the defense said pistorius is not a flight risk and one of the primary reasons he should be released on bond is his prosthetic legs as they need adjusting every month. also he said that he's too famous to flee saying it would be difficult for him to get away with it. for the first time, the defense said at most the 26 year old should be charged with culpable homicide. the prosecution argued that pistorius is a flight risk and his entire story of why he shot and killed his girlfriend is improbable that he accidentally shot her. if bail is not granted, we are hearing that the defense, pistorius' team, is going to appeal immediately again any minute now we expect this judgment. we'll bring that to you once that comes down. >> you've been doing great job following it for us. we'll check back with you as soon as it does. thank you very much. 6:02. another developing story we're following as the search

continues in nevada and southern california for a range rover that set off a shooting and fiery crash on the las vegas strip. this morning six people are injured, three people dead including an aspiring rapper from oakland. this morning that man's grieving father is speaking out about his son's death. "today in the bay's" bob redell joins us live in oakland where the rapper's family lives. we understand it started with an argument outside of a casino. >> reporter: it did. good morning to you, laura. his father who lives here in oakland tells us that his son, kenny cherry, rapper name kenny clutch, was the sweetest man he ever met. he received the worst kind of news. a phone call from his son's girlfriend that his 27-year-old boy had been murdered in las vegas after an argument that did start with some people in the parking lot outside of the hotel. six months ago kenny cherry appeared in this music video filmed on the vegas strip.

he's rapping about women and guns and showing off his maserati. it turns out he was driving that maserati down the strip when he was shot and killed early yesterday morning. >> i heard it was some kind of disagreement and then the guys pulled to the side of him and let the window down and started shooting. my son, for the record, did not have any guns in his car. there was no gun battle. nothing like that. >> reporter: someone in a black range rover shot cherry causing his maserati to slam into a taxi. the cab exploded and caught fire killing the driver and passenger. a passenger in cherry's car was shot but so far survived. police in nevada and neighboring states are on the lookout for that black range ovrover. his son attended several catholic schools in the east bay including st. mary's in albany. a bright kid especially when it came to math. his priority is to bury his son

and help take care of his three grandchildren including a 2-month-old baby girl. bob redell, "today in the bay." one person is dead after an early morning crash in redwood city. police say this happened near east bay shore road off highway 101. initially redwood city police shut down traffic in both directions of east bay shore road during this investigation. also some breaking news here to tell you about from san jose where at least one person is injured after a car crashes right into a bta bus on tully road and capital expressway. we understand that the intersection has now been blocked off for more on this and a look at the traffic surrounding this, let's check out things with mike inouye. >> good morning. this is another chopper live shot over that intersection basically it's at capital expressway and tully where there are two centers here.

folks familiar with it, it's a large intersection. it looks like most of the activity is off to the shoulder. center of your screen there is a car that looks like it's the one that hit that vta express. that motor coach. it is very heavily damaged as far as that front passenger side goes. no details on specifics for the injuries. we just know that one person was taken from the scene. there's that vta express bus. a few minutes ago we saw a couple dozen people walking around and there were reports of 20 people having been on that bus. looks like another vehicle has just arrived. vta express bus leaving the scene presumably taking that around the way. if you are traveling on vta through this intersection, minor reroute one block down toward quinnby and back up toward white and capital expressway. the traffic flow should be okay and continuation of the investigation will be an issue. we'll track that as volume builds through the south bay. on maps you see where it is on relationship to 101 and 680.

