backup in cash lanes off the fastrak and hov lanes. we saw in the last two minutes the cars clear. it looks like they opened all toll gates. no backup here at oakland, 880 past the coliseum. san leandro southbound crews clearing from the roadway early. that's good. it might cause distraction and slowing. we'll track that. back to you. >> thank you, mike. happening right now, the coast guard has been searching all night for two adults and two children who simply vanished off the coast of san mateo county. the coast guard said the four went missing after their sail boat started taking on water. it happened 65 miles off the coast of pillar point. the coast guard tells us it's not sure what the group had onboard for flotation other than a life ring. with frigid temperatures overnight, the search now growing more desperate. "today in the bay's" bob redell is out there gathering new details on this case. we'll be checking in with him later on in our 5:00 hour.

las vegas police have identified the man they say shot an oakland rapper as he was driving down las vegas boulevard last week. officers say 26-year-old amar harris is armed and dangerous. his history with the law includes kidnapping, robbery and sexual assault arrests. on thursday morning police say harris was driving a black range rover on the las vegas strip when he shot at oakland rapper, kenny "clutch" cherry. cherry was hit and the maserati he was driving crashed into a taxi that exploded killing the driver and passenger in the cab. they found harris' suv a few blocks away on saturday. this morning the alameda county coroner's office working to identified a body. firefighters pulling the person out yesterday afternoon. it remains a mystery who the individual is and how they got

there. if you happen to know anything about this incident, you're asked to please call police. the families of a bay area couple missing in peru right now will speak with the american embassy later today. 25-year-old garrett hand and 27-year-old jamie neil left the bay area in november on a five-month cycling adventure through south america. they've been chronicling their trip on facebook but all posts abruptly ended one month ago on january 25th. at that point the couple was in peru. friends are worried especially since the state department recently issued a travel warning about criminals looking to kidnap americans. the city of san jose is working on a plan to fix the bad roads. that's the good news. on the downside, taxpayers will likely flip that bill. the city says nearly a quarter of its roadways are in fact in poor condition and by 2020, every road would be in that

category. city leaders proposing a series of taxes to help increase funding for road work. the possible taxes include a quarter or a half cent sales tax increase as well as a bond measure that would cost the average homeowner about $100 a year. about 4:35 now. the academy awards wrapped up last night with plenty of big winners. >> "argo." >> first lady michelle obama announced the biggest prize best picture which went to ben affleck's thriller about the rescue of six american hostages in iran. affleck produced, directed and starred in the film which won three oscars including best adapted screen play. you want to get out there and enjoy it while it lasts. 39 to start the day in sunnyvale. we'll see temperatures today in the mid to upper 60s. really comfortable weather even before spring officially arrives. 40 degrees to start the day in san jose. 32 freezing in gilroy. however, by noon look at where we're headed. up to 60 in antioch as you break for lunch. 60 in santa rosa. 58 degrees at lunchtime in concord. we're already going to hit our averages as you break for lunch rounding out the day five to eight degrees above average. look at fairfield, 69 degrees. 66 for livermore. 65 degrees in gilroy. we do have changes to get through as we head throughout the week. two disturbances making their way into the bay area. we'll let you know how that will change the pattern. we're headed toward mid 70s and maybe even 80s at the end of the week. we'll talk about that in the full forecast. 4:38. back to work, back to school monday. let's check the drive. good morning, mike. >> south bay schools were off last week. they will be back. heavier south bay commute. we're looking over toward the

east shore freeway westbound 80 that's the commute direction through berkeley out of richmond with headlights. in this area we're tracking there's a report of an accident and no slowing approaching the area and no slowing at powell in the westbound direction. eastbound away from the berkeley curve and we do see slowing and that's typical on our sensors overnight. a light volume there. easy drive overall heading toward the bay bridge. through the maze no problems. caldecott tunnel, no problem. slowing 880 bottom of your screen. coming through a construction zone but not a lot of cars heading through the area. expect that to be an issue slow a bit for the cone zone but not a problem. carrie underwood concert at the coliseum tonight. keep that in mind. looking over across the bay, san mateo bridge nice flow on 92 westbound with headlights off high-rise into san mateo. >> it's 4:39. coming up, practically a done

as we enter the last week of february, we give you a live look outside. that's the south bay san jose all lit up on this monday, february 25th. we're checking the forecast. christina said it will warm up nicely so get ready. 4:43. yahoo! has a new ultimatum for employees. show up for work or quit. the sunnyvale company issued a memo friday telling all remote employees they need to start working at yahoo! offices. according to the san francisco chronicle, yahoo!'s human resources boss told employees that working at yahoo! "is not just your day-to-day job. it's about interaction and experience only possible when you are in the office." yahoo! says the move is to boost productivity. employees in mountain view google working on a new project.

