the morning hours. i want to show you the bay bridge, richmond san rafael bridge hit hard. travel cautiously through there. expecting gusty winds today. potential for strong thunderstorms to develop. highs are going to be cool. only ending up in upper 40s and low 50s. let's take a look at your drive this morning. 6:03. good morning, mike. >> good morning. we'll illustrate exactly what you're talking about. here is the bay bridge. the big build is just on now just after 6:00. we expect the build but they may have turned metering lights on early. you see wet roads on the approach. you see lights and backup past the 880 over crossing building in less than five minutes. we'll take you to another look. this is from emeryville. looking at berkeley west 80 commute direction into the area. you see rain on the lenses and you see the build for the commute. a bad combination.

the sensors show yellow coming down through richmond out of hercules down so expect a slower drive and wet drive. where there is highlighted green on maps integrated with the weather system, we see wet roadways. over on the peninsula, we've been having rain for a half hour. it's causing an issue as far as surface street traffic and freeway is slowing as volume builds north 280 specifically coming up toward 101 out of daly city and into san francisco. the north bay itself san rafael into mill valley, a build for volume. no slowing but watch approach toward the richmond san rafael bridge. we'll look at how things are for the san mateo bridge approaching foster city just about a minute ago the camera was shaking quite a bit. christina talks about gusting winds which is an issue over the high rise and south bay looking at 101. slowing from 680 toward the airport. we'll track the rest of your south bay coming up.

back to you. 6:05 right now. pittsburg city council looking to ban dispensaries. it would make some exceptions in limited situations. the ban if passed is expected to go into effect sometime next month. hayward is cracking down on internet sweepstakes cafes. the cafes offer online sweepstakes games which are technically a form of illegal gambling. the city council will consider an emergency ordinance tonight that would shut down any cafes for 45 days. once the moratorium is in place, the council will discuss a long-term solution. a live look at one of the cafes that would be affected by the moratorium. 6:09. time for a quick check on the day's top stories. olympic sprinter oscar pistorius charged with premeditated murder for the shooting death of his girlfriend reeva steenkamp after reading a statement in court, the olympic athlete started crying uncontrollably. the trial was adjourned until tomorrow. police released a sketch of a suspect wanted for raping a young woman visiting the uc santa cruz campus. the suspect described as a muscular white man in his 30s and dark hair and full mustache and goatee. president obama expected to urge congress to protect the middle class while voting spending cuts kicking in march 1st. congress in recess this week but staffers continue to negotiate a deal while the lawmakers are away. some of the top minds in law will meet today to hammer out changes over hacking laws. >> aaron schwartz's supporters

say he never should have been prosecuted. >> schwartz hanged himself before he was to go to a trial for downloading documents at m.i.t. many thought federal prosecutors went to far in attempts to put him in jail. there is a proposed changes to the computer fraud act. legal scholars will debate and mark up that bill at stanford today. critics say the current law which was originally written in the '80s though changed several times is far too vague. serious accusations about hacking have been leveled against the chinese this morning. security company says one particular unit of the chinese army is behind years of attacks against the united states. though just a few hours ago chinese officials called a press conference where they denied all of those accusations. they said a majority of hacks against chinese companies originate in america.

company will build here. it will include a restaurant, museum and brewery allowing the company to increase the beer it produces and create a hundred new jobs in the process. if you wonder about the brewery's original location, that's not going anywhere. when the san francisco giants $1.6 million mission rock project is completed in 2017, it will cover 24 acres here roughly here at pier 48 and parking lot a. it will offer office space and will create just under 7,000 jobs for the city and bring in hundreds of millions of dollars in tax revenue which is why the baseball team is calling this one of the largest urban mixed use developments in the country. reporting live here at pier 48, bob redell, "today in the bay." >> all right. not raining on bob right there but we're on storm watch this morning. we want to check in with

meteorologist christina loren. how are we looking now? >> we have showers out there. the steadier rain is a few hours away. it is on the way. slowly but surely. 6:17 now. we're getting some good rainfall right now. mostly along the east shore. oakland, you just got hit. watch out for slick conditions. 880 usually a nightmare this morning. not going to be great. we'll check on that with mike in just a moment. as you can imagine, slick conditions are not a good thing when it comes to morning rush. temperatures are going to be nice and cold out there. it's cold enough for snow levels. right now at 2,000 feet they will stay at 2,000 feet numbunt noon today because it will be cold. 57 minutes away from heavy rainfall down in concord so watch out for that. take you to south bay and show you here it's still mostly dry. dry from heavier rainfall. we do have a steady mist and drizzle because it's thick low clouds overhead. you're really not going to catch a break where you wake up with

