it happened at centerpointe christian preschool. the woman that taught here since the school opened in 2008 and left earlier this year, apparently took a picture of the girl bound sitting on a cot. the ordeal went unreported until march 1st. that's when the former teacher shared the story at a luncheon with other employees here and shared the picture of the little girl. one of the people she showed it to was the girl's mother who teaches at the school. >> we immediately listened to her, talked to the other teacher and notified licensing about the incident. >> now, the reports from the state community licensing chair department state that the allegation is substantiated and that the school needs to notify all the parents and have a meeting to discuss the discipline. the church tied to the school

reported this on their own to the department of social services. we are told the school will cloth close this friday for that retraining and open again next wednesday. reporting live, christie smith, "today in the bay." the mother who used her daughter to help her shoplift and ditched her outside a morgan hills safeway will serve 60 days for her crime. marcy erika also known as marcy keeland was sentenced to 60 days in jail and three years probation. she has already served 12 days. a judge has ruled she can serve the remaineder on public work detail. she is currently in the custody of her grandmother. >> the family of the missing oakland woman is widening that search later on today. the 31-year-old erika mascarelas disappeared thursday morning of last week. she was seen in this surveillance video walking outside on telegraph avenue. her family now wants the public to take a very close look at this video hoping somebody will

remember seeing her. controversial changes coming to san jose with the way they deal with the homeless population. proposed plans mean less money for other services in the budget. "today in the bay's" bob redell joins us live with a look at the proposals and where the money is coming from to pay for them. good morning, bob. >> reporter: no dollar figure has been put on these proposals as of yet. good morning, laura. the city council will later today discuss the proposals to help improve the homelessness situation in the south bay. the most recent figures estimate there are 7,000 people that do not have homes. some living in one of these 60 or so encampments that have sprung up in wooded areas and along waterways. the city took down one of the largest encampments. they evicted dozens of people from a camp that had been set up on city-owned land. about 100 people had set up

their tents in that area. the problem is, where do they go? most likely to other encampments. today, the city council will discuss solutions put forward by counselman sam lacaro. they report that ideas include building more affordable housing, cracking down harder on those encampments and steering faith based groups to encourage more to live inside in shelters. two opposing forces that they must grapple with, shrinking police forces and tighter budgets. that brings up the issue you were alluding to when you were tossing out to me, laura. how much is this going to cost and where is it going to come from? we are speaking from the director of housing encampments on friday. he was pointing out the time has tremendously limited resources. reporting live, bob redell, "today in the bay." it is time to bag the bags.

that new plan to attract silicon valley tech companies mean they build more office space. one would go right here. we have the movie theater behind me to give you a little bit of perspective. if you thought parking was tough already. more than 100 shops and eateries with just five designated parking areas. the plan is to add three office buildings that equal about 700,000 square feet to accommodate 3,000 or more workers. one would be built at the corner of winchester boulevard and olson across the street from the winchester mystery house. another would go up on the other side of the movie theater. that office space would require the dudley apartments on the other side to be completely demolished. reportedly, the plan also includes more restaurants and retail shops. what about parking. well, the developer says they

the sedan. let's check in with bertha coombs. good morning. we have the futures a touch lower today. yesterday, these markets just don't seem to want to go down. we ended up closing higher at the close. the dow extended its winning streak to seven days, the longest in more than a year. the dow hasn't been up eight days in a row in over two years. we will see if today we make it eight. another record high for the dow and another record high for the broader s&p 500 index, which is what a lot of investors watch more closely. about nine points away from its all-time closing high. the dow rising to 14444. the nasdaq up 8 to 3252. the s&p adding five to 1556. it is not just overall index. transport and biotech and a lot of health care at an all-time

the popes, the cardinals are convening to elect another pope. they have never had one go past five days. it officially starts today. something we will closely be watching for you. 5:24. diners will have to wait a little longer before seeing calorie counts show up on menus. the head of the fda says writing a new menu label law has become extremely thorny. the issue is figuring out who should be covered by that law. the 2010 health care law will require restaurants and other establishments that serve foods to put calorie counts on menus and vending machines. they issued a proposed rule as some nonrestaurant establishments lobby to be exempt. the fda says the final rule may come out this spring santa clara is now looking to give its brand new football stadium a distinct 49ers feel.

