building and pistorius was taken back to his cell for security. we now learned that threat has been canceled. everybody has gone back into that court. we have video from inside the courtroom just a short time ago prosecutors spending much of the morning arguing pistorius is a flight risk and they believe he'll flee the country if granted bail. in a potentially damaging blow to the prosecution, we mentioned strange twists. here's another one. the lead investigator in this murder case now facing murder charges himself. south africa police say the charges against hilton botha step from a 2011 shooting. botha and two other officers fired shots while trying to stop a minivan. we'll have continuing coverage and bring you the latest as it happens. we now have a picture of the man police say is connected to a triple homicide at a house in forestville. investigators think this man is a potential associate of suspect

mark capello arrested last thursday in alabama. these pictures were taken at a st. helena gas station a day before the homicides. investigators think they came to sonoma county to buy a large amount of marijuana. new details this morning in the search for three teenage girls wanted for attacking two women near the cal campus. police say they assaulted that victim on dwightway near prospect street on friday night. "today in the bay's" bob redell joining us live from the berkeley police department with the latest on this ongoing investigation. bob, good morning. >> reporter: good morning to you, jon. police in berkeley need your help in finding the people behind this late-night assault. what makes this crime somewhat unusual is the fact that the suspects are three teenage girls. last friday night around 9:40, they attacked and attempted to rob two adult women on the edge of the cal campus on dwight way near prospect street. victims tell police as they were walking they tried to go past

the three teens. one of those teens sprayed something in the face of one of the women, possibly pepper spray. the girls grabbed the second woman as they tried to run away, punched her in the face, knocked her to the ground, sprayed her and tried to rob her. a man who happened to be walking by stopped the robbery and scared the teens away. the women were hurt. police say suspects drove off in a white dodge charger and description of them is such that they are three african-american teenage girls. the first suspect short hair and thin build. second one, long hair and pony tail. long skirt. and third suspect braided hair, pink shirt and a jean jacket. berkeley police are asking for help if you saw anything or know who these women are to give them a call. reporting live in berkeley, bob redell, "today in the bay." a reward is being offered for information leading to the arrest of someone who shot a

raccoon in south san francisco. last sunday morning a neighbor reported the injured animal on palm avenue less than a mile away from highway 101. the peninsula humane society rushed it to the wildlife center where they discovered it was shot in the head. doctors eventually had to euthanize the raccoon. >> we hear why are people doing this? we think it could be a couple scenarios. it could be kids being kids doing dumb things or adults that see animals as a nuisance and that's what they decided to do. it's just shocking. >> the peninsula humane society says this marks a dozen animals shot since december including a falcon, two crows and another raccoon in palo alto. that growing tent city near san jose is now coming down. the camp near guadalupe river north of columbus park there. "today in the bay's" arturo santiago is live in san jose with what the city is planning to do about it and when they're

planning to do it. arturo, good morning. >> reporter: the situation out here has not improved in the last few weeks. the population of the tent city in fact has swelled to more than 100 people and the city of san jose now has plans to move the encampment out the first week in march. now the site is located along spring street between taylor and heading streets. it's in a large grassy field near the guadalupe river park. the tents are spread out and clustered around trees on the land. the tent city started to grow back in january after state lands along the guadalupe river were cleaned up by caltrans and that displaced the homeless camping in those areas. mayor chuck reed says the people are trespassing here and there are no sanitary facilities and city cannot have people living in unsanitary conditions. nonprofit organizations have come out to the site to reach out to the homeless and offer alternative options for shelter.

according to san jose police department, there has not been a noticeable increase in crime near this tent city. the most difficult task as always will be to find some kind of long-term solution in which the people of this encampment are kicked out for a few weeks or few months and then do not have to return a short time later and create another tent city. we're live this morning in san jose, i'm arturo santiago, "today in the bay." thank you very much. let's check in with meteorologist christina loren. she's got a look at our forecast for today. rising temperatures? >> a little bit. even more so to finish off the week. good morning to you. 34 degrees to start the day in sonoma. 20s at this point yesterday. a welcome change there. good morning, san francisco. taking you down to the south bay, 39 for gilroy. 37 degrees in santa cruz. we're expecting some fog to develop although no reduced visibility to point out. future cast tells the story of the day. between 6:00 and 8:00, thick

