family and friends of richard vega. the 18-year-old man shot in this neighborhood. police found him around 10:20 last night suffering from more than one bullet wound. doctors tried to save him but he died during emergency surgery a little bit after midnight making him the first person to be murdered in campbell in several years. the last homicide in this town was back in 2007. reporting live in campbell, bob redell, "today in the bay." it's 5:02. we can tell you an embarrassing loss for san francisco police this morning. over the weekend an assault rifle stolen right out of one of the department's very own vehicles. and now the department is using all of its resources trying to get that assault rifle off the streets. "today in the bay's" christie smith is live in the city right now with more details. christie, good morning. >> reporter: good morning to you, jon and marla. this is exactly the type of thing you don't want out there on the streets in the wrong hands but that's exactly what happened. the search is on this morning to try and get this assault rifle back.

someone broke into an unmarked police car over the weekend and stole an ar-15. according to san francisco police, officers had parked and secured the car that it was in. they were working. someone broke in and stole it. an assault rifle. very similar to this one. the type that is issued specifically to specially trained officers so they can deploy at a moment's notice when they have incidents like a suspect that's barricaded himself inside a building. san francisco police saying no resource is being spared to try and get this back. they issued an alert to all area law enforcement to let them know this weapon is out there. anyone with information is asked to call southern station. they are also letting people know that they can remain unanimous if they do have any information. reporting live in san francisco, christie smith, "today in the bay." 5:03. investigators are trying to figure out what caused the death of a triathlete during the escape from alcatraz triathlon

over the weekend. it was held yesterday. race officials say they believe the 46-year-old man from austin, texas, suffered a massive heart attack during the swimming portion of the triathlon which begins at alcatraz island. we spoke with a race organizer that says in the race's 33-year history almost 100,000 athletes have participated and this is the first time someone has died. >> if you are an athlete and something happens, you want to get assistance as soon as something happens to you in the water or on the bike or on the run. he got that assistance today. unfortunately, you know, any type of assistance we could give him it just wasn't enough. >> the race was held three months earlier than it typically is in order to accommodate the america's cup so people say the waters were colder than normal. participants from 7 years old to 70 finished the race. the winner, a 29 year old from

spain. the death of a woman say senior living center in bakersfield sparking debate over what some facilities will and will not do for residents. the newly released 911 call shedding a shocking light on this situation. >> i understand if your boss is telling you you can't do it. but if there's any -- as a human being i don't, you know, is there anybody that's willing to them this lady and not let her die? >> not at this time. >> that call coming from glenwood gardens, a senior independent living facility in bakersfield. an 87-year-old resident collapsed inside but employees there are not allowed to attempt cpr on residents. senior care experts confirm independent living facilities are not legally required to provide medical care. >> it's really more like a hotel where they will offer you concierge services, meals, housekeeping, change your bed, you can't even get care in an

independent living. >> that victim was rushed to a hospital nearby where she was pronounced dead. management at the glenwood gardens issuing this staples. our practice is to immediately call emergency medical personnel for assistance and to wait with the individual needing attention until such personnel arrives. that is the protocol we followed. new efforts are under way this morning to restore moffett field's hangar one. the federal government filed a notice of intent to seek private bids for restoration and reuse. one possibility is for google's founders to pay the estimated $33 million in cost in exchange for permission to use it to store their private planes. another proposal would turn it into a museum. u.s. representative says a notice of intent was a result of a meeting last week between her, the white house and other government agencies. it's 5:06 right now. meteorologist christina loren has the day off so meteorologist

rob mayeda joins us now with a look at our monday forecast. good morning to you. >> mostly cloudy skies right now. 40s and low 50s outside. mild start. still probably need a jacket this morning. a sea breeze helping to bring in low clouds we're waking up to this morning and during the day today we'll see clouds break up. before the storm that is over my shoulder here comes in during the day tomorrow that is going to bring us wind and rain for tomorrow afternoon. this morning, a few areas of drizzle or mist and then as we heads toward lunchtime the skies clear. hi hill top locations may see clouds building up during the afternoon. maybe a stray shower in the hill tops but today the dry day. we'll see changes as we head into tomorrow. hour by hour with temperatures around lunchtime, not too bad. upper 50s where the sun is breaking out. inland low 60s by noon. we'll see mainly 50s across the bay today and some low to mid 60s inland. turning cooler tomorrow with more clouds. rain coming in tomorrow afternoon into wednesday morning

