hours and they gently tugged it out of the sand at the beach in pacifica. a strange ordeal. the luxury yacht ran aground yesterday morning. three people on board who refused help from the coast guard. it turns out it was stolen out of sausalito and after a standoff with police, two men and a woman were arrested. now the keel of the boat was stuck in the sand as it rocked back and forth. we asked the man who towed it out about possible damage. >> we do know the router is spent. i suspect the propeller is bent and probably the shaft as well. there's probably got to be some damage to the hull itself. >> reporter: now, the owner didn't want to talk about it on camera. he actually was there at the scene yesterday. three people on it partying inside. authorities say that it was littered with beer and pizza boxes. now the cost of something similar like this, a similar yacht would be listed at $2.5

million to $2.8 million. so the question is how much damage to the boat and how much it will cost to repair it. reporting live in richmond, christie smith, "today in the bay." >> new this morning, a man is dead after a serious crash on highway 101 in novato. chp says the 57 year old was northbound when he swerved off the road near the redwood sanitary landfill just north of marin county airport. investigators say the man may have suffered some sort of medical issue that led to the crash. some lanes had to be closed while the chp cleaned up the crash but all lanes have reopened this morning. it is hugs and tears as a small south bay community remembers a teenager gunned down with what the family cause a case of mistaken identity. a memorial for richard vega growing near the campbell intersection where he was shot. campbell police now say the 18 year old was walking just north of the campbell community center sunday night when somebody came

up and shot him multiple times. he was rushed to the hospital for emergency surgery but unfortunately did not survive. >> it could have been mistaken identity and mistaking him for something else. he wasn't into anything negative. >> vega was a santa clara high school graduate and about 150 of his former classmates gathered at the school's football field last night to remember and reflect. campbell police say a dark colored car was seen leaving the area after the shooting. investigators hope surveillance photos will help catch a suspect wanted for stealing drugs from an east bay pharmacy. investigators say this man right here walked into a discovery bay safeway store along highway 4 last wednesday. he allegedly demanded drugs from a pharmacist and then grabbed the medicine and then just took off. deputies have not said if the suspect threatened the

pharmacist or whether he was armed. we'll get a better idea today of exactly what kinds of guns the santa clara county sheriff's department collected over the weekend. the sheriff will hold a show and tell today with some of the 1,100 guns turned in at the county fairgrounds saturday. the county set aside $150,000 to pay for handguns, shotguns, riv rifles and assault weapons turned in. a new demographic of people travel more than 50 miles or spend at least 90 minutes getting to work. about 4% of the bay area workforce are considered megacommuters. the national average is 1%. so as you are at home getting ready to head out the door, the question is are you in for a megacommute this morning? let's check in with mike inouye to find out what it looks like. >> it's a traffic tuesday. that's the heaviest volume

usually for the week and so a lot of folks say it feels like at least an hour and a half for them to drive. that's what the stories are to me any way. we're looking to the bay area. one of the major congestion spots. bay bridge toll plaza with cash lanes backing up. no fastrak. we should see metering lights turned on if it goes according to tuesday schedule in about three or four minutes. we see a smooth drive off the east shore freeway under the clouds. east shore freeway and map shows a smooth drive at the limit once you leave richmond. slowing through richmond on the approach toward that racetrack off the richmond bridge. it is slow because of congestion there. 238 top of your screen, slowing off castro valley off 580 and then south 880 toward a street where there is that crash. car went into a wall. sounds like it scraped the wall from the update because there are no major injuries. no injuries reported at all. that is over on your shoulder. a distraction around a street where things start to slow on the approach to the san mateo bridge. that's actually not so bad for a

tuesday through that area. we are looking at altamont pass. a crash countercommute eastbound. look at the folks in out of the altamont and mountain house. john talkeded about megacommutes and there are folks heading there and highway 4 farther driving and we'll end with another live shot for 101 through san jose where the commute is kicking in north of 680 where you look here heading up toward 880 and the airport. a wider view. the roadways are dry right now but changes are in store. >> we don't have much in the way of fog or any rain just yet. 30s and 40s outside currently. we should see numbers close to 6 60 this afternoon. the cold front will drop down the coast and bring us wind and increasing rain after sundown tonight starting off hour by hour in the north bay rain by the afternoon passing south of the golden gate by 7:00 into the south bay at 10:00 later on tonight. temperaturewise warmest temperatures of the day around lunchtime. some low 60s as the clouds fill