pleasanton this morning with the school's reaction to that incident. good morning. >> reporter: good morning to you, laura. appalled, shocked and stunned, those were the exact words from the preschool spokesperson when we spoke to him about this. the allegations were disturbing. a little girl, just two years old, had her hands and feet taped up, because she refused to take a nap when she was expected to. the teacher taught here at centerpointe christian school since 2008. she left earlier this year. she took a picture of the 2-year-old bound with masking tape sitting on a cot. the incident went unreported until march 1st when current and former employees had a luncheon. the former teacher shared the photo with the people that were there, including the girl's mom that teaches at the school. she went to the police and the school who notified the state licensing company.

san jose's santana row is known for luxury shopping and traffic. soon, it could be known for its silicon valley tech company. this place always so busy on the other side. on stevens creek boulevard. you have valley fair shopping center, finding a place to park can be so difficult. this proposal to attract some high-tech companies would require to build more office space. that would equate to adding three buildings, totalling about 700,000 square feet. the oakland tribune reports we would see 2800 to 3500 more workers here. it would reportedly wipe out the parking lot. that's where we are standing this morning. another building would go up on the south side of the theater. that space would acquire the apartment complex on dudley avenue to be torn down all together. as is, santana row has just five designated parking lots for 100 shops and restaurants. it also has condos here as well.

rome where it is afternoon. the cardinals have had their lunch and will soon be beginning this process. what will you do if you are a cardinal before the conclave? they had mass here in rome, celebrated mass for about two hours before they came out around lunchtime. this was an opportunity actually for the public to see some of these cardinals, one of whom may become the next pope. take a live look at what we're calling here the smokestack. this is the chimney above the sistine chapel where these 115 voting cardinals will enter and vote. we expect later today. a pretty ceremonial procession from an order of reversal of seniority as they move toward the chapel later this afternoon, a couple of hours from now. they will be sworn in. then, the voting begins. what will they be looking for? whom might they elect?

you are watching "today in the bay." welcome back. a good tuesday morning to you. taking a live look outside. traffic picking up a little bit. hazy start. clear skies. fabulous forecast. we will check in with christina. 5:52. >> the 49ers, alex smith, is soon to become former 49er alex smith. the free agency period starting at 1:00 p.m. when the niners will officially trade smith down to the kansas city chiefs. in exchange, the niners expect to get a second-round pick this year. a conditional pick in 2014. smith spent eight years with the 49ers, most of them as a starting quarterback before he was replaced by colin kaepernick. he got kaepernicked in the middle of the season. the niners will gain some cap room allowing them to acquire a new wide receiver.

you probably remember this guy. anquan boldin. very painful loss to the ravens. he will be wearing a 49ers uniform next fall. san francisco gives up a sixth round pick in the pending trade. a special treat for some junior giants that get to spend some time with the world series trophy. between 4:00 and 6:00 today, fans can take their pictures with the trophy at hayward city hall. the event is free through a donation to the junior giants baseball fund. it would be appreciated. scott mcgrew says, watch shares in apple this morning. >> scott, a weird spike in that stock. >> shares were sort of muddling along on monday. all of the sudden, absolutely

spiked in the last half hour. why, you ask? we don't know. there are a couple of possibilities. one could be that apple is getting ready to get rid of all that money they have been talking about. the billions and billions. maybe through a stock buyback. so we shall see. apple, one worth watching this morning as that share trades at about 400 and some dollars. $437 a share, up $6.15. apple hasn't enjoyed the same spike the rest of the stock market has. there is talk they will announce another dividend, perhaps another buy back. certainly, pricewise, now would be the time of such a move. also, watch zenga. they are worth watching. it is hard to tell what's going on as we watch the dow clothes at yet another record high on monday. we were talking earlier about cnbc's reporters kind of

bewilderment over why the market has moved so higher. one theory is that the economy will grow very quickly at the same time the fed begins to ease to keep interest rates low. the patient is getting better but the medicine is still flowing before doctors can turn it off. it's a theory. tomorrow shall we will hear from something called the anderson forecast. if we hear about the prediction of a big spike, maybe that is right. >> sounds like a market utopia. >> for the moment. >> how quickly things can change. >> we must remain very pragmatic. >> very positive when it comes to the forecast. we are getting spoiled. we are the envy of the nation. when we are talking about 80s here in the bay area, that typically translates to 90s in l.a. temperatures this morning are chilly. by noon, 40s and 50s into the 60s. low 60s at lunchtime rounding