commute. middle part of the week looks busy but weekend looks nice. 60s and low 70s. it's monday. never too early to plan ahead for next weekend. >> always looking forward to the weekend, rob. looking here toward the bay bridge. we're often looking there for the morning commute. right now close-up we'll show you the incline itself is moving from left to right. moves smoothly in the direction of your commute to san francisco. you can see the glowing lights on the san francisco side. san francisco itself some low clouds hovering but visibility is fine for the drivers. we'll take you to the map. no problems off the east shore freew freeway. 880 has typical construction into downtown from both directions. south 680 all right. northbound 680 out of sunol into pleasanton shows a slowdown. i checked the live camera. light volume of traffic. slow moving vehicle or two. across the bridge here's san mateo bridge. westbound for your commute direction. that's a nice easy drive over toward the peninsula side with no problems for visibility here and smooth flow for 101 and 280

cardinals arrive this morning for the first formal meeting since pope benedict retired. today's meeting is known as a general congregation and on top of 115 cardinals eligible for conclave attending, some of the older noneligible attending cardinals are also taking part in this meeting. the meeting is intended for card n car cardinals to get to know each other better.

plans to ex-plannpand a met station includes building a tunnel and it's built on soft soil. the heritage association says there is risk here because the digging could trigger the landmark to sink. stopping the metro expansion project is up to the court. >> from the arena to the court trial that pits two combatants. >> we said at the start of the apple/samsung trial that this thing would last forever. forever is a mighty long time. the judge will be looking for a new set of jurors this morning to recalculate the amount of money samsung is going to have to pay to apple after samsung was found guilty of copying the iphone and ipad. they calculated the number incorrectly.

new this morning, tesla asking the federal government for an extension on an annual financial report that was due friday but hasn't been turned in. tesla says there's an error in the report regarding the way $31 million was classified. $31 million is chicken feed to most companies but not to tesla. investors worry about tesla cash flow spending so much money on tools and devices to make the model s car it has to make cars fast enough to regenerate that cash pile. the stock market continues to chug along despite europe and the sequester. let's turn to jackie deangelis. she's live at cnbc world headquarters. good morning, jackie. >> good morning, scott. the futures are lower this morning as the markets come off a positive week. the dow will try again to top its all-time closing high. the index coming within 57 points of that mark on friday posting the third highest close.

48 in san francisco. moisture was brought in by overnight sea breeze. winds not too strong. it's almost like in june when you have low clouds to come in from the coast and then they'll break up as sun comes up around lunchtime today. so a bit of drizzle possible for the morning. we'll start off partly cloudy and mostly cloudy toward tomorrow afternoon and evening as we get some much needed rain and sierra snow in the forecast. so today areas of drizzle for the morning clearing around lunchtime and as we head through the afternoon in the hilltops out toward mt. hamilton and north bay northern sonoma county might see an isolated shower during mid afternoon hours with the heating of the day and partly cloudy watching the sunset later on. the storm system we're tracking here coming in for tuesday is a potent one. you can see the cold front offshore spilling in now jumping ahead to tomorrow's forecast. morning commute is fine but

toward the afternoon and evening you can see you're starting off in the north bay as that cold front comes in moderate rain and cooler air aloft wile keep showers going tuesday night into wednesday and maybe during the day with some daytime heating we could get isolated thunder during wednesday afternoon's forecast. the storm coming in for tomorrow into wednesday should get us close to a half inch of rain in parts of the north bay and maybe around a quarter inch of rain for most inland locations around the bay area. winter storm watch in the sierra today. dry commute if you are heading up to high country today. by tomorrow on into wednesday we could see about a foot of snow with that system coming in for the middle part of the week. low 60s in san jose. low to mid 60s inland toward the tri-valley. cooler day with the onshore winds around san francisco. 58 degrees closer to 60 in oakland. tomorrow the rain is going to pick up during the evening into wednesday and thursday. showers and good timing here wrapping up the week we'll see clearing skies into friday and warmer and sunny weekend forecast on the way as we head