not affecting onramps. just minor slowing northbound 101 through the area. also we're looking at the peninsula where jon talked about that deadly crash at redwood city just off seaport boulevard east bay shore road and that's a business road but it may be visible as far as flashing lights go from the off-ramp. meanwhile, on the peninsula side we still have the third avenue off-ramp from north 101 in san mateo that's closed by overnight road work. we're showing a nice smooth flow over the dumbarton bridge to the east bay where 880 shows slowing off castro valley y and 238. we have that forecast coming in for the weekend, christina. what do you have in store? people want to know. >> no flight delays out of any major airports. this is the reason why. it's a crystal clear start to the day. san jose looking just beautiful. a few high clouds but that's it. it's going to be another stunner in the bay area just like yesterday. 39 degrees on the way for san

jose right now. cold to start. make sure you grab your coat. something you can peel off by noon as temperatures climb into the low 60s at lunchtime today. so the cold start will lead to a nice rebound in temperatures. crisp p.m. sunshine just like yesterday. a weak disturbance comes through as we head throughout the weekend and that will bring maybe a stray shower to some parts of the bay area. we'll talk about that coming up. big news is warm stretch of weather that we're in store for next week. sunshine and 70s on the way. a lot to talk about when we get to the seven-day forecast. 63 and 62 degrees at the coast. seven-day outlook ready to go in my next report. you are excited about the weekend. back to you for now. >> all right. thank you very much. happening right now, a student sit in continues at city college of san francisco as we have been bringing you live pictures all morning. seen a little bit of activity this morning. the students have been occupying common hall since yesterday and now they are just refusing to leave. looks like the crowd is picking

up. the students are hoping the protest will force the chancellor to meet with them to discuss how the school plans to avoid closure. the college could lose its accreditation in june. the school was cited because it has too many campuses and because of high faculty costs. no word on what caused a crane to topple on a new eastern span of the bay bridge. that crane slipped yesterday while it was lifting a piece of scaffolding into place. none of the four people working on that crane were injured. that's the good news. uc santa cruz is taking action this morning. a young woman was raped and beaten on campus. university vans will now pick people up and drop them off at their homes or parked cars at night. the rape itself happened during the day on sunday afternoon in a secluded spot near the upper quart

quarry amphitheater. a woman who claimed she found a human finger inside a bowl of wendy's chili is back in court again today accused of lying to police. anna ayala is accused of coming up with elaborate stories after her son accidentally shot himself right in the ankle in their san jose home. she apparently gave police names of two men who she said had shot her son for no apparent reason. she later admitted making up the story because her son is a convicted burglar who is not allowed to have a gun. "today in the bay's" arturo santiago is digging deeper into this case and will bring us specific details about that arrest and why police are now striking similarities between this case and the wendy's chili arrest. we'll have that in a half hour from now. >> a big story when that happened. coming up, keeping the grass green in the desert. >> we do a lot of smoke and mirror tricks to get by for this little 45-day stretch. >> ice in the outfield. we'll show you the big league

i'm laurence scott bringing you our coverage of giants spring training in arizona. i tell you something. it's been a tremendous start to this spring training for the world champion giants. a lot has been going on as a matter of fact as they get ready not just for cactus league play tomorrow but also for the world baseball classic and all of the festivities that are in store when giants get that season started at at&t park on opening day in just a couple of weeks from now. there's so much going on here to prepare the field not just for cactus league play but for practices and workouts and all of the foot traffic they have. the grounds crew here really exceptional. very much like greg elliott's crew at at&t park in san francisco. this crew here in scottsdale making it happen. take a look. each day at sunrise in arizona be it a day marked by rain or shine, the giants have to be ready for whatever is thrown their way. even ice in the outfield.

the field crew at scottsdale stadium is always up for the challenge. >> we do a lot of smoke and mirror tricks to get by this little 45-day stretch and when the team breaks, it's back to a little bit of normalcy. >> reporter: josh is the arizona's field operations manager and explains what makes this spring training home so unique. >> so many players on one field. we're not set up like a lot of the other complexes that have eight to ten fields at their mercy. we really have 2 to 2 1/2 and minor leaguers are a mile and a half away where it's tough to rotate foot traffic. you never know when we'll get an irrigation break or they are going to say we want to do something early and we're stuck. so the goal is always to be prepared in the bay and then pull tarps off. >> reporter: the crew gets an extra spring in their step knowing they're working alongside the world champs. >> absolutely.

