this is nimitz north of the coliseum. high street and north of there there are spots for construction. on the maps we marked southbound 880 through downtown losing a couple lanes but no slowing because of light volume there. san leandro, that should clear around the marina, davis area and no slowing and no wind advisories for the san mateo bridge this morning. back to you. >> mike, thank you very much. happening right now, oscar pistorius back in court in south africa for what is expected to be the last day of his bail hearing. this is video from inside that courtroom just a short time ago. prosecutors arguing pistorius is a flight risk and he will flee the country if he's granted bail. but in a potentially damaging blow, a strange twist to the prosecution, the lead investigator in this murder case now facing murder charges himself. south africa police say the charges against him stem from an october 2011 shooting. he and two others officers fired

shots while trying to stop a minivan. of course we'll have continuing coverage on this pistorius case as it develops through the morning and if a judge makes a decision any time we'll bring you that as far as his bail is concerned as soon as it happens. closer to home this morning, investigators trying to figure out how a man ended up dead at the montgomery b.a.r.t. station in san francisco. b.a.r.t. police say they found the man while conducting a welfare check on several people sleeping on the concourse level of the station. they say the man wasn't breathing. an officer tried to revive him, a white man in his 30s, was pronounced dead at the scene. as of now officials say it appears he died of natural causes. the fairfield man accused of kidnapping and raping a 13-year-old girl is expected back in court sometime this morning. 32-year-old anthony lamar jones will likely be arraigned today. jones stands accused of killing

13-year-old and leaving her naked body in a fairfield park earlier this month. prosecutors say he could face the death penalty. uc berkeley police searching for teenage girls wanting for attacking women near the cal campus. they say both women were sprayed in the face with a toxic substance possibly pepper spray and one was punched and knocked to the ground. the teens allegedly tried to rob the victims but a man passing by the area intervened and suspects took off getting in a white dodge charger. the victims were not seriously hurt. president obama may be joining the effort to overturn california's ban on same-sex marriage. this morning the white house says the president is considering urging the supreme court to overturn proposition 8. the president has expressed his support for gay marriage saying his administration would do whatever it could to promote marriage equality. the administration has until the end of this month to intervene

in the case by filing a friend of the court brief. 4:34. this morning the oakland a's are one step closer to moving to the south bay. "l.a. times" reporting the commissioner's office has given the organization tentative guidelines for the potential move. as of now, it's unclear what specifically is laid out in those guidelines but if the organization can satisfy them, the commissioner, bud selig, could let club owners vote on it. the article does point out this does not guarantee the a's will come to san jose any time soon or at all. major hurdle, the giants own territorial rights in the south bay and they are against that move. in the meantime, a top oakland official is apologizing this morning. the city administrator mistakenly accused wolfe of releasing a letter about a short-term lease extension in oakland to the media but not coliseum authority officials. that, however, was not true and

after being told of santana's claim, wolfe fired out an e-mail saying it's sad when someone is devoted to harm someone else's reputation. yesterday santana apologized for the mistake calling it human error. hosting those 2024 summer olympic games is an exciting proposition. the city of san jose says it simply doesn't have the money to make a bid. mayor chuck reed says it takes billions of dollars to host olympic games. a price tag just too heavy for a city that's still struggling to keep cops on the streets. san jose was one of 35 cities invited by the u.s. olympic committee to bid for those games. san francisco and sacramento were also asked. san francisco mayor ed lee says he wants to establish a permanent nonprofit organization to work on securing major events like the olympic games. >> not a bad idea because it keeps coming up. it would be nice. >> 4:36 right now. nice forecast ahead. let's check it out with

nice light drive right now. we'll point out a couple spots coming up. back to you. >> it's 4:38. this morning neighbors against a proposed cemetery near the border of san ramon and danville say she don't want their backyards turned into graveyards. the proposed cemetery would be large enough to accommodate 150,000 bodies along camino tassajara. the developer says the mayors of several nearby cities approached him seven years ago asking if he would be willing to have a cemetery on his property. those against it say the cemetery would negatively impact property values and wildlife in the area. a big concern, the amount of water necessary to keep the cemetery green. >> if they put that cemetery in and the landscaping they're