a shimmering spectacle rain or shine along the san francisco waterfront. take a live look at the bay bridge. i promise you that you will want to look at this which in just a few hours is going to be glitter against the night sky courtesy of 25,000 white l.e.d. lights. it's already dazzling and will attract plenty of spectators. we do have team coverage. mike and rob are taking a look at the traffic impact and the forecast ahead of tonight's big event. we begin with "today in the bay's" bob redell live along the

embarcadero in san francisco. one of the best places to watch the bay lights come to life. i know you're having a good time out there. >> reporter: good morning to you. you have to wonder if this will give the golden gate bridge a run for its money when it comes to gathering eyeballs and crowds for something to look at. you're looking at the bay lights art project. they are doing a test run right now. the actual official unveiling will be tonight at 9:00. that's when they will flip the switch on what's being billed as the world's largest l.e.d. light sculpture and it will illuminate every night from dusk until 2:00 in the morning. you have 25,000 individually programmable l.e.d. lights that have been strung up and down the bridge's suspension cables and they've will put on a show that promises to mesmerize the audience and that anyone in sf or marin with a view of the bay bridge. >> interesting in sequences that

will display patterns based on all of the motion that i find around the bridge. >> reporter: the artist with roots in silicon valley now based in new york city created this art project using $8 million in private money and to give you a sense of how advanced our technology has become, all 25,000 of those lights can be turned on and programmed with just a laptop computer and software that he created. by the way, if you're going to head across the western span into sf for the next two years like a lot of us do, you wonder can i see it? no. that's on purpose so that you're not to be distracted. caltrans asked the l.e.d. lights face outwards away from the bridge. some of the imagery you see now looks like you are looking at the reflection of water. other times it looks like you have waves and you see a speed boat going across. sometimes it looks like the water fountain outside the mirage in las vegas. it's definitely a sight to see. again, they are flipping the

9:00. we'll see some rain. maybe that will add to the ambience and reflection off raindrops around the lights of the bay bridge. the weather will be a factor. let's see how it will affect the commute around the bay with mike. >> it's on the bay bridge. lights are on the northern side of the bay bridge. you see it here great shot from bob and the team out there. it will affect folks approaching from the san francisco side but on the span itself it is not visible. the lights are on the outside of that span so driving across should not be interrupted. look at the map that i'm showing you here. san francisco approach. this is the stretch where the lights are strung on the outside of the roadway and it's on the north end that's visible. you can see it from embarcadero from the roadway itself or hotels and restaurants along that stretch. golden gate vista point on north side of the golden gate bridge weather permitting as rob talked about. that will not be the best viewing weather the entire night. you'll catch a glimpse or two

the state agency paid to protect us from polluters is now under fire again today. the investigative unit has learned some leaders at the department of toxic substances control own stock in the very same companies they're supposed to regulate. now state senators want their own investigation. the investigative unit obtaining financial statements showing two deputy directors at the dtsc have stock in companies including ge, chevron and procter & gamble. these are also companies that dtsc regulates. >> any time you have regulators who have a direct financial interest in the industry, the company or the activity that they are regulating, then that is a conflict of interest. >> investigative reporter vicky nguyen is back with financial statements and now the call from several state senators demanding an independent investigation after seeing our very first report. that is tonight at 11:00. the faa is investigating a

scare at one of the nation's busiest airports after a pilot reported seeing a drone on a final approach at jfk. >> kennedy tower just for your information we just saw a little drone below us. >> i'm sorry. what did you say? >> we saw a drone, a drone aircraft. >> the pilot reported seeing a small unmanned aircraft about 1,500 feet in the air. the pilot was still able to land safely. the faa says even though the craft was small, it could have easily done damage to the plane. the agency is developing a plan to regulate remote controlled aircraft. >> wow. interesti interesting. 6:18 right now. you're familiar with white house petitions that people ask the president to do all kind of things like building a death star. >> mr. obama said he wasn't interested in the dark side. a san francisco man may have convinced the government to let us unlock our cell phones. >> good morning. we're not talking about the kind