boulevard. a temporary fix for battery problems on dreamliners. boeing put batteries inside a fire resistant container to prevent more overheating. if the faa approves this fix, dreamliners could be back in the air by april. 6:16. investors happy with hewlett packard this morning. >> the company says sales did slump but not quite as much as everybody expected. scott mcgrew, that's kind of an odd way to make people happy. >> it really is. it's a big but. meg whitman is on our sister station cnbc right this minute. nobody covers silicon valley as well as the nbc network. one of the things she just said is hewlett packard continues to struggle in europe as many companies do. pc sales have slumped. we expected that as well. hp does expect better business ahead. looking ahead to next week, apple holds the shareholder

meeting. one in particular. einhorn tried to rally others to get apple to create stock to pay out adividend. companies try to resist dividends because it's a sign the company is no longer cool. it's a mature company with no growth ahead. einhorn said if you have cash sitting around and no idea with what to do with it, it's a sign you're not a growth company any way. we have talked much about this man. he's aaron schwartz. he's the young man who hanged himself before going to trial for hacking. he faced potentially years in prison. despite the fact the organization hacked wanted the charges dropped. his defense attorney still enraged at federal prosecutors. i asked him if he talked to them at all after aaron schwartz's death. >> i got a phone call from him on the morning after aaron

6:19 now beautiful san francisco all lit up this morning. no fog to get in the way of that perfect lighting. it will be just a beautiful start to the day and better finish with temperatures warming up into the mid 60s. want to point out we don't have fog to report across the bay area. a beautiful start to the day. hard to believe we're getting toward the end of february and temperatures are going to get close to 70 degrees. we have a nice warmup on the way. this morning it's cold enough for frost in napa. 35 in livermore. 31 degrees in gilroy and 39 in san jose. take you through your detail via the future cast. this is my favorite thing to do. it kind of shows you what's going to happen. this thing is right on the money. 4:00 p.m., you can see area of low pressure trying to get into the bay area. you see an area of clearing. high pressure will keep it out for today. it means temperatures will climb. waking up tomorrow morning, cold front does arrive. you can see all of these clouds associated with that front. that's going to make for a cooler day and not great

sunshine for the first part of the day. partly cloudy in san jose. mostly cloudy at the coast tomorrow morning. by 4:00 p.m., it's out of here. cooler temperatures. temperatures holding onto 60s for saturday and then sunday high pressure builds in quickly. this is going to warm us up. it's going to be beautiful. santa cruz on sunday, 66 degrees. that's perfection. 63 today in livermore. 63 in santa theresa. 63 in san jose. getting into the next couple days, temperatures stay steady. we'll start that climb on sunday. monday into tuesday, temperatures level off to a comfortable level at 65 degrees. you can't beat that on tuesday. then wednesday into thursday, we'll increase your clouds. another disturbance tries to get through. high pressure will not let it in. cooler and more cloud cover. warming you back up by thursday into the 70s. 6:21. a busy morning on a friday. usually not the case. >> this morning it's the surface streets that are the issue. major ones.

here's vta express bus involved in the crash we talked about right there in front of the best shop motor cars. 15 to 20 passengers on this bus. one taken to the hospital. we don't know how bad injuries are. this is intersection tully at capital expressway. starbucks and motor dealership here. the truck on the flat bed tow cleared the scene. that was the car that hit the bus has cleared from the scene. the investigation continues right there. it's not blocking the intersection so just plan on that as your visual distraction. no delays now through the area. vta only that one bus was affected. seven of them go through the intersection. that was a major concern. back to the maps. we'll talk about that area off 680 and 101. this is tully toward capital where the crash happened. that intersection is open. 680 and 101 is open. 101 starts slowing and 87 mild for the south bay. not a major concern. out to fremont we'll show you