us this morning. plan on a slow commute. bulk of moisture comes through before noon. active time frame. snow levels at 2,000 feet until noon. in addition to cold, our atmosphere is so unstable that we're also expecting the formation of pretty strong thunderstorms. they will be isolated. best chance over the higher elevation of santa cruz mountains for instance. however, we'll watch for that for you and if you get caught up under one of the strong thunderstorms, that means potential for pea sized hail and gusty winds up to 50 miles per hour and brief heavy downpours really dangerous driving conditions. as we head throughout this afternoon, we'll see partial clearing. a little bit of sunshine on the way. let's time out the system to your doorstep. 8:00 a.m., moderate rainfall. lighter stuff starting to move into palo alto at that point. we stop the clock for you again at 11:00 a.m. that is when it will get active across the south bay. you can see we have heavy to moderate showers along the peninsula. silicon valley getting hammered

at that point. mt. hamilton picking up snowfall. we could measure four to six inches of powder on top of mt. hamilton before the day is done. at 5:00 p.m., things clear out. showers deteriorate and we get a little bit of a break. it's going to be cloudy. kind of damp as we head throughout tonight and then tomorrow morning clear skies mean a very cold morning. highs will require a jacket all day long. 48 degrees. that's it for you in livermore. 49 degrees in san francisco. wednesday, temperatures climb just a touch after a very cold start. we'll see some pretty good sunshine tomorrow afternoon as well with most of the cloud cover lingering over local mountains thursday into friday. a little bit more sunshine. we stay unstable. another disturbance will wring us light showers for thursday and then saturday and sunday we get another chance for rain very slight. best chance will be late saturday and then sunday into monday kicking off another dry

pattern. 6:20. let's check on your drive. count on a slow one this morning. >> plan the extra time. you'll need to slow speeds in spots. specifically where you show that rain and having already come through a bit before the main front. a preview for berkeley in the north bay. right now we're watching west 92. san mateo bridge. commute direction reports of some sort of stall mid span now. i've been watching for the last five minutes and haven't seen anything big. i'm tracking this because chp has not yet confirmed whether or not any lanes are blocked. we do see traffic flowing to the peninsula. steady flow. we'll look at the maps now. south bay i told you overall looking good. northbound routes a little bit lighter and here just slowing from north 101 from 680 toward 880 and continuing with the buildup toward the airport. the south bay many school districts down here have the week off for winter break. this may contribute to a lighter flow. folks coming down here from tri-valley. we're looking at west 580 and south 680. i started to see slowing through

pleasanton from time to time. speeds dipping down into the 50s. south 680 an earlier stalled vehicle reported from chp but not reported in the lanes. i haven't seen slowing coming off or approaching the dublin interchange. better news there. smooth drive toward castro valley y with slowing north 238 off west 580. earlier crash has cleared. no problem toward that san mateo bridge. we watch for delays across that span but so far westbound looks okay. bay bridge will show you this backup here at the toll plaza itself. as that rain came in, so did a bunch of traffic. they turned metering lights on. wet roads but getting a break now. east shore freeway is slow coming down through richmond and into berkeley. speeds into the 50s. that's not so bad. we'll look at peninsula as well and end with this shot for 101 north past willow. nice lighter drive southbound coming out of the city. it's wet roads down in toward millbrae north of millbrae and into the north bay.

taking you back live to dale city, virginia. look at that. moving away from it just a bit. a car crashed right into the house. >> that's not the garage. >> talk about coming through the front door. it all started with a police chase. this is about 30 miles south of washington d.c. we don't know if there are reports of injuries right now. authorities there -- had to come quite a bit off the road to veer right into that house. keeping our eyes on that for you this morning. >> can't tell what kind of car that is. doesn't look like a bmw but they are recalling thousands of cars in the u.s. and canada for a

faulty battery connector. the automaker says the connector can fail and then cause the engine to stall. the recall affecting the popular 3 series sedans, wagons, conv t convertibles and coupes and also include the 1 series coupe and convertible and z-4 sports car from 2009 to 2011. it knows of one minor crash in canada because of the problem but so far no injuries. new this morning a sudden fire at a florida gas station caught on tape. a driver was passing by a station in jacksonville and grabbed his cell phone video last night. there were cars nearby but luckily no one was hurt. no cause of that fire. >> scary stuff. 6:27. still ahead. was it mistaken identity or premeditated murder? oscar pistorius offers his side of the story for the first time since the death of his

locked herself in the bathroom of pistorius's home after a shouting match in the bedroom. pistorius said he thought an intruder was inside the house and started shooting at the bathroom. he said he felt vulnerable because he was not wearing his prosthetic legs at the time and then realized that reeva steenkamp was not next to him in the bed. in a sworn statement, he said he realized it filled him with horror and fear. he put on his prosthetic legs and tried to kick down the door and then bashed it with a cricket bat and then steenkamp died in his arms. whe steenkamp was laid to rest today. pistorius will remain behind bars tonight. marla tellez monitoring the case in our newsroom and will have an update in 15 minutes. east bay city right now cracking down on internet cafes.