one that could have them going head to head with the likes of pandora. bertha coombs is live at cnbc world headquarters with a look at that and how futures are trading today. bertha, good morning. >> good morning, jon. futures are higher this morning. markets off a mixed week. the dow did manage to close higher back at that 14,000 level. we did see the nasdaq fall for the second straight week and the broader s&p 500 snapped a seven-week winning streak. no economic data on tap today. that won't really set the tone. investors are going to be watching capitol hill. the talk of the sequester and also fed chairman ben bernanke testifying twice about the economy on capitol hill this week. the dow rising nearly 120 points on friday to regain that 14,000 level while the nasdaq added 30 to 3161. and google is reportedly in talks with music labels about creating a streaming music service to compete with the

likes of spotify. it would offer a free and subscription based models. google launched a music download service in the u.s. in 2011 and expanded that to several areas in europe. glasses, cars, into everything at google. >> they are taking over all facets of our life. bertha, thank you very much. we'll check back later on. >> nothing to complain about in terms of the forecast in the south bay over the weekend. it was spectacular. >> we'll get spoiled just about all week long. you know, i get excited about this. we had such a boring week last week. really nothing going on after that storm came through. this week we actually have a substantial warmup to tell you about. some cities getting close to 80 degrees later this week. we have a warmup. if you want a barbecue and cold kept you indoors, everything changes as we head throughout the end of the week. this morning temps are in the 30s and 40s.

we're right at freezing in gilroy to start the day. around 36 degrees in livermore. 39 degrees in sunnyvale. headed toward a comfortable week. break out that spring wardrobe early. you'll get up to use it just about all week long. we do have winds to tell you about. today that's the only thing that's going to make for not so perfection when it comes to your forecast today especially at the coast. you can see here we set that future cast in motion. winds increase between 10:00 and 4:00. tie down any loose objects. it's offshore flow that will create those winds and those winds mean temperatures today close to 70 degrees in some cities. that means fairfield, 69. 66 in livermore. getting into the rest of the workweek, look at this. tomorrow we level off in upper 60s. then we hit 68 degrees by wednesday. 69 on thursday. and then mid 70s arrive on friday and saturday. you know some of the outlying cities around here, they get even warmer than the metropolitan san jose area. livermore, as we head throughout the end of the week could be

talking 80s. we're also talking about potential for 80s in gilroy and a couple other cities just make sure you're ready. spring has sprung a little early. 4:46. back to you for now. >> we'll take it. thanks so much. 4:46. oscar pistorius' attorney says the olympians brother is facing homicide charges from a 2008 crash in which a motorcyclist was killed. carl pistorius who sat behind his younger brother oscar every day at his bail hearing now will face his own homicide trial for the incident five years ago. carl quietly appeared in court on thursday one day before his brother was released on bail. his next appearance is scheduled for the end of march. oil giant bp may be forced to pay billions more dollars for its role in one of america's worst oil spills. bp in court today to face a civil trial brought by several gulf states affected by that 2010 spill. the trial is aimed at finding the cause of the oil rig

explosion that ultimately killed 11 people. it also spilled millions of barrels of crude, which polluted the gulf of mexico. bp, if you recall, has already agreed to pay a $4.5 billion settlement to federal criminal charges. jerry brown is attending an emergency meeting at the white house today. he'll join other state governors to attend a meeting hosted by president obama. the concert slated to take place by the end of this week and would affect federal aid to california. mr. obama is calling on governors from both parties to work with him on finding a compromise budget. congress right now running out of time to strike a deal ahead of those self-imposed cuts. $85 billion across the board spending will be slashed this friday morning unless lawmakers can figure out some kind of budget compromise. if there is no deal, furloughs will start taking effect for air traffic controllers and meat inspectors and thousands of teachers could also be laid off.