toward saturday and sunday. mike? >> we'll head steadily toward that saturday and sunday with that in our sights. we're looking at the morning commute. we see slowing for southbound 101. i took a look with live cameras because that slower drive is unusual for now and there's a lighter volume of traffic. it's just our sensors registering slower but not a big deal. we'll take you back to the maps when we get a chance. right now we look toward foster city. traffic moves smoothly across the san mateo bridge over toward the peninsula side. easy drive. i think we'll continue with live cameras for oakland northbound 880 past the coliseum. nice easy drive. no problems for the speeds. just picking up volume a little bit and there's construction between here and downtown. another look outside and we'll see how things are for emeryville. the folks are heading down toward the bay bridge toll plaza. see the spacing right here. no problems as far as speeds go through this area and a nice easy flow of traffic. nice smooth drive off the carquinez bridge. low clouds in the distance and that will be an issue but it's above the roadway as far as on the deck where you drive no

problem for visibility and things are moving smoothly. we'll end it here with a live shot and send it back to you. >> mike, thank you very much. this one is a landmark announcement and really a shocker. a baby born with hiv has apparently been cured. doctors at children's hospital at the university of mississippi gave her a drug cocktail when she was just 30 hours old and then they kept her on a regimen. she's been off this now, hiv drugs, for about a year with no signs of infection. when her mother brought her back for more tests, doctors were simply shocked at the results. >> we believe that perhaps the initiation of very early therapy prevented formation of the viral reservoirs in cells and really set the stage for pediatric cure going forward. >> if this child does remain healthy, it would mark only the

world's second reported cure for hiv. >> that story gives you chills. >> unbelievable. 5:19. if you are having trouble getting a good night sleep, maybe, just maybe, you just start exercising. according to a poll by the national sleep foundation, adults who regularly broke a sweat slept better and then also felt more refreshed. most of those surveyed did simple activities like walking just to get bodies moving and those that spent less than eight hours a day sitting were more energized. researchers found people who did not move as much were more likely to feel restless. >> you are a workout machine. you must sleep every night about 15 hours as much as you put in. >> i wish i did. i'm sore. coming up, another change in the 49ers lineup. see which player drops the hint tell not be back next year. a disappointing showing at tryouts but a college football kicker makes history by becoming the first woman ever with a bid

welcome back. 5:23 right now. 49ers wide receiver randy moss will not be back for another season. moss tweeting this message over the weekend hinting at his departure. wish i could have finished the job. thanks for the opportunity and good luck in the future niners. moss started the season very strong with four receptions and 49ers first touchdown in the season opener at green bay. but his performance slowly dwindled later in the season leading to speculation he wouldn't return to the team next year. moss officially becomes a free agent march 12th. disappointment for the first woman trying to land a spot on the nfl team. 28-year-old kicker lauren

"today in the bay's" bob redell is live in campbell right now with what we just learned about this incident. bob, what's the latest?

>> reporter: good morning to you, jon. the crime scene itself has just been cleared. the investigators have left after having them processing the scene here lattimer and dumpster for the last several hours. this is unusual for the city of campbell. several years since someone was murdered within this town. last homicide taking place in 2007 and police are trying to figure out this one in a neighborhood of apartments and duplexes not far from hamilton and winchester. police found the victim in the area after someone called 911. richard vega, an 18-year-old man, was bleeding having been shot more than once. he died a little bit after midnight during emergency surgery. >> at this point we're looking into all possibilities. we don't have any solid evidence that the victim was specifically targeted or that it's gang related. we're certainly considering those possibilities in our investigation and our

investigators are contacting family and friends and witnesses to help us determine the cause and who may have done this. >> reporter: and there was a witness who saw someone leaving the scene headed toward winchester just after the shooting. this person was driving a dark sedan. police are trying to find that vehicle and its driver. reporting live here in campbell, bob redell, "today in the bay." 5:32. despite all of the efforts to keep guns off our streets, there's another assault weapon out there after someone stole it right out a san francisco police car. "today in the bay's" christie smith is live in san francisco with what police are doing this morning to try to get it back. good morning, christie. >> reporter: good morning to you, marla and jon. this is not the type of thing that you want out there on the streets unchecked but that's exactly what's happened over the weekend. someone broke into a police car and stole an assault rifle sometime this weekend. san francisco police have put out a bulletin and alert to all