the hayward city council saying the cafes are hot beds for online gambling. good morning, arturo. >> reporter: these cafes apparently have computer terminals that have sweepstakes games on them which are considered to be an illegal type of slot machine and also illegal types of gambling which are prohibited by state law. there are reports of three of these cafes in hayward. there's net connection on 700 block of b street across the street from city hall and i-biz on maple court. today the hayward city council is going to consider an emergency ordinance that would prohibit these kinds of cafes during a 45-day moratorium and during that 45 days city staff members will explore some long-term recommendations. options including extending the

moratorium or changing the city's zoning ordinance. after the city found out about the three locations, it sent letters to each one earlier this month ordering them to shut down the sweepstakes computers. world head closed all together. the state bureau of gambling control considers these kind of internet cafes to be illegal gambling operations. alameda county is now in the process of shutting down sweepstakes cafes in unincorporated areas. we're live in hayward, i'm arturo santiago, "today in the bay." >> it is 6:33 right now. a follow-up for you for a story we first brought you on sunday. this morning we still don't know who is at fault for a boat crash on the bay but we do know more about the man who died. investigators say a 68 year old from oregon died after a speed boat slammed into a ferry. another man also onboard that speed boat is right now in the hospital with some serious injuries. we can also tell you no one on

board that ferry was hurt. we are on storm watch this morning and that could affect your roads out there. we want to check in with mike. he's got a look at the morning commute. >> good morning. definitely wet roads the critical factor for traffic tuesday returning from a holiday weekend. we'll check the wet san mateo bridge. just getting hit with some mist and the rain is coming because i just saw it hit oakland. the good news is westbound earlier stall that has been cleared from chp report now as we speak you see more drops hitting this lens. it will be a factor crossing the bay. coming down from the north east bay and peninsula side. let's show oakland because i did just see a lot of glowing rights. things are clearer as far as view of the roadway but you see mist getting kicked up on cars and on windshields. tougher drive slower because of conditions through 880 and 580 through oakland toward the bay bridge toll plaza. the metering lights were turned on early there. by 6:04 we had full plaza backed

up to 880 over crossing. holding steady about west grand avenue. you see low clouds in the distance. richmond just hit by rain as well as berkeley. wet roads throughout the approach and down the east shore freeway. the map will show you overall conditions where the green is highlighting on my maps is where we are integrated with the weather system so that means wetter woods and puddling on the surface streets. keep that in mind. yellow slowing to the 50s around 50 through berkeley and approaching the emeryville area. slow for 880 at the bottom of your screen. a big concern south 680 approaching that walnut creek interchange just before you get to 24 there's a crash sounds like maybe at least one lane is blocked and now backed up off 242 and blue meaning puddling through walnut creek. some more slowing now toward the castro valley y with a crash now a new one heading south approaching 580. northbound side. commute direction is slowing

slowdown. there's the shift. continuing down toward union city. we'll show you the south bay as well. starts in pleasanton. slowing starts heading toward san jose. no big surprises for livermore and tri-valley. a nice smooth flow northbound past the university avenue exit. it's pretty light traffic here and it's dry for now. you have big changes coming ahead. >> good morning to you, mike. good morning to you at home. you just saw from all of those traffic sensors a slower than usual drive and you want to keep in mind a lot of kids are off this week for ski week. you'll have to find something for them to do indoors today. let me show you where heavier rainfall is coming down right now. we had a good batch pass to the east bay and on the way to san rafael and also hayward getting the first significant rainfall of the morning extending north to san leandro and oakland. nice and slick at this point. so basically the nature of this storm system we'll see the