>> it's something that nobody wants, right. it's not a balanced compromise. >> to not cut 2.5% out of the total budget over a year when it's twice the size it was ten years ago, give me a break. >> republicans insisting the cuts must happen and they must happen now. right now there's no sense if there's any serious compromise in the works with only four days left to reach a deal. as for those impacts and how those cuts would have an effect here in california, the white house says our state alone would lose more than $150 million in educating funding putting at risk jobs for nearly 2,000 teachers and special education workers. $1.6 million in public safety grants would be taken away from law enforcement and crime fighting programs and the state would also lose more than $3 million in funding for job search assistance and training. 4:49. big news for two bay area sports

francisco. that is the bay bridge illuminated. looking good there. traffic you can see flowing on the upper deck. mike inouye is standing by as we speak to fill us in on what's happening out there. it's 4:52. she did not win it all but danica patrick says i'm still strong and she makes history at daytona. patrick started the race as the first female to go off from the pole position at lap 90 she was the first woman to ever lead a lap at daytona. however, patrick's front runner status starts to fade. she was in third place at the start of that final lap but she loses ground finishing in eighth place. big congratulations to her. jimmie johnson is the big daddy of the day winning it all. to football where rumors are swirling that 49ers worked out a deal to trade alex smith. cbs sports say the deal is done but cannot be announced until march 12th when the league season officially begins.

the niners will not confirm the rumor. there's no word on who will acquire smith, but many experts believe it is the kansas city chiefs. new chiefs head coach andy reid was reportedly interested in acquiring smith a year ago when he was coaching the eagles. and speaking of deals, it looks like giants are working on a deal to keep their manager and general manager. the san francisco chronicle reports team president is working on a multiyear extension. both are signed through 2014. >> that's good news. >> you don't want to break up that combo. >> sounds like they may make mike inouye money. let's check in with mr. road warrior. >> they do sell peanuts there, don't they? my money. 101 in san jose. a smooth, light easy drive under 680. let me give you a live shot out here as well. 280 coming toward us through middle of the screen once we get the other camera at 280/17

interchange. headlights to the right. you see san jose city college. light volume of traffic because the map does show you a bit of yellow as you head through the area. not a major concern. speeds down just to 60 a just a light volume of traffic. less cars to do the average means one slower car makes a bigger difference. we're looking at smooth drive through livermore and pleasanton and no problems for commute direction. it's eastbound where we do see slowing heading past greenville and then over toward the altamont pass. overnight construction down to one lane tonight. folks going eastbound. westbound starting to pick up volume coming into the altamont and over toward livermore. live look outside. we'll show you how things shape up for the peninsula as well. it's a nice, easy drive northbound with two headlights past university and up into san mateo and city without delays for 101, 280 moving smoothly. we'll send it back to you. >> thank you very much. 4:55 right now. new video this morning from china. a fireworks factory goes up in flames over the weekend.

outside webster parking garage and pulled out a gun and demanded cash. the victim tried to wrestle that gun away but when he couldn't, he says he did manage to run away. he was not hurt in the incident. three other armed robberies have happened in palo alto in recent weeks. police are right now trying to figure out if these scenes are related. the alameda county sheriff's department is telling its side of the story after an incident landed mc hammer in jail. hammer was arrested on thursday in dublin on charges of obstructing and resisting an officer. the rapper claims he was the victim of racial profiling and that the first words out of the officer's mouth were "are you on parole or probation?" the alameda county sheriff's office says the car hammer was parked in was not registered to him and registration had expired. a lieutenant tells us hammer became very argumentive when questioned about the vehicle. he refused to exit the vehicle when the officer asked him to

and continued to argue. now over twitter hammer dubbed the incident a "teachable moment." happening now, a desperate search is under way off the san mateo county coast for four people aboard a sailboat that sank 65 miles off pillar point. two of the missing are children under the age of 8. "today in the bay's" bob redell is live at the coast guard station where crews have been sending out rescue boats to find them. good morning, bob. >> reporter: and aircraft. good morning to you, marla. coast guard san francisco is very concerned about their possible lack of survival equipment and the bad conditions out there. their plan has been to continue this search throughout the night and in a couple of hours they will be sending another chopper back out there being launched from sfo. the coast guard received this distress call around 4:20 yesterday afternoon from people onboard a 29-foot