hit a bicyclist but update come in new ambulance needed. maybe bruises there. it doesn't sound like an issue as far as traffic flow or injuries to the person. that's good news. b.a.r.t. police are helping take care of that north of the bay fair station. no lanes blocked. 580 for unusual slowing. eastbound out of dublin, we see slowdowns in mornings and i never figured out why. no equipment that's scheduled to move through there. it's westbound that we're concerned with commute direction out of livermore. we do see slowing into pleasanton. reports of a toolbox in the same area. that should be in the opposite side of the freeway. i'll track that and give chp a call and get another live look outside. san mateo bridge easy flow off the high rise westbound with headlights which are frozen now because of the computer system but not because of traffic. there it goes. back to you. >> thanks so much. it's 5:09. how you can get your hands on google glasses before they're available to anyone else. >> very cool. we'll look at photo day down in

good morning to you. i'm laurence scott. the rain has stopped here in scottsdale for the time being at least. there's still a tarp on the field as they rise and shine here in arizona. yesterday it was pouring down rain. it was a good opportunity for guys to do something different. they got in some workouts inside in the weight room and some light throwing in this rain but it was also a day to get everybody together. they had them at one place at one time for photo day. they get one chance at this. this captures in time what

giants will look like from 2013 season moving forward all in one day. take a look. annual spring training tradition where they dress up in full uniform posing for what will be used all season long on game programs on the video board and elsewhere. they take photos as defending champs. >> fun to look back and remember what we did last year and remember how special it was. i think it also signifies the beginning of a new season. photo day is the beginning of a new year. >> giants baseball starts now. >> it's also a chance to capture the moments with giants that help make connections with the fans and in this case with sfg productions filming what will be later seen on video board in center field at at&t park. >> this material will go on the scoreboard prior to every game. it gets fans fired up and personalizes players as they are about to take the field at the

san francisco. not as frigid. you'll probably notice the difference. it's nice out there this morning. good air quality. breathe it in. recent rain. recent snow kept things nice and clear atmosphere has been renewed. we have good air quality today. it will be pretty. open up windows in your home. let the clear air in. low pressure keeps onshore flow in place for today. we have another system on the way. a weak system. it's also a dry system. what will happen is we'll continue that westerly flow so that cool ocean air pumping onshore all day long will keep temperatures about as mild as they were yesterday. a touch warmer in some cities. you'll notice the difference tomorrow. warmer day ahead. 61 in livermore. 60 in fremont. that's when high pressure will take grip on our forecast and warm us up into the mid 60s. that comes into play on friday. now saturday same deal. jet stream still south. that means we'll see another weak disturbance come through. that will bring in more clouds and maybe 10% to 20% chance of a

north bay shower. not expecting anything heavy. maybe a few light raindrops on saturday morning. then on sunday, best day for outdoor activity this weekend. we warm you up into the mid 60s. you can hit the beach comfortably. next week dry stretch of weather on the way. 5:18. let's check your drive. good morning. >> good morning we're looking at the south bay and actually chp blotter not showing any incidents and no concerns or slowing out of the south bay. however, i've been tracking this 880 we often see this about this time of the morning heading south down toward 280 and 17 interchange. slowing shows up. speeds down to 60 and nothing big going on. i continue to track reports. the only thing on my reports is for tonight and that is today and tonight with disney princess show going on. watch for smaller pedestrians probably wearing sparkly stuff. that's what's going on for san jose right now. folks coming into downtown for morning commute. we're looking at here west 580. we saw considerable amount of slowing that has cleared up but

now eastbound around areas of large toolbox in the lane. chp hasn't given a lot of details. we're tracking the area between north livermore and dublin interchange of a possible rolling traffic break there. we'll also track the traffic here through oakland with just road crews going on here. mostly southbound coming through downtown. the northbound side at marina cleared some time ago and we haven't seen slowing as they left the scene. over toward emeryville, i turned the camera to look at berkeley curve. nice, smooth easy light drive off 580, 24 and 880 this way. things are moving smoothly. look at the space between these cars. golden gate bridge easy light drive north bay down into the city. no problems. you see glow with lights. we're watching for developing fog later in the day and palo alto 101 here moves smoothly. no delays for 101 or 280 along the peninsula. back to you. >> thanks so much, mike. 5:20 to an investigative unit exclusive. the highest ranking officer in the california guard is ignoring a toxic culture.