law enforcement in the area to let them know that this weapon is out on the streets. they're saying no resource is being spared to try to get this back in police hands. it's ar-15 rifle similar to the one you see on your screen. investigators say the weapon was stolen from a police car unmarked car that was actually locked up while officers were working. they say the ar-15 is the type of rifle issued to specially trained officers so they can deploy quickly when they have a situation like a barricaded suspect. anyone with information about who may have taken the gun or exactly where that gun is, is asked to call san francisco police department southern station and you can also remain unanimous. reporting live in san francisco, christie smith, "today in the bay." investigations are under way this morning into five deadly officer-involved shootings happening over three days here in the bay area. the first thursday in sonoma county followed by shootings over the weekend in san francisco, san jose, union city

and hayward. that hayward shooting sunday police say a driver rammed his car into a police cruiser during a traffic stop. the officer opened fire hitting a passenger. that passenger died at the scene. the driver, a 23-year-old oakley man, remains in custody. >> everything is just escalating between the cops fearing for their lives and people on the streets fearing for their lives. >> on saturday police shot and killed a man after a high-speed chase through south san jose. another pursuit saturday ended near candlestick park with a daly city police officer shooting and killing a suspect. the officers involved all remain on administrative leave. los gatos town council voting tonight on an emergency moratorium on new gun dealers. templar sports opened doors in late december and many residents were outraged the store could open without public debate. los gatos holding two meetings on that issue last month. each drawing hundreds of

residents. in the emergency moratorium if approved, tonight it will apply retroactively to templar sports. among many tributes left for two police officers in santa cruz last week there was one that stood out this weekend. an unanimous soldier left this. a teddy bear with a purple heart medal saying it's for sacrifice above and beyond the call of duty. soldiers who are killed or wounded in service are awarded purple heart medals. deputy chief steve clark says the families of butch baker and elizabeth butler and everyone else on the force were touched and honored. >> officers in the department are just blown away. a number of them are military and so they understand the significance of not only earning this medal but the significance of giving it as a gift. >> the memorial outside the santa cruz police department has been growing since tuesday when

baker and butler were gunned down. the public memorial service for baker and butler will be held in san jose at the hp pavilion. it was originally going to be held in santa cruz but organizers needed a bigger location to accommodate a massive amount of people expected to attend the service. the service will be held on thursday at noon. san jose firefighters this morning investigating a suspicious fire at an east side high school. the fire broke out sunday afternoon at independence high school near mckee road and jackson avenue. this started outside a building in the b villa which houses one of the principals at that school. firefighters say there could have been more damage if not for one thing. >> the thing that helped us out is that the building was sprinklered. >> we can tell you nobody was hurt in that fire and

investigators say this is not the first fire at that school. the fire will not affect the school day. students and faculty will report on time as usual. right now 5:37. good morning to you. i keep forgetting to wash my car. is it too late? >> depends on how much of a stickler you are for a clean car. >> there's a free one coming tomorrow. this weekend we had 60s and 70s outside. not going to find that this week. 40s and 50s outside right now. you don't need a winter parka as you head outside. don't have 30s thanks to the fact we have a lot of low clouds. in terms of fog or things that will reduce visibility with low clouds is not the case. the ceiling or bottom layer of low clouds high enough away from ground to keep visibility fairly good but with those winds onshore overnight into this morning that has helped to pump in low clouds all of the way into the delta and a few areas this morning could have mist with low clouds today before skies clear around lunchtime. highs 50s and 60s today and then