of swipe to unlock. we're talking about the ability to break your phone's connection with one service to use it on another. that became illegal back in january, which led a san francisco man to petition it the white house. both the obama administration and the fcc agree with him. it's up to bureaucrats at the library of congress this morning and we haven't heard from them yet. now, why would you want to unlock your cell phone? say you signed with at&t and then you canceled that contract. you take at&t's cell phone to t-mobile. under current law you would need at&t's permission to use their phone on someone else's network. the thinking being at&t subsidized the cost of this phone and they should have some say as to how it's used. the big takeaway this morning isn't so much the cell phone unluu unlocking issue but the gentleman from san francisco was

able to get the federal government to rethink rules simply by asking nicely. we do have other news this morning. google setting records. the dow may set an all-time high today. apple headed the other way in a hurry. we'll look at that as the markets open at 6:30 this morning. >> ten minutes away. all right. thanks so much. >> look forward to it. right now let's check in with rob mayeda sitting in for meteorologist christina loren off on a nice break. you have some weather to tell us about. >> it's nice and calm this morning. we're seeing partly cloudy skies. no wind. no rain just yet. by the evening commute and starting off in the north bay you're going to notice big-time changes as we take you outside right now and look at the bay bridge right now. quiet as we watch some of the testing of the light displays there on the other side of the bridge. we'll continue to bring that for you throughout the morning. let's show you the temperatures we're seeing outside right now. 30s and 40s. it's colder than yesterday at this time. you're going to want a thicker coat as you head out. especially in the north bay where it is 36 degrees. 46 in san jose.

no need for the umbrella just yet. when the rain does arrive, you'll want to hang onto that umbrella. we'll see gusty winds picking up out of the south. winds turning out of that direction out of the southeast changing around the flight direction for san jose airport. we may see some arriving flight delays as the airport start to deal with increasing clouds and increasing winds later today. hour by hour your forecast into the afternoon. rain in the north bay. 7:00, 8:00 pushing across the bay bridge and then more showers to follow. this is good news knocking down both the pollen that's been in the skies over the last few weeks. a good rain for most of the bay area maybe up to an inch in coastal ranges and some cold air coming in dropping those snow levels in the sierra. this is great news. a foot of snow above 5,000 feet and snow levels dipping into the sierra foothills come wednesday and thursday. some of the cooler air starts to sweep on in which means some of our bay area mountain tops higher peaks by thursday could

see a bit of snow. 61 in san jose today. increasing clouds. increasing wind into the afternoon. low 60s around the tri-valley. upper 50s closer to san francisco. and into the north bay we'll have round one of the rain coming in later on this evening. sunny breaks mixed with scattered showers. chance of isolated thunder for wednesday into thursday. then friday it's a transition day as we clear out with great timing if you want to check out that fresh snow over this weekend. 60s and 70s back in the bay area early next week. mike? >> all right. it is traffic tuesday. typically we see heavier and stronger build for the bay bridge and vicinity. right now the bay bridge does show all lanes backed up going back toward the 880 over crossing. it's a more gentle build off the east shore freeway. we'll show you the maps and i'll tell you what i'm talking about here. a nice slowdown starting for berkeley but no big drama. smooth flow off the berkeley curve. backup towardi inthe incline.

now, one thing contributing to an easier east bay east shore freeway is westbound direction through east richmond and approaching that merge. we do have a crash over by cutting boulevard. it sounds like everything might be off to the shoulder. we do have a good deal of slowing by spectators passing through the area. a good build off the bridge. causing slowing as you get to the racetrack. more areas where you see orange and red. south 880 slows down toward a street. the car hit the wall over on the shoulder out of the roadway but a distraction. now northbound at a street there's also an accident reported. there may be a car that's sideways across the slow lane. single car spinout sounds like that's what happened. we may see slowing north past the san mateo bridge. we'll track that. the castro valley y and 580 starting to build out of livermore and altamont pass. south 680 smoothly at the limit through the south bay itself where you have slowing in the northbound direction but we're talking about gentler commute. 101 is slow.