traffic coming into the area. southbound 880 past the truck scales here and tesla a smooth drive southbound 880 and northbound heading into fremont and toward union city. we'll check the tri-valley with 680 into fremont. moving smoothly. westbound out of altamont pass a smooth drive to livermore approaching north livermore avenue. things slow down as well as right here at the dublin interchange. no big surprises for the freeways through the tri-valley as we have south 880 through hayward typical build for this friday morning. no delays across the san mateo bridge. we'll cross the bay bridge. look at the backup. metering lights are on. backup at the metering lights. fastrak lanes are moving. they are creeping but moving and backup just building back to the end of the parking lot. east shore freeway still in the upper 50s. back to you. >> breaking news coming into our newsroom right now from south africa where we understand oscar pistorius has just been released on bail.

breaking news in south africa. olympian oscar pistorius will be released on bail. "today in the bay's" marla tellez has been monitoring the developments all morning long and with us live in the newsroom with the latest. a lot of emotion going on there. >> right when the judge handed down his decision just moments ago, the court erupted with emotion and we're getting word that oscar pistorius is sobbing in tears as you can imagine. the magistrate spoke for more than two hours and explained his decision to allow pistorius to be released on bail. he said "it has not been established that he's a flight risk" saying he doesn't think pistorius will risk what he has left referring to his career and his assets. he doesn't think he wants to "duck and dive" all over the world running from the law. he says prosecution has shown pistorius has tendencies of aggression. however he says, "i appreciate that a person is dead but it's not been established that he committed violence." he said pistorius will not be a threat to the public. he won't interfere with state

witnesses and that's when he announced his decision. this decision coming down for oscar pistorius to be released on bail just moments ago. now something that's not mentioned much is that when pistorius does go to trial, it will not be a trial by jury. jury trials were outlawed in south africa in the 1930s. it will be a trial by judge. now, the exact details on pistorius' bond have not been released just yet. i'm going to continue to monitor the situation down in south africa to bring you the latest in the next live report. >> thank you very much for that update. also a developing story in las vegas. investigators are still trying to track down a range rover that setoff a shooting and big fire and crash on the las vegas strip. six people are injured. three people are dead including kenny cherry, an aspiring rapper and father of two young children from oakland. miguel, what can you tell us?

what have you learned about this investigation overnight? >> reporter: jon, it's a situation here that's very fluid. police are still looking for those suspects in that black suv. witnesses described what happened here on the set as something out of a hollywood set. a shooting between vehicles on the move. a high-speed crash and fiery explosion. police say it started 24 hours ago at 4:20 a.m. on thursday inside a parking area. there was a confrontation between a group of men. that led to and spilled onto the vegas strip. they say there was a suspect inside a black suv, a range rover, who were going down the strip northbound and opened fire on two men who were inside that maserati. the driver was hit. he sped through an intersection, clipped several cars, smashed into a taxi cab which then exploded. two people inside that taxi cab were killed on scene. the driver of that maserati was

also killed. today his family is identifying him as ken cherry, known here in las vegas as kenny clutch, an aspiring rap artist from the bay area, grew up in oakland and lived in vegas for some time. in his rap video, he's with that maserati. police have not positively identified him. they say that's the job of the coroner. his family in the bay area tells nbc news that ken cherry is the victim of this shooting. police say there's multistate and multiagency manhunt continues. the description of the suspect is vague. they say they want folks to be on the lookout for a black suv, a range over, with paper dealer plates from out of state. that's the best lead. if suspects were in this area whether inside a hotel or on the strip for very long, it's highly likely they were caught on surveillance tape. police say if they were in fact caught on surveillance tape they'll release that at some point in the future. >> interesting to see how that plays out with surveillance

about 101 north of 680 and 87 coming up into downtown toward that 280 interchange just mild slowing there. issue here at capital expressway, still have activity over on the shoulder. the vta express bus involved in an earlier crash that's on the shoulder but all of the other vehicles and people that were at the scene have cleared except for the investigators. the intersection is open but expect slowing past starbucks at the intersection there. rest of the south bay moving smoothly. we'll check on the peninsula. palo alto, 101 shows a nice drive coming up through the area past university with the northbound headlights and the southbound taillights. there's the university avenue onramp at the bottom of the screen. bay bridge toll plaza shows a backup here. metering lights turned on. that's that's heavier than we have seen yesterday at this time. friday traffic not light. it's heavier this week. the ski week for the south bay. back to you. >> thank you very much. coming up next, it's 6:36.