"the new york times" reports google is negotiating to help design the frames. google letting some people apply to test the glasses. applicants have until wednesday to actually post on google plus

"today in the bay's" bob redell joining us live from berkeley pd with more details on this continuing investigation. bob, good morning. >> reporter: good morning to you. police are trying to get the word out in case you might know something about what happened. this was last friday night around 9:40 and what makes this crime unusual is that the suspects are teenage women. as i mentioned around 9:40 last friday night.

kidnapping, raining and killing a 13-year-old girl is expected back in court this morning 32-year-old anthony lamar jones will be arraigned today accused of killing genelle conwaconway-. the bail hear for oscar pistorius suresumed this mornin after a threat outside of the courtroom put the hearing on hold briefly. pistorius was taken back to his cell for security but court is back in session. the delay combined with a late start this morning could mean a bail decision could take longer than originally planned. a decision was expected sometime today. we're still watching to see how these new developments play out. meantime, the lead investigator in the murder case against pistorius now facing attempted murder charges for a 2011

shooting. he's being tried himself. police say hilton botha scheduled to appear in court in may. prosecutors say were unaware of the charges when they put him on the stand yesterday to testify. a tent city in san jose is coming down. the city is taking action before the first weekend in march. "today in the bay's" arturo santiago joins us live in san jose this morning. what will happen to all of the people that are currently living there? >> reporter: they are going to get rid of them. numbers have been steadily growing so much so the city of san jose is now planning on cleaning out the area which includes getting rid of tent city and its homeless population. the site is near the guadalupe river park along spring street. the tents are clustered among the trees that dot the land. the goal is again to have the tent city gone by the end of the

first week in march. the city's nonprofit organizations have been visiting the site and reaching out to more than 100 homeless that are camping in the area offering them sources for alternative shelter. the land is owned by the city of san jose and the san jose airport. mayor chuck reed says people are trespassing and there are no sanitary facilities for them and city cannot have people living in unsanitary conditions. once the area has been cleared, the hardest part will be to keep homeless from setting up camp here sometime in the future. that's where long-term solutions are badly needed and coming up with long-term solutions are quite difficult. this is of note. according to the san jose police department, there has not been a noticeable increase in crime in the area surrounding the tent city. live in san jose, i'm arturo santiago, "today in the bay." >> thank you. 5:34 right now. let's check back in with meteorologist christina loren. you know why? she has nice, good weather for us. >> even if i didn't, i would try to paint it that way.

didn't we draft buster posey? steady hand. great influence in the clubhouse and perhaps baseball's top player in many regards all around at least he's one of the fan favorites in san francisco. we take time with buster to talk about spring training. take a look. buster posy's impact on the success of the giants goes without question and as one of the team's leaders coming off an mvp season, capped by yet another world series title, he knows that rituals of spring start the process of being ready for opening day. >> feels good. it's nice to have the whole squad out here now. doing some live bp which is not really the hitter's favorite thing to do facing your own pitchers. it's definitely good to be back out on the field. >> reporter: what a difference a year can make in scottsdale between spring trainings. >> for me it's especially different just with last year i was answering questions about my injury from the year before.

it's nice to have that past me a little bit. for the most part you're just trying to do the same thing you did last spring and that's get prepared for the season. >> reporter: a season that will have competition circling the dates that the giants come to town. >> we know we have our work cut out for us in the division. the diamondbacks are a team that can get really hot and play good baseball. i think they play the game the right way. you have obviously the dodgers who are loaded up over the past year and even the rockies are a team and padres. you just don't know. i think it's a division that's probably overlooked a lot because a lot of our games are being played at 10:15 on the east coast and a lot of people don't see us. there's a lot of talent. >> reporter: it's that west coast bias they always talk about. not just in the division but all around major league baseball. the teams will be gunning for the world champs and really you love the steadying influence of