"today in the bay's" marla tellez joins us live from outsiour newsroom this morning. difficult for the families this morning. >> the reality star was laid to rest this morning in port elizabeth. her coffin was draped in a white cloth covered in white flowers as it was carried away. her family says family and friends traveled from all over the world to make it to this morning's memorial service. meantime, hundreds of miles north her boyfriend, oscar pistorius, once revered star sat and cried throughout his bail hearings. at times they had to stop the proceedings and ask if he was okay. steenkamp's best friend releasing a statement in court saying reeva and oscar had nothing but love for each other. the prosecution was out to prove otherwise arguing pistorius shot and killed steenkamp in an act of premeditated murder. they argued pistorius fired through a bathroom door where she was hiding after they got

into an argument. the defense says pistorius thought she was a robber and s mistakenly shot her three times. his team says he felt vulnerable because he didn't have on prosthetic legs when he fired through the bathroom and then realized that steenkamp wasn't in the bed and filled her with horror and fear. pistorius's team is arguing he should be freed on bail. the hearing last the for several hours. the magistrate did not hand down that ruling. our team inside that courtroom says pistorius left court with bloodshot eyes yet composed and reportedly we're hearing he's doing okay in jail. the hearing will resume tomorrow at 9:00 a.m.

police releasing a sketch of a woman.ey say attack and raped we have a look of the sketch. the victim describes him as a muscular white man in his 30s, dark hair, a full mustache and goatee and a tattoo on his upper right arm. the victim says she has been treated at the hospital for bruises. 6:46. how did he fall? that's the question rangers at a south bay park are trying to answer after a hiker died after falling 150 feet down a cliff. the man's body was pulled out yesterday. the middle-aged man went hiking saturday. rangers say he ventured into a dangerous area closed to the public and clearly marked for park visitors to stay out. police are calling it an accident. a wild sight here. a home nearly split in half after a tree goes crashing down. three of the four family members were there when that was hit.

winter weather in the bay area warrants. temperatures today are going to be cold all day long. in fact, it's so cold look at all the straight snowfall we're seeing more white than green up in northern california this morning. snow levels this morning at about 1,500 feet in the ukiah area. we expect a nice dusting of snow high atop mt. hamilton. showers coming in. right now spotty. heavier steadier rainfall is still a couple hours away. so far san jose has been dry. just want to show you that. nonetheless, we still have a steady mist and steady drizzle because of the low clouds really thick low clouds overhead. for today, we're going to get rain, wind and thunder. isolated thunderstorms on the way. stronger storms could produce hail and lightning. keep that in mind. temps tumble today as well. we're only going to break into the upper 40s. like i said before, snow levels 2,000 feet we would pick up to six inches. four to six possible on top of

mt. hamilton. we stop the clock at 10:00 a.m. more active at that point. widespread rainfall light to moderate across the greater bay area. that's when the bulk of moisture will come through. turning showery north of the golden gate bridge. we're getting pounded heavily in the south bay. so cold even at 11:00 a.m. still getting the straight snowfall over mt. hamilton. daytime heating between 11:00 and 12:00 is when the thunderstorms become a little bit more active. chance gets better as we get warmer. so today we're going to watch that for you all day long. and nbc bay area weather center will let you know if anything strong develops. a break through the overnight hours. tomorrow morning waking up with a very, very cold start to the day. 47 degrees in gilroy today. 50 in los gatos. 50 in san francisco. 49 degrees in oakland. you need the heavy raiders jacket today. wednesday into thursday, temperatures will be cool. we'll start to climb a little bit as we head through friday

through oakland slowing things for 880. south 680, south 242 down toward walnut creek interchange. earlier crash sounds like activity pushed to the shoulder but activity itself caused a slowdown and green, wet conditions and blue puddling and ponding possible through walnut creek and watch the surface streets or getting off the freeway definitely watch the off-ramps slick as you come off highway speeds. castro valley, backup here earlier crash northbound 238. i say was. it moved to the shoulder. look at the backup that it caused with a few minutes in lanes. slow off dublin grade and through castro valley westbound. unusually slow approaching that castro valley y. slowdown starting as more folks hit 880 south past the san mateo bridge into union city. i got to show you san mateo camera. the rain came through the area. it's misty and wet as that rain travels off 880 and parts of the

peninsula side foster city wet roads. anywhere north of 92 has wet conditions. we'll show you the south bay as well as san jose shows the build in the northbound direction slow from 680 to the airport as we showed you before. now the build starts over here at capital expressway. 87 slows into downtown. 85. doesn't look as bad as it typically does because schools in the south bay have the week off. a traffic shift right now. we'll send it back to you. >> a lot of people off today. wall street back to work after a three-day break. >> scott mcgrew says one of the best performing stocks this year is hp. >> hp. that's a shocker. the best performing stock in fact on the dow 30 industrials. to be fair it's still down 40% from last year but looking at just 2013, hp is quite the performer. hp will report profits this week so too will tesla. a key number to listen for will be working capital. how much money does this company have on hand not including people's deposits.