right now we'll show you the midwest. a fierce winter blizzard leaving the heartland and heading toward the midwest. some parts of kansas calling it the blizzard of oz. messy and dangerous conditions expected from southern wisconsin to the northeastern parts of iowa and chicago. that storm just shut down some airports in missouri, stranded truckers in illinois and buried parts of kansas in knee-deep powder. at least two deaths right now are being blamed on this rough storm. >> look at the snowplows out there. >> george zimmerman's attorneys are in court demanding a deposition from a witness saying she was on the phone with trayvon martin before he was killed. zimmerman is pleading not guilty to second-degree murder. a shocking revelation in court at a bail hearing for eight former leaders of the city of belle accused of paying them themselves massive salaries at the expense of taxpayers.

at 6:43. an update to breaking news from south africa where just moments ago olympian oscar pistorius learned he will be freed on bail while he awaits trial for the shooting death of his girlfriend, reeva steenkamp. marla tellez joins us live from the newsroom with developments from south africa. you have been closely monitoring everything going on. >> right now bail conditions are being outlined in that south african courtroom. i'm hearing from one of our nbc news reporters who is inside that courtroom that he's tweeting out the bail conditions. the suggested bail is 250,000 which equates to about 28,000 u.s. dollars. also pistorius will need to report to police between 7:00 a.m. and 1:00 p.m. every monday through friday. so far that's what we're hearing about the bail conditions. those are still being worked out. ultimately the magistrate

explained he doesn't think that pistorius is a flight risk. he doesn't think he'll commit violence or interfere with the case while out on bond. after more than a week in jail, oscar pistorius is going to be a free man. pending of course his trial in the shooting death of his girlfriend, reeva steenkamp. the prosecution fought hard to keep pistorius locked up convinced he will flee. the magistrate doesn't think he'll risk what he has left referring to his career and assets and while he says that pistorius has tendencies of aggression, he does not have tendencies to commit violence while out on bond. that is according to the magistrate. a win for the defense who argued just today that pistorius should be released primarily because of his prosthetic legs saying they need adjusting every month. we know that two representatives for reeva steenkamp were in court today. we haven't heard reaction from

them. pistorius is said to be emotional as he has been throughout the four-day hearing. much of his family was in court today and his brother immediately put his hand on oscar pistorius' back when that decision came down. >> updates all morning long. thank you very much. a developing story in las vegas as the search continues in nevada and southern california for a range rover that set off a shooting and fiery crash on that las vegas strip. this morning six people injured and three people are dead including an aspiring rapper from oakland. this morning that man's grieving father is speaking out about his son's death in las vegas. the police there say oakland rapper kenneth cherry was shot as he drove down las vegas boulevard about 4:30 yesterday morning. the rapper's maserati crashed into a cab that caused an explosion and that's when flames and everything broke loose. cherry's father says the rapper leaves behind two young children. >> when i talk about my son, that was the sweetest young man

result. then on sunday high pressure really takes its grip and that means for us we'll climb even more so. you can actually hit the beach on sunday. saturday is a better day to hit the slopes with cooler weather. that means snow will stick around. the new snow up in tahoe. 63 for livermore. 63 in fremont today. getting into the next couple days, temperatures will stay nice and mild. monday, tuesday, into wednesday, temperatures start to climb. we'll be in the 70s at the end of next week. so as we transition closer to spring, it's going to get warmer and more comfortable around here. let's check your drive. good morning, mike. >> good morning. this week has been lighter in the south bay because schools are on officially ski break in some cases but we see heavier flow of traffic now so slowing capital expressway toward the airport. slowing into downtown on 280. earlier crash at capital that cleared from that major intersection. over here we're following this closure. it's just off the seaport boulevard off-ramp from northbound 101 at redwood city.