saw a pr company with confetti this morning. apple falling once again behind exxon mobil. this is the tale of two stocks. best of time for google. not the worst of time for apple. they came in the '90s. let's talk about the dow. we could set a record for the dow with the highest close ever this afternoon. the dow where it was right now about about 2007 as we wait for the first numbers to come across. here they go. up 57 points to 14,184. that is above the record close that we saw so many years ago. now, we have to get through the whole day to set that record but it could. the highest the dow has ever been ever before now was 14,198 set back in the middle of 2007. now, why don't we talk about nasdaq highs? because, marla, as you well know, we are unlikely to see those any time soon.

that was march of 2000. nasdaq crossed 5,000 in the height of the dotcom boom. info space and excite at home were big then. that's are not doing as well as they used to. no chance of a nasdaq high today. dow, google, you bet. >> fun to watch. we love to see numbers going up. thank you very much. in washington, lawmakers working on a solution to try to avoid a government shutdown later this month as the nation starts to feel the impact of the $85 billion in sequestration cuts that took effect just days ago. lawmakers have already been ordered to cut their office budgets by more than 8%. the pentagon planning furloughs and airport lines are getting longer. president obama says the cuts will be hurting families as well but republicans say it's an exaggeration. >> does anybody in this country believe that our federal government is so efficient and so effective that we cannot

afford to trim two pennies out of every dollar? >> this thursday the house votes on a temporary budget to prevent a government shutdown that includes spending freezes and keeps the cuts in effect for most government agencies. new this morning, cardinals have just left the vatican after day two of pre-conclave talks. the cardinals have already taken on an oath of secrecy. they are vowing not to share any details surrounding the upcoming conclave. but a cardinal from boston spoke to reporters briefly after today's meeting. >> as a group we sent a message to holy father pope benedict thanking him for his wonderful and generous ministry to the church for the last eight years. >> the date the conclave will start has not yet been announced. it's a series of meetings in which all of the cardinals

younger than 80 meet at the vatican to vote for the next pope. all participating cardinals are supposed to arrive at the vatican by tomorrow. it's 6:33 right now. rob mayeda is in for christina loren and rob says that weather just hours away now. the rain. >> the rain is holding off and right now it's just a gorgeous start to the morning. every morning a postcard view looking across the embarcadero. this brought to you through the camera lens of aaron murphy this morning. not a bad start. a storm and you see views of that and think it's not going to come to the bay. later on this afternoon you'll see more clouds and winds picking up. 44 right now in san francisco. 46 in san jose. 30s in the north bay. we've had patchy fog around napa. notice wind direction turning out of the southeast into san jose. those wind speeds are going to increase into the afternoon as the cold front drops down the coast increasing clouds. eventually the rain producing clouds along that surface front boundary coming through later

this evening. notice in the north bay early afternoon starting to see rain and by 7:00, spreading right across the bay area as we celebrate the bay bridge lights. looks like you'll see wind and rain around that time. hour by hour, temperatures 50s and low 60s by 1:00. we'll see cooling temperatures heading into the evening. mid 50s around the bay area. rain becoming widespread this evening and then sunny breaks and showers. that's going to be the trend all of the way through friday morning. a chance of snow levels dropping close to 3,500 feet and clearing out and warming up nicely for this upcoming weekend. mike? >> we're talking about the south bay lights right now. the headlights northbound 101 just north of 680. we see things starting to stack up over the last couple minutes and the map showing a similar situation. here's 101 a stretch from story road past 680 and toward the airport and reports of debris in the roadway north of 87 but folks are getting fine by. 87 slowing down north of capital expressway into downtown.