meeting. the central bank has been buying up billions of mortgages and government bonds each month to keep interest rates low. we do get data out today on unemployment, inflation and housing as well as a fresh snapshot on the consumer walmart reporting earnings this morning. dow falling 108 points in yesterday's trade and nasdaq losing 49. here's a story we're watching. google is reportedly developing several touch screen devices that use its chrome operating system. now let's enjoy the good stuff. temperatures today are going to be comfortable enough to ditch your jacket and maybe even give your heater a break depending on insulation in your home. a live look at san jose. you can see the general sky over the bay area from this picture. you see low clouds hanging out. we don't have a thick deck blanketing the entire bay area but we'll see clouds move inland. we'll track that this morning. 45 to start the day in san francisco. not as frigid as yesterday. we bumped up numbers from this time yesterday morning by 10 to 15 degrees in some cases. you notice that difference up in the north bay where we have 20s at this point. 40 degrees to start the day here in beautiful san jose. want to point out winds out of the west. that's an indication of onshore flow that will strengthen for today. another weather system on the way. it's a dry system. it will fall apart as it moves over the bay area. however, it's going to keep that onshore flow in place and that means we'll see low clouds roll right back in tonight at about

killed last week in a shootout with christopher dorner. he died after arriving at a cabin that dorner was holed up. he was a 15-year veteran of the sheriff's department. survived by his wife and two young children. pentagon getting ready to announce creation of a new marine crisis response team. nbc news says this idea is in response to the attack on the american consulate in benghazi last week. a group of 1,000 marines will be based at a naval station in italy so it can quickly respond to north africa and eastern europe. bay area native and u.s. ambassador christopher stevens was one of four americans who died in that benghazi attack. hours before his death, stevens sent a cable to the state department warning of deteriorating security conditions. 4:49. the u.n. security council is meeting this morning to discuss sanctions against north korea for detonating a nuclear device. the obama administration is negotiating with council members for stronger sanctions.

a week ago north korea detonated its third underground nuclear test since 2006. it was the strongest blast to date. some monster size goldfish up to a foot and a half long are pulled from lake tahoe in what biologists say are steadily multiplying in waters and that has biologists warnings. they say the fish eat and excrete nutrients which stimula stimula stimulate algae growth. >> could change everything there. have to keep it blue. why a winery tossing perfectly good wine into the atlantic ocean. >> all right. we'll tell you why facebook is apologizing to one of its oldest users. >> a look here at the east shore freeway off in the distance. we see traffic starting to come off of that richmond bridge. we'll show you how things are shaping up for the south bay and tri-valley coming up.

last night 108-98 at oracle are arena. this marks the first victory for golden state since february. the warriors next play tomorrow night another home game against the san antonio spurs. a napa wine maker is trying to age wine in the middle of the ocean. the winery tossed four cases of wine into the charleston harbor. the 2009 cabernae was placed in special cages before being emerged and wants to see how ocean movement affects the wine. >> in the ocean where you have constant motion, where you have variance of temperature but also very similar to what the ideal storage in a warehouse is where you have a lack of light, different pressure, we're going to find out what happens. >> wine makers think the ocean is key to giving wine recovered by sunken ships a unique taste.

thursday, february 21st. this is "today in the bay." it is just about 5:00. a very good morning to one and all. i'm jon kelley. >> i'm laura garcia-cannon. new this morning, the obama administration says it may get involved in california's controversial proposition 8. "today in the bay's" marla tellez live in san francisco with what the president may do and what it could mean for california. good morning, marla. >> reporter: good morning. for one it could mean wedding planners would have a lot more business not just here in california but potentially in the 29 other states that currently ban gay marriage. it was in san francisco in 2010 when that federal judge who happened to be gay himself declared prop 8 unconstitutional and the california supreme court agreed. now since then the initiative that defines marriage as a male/female union in the state of california has been paralyzed