tomorrow more clouds and rain and snow in our mountain areas as low as 3,000 to 4,000 feet by wednesday. so today areas of low clouds should get afternoon clearing in the hilltops of the north bay and around mt. hamilton may see a stray pop-up shower or two but the main event in terms of the storms will be coming up later tomorrow into wednesday. it's a system here that's still far offshore as we jump ahead to your tuesday forecast. this time tomorrow morning and into the rest of your tuesday commute should be fine for the morning. it's the evening commute heading into wednesday morning. that's when the rain sweeps on in and our highs are really going to cool off for the middle part of the week. upper 50s near san francisco. close to 60 in fremont today. 62 in san jose. yes tomorrow more clouds, rain coming back and a chance at maybe thunder on wednesday. active for middle part of the week and then we clear out and warm up for the weekend. mike? >> all right. we're looking over here to the peninsula first. we have a look. there's a little bit of a build for 101. 280 not a problem. a smattering of traffic there.

those budget cuts known as sequestration are a reality. after signing the order president obama has been on the phone working lawmakers trying to reverse it. tracie potts is live on capitol hill this morning with the latest and not only do we have to worry about these cuts, but now we have another possible government shutdown on the horizon. >> it looks like that is good news. that may not happen. republicans and democrats saying they are willing to work together to at least temporarily extend funding until the end of the fiscal clear. rolling back cuts could be a challenge. president obama over the weekend on the phone not with republican leaders but with individual lawmakers who he thinks may be willing to compromise.

move.gov or the let's move youtube channel or the white house google plus page. the commercial supply capsule dragon has docked with the international space station. the station astronauts used a robotic arm to grab the supply ship. the company struggled with the dragon following friday's launch. a clogged pressure line or a stuck valved prevented the dragon's thrusters from working and it took flight controllers several hours to gain control and salvage the mission. in the end the dragon arrived just a day late with its 1 ton load. also onboard are plant experiments developed at moffett field's nasa ames research center. spacex is one by paypal and tesla founder elon musk. look at this. chp found two horses just running loose on northbound 680. that was in martinez about 2:30 this morning.

in the east bay on countercommute direction. now speeds are starting to come up. that might indicate crews have just cleared. that may be the reason why we saw slowing for a short time here. westbound is your commute that we're worried about now out of the altamont past continuing to build north livermore avenue and continuing toward that dublin interchange. just there at the interchange in the last couple minutes reports coming from chp of a three-vehicle crash there in your center lane. doesn't matter if you are going to 680 or continuing to castro valley, either way you'll have to slow and get around that crash. look at that. backup form and only three minutes old. we'll track that. that will keep folks off pleasanton and 680 moves smoothly. moving through san jose northbound 101 from 680 up toward 880, first burst kicking in. a live look will show you the reason for slowing is there's more company and right around the interchange folks changing lanes and there's just that congestion there which typically builds. a look at the bay bridge toll

plaza. south bay is not compared to this. we do have a backup in these lanes between the hov and fastrak lanes. it looks like that lane right there, lane number three, not open for the toll so stay to your right if you can. one more quick look outside and we'll see how things shape up over the high rise. no problem toward that bay bridge and into the city but you have to get through the backup on the left side at the toll plaza. back to you. >> all right. thank you very much. a little royal update for you. queen elizabeth remains hospitalized this morning. doctors treating the 86-year-old for a stomach infection that she's been suffering for days. this marks the first time in a decade queen elizabeth has been hospitalized. she's had to cancel several royal engagements including a trip over to rome. >> they said she traveled to the airport in a private car and not an ambulance so that's good. less of an emergency. coming up, a hollywood star at the cinequest festival. >> i'm very honored to be here and receive this award.

good morning. thanks for waking up on this monday. it's 6:00. i'm marla tellez in for laura garcia-cannon. >> i'm jon kelley. good morning, everybody. we start off with some breaking news in campbell right now. an 18-year-old man the victim of a deadly shooting overnight. in fact, right now a manhunt is under way for that gunman. this happened near the corner of west lattimer avenue and dumpster drive not too far from the campbell shopping center. "today in the bay's" bob redell is live at that scene right now with what he's just learned from police. bob, good morning. >> reporter: good morning to you, jon. police have actually finished processing the crime scene here at this street corner in this neighborhood not far from winchester and hamilton. they are looking for someone who was seen driving away right after the shooting in a dark sedan headed toward winchester. investigators are also interviewing family, friends, acquaintances of richard vega.