85 and 280 holding steady. this is a lighter build. a slower build for traffic tuesday here in the south bay. south 880 toward a street earlier crash on the shoulder. northbound side another disabled vehicle reported there. nothing as far as slowing goes. your typical commute castro valley and hayward for the slowing in that commute direction. slow also down through berkeley, emeryville out of richmond. shouldn't be a problem except for spectator slowing and paperwork there. another issue reports on this map marked as a disabled vehicle but it's a fender-bender but paperwork should be done quickly by chp west 80 at hill top so slowing through there. keep that in mind. the rest of the freeway typical build. actually lighter for traffic tuesday. back to you. >> we'll take it. thanks, mike. it's 6:36. in health news scientists at ucsf say they have discovered a new type of cell that can be used to heal damaged organs. researchers discovered the cells

new details about a man accused in nothing short of a horrific heartbreaking hit-and-run crash that kills a young new york couple and their baby. the 44 year old is still at large this morning. police say that he was arrested just last month on a charge of driving under the influence and he served a decade in prison back in the '90s for manslaughter. police say that he was speeding in a bmw when he hit a car taking an expectant young couple to the hospital. the baby was delivered and survived but tragically died a day later. charges may be brought

against a sixth grader in pennsylvania for starting a fight that killed a fellow classmate. bailey o'neil died over the weekend. he had been on life support in a medically induced coma. doctors say he suffered a concussion, a broken nose and other injuries during a fight at his school on january 10th. his mother says a taller boy challenged her son to a fight at recess but her son didn't fight back because he was worried about being suspended. the district attorney is now reviewing that case. >> so, so sad. 6:41 right now. coming up, up in arms over gun sales in the south bay. the drastic stop los gatos is taking to disarm new stores just ahead. a joyride is over. we'll tell you where a stolen saleboat sailboat is docked this morning after a booze cruise bust. all set up to light up the night along the san francisco waterfront is a sight to see.

we have breaking news to tell you about right now in south san jose where police say a woman woke up to a strange man standing right over her bed. this all happened at a home in the silver lake area near

highway 101. san jose police tell us that man now in custody is a second offender and was wearing an ankle bracelet at the time. they say he also had a pair of women's underwear in his pocket. they are not sure at this point if it belonged to the woman or one of her daughters who also lives in that home. of course this is still an active crime scene right now. we do have a crew on the way to that scene to gather some information. we'll have more details for you as soon as we get them into our newsroom. to a follow-up on a story we brought you yesterday morning. a sailboat brought back to port. christie smith joins us from richmond where the boat arrived about an hour ago. i know they've been inspecting it ever since. how is it looking? >> reporter: you know, it's not looking as bad as some thought. what a story here. the boat was stolen and taken on a joyride and run aground in

pacifica where it was stuck for hours. now the next chapter, the luxury yacht "darling" is here in richmond where workers got the first look at the damage. one of them told me he actually thought it would be much worse than it is. they power washed it and gave it a good cleaning seeing damage to the router, propeller and some separation of the keel. that's the part that was stuck in the sand. the 82-foot sailboat was towed in overnight by a tug boat from pacifica. the boat was stuck offshore. three people on board refused coast guard help. there was a standoff for hours. they eventually complied and got arrested inside the yacht was littered with beer and pizza boxes. they tried to rock it back and fort to get it out but the boat wouldn't budge. this is how the salvage operator got it out. >> we rigged a big bridle on the boat and brought in a couple vessels and a tow and hooked them up and did a gentle pull on

first half of the day will be fine. i held up my end of the bargain through 5:00. after that the winds will pick up and we'll see changes. a nice view there looking across the bay. notice the clear skies we have across many parts of the bay area especially to the north bay right now where the clear skies have led to some pretty chilly temperatures. you'll want to dust off your winter coat this morning. not going to get away with a wind breaker with 30s around napa. 34 degrees. 36 in novato. 46 in san jose. 44 even in san francisco. so some clear skies for now. winds will be the other part of the story. wind will be the first part of the story before the rain arrives. winds picking up out of the south from 15 to 30 miles an hour by the time we head toward evening. rain is still up here on the north coast. this is going to drop through the north bay by the afternoon and we may see a few stray sprinkles around the bay area as lift increasing heading into mid afternoon and late afternoon