"today in the bay's" tracie potts is live on capitol hill right now where a handful of congressional and white house aides are meeting right now trying to save the day. tracie, good morning. >> they're trying. not clear yet if they're actually making any progress and of course congress is off this week so we won't see hard action until just a few days before these cuts kick in. let's talk about what effect they would have. the vast majority would affect pentagon employees, defense

secretary leon panetta has already said a one day a week furlough for pentagon employees for defense department employees. that means about a 20% pay cut. there are others out there who could be affected by this. going to the airport, tsa workers could lose 9,000 agents. that could mean some long lines at security. 1,000 fbi agents. border patrol agents as well could be lost. food inspectors could be temporarily furloughed according to what we're hearing and a number of other programs. the democrats in particular say would hit the middle class and working families harder. where are we now? behind the scenes aides are trying to work out a deal. some sort of compromise to prevent these $85 billion in automatic spending cuts from happening march 1st. jon? >> tracie potts from washington d.c. thank you very much. there's news the white house this morning is considering urging the supreme court to

overturn california's controversial proposition 8. there are more details with impact on the president's decision. good morning, marla. >> reporter: good morning. the president has one week from today to make the move when it comes to prop 8. if he officially decides to give his opinion to weigh in on this case, his opinion carries significant weight with the u.s. supreme court. back in 2010 here in san francisco when a federal judge declared prop 8 unconstitutional and the california supreme court agreed. since voters approved it in 2008, the initiative which defines marriage as male/female union in the state of california has been stuck in a legal battle. now the president is thinking about weighing in on the debate before the u.s. supreme court does. his administration says the president is considering urging the high court to overturn prop 8. we spoke to a couple people here in the city this morning who agree he should take action including one man who has been with his partner for more than a decade.

>> he should definitely if he has an opinion on it. his opinion sways a lot of people's opinions especially if we look at prop 8 who voted for it in california it was african-american community who backed it here in san francisco as well as the asian community. as a gay man myself, i would hope the president would come out for my partner and i getting married eventually. >> i don't have a problem with them legalizing it. it's a free country. >> reporter: conservative religious coalition known as protect marriage put prop 8 on the ballot in 2008 and getting back to the white house, the president is a known supporter of gay marriage and once again he has until february 28th, that's one week from today, to file what's called a friend of the court brief. the u.s. supreme court will take up prop 8 next month on march 26th. live in san francisco, marla tellez, "today in the bay." >> thank you, marla. 5:45 right now. christina loren is back on the way here i felt like it was cool out there but it was refreshing.

degrees on sunday. you can't beat that. let's check your drive. good morning, mike. >> good morning. we're looking over here to fremont where the southbound side you see headlights going down past this sign here for auto mall and the truck scales on the northbound side. things are moving nicely. picking up company. no problems as far as speeds on maps. our sensors are showing green through the entire area. this is newark and fremont. south here they marked the crash reported from chp. that southbound right around the fremont exit shows up here as well. what do you know from that? it's on the side of the road. signs are gone making changes there. as far as speeds, no changes to report for 880 down through fremont or 680 through mission as well. the northbound side of 101 shows typical first burst of slowing. just before 6:00 we see the slow right here. no other problems. 87, 280, looking good. we'll get a quick look toward the tri-valley with slowing for livermore westbound. slow. basically out of the altamont pass over toward the dublin interchange.

"l.a. times" reporting the commissioner's office has given the organization tentative guidelines for potential move to san jose. it doesn't say what those guidelines are. the report does say if the organization can satisfy them commissioner bud selig could let club owners vote on the move. it doesn't guarantee the a's will come to san jose any time soon or at all. a major hurdle giants own the territorial rights in the south bay and they are against the move. in the meantime, at top oakland official is apologizing

this morning. santana accused wolfe of releasing a letter about his wish for a short-term lease extension in oakland to the media but not the city, county or coliseum officials. that was not true. after being told of santana's claim, wolfe fired off an e-mail saying, "it is sad when someone is devoted to harm someone else's reputation." yesterday santana apologized for the mistake calling it human error. hosting 2024 summer games is an exciting proposition. the city of san jose says thanks but no thanks. it doesn't have enough money to make that bid. the mayor says it takes billions of dollars to host the olympics. a price tag too heavy for the city struggling to keep cops on the street. san jose was one of 35 cities to be working on an invite by the u.s. olympic committee to bid for those games. san francisco and sacramento also asked. san francisco mayor eds lee says he wants to establish a