it's called east bay shore road. a road on the other side of the bushes. you may see activity. an overnight deadly crash. car into a fire hydrant. chp is assisting with that investigation. the off-ramp at seaport boulevard highway 84 okay north 101 getting off there. the other side of the bay seeing the slowdown because volume of traffic is picking up. slowing hayward into union city. slowdown off the 580 and 238 interchange there. farther north we see a smooth drive through oakland for 880 and for 580. over here at the toll plaza there are reports of a crash there just off the 880 over crossing and metering lights are on. let's get a look. i did see flashing lights traveling through the area. foster city. we're looking at a smooth drive coming across that 92 interchange and into the peninsula. we'll continue with live shots because i messed up the maps. we'll go with toll plaza now and we'll see the backup at the toll plaza as we looked for flashing lights. it looks like it made its way

past the toll plaza where the crash was reported and lanes are still moving so that's good news. and now we'll end with our shot in emeryville and berkeley. approach on west 80 underneath university avenue over crossing and then down continuing with this nice spacing between cars. you're into upper to mid 50s coming down off the richmond san rafael bridge. back to you. in the east bay, 2,000 people are at risk for identity theft after thieves stole private information from a mercedes-benz dealership in walnut creek. information includes social security numbers, credit card numbers, and driver's license numbers. the information was stolen from a locked office at the dealership on parkside drive between february 7th and 8th. happening right now, some police activity going on at that sit in that's been under way since last night at city college of san francisco. these are live pictures from the scene where police at this hour want to move protesters over to the side of that building so

they can open up for business there and have classes. students insist these protests will continue today. students have been occupying that hall as we said since last night. they would like to meet with the chancellor to talk about how the school plans to avoid closure. the college could lose its accreditation coming up in june. the school was cited because it has too many campuses and because of high faculty costs. switching gears. it's 6:53. every kid likes sidewalk chalk. >> every parent knows that. scott mcgrew has the ultimate in chalk. miles and miles of chalk. >> good morning. our gadget this gadget friday is a device that fits on the back of your bike. it holds a piece of chalk and either you can immediately figure out what happens from there. you can draw all over the sidewalk. it's great fun. it's 20 bucks from a website i really like called think geek.

we did find a couple of things in our tests. we found it's better to add weight to the back because it tends to bounce as it goes down the road. also you can't just stick any chalk in here. you have to buy a specific replacement chalk because of the way it's shaped but it's not expensive. just widens out. fits on the back of of a kids' bike. piece of cake. we had ways to track your kids on gadget friday before. this would be the world's lowest tech way. more for fun than figuring out where they went. back to you. >> try to follow that line. >> parents complain about that chalk. brings new meaning to junk in the trunk. tomorrow the world champion giants taking the first swing at cactus league at a real ball game down there. >> a week from now giants players will take on the world literally. laurence scott joins us live at scottsdale stadium in arizona with a look at the team's first spring training game and preparations for the world

wow. police on the lookout for the shooter who killed an oakland rapper on the las vegas strip. kenneth cherry was shot yesterday morning while driving his maserati on las vegas boulevard. two other people were also killed when cherry's car slammed right into a taxi and that caused an explosion. boeing is meeting with the faa today to go over a temporary fix for battery problems aboard dreamliners. boeing will reportedly put batteries inside a fire resistant container to try to prevent overheating. if the faa approves that fix, dreamliners could be back up in the air by april. looking forward to the weekend. how about the academy awards. oscars this weekend. some bay area college students could say they worked on an oscar winning film. >> students at san francisco's academy of arts university worked on the movie "beast of the southern wild." students there helped with the special effects in the film and that "beast of southern wild" is up for multiple oscars including