hours but the main widespread rain should hold off until later on this evening. you're looking at 7:00 and 8:00 and 9:00 and south bay toward 10:00 you see the cold front pass through. rainfall estimates right now could be close to an inch in coastal mountains and maybe about a quarter inch to a half inch around the rest of the bay. we hope this plays out. we could use rain after this dry start to the year so far. this is a cold storm which means it is a big-time snow producer for the sierra. winter storm warning up if you'll head to high country. you might have to chain up as low as 3,000 feet by tomorrow afternoon along highway 50 and interstate 80 in the next 24 to 36 hours. sunny start. you'll notice winds and clouds filling in for the afternoon. low 60s around the tri-valley. sunny conditions midday and high clouds by this evening. 58 around san francisco. so the three-day forecast shows rain coming in this evening into

tomorrow morning. and then we'll be in and out of the raindrops at times. unsettled weather dealing with showers and thundershowers with small hail into thursday. friday the showers move out and then we clear out for the weekend. nice forecast ahead with 70s early next week. >> we're looking forward fremont right now with southbound side looking light and northbound side even lighter. i do want to show you that outside of this shot there's the auto mall parkway sign and north of here at auto mall parkway i marked on maps where there's report of a crash there. everything off to the shoulder but a distraction and the southbound side is where the slowing comes down to that area. it will start to creep down toward mission where 680 starts to slow toward that funnel as well. funnels over between the freeways and we don't see any unusual flow of traffic for mission boulevard. north 680 near the mini golf course there right by that mini golf course reports of a minor crash there. no major injuries but blocking

one lane. watch for slowing we see that north out of milpitas and in toward fremont. slow for 237 toward 880 as we see heading over toward first street and northbound routes kicking in now north past capital expressway and kicking in north of 101 and 680 up toward the airport. 280 also showing the slowdown kicking in over the last five minutes. volume starting to build there. 87 into downtown just north of capital you see slowing and that's here to stay for the morning commute. 85 continues to sort itself out and we see slowing in blobs up toward saratoga avenue. that's a technical term for traffic. we'll look at palo alto. smooth, easy drive and not a big problem northbound. southbound into the sunlight. sunrise slowdown happening earlier and folks are squinting and that's tough visibility here as well as bendy parts of 280 coming through the trees. keep that in mind. light flow of traffic there. oakland 880 showing a nice build toward the high rise and up

toward the bay bridge toll plaza where metering lights are on and slow southbound through hayward and union city. not bad for a tuesday. back to you. a santa rosa surgeon now being charged with attempted molestation. the press democrat reporting 53-year-old being charged with sending sexually explicit text messages to a 13-year-old girl he met online. police say he also arranged to meet that girl in person for sex just last month. the attorneys say that girl led the married doctor to believe she was of legal age. the orthopedic surgeon will be barred from practicing medicine while the case is pending. a suspect accused of killing three men in a sonoma county cabin will be arraigned in court today. police say that he killed the men during a marijuana deal on february 5th. officers are still looking for this man who may be linked. the pictures were taken at a chevron gas station in st.

helena the day before the men's bodies were discovered. los gatos going forward with an emergency ban on new gun dealers. the moratorium is in place while the city considers a permanent change to its policies regarding retail sales of guns. the move is in response to the opening of a new gun store in los gatos back in late december. a lot of people in that town felt they should have had a public debate before templar sports was allowed to open its doors. in oakland, the city council will discuss a proposal that would ban the city from investing in companies that make guns. the measure would also put pressure on police, fire and public employee retirement funds to do the same. right now the city does not have any investments in gun makers but it is unclear if its police or fire retirement systems do. and in san francisco, the board of supervisors considering a proposal today that would ban so-called extra lethal bullets. these hallow point bullets

14,227 up 99 points. now, over on the nasdaq, we've got a tale of two companies. google also hitting record highs well over $800 a share. up another 2% this morning. apple actually gaining this morning but trending downward. apple lost its position as the most valuable company in the world yesterday when a 52-week low. apple trading up less than 1% this morning. again, this kind of runs counter to logic when you compare the price of apple shares to the company's earnings. apple really is an incredibly cheap stock and it's interesting that it is not participating in this huge rally today. two other stocks to watch today, jon and marla. you were talking about guns. smith & wesson reports its profits today. that stock at a record high. one of the reasons you're opening gun stores these days, people are buying a lot of guns.
